5 Important Dates May 2010 SMARTS available to existing DWQ permit holders July 1, 2010 all existing dischargers must submit Permit Registration Documents (PRDs) by this date/available to public September 2, 2011 Grandfather clause terminates, all existing dischargers under DWQ must conduct a Risk Assessment September 1, 2011 First Annual Report to be submitted on SMARTS What is SMARTS? Storm Water Multiple Application and Report Tracking System Is a system that allows dischargers to apply for permit coverage through an online database system. Allows dischargers to submit their Permit Registration Documents (PRDs), such as Notices of Intent, Storm Water Pollution Prevention Plans and site maps. Allows the State Board and Regional Board staff to process and track the discharger submitted documents. 10 User Definitions: LRP Legally Responsible Person: A Legally Responsible Person (LRP) is able to submit Notices of Intent (NOIs), Notices of Termination (NOTs), and Annual Reports on the behalf of a facility. In the simplest terms, the LRP is the individual that signs the Notice of Intent (NOI) and the Storm Water Annual Report. The LRP is responsible for reviewing, validating and certifying the annual report for accuracy and correctness before it is submitted. For a corporation: a president, secretary, treasurer, or vice-president of the corporation or the manager of the facility if authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures. For a partnership or sole proprietorship: a general partner or the proprietor, respectively. For a municipality, State, Federal, or other public agency: either a principal executive officer or ranking elected official. For the military: Any military officer who has been designated. For a public university: An authorized university official User Definitions: Approved Signatory Approved Signatory The approved signatory may upload data and certify documents on behalf of the Legally Responsible Person (LRP). For a corporation: a responsible corporate officer. For the purpose of this section, a responsible corporate officer means: (a) a president, secretary, treasurer, or vice-president of the corporation in charge of a principal business function, or any other person who performs similar policy or decision-making functions for the corporation; or (b) the manager of the facility if authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures; For a partnership or sole proprietorship: a general partner or the proprietor, respectively; Attorney Advertising Prior results do not guarantee a similar outcome Models used are not clients but

11 User Definitions: Approved Signatory For a municipality, State, Federal, or other public agency: either a principal executive officer or ranking elected official. The principal executive officer of a Federal agency includes the chief executive officer of the agency or the senior executive officer having responsibility for the overall operations of a principal geographic unit of the agency (e.g., Regional Administrators of U.S. EPA); For the military: Any military officer who has been designated. For a public university: An authorized university official User Definitions: Data Submitter and General Public Data Submitter (DS) A Data Submitter (DS) is any individual authorized by the LRP to enter data on behalf of the LRP. A data submitter may be a SWPPP Practioner, employees, etc. Data Submitters can only submit data, they do not have authority to certify documents. General Public: If you are not a discharger or a data submitter you can still create an account under the general public category. Legally Responsible Person (LRP): Create LRP SMARTS Account Data Submitter: Create DS SMARTS User Profile Account Add Projects Under Account (Existing Projects by WDID and Secret Code Number (SCN) DS sends LRP their UserID Link Data Submitters to LRP s Organization Based on Data Submitter s UserID Access LRP s Account LRP Reviews uploaded data Upload & Save Data LRP Certifies data & submits to State Board Utilizing SMARTS throughout the life of the project Properly managing the electronic submittal process: 1. Create a SMARTS account as a Legally Responsible Person (LRP) 2. Designate responsible parties, such as data submitters (DS). 3. File Permit Registration Documents (PRD) through SMARTS 4. Receive Waste Discharge Identification Number (WDID) via 5. Submit data throughout life of project 6.
