1 BREVARD COUNTY (FLORIDA) 9702/page 1 of 5 Changes: 7/30/ MRI ADVERTISING AND COMMERCIAL ACTIVITIES The purpose of this policy is to provide guidelines for the appropriate and inappropriate use of advertising or promoting of commercial products or services by outside not-for-profit and for-profit entities to staff, students, parents, and visitors in schools or other District-owned property. "Advertising" comes in many different categories and forums and is defined as an oral, written, or graphic statement made by the producer, manufacturer, or seller of products, equipment, or services which calls for the public's attention to arouse a desire to buy, use, or patronize the product, equipment, or services. This includes the visible promotion of product logos for other than identification purposes. Brand names, trademarks, logos, or tags for product or service identification purposes are not considered advertising. It is the policy of the Board that advertising shall be permitted in School District facilities or on School District property. However, the District's name, school's name, students, and staff members shall not be used for any commercial advertising or otherwise promoting the interests of any commercial, political, nonprofit, or other non-school agency or organization, public or private, without the approval of the Board. Advertising is limited to the following categories or forums, provided that it is in accordance with the guidelines set forth herein and is approved, in advance by the Superintendent. Product Sales A. Product sales benefiting the District, school, or student activity (e.g., the sale of beverages, food, school supplies, clothing, etc., within schools). B. Exclusive agreements between the District and businesses that provide the businesses with the exclusive right to sell or promote their products or services in the schools (e.g., pouring rights contracts with soda companies). C. Fundraising activities (e.g., short-term sales of gift wrap, cookies, candy, etc.) to benefit a specific student population, club, or activity where the school receives a share of the profits.

2 BREVARD COUNTY (FLORIDA) 9702/page 2 of 5 Direct Advertising/Appropriation of Space The following types of direct advertisements that require the appropriation of space are permitted: A. Signage in schools and school facilities advertising commercial or nonprofit organizations shall be allowed in all locations on campus with the exception of core curriculum K-12 classrooms. For the purposes of this policy, athletic facilities (e.g., practice or competition fields, fencing surrounding athletic or school facilities, gymnasiums, locker rooms, etc.) are not considered core curriculum classrooms. B. Signage on or in school buses shall not be allowed. Signage may be allowed on or in all other District-owned vehicles (e.g., delivery vans, maintenance vehicles, driver s education vehicles, golf carts, etc.); however, such signage shall not be permanently affixed to the vehicle. C. Advertisements, corporate logos, or brand names may be displayed on all district produced and monitored media formats in compliance with State and Federal law.the District network and school web pages. D. Advertisements, corporate logos, or brand names may be displayed on school equipment (e.g., school marquees, message boards, scoreboards, or uniforms). E. Advertisements, corporate logos, or brand names may be displayed on textbook covers, student assignment books, and/or posters. F. Advertisements, corporate logos, or brand names may be displayed in District and/or school publications including, but not limited to, calendars, newsletters, event programs, school-sponsored student publications (e.g., newspapers, yearbooks, play bills, etc.). G. Advertisements, corporate logos, or brand names may be displayed on the District media-based electronic advertising (e.g., BPS-TV, Channel One, internet, or web-based sponsorship). H. Free samples (e.g., food and/or personal hygiene products).

For-profit entities in keeping with the general advertising guidelines listed below may advertise their name in sponsorship of a building, classroom, or wing of a school, etc. This sponsorship shall not be a permanent sponsorship as described in Board Policy Commemoration of School Facilities, but shall be in compliance with the requirements of this policy and must be for a definitive period of time. Indirect Advertising A. Corporate-sponsored instructional or educational materials, teacher training, contests, incentives, grants, or gifts shall not be allowed with the exception of those offered through a school business partner relationship. B. The use of instructional materials developed by commercial organizations such as films and videos may be displayed only if the Superintendent determines that the education value of the materials outweighs their commercial nature. General Advertising Guidelines Any commercial advertising shall be structured in accordance with the following general advertising guidelines set forth below: A. When working together, schools and businesses must protect educational values. All commercial or corporate involvement should be consistent with the District's educational standards and goals. B. Any advertising that may become a permanent or semi-permanent part of a school facility or District facility (e.g., stand alone billboards, towers, etc.) requires prior approval of the Board and must be in compliance with all local zoning laws and regulations. C. The Board reserves the right to consider requests for advertising in the schools on a case-by-case basis. D. No advertisement shall promote the use of alcohol, tobacco, drugs, drug paraphernalia, weapons, or lewd, vulgar, obscene, pornographic, or illegal materials or activities, gambling, violence, hatred, sexual conduct or sexually explicit material, X or R rated movies.

No advertisement shall promote the teachings for or against any: seminal cause, specific religion or religious, ethnic, or racial group, political candidate, ballot issue, or political issue pending or otherwise, and shall be non-proselytizing. F. No advertisement may contain libelous material. G. No advertisement may be approved which would tend to create a substantial disruption in the school environment or inhibit the functioning of any school. H. No advertisement shall be false, misleading, or deceptive. I. Each advertisement must be reviewed in advance by the Superintendent for age appropriateness. J. Advertisements may be rejected by the District if determined to be inconsistent with the educational objectives of the District, inappropriate, or inconsistent with the guidelines set forth in this policy. K. All corporate support or activity must be consistent with the Board's policies prohibiting discrimination on the basis of race, color, national origin, religion, sex, sexual orientation, disability, or age, and must be age-appropriate. L. Students shall not be required to advertise a product, service, company, or industry. The Superintendent shall screen all advertising and consider the guidelines listed above when considering approval to advertise and may require that samples of advertising be made available for inspection prior to approval. The inclusion of advertisements in School District publications, in School District facilities, or on School District property does not constitute or imply approval and/or endorsement of any product, service, organization, or activity. In addition to the guidelines set forth in this policy, the Superintendent shall prepare administrative procedures that will address the process and criteria for commercial messages and how this policy must be implemented at the school level. All administrators must implement the tenets of this policy based on the administrative procedures developed by the Superintendent for this policy.
