3 FOOD SAFETY LAW IN Food Safety Hygiene Ordinance, Law: construction began in 2007, the main activities in The XII National Assembly approved in June Food Safety Law consists of 11 Chapters and 72 Articles; has been effective from 1/7/ The Implementing Agencies: MOH, MARD, MOT.

4 FS STRUCTURE - CHAPTER I: GENERAL PROVISIONS (6 Articles, from 1 to 6: Scope of regulation; Definitions; Principles of Management; The government policy; The prohibited activities; Handling of violations of food safety law); - Chapter II: RIGHTS AND OBLIGATIONS OF THE ORGANIZATION AND INDIVIDUALS IN FOOD SAFETY ASSURANCE (3 Articles, from 7 to 9: stipulate the rights and obligations of the three main target groups: - Organizations and individuals producing food - Organizations and individuals trading food - Food consumers).

5 FS STRUCTURE (continued) - Chapter III: CONDITIONS TO ENSURE FOOD SAFETY (9 Articles, from 10 to 18: General Conditions of ensuring food safety; Conditions for ensuring the safety of fresh foods, processed foods, food fortification nutrition, functional foods, genetically modified foods, irradiated foods, additives, processing aids, packaging, food containers). - Chapter IV: CONDITIONS TO ENSURE FOOD SAFETY IN PRODUCTION and BUSINESS (15 Articles from 19 to 33 includes 5 categories: General conditions to ensure safety in food production, food trading; Specific conditions to ensure safety in food production, fresh food trading; Specific conditions to ensure food safety in pre-processing, food processing and trading of processed foods; Specific conditions to ensure safety in catering services; Specific conditions to ensure the safety of street food business.

6 FS STRUCTURE (continued) - Chapter V: CERTIFICATE OF ELIGIBILITY BASIS IN PRODUCTION FOOD SAFETY, FOOD BUSINESS (4 Articles, from 34 to 37: Regulation on requirement, procedures, applications and duration for Certificate of food safety conditions; Certificate is valid for 3 years). - Chapter VI: EXPORT AND IMPORT FOOD (5 Articles, from 38 to 42, include 2 Sections: Specific conditions to ensure the safety of imported food; Specific conditions to ensure the safety of exported food).

7 FS STRUCTURE (continued) - Chapter VII: ADVERTISING, FOOD LABELING (2 Articles, from 43 to 44: New point in this Chapter: Regulations on responsibility of issuers of advertisement and businessman of advertisement services). - Chapter VIII: FOOD TESTING, RISK ANALYSIS IN FOOD SAFETY, PREVENTION, CONTROL AND TROUBLESHOOT ON FOOD SAFETY (11 Articles, from 45 to 55, include 4 Sections: Laboratory test for food; Risk analysis in food safety; Prevention, control and troubleshoot on food safety; Traceability of food, retrieval and processing to ensure food safety).

8 FS STRUCTURE (continued) - Chapter IX: INFORMATION, EDUCATION AND COMMUNICATION ON FOOD SAFETY (5 Articles, from 56 to 60: Regulations on the purpose and requirements; content; approaching object; and responsibility in sharing information, education and communication on food safety); - Chapter X: STATE MANAGEMENT OF FOOD SAFETY (10 Articles, from 61 to 70, include 3 Sections: State Responsibility for food safety management; Food safety inspectors; Control of food safety; Article 63: Responsibility of MARD). - Chapter XI: IMPLEMENTING PROVISIONS (2 articles 71 and 72 stipulate the effectiveness and implementation of the law).

9 DECREE 38 Stipulate details for implementing a number of articles of the Food Safety Law Article 21. Responsibility of the government management of food safety of MARD 1. Management of animal production to meet requirements for food safety; 2. Management of processing food originated from animals during slaughtering, preprocessing, food processing, storage, packaging and trading of processed food.

13 Function and Task of MARD on Food safety Steering Organizations/Departments which are under the control of MARD in the field food safety. Making and promulgating regulation documents, technical procedures on food safety.

14 Function and Task of MARD on food safety (continue) To propose the Minister/Government projects on food safety. Cooperating with other Ministries and others organizations in the field of management of food safety. To examine and control all activities on food safety.

15 III. Function and Task of DAH on Animal Production Food safety To submit to MARD proposals of regulation Documents, technical procedures on food safety of products derived animals. Composing programs, projects on food safety Building production models on FS.

16 Function and Task of DAH (continue) Conducting researches on Animal production FS. Implementing supervision and analysis of samples of animal origins To carry out inspection and punishment in the field of Animal production FS.

17 Organizations of DAH on food safety NCVHI: National Centre of Veterinary Hygiene & Inspection in Hanoi and HCM City; NCVDC: National Centre for Vet.Drug Control; RAHO: Regional Office of Animal Health; VPH: Vet. Public Health Division IQ: Inspection and Quarantine Division; DVM: Drug & Vaccine Management Division.

18 National Programs on Inspection and supervision of FS National Programs on supervision of FS period and FS project, cooperation with Canada is carrying out with C$ 18 million. Program of envir. Protection in the field of animal development and processing. Monitoring and surveillance programs for: BSE, FMD, CSF, HPAI, PRRS.

19 Analisis capacity Many Labs. in Vietnam can analyse residue. 2 centres in the field of Veterinary can analyse residue: NCVHI No1 (in Hanoi) and NCVHI No2 (in HCM city). Analysis machines: HPLC, LC/MS, LCMSMS, ASS, ELISA Manpower & Human resource: PhD, MSc, Chemical Bachelors, Veterinarians which are qualified in Vietnam and overseas (Japan, Singapore, Germany, UK)

20 Measures to enhance management and supervision of FS, period to 2015 Human resource: Education & training in the country and overseas. Enhancement of lab. Facility and equipments: LC/MS; LCMSMS. Strengthening of management system from central to local government, enhancement and development lab system in RAHO and Sub-DAH. Strengthening of inspection of whole food chain: from farm to folk. Strengthening cooperation of multiple ministries such as MOH-MARD in supervision of animal products.

21 Measures to enhance management and supervision of FS, period to 2015 (continue) Improvement of education and communication for manufacturers and consumers to be awareness of FS. Enhancement of international, regional cooperation, inside ASEAN, particularly the Bilateral Agreement of Animal inspection. Strengthening the control of movement transportation through border. Strengthening the national programs on disease prevention, environment protection, management of animal feed. Promulgating and enforcing new legal documents (regulation, decisions, etc.), amendment of inadequate documents to ensure FS for consumers and export.
