3 1 General information Thanks to high irradiation levels, the Iberic peninsula and a large extension of Latin America will be one of the first markets worldwide that could achie ve PV competitiveness making solar electricity competitive in price with conventional electricity from the public grid. Thus, the PHOTON editorial team is convinced that Spain and Latin America will continue to be one of the most interesting markets for photovoltaic installations. Since January 2007, it has been the primary goal of the Madrid-based team to inform both interested laypeople and experts about all the latest innovations in the area of solar electricity production in a comprehensive and competent manner. Appropriately, the range of topics covered is rather broad. Every issue features one main topic (see page 10) and the latest results from products tested by PHOTON Laboratory (Germany), an independent testing company within the PHOTON Group., specially tailored to the needs of system operators, as well as companies, installers, scientists and policymakers is divided into several sections including politics, economics, research and technology, architecture, panorama and practical examples. Breakdown of editorial and market sections The advertiser has the choice of placement within the high-profile editorial section, or a less expensive alternative in the market section. The market section can be found in the back pages of the magazine and covers the entire spectrum of our services, such as events, employment classified and small ads, a solar-irradiation atlas, and the industry registry. The costs within the market section are significantly lower than those in the editorial section. An insertion within the editorial pages has the advantage of a cleaner layout and a lower concentration of other advertisements. As a general rule, 1/2 page insertions and up will be presented alone on a page. In many cases, this is a good option to avoid the need for a special placement order and the ensuing surcharges. In addition, we offer special placements in the first half of the magazine as well as in the magazine s centre-fold.

13 11 Lithography Digital lithograph General conditions File transfer Data format Care must be taken when creating a digital lithograph. Faulty files can lead to faulty printing. Such printing errors are not considered reasons for reclamation or price reductions. Only one file per advertisement. If more than one file per advertisement is received, there is no guarantee that the right one will be used. Please don't send any preview files in advance! File transfer: via FTP-upload at ftp://photon.de, user name: user, password: pass Files must be sent as PDF files Please save your ads in accordance with the following nomenclature: PE_2012-(issue)_Ad_(company name).pdf PDF must be version 1.3 (according to Acrobat 4.0) Please apply CMYK composite No password protection in the PDF file, no overprint settings, no transparent background File format is the actual size: no trim marks or calibration bars (including faded or hidden) No placement of advertisements on paper formats larger then actual advertisement size: page size is advertisement size All fonts must be converted to outlines; no embedded fonts (Photoshop: flatten image) For embedded pictures, please use the tiff-format only. Please check the following: - Resolution at 300 dpi or higher - Colors CMYK separated (no black and white picture, please convert them to CMYK) - With CMYK separation, dot gain should be set based on printing process (sheet-fed or web offset), according to your advertisement's page placement Printing Printing process Cover pages and postcards on sheet-fed offset with dot gain of 18%. Inside pages on web offset with dot gain of 24%. Area coverage to a maximum of 350 % (C+M+Y+K). Paper Cover and postcards: both sides use recycled dull stroked paper. Inside pages use recycled offset dull stroked paper. Printable tones Printable tones start at 4%. Photo borders should not be less than 7%. Proof Note - No alpha channels - No JPEG compression - No color profiles A proof only serves as an orientation regarding color and not an exact representation of how the final printed version will appear. Recycled paper can cause variations in color and shapes due to manufacturing processes. Such occurrences are not considered grounds for reclamation or price reductions.

