4 Pueblo Parks and Recreation Program Guide Advertising Policies Effective December 13, 2011 The Pueblo Parks and Recreation Department ( Recreation Department ) has established the following policies for its Advertisers ( Advertisers ). Advertisers and their agencies must read and agree to comply with the following policies as part of their Advertising Agreement ( Agreement ). Current Agreement holders will be notified in writing of any changes to these policies, rates, and deadlines and be given the opportunity to cancel remaining commitments in writing if they feel that advertising terms are no longer acceptable. The Pueblo Parks and Recreation Program Guide ( Guide ), a non-public forum, was created to describe recreation programs of the City of Pueblo Parks and Recreation Department; any advertisement contained herein is meant to defray the cost of the Guide. Although the advertisement content must be consistent with the mission and goals of the Pueblo Parks and Recreation Department, in no way does the City of Pueblo endorse such activities, goods, or services offered by the advertiser. Design and Submission Format: Ads must be designed at 300 dpi or as vector art at the exact size listed on the Ad Rate per Issue section. Ads must be submitted as a PDF file created with the PDF/x-1a:2001 preset,.tif,.ai or.eps files. Color ads must be submitted in CMYK format. Ads submitted electronically by Advertisers or their Agencies are assumed to be approved by the Advertiser. The Recreation Department provides ad design services at no charge. Proofs will be sent and it is the Advertiser s responsibility to submit any errors, typos and omissions prior to the deadline date. Advertising Placement: Advertisements will be placed at the Recreation Department s discretion. While we will try to make accommodations, we cannot promise to accommodate such requests in every case. Premium placement options include: inside front cover, inside back cover, or back cover and are only available for ½ page and full page selection. Premium placement for back cover is limited to ½ page horizontal. Premium placements are limited and accepted on a first come, first served basis. Rate Changes: Rate changes will not affect advertisers that have an active agreement at the time of the rate change. All rate changes will take effect after the current agreement has expired. Advertisers will be given notice of rate changes prior to the expiration of the current advertising agreement cycle. Payment: First time advertisers are required to pay immediately upon acceptance and approval of the initial advertising agreement. Other advertisers will be invoiced within thirty days upon acceptance and approval of the renewed advertising agreement. Payment may be made by cash, check, Discover, Visa or MasterCard. There is no cash discount. Advertisers and their Agencies are jointly and severally liable for payment of all invoices for advertising. Pueblo Parks and Recreation reserves the right to change the payment terms at any time. If it becomes necessary to turn an account over to a collection agency, the advertiser will be responsible for the account balance plus any interest or fees resulting from the collection action.

5 Copy and Agreement Regulations: All advertising is subject to approval by the Recreation Department. Advertisers and advertising agencies assume liability for all printed advertising content (text and illustrations) and also assume liability for any resulting claims against the City of Pueblo resulting from that content. Advertisers assume full responsibility to submit any copy changes in an approved electronic file format by each deadline date. If new copy has not been received by the deadline, your previous ad will be repeated. Right of Refusal: The Pueblo Parks and Recreation Department reserves the right to refuse an advertisement for any reason at any time. Reasons for refusal may include: Simulation of the publication s editorial material in content or style. Design that is not immediately recognizable as an advertisement. Ad content that is contrary to Pueblo Parks and Recreation s mission and goals. Ads for services that compete directly with Pueblo Parks and Recreation programs or facilities. Ads which do not conform to submission format or size parameters. Ads which do not meet Pueblo Parks and Recreation s standards for quality. Liability: Advertisements are accepted and published or displayed upon the representation of the agency and Advertiser that they are authorized to publish or display the entire contents and subject matter thereof and that such publication (or availability) will not violate any law or infringe upon any right of any party. In consideration of the publication of advertisement, the Advertiser and agency will, jointly and severally, indemnify, defend, and hold the City of Pueblo harmless from and against any and all losses and expenses (including, without exception, attorney s fees) arising out of the publication of such advertisements in the Guide, including, without limitation, those claims arising from claims or suits for defamation, copyright or trademark infringement, misappropriation, violation of rights of privacy, failure to timely or accurately publish advertisements in the Guide, or from all similar claims now known or hereafter devised or created. 11/6/2017