14 12 General Terms and Conditions for Advertisements and Supplements 1. According to the following general terms and conditions (AGB),»advertising orders«are understood as a contract to publish one or more advertisements by a particular party in one of the publisher's publications with the intention of being circulated. 2. Orders for advertisements or external supplements, which are only to be published in a pre-designated amount, in a pre-designated issue and in a pre-designated area within a publication, must be received in a timely manner by the publisher so that the publisher can inform the client prior to the reservation deadline whether the order cannot be completed according to the above criteria. 3. The client is responsible for the timely delivery of suitable, flawless documents or supplements. The contract becomes legally binding after the client has received an official order confirmation from the publisher and the order confirmation is not disputed within 10 (ten) working days after the date of issue, or after the client sends their ad file to the publisher for insertion (whichever comes first). In the event of cancellation of an advertisement order, the publisher will charge the client the full price of the advertisement as a cancellation fee. 4. Advertisements that are not readily recognizable as such because of their design will be clearly marked»advertisement«by the publisher. 5. The publisher, based on justifiable and equal principles, has the right to refuse an advertisement order if that advertisement's content, source, or technical form is illegal or infringes upon official regulations, or if publisher feels the publication of the advertise ment is unacceptable. This also holds true for orders received by agencies or company representatives. Supplement orders are only completed after the publisher receives and approves an exact sample copy of the supplement. Supplements that give readers the im pression that they are an integral part of the publication as a result of their format or presentation, or supplements that contain additional external adver tisements, will not be accepted. 6. In the event that a printed advertisement is partially or totally unreadable, incorrect, or incomplete, the client has the right to demand a reduction in price or the substitution of a corrected advertisement in a later issue of the publication, but such claims can only be made in the event the purpose of the advertisement was negatively affected. If the publisher fails to reduce the cost of the advertisement within a given period of time that is acceptable, or if the substitute advertisement is again incorrect, the client has the right to a further reduction in price or a change of the contract. Claims for damages regarding positive infringement on requirements, default on the contract, or other unacceptable actions cannot be made even if an order is placed by telephone. Claims for damages as result of an order's incompletion and other delays are limited to compensation for predictable damages and the total price of the advertisement or supplement. This does not refer to intentional and gross negligence on the part of the publisher, its legal representatives and its employees. The publisher's responsibility for damages as a result of the absence of guaranteed features remains unaffected. Furthermore, the publisher is not responsible in commercial business connections for gross negligence on the part of employees that are not executive staff, in all other cases towards salespersons the responsibility for gross negligence and compensation will be limited to foreseeable damages, thus not exceeding the cost of the advertisement in question. Apart from nonobvious mistakes, complaints must be registered 2 weeks after arrival of the invoice and sample. 7. In the event that the client doesn`t pay in advance, the invoice will be sent immediately, but if possible 14 days after publication of the advertisement. Invoices are to be paid without delay and any deductions, that is unless the client and the publisher have already agreed in writing to a different payment period. 8. The contract is considered fully performed by the publisher once the magazine has been released online in the myphoton section ( myphoton). In the event of a delay of payment or moratorium, interest and collection costs will be added to the invoice. The publisher can demand a payment of 5.00 for expenses with every reminder. In the event of a delay in payment, the publisher can refuse fulfilment of open orders for which prepayment has not been received prior to the advertising deadline of the corresponding issue. In the event of non-payment, the publisher will charge the client the full price of the advertisement as a compensation for loss. If the publisher has justified doubts as to whether a client can pay an invoice, the publisher has the right without consideration of an originally agreed term of payment and even during an advertisement s runtime, to request a credit card for payment. The publisher has the right to charge the credit card upon the advertising deadline and the advertising deadlines of all future ads for which prepayment is delayed. Furthermore, the publisher has the right to close the online access to myphoton for the people employed at the customer s company until payment has been received. 9. If the client placing the order is not the same as the advertiser and if the client delays payment despite two reminders, the client will be required to give the publisher the right to demand payment directly from the advertiser. 10. Upon request, the publisher delivers a sample of the advertisement with the invoice. Depending on the type and size of the order, this sample may consist of only advertisement segments, single pages or a complete issue. 11. The client is responsible for any costs accrued during the preparation of reproductions and paper originals requested by the client or major changes to the originally agreed upon design. 12. Lay-out sketches will not be returned. 13. Remuneration for an intermediary will only occur if the third party has directed a new client to the publisher, and only if expressly agreed upon by the publisher at the time of the contract s award. New clients are defined as clients seeking to advertise that have no prior contact with the publisher. A client will not be consi dered»new«if that client has already received advertising rates or other information from the publisher. The limit for remuneration of intermediaries is 15% of the cost of the advertisement or supplement. 14. Place of payment is Aachen, Germany. Aachen is the area of jurisdiction for business dealings with traders, legal representatives of public law and public assets. As long as PHOTON Europe GmbH s demands cannot be enforced in a dunning procedure, the place of legal venue for non-traders/sales personnel is the customer's place of residence. If the customer's home or typical place of residence, including non-traders/sales personnel, is unknown at the time of the lawsuit, or if the customer moves his/her home or place of residence outside the area of legal jurisdiction following the conclusion of the contract, Aachen will automatically become the agreed legal venue. German law is applicable. 15. In the event that one or more of the paragraphs in this AGB are or are made null and void, it will not affect the validity of the remaining paragraphs. The void paragraphs, or those paragraphs made null and void, are to be replaced with a new regulation that comes as close as possible to fulfilling the original commercial purpose. 16. Insofar as the ordering party is obligated under statutory regulations to withhold a tax or other dues from the invoiced amount and to pay them, he undertakes vis-à-vis the publishing house, upon placing of the order, to promptly fulfill the fiscal duties to withhold and pay the taxes or dues in accordance with the legal requirements. The ordering party also undertakes to provide, unprompted and within two weeks after payment of the invoice amount, the publishing house with proof of payment of the withheld tax amount by means of a copy of the voucher for payment. If the ordering party fails to meet his obligation in spite of the publishing house s request that he do so, the publishing house is entitled to with draw from or terminate the contract concluded with the ordering party. Further the publishing house is entitled to make the appearance of further advertisements dependent on the provision of the proof.
