1 Frequently Asked Questions In Respect Of Inds. Deptt. Of Himachal Pradesh. Q.1. What is the Classification Industries as per MSMED Act? In accordance with the provision Micro, Small & Medium Enterprises Development (MSMED) Act, 2006 the Micro, Small and Medium Enterprises (MSME) are classified in two Classes: (a) Manufacturing Enterprises- The enterprises engaged in the manufacture or production goods pertaining to any industry specified in the first schedule to the industries (Development and regulation) Act, 1951) or employing plant and machinery in the process value addition to the final product having a distinct name or character or use. The Manufacturing Enterprise are defined in terms investment in Plant & Machinery. (b) Service Enterprises: The enterprises engaged in providing or rendering services and are defined in terms investment in equipment. 1. The limit for investment in plant and machinery / equipment for manufacturing / service enterprises, as notified, vide S.O. 1642(E) dtd are as under: Manufacturing Sector Enterprises Investment in plant & machinery Micro Enterprises Does not exceed twenty five lakh rupees Small Enterprises More than twenty five lakh rupees but does not exceed five crore rupees Medium Enterprises More than five crore rupees but does not exceed ten crore rupees Service Sector Enterprises Investment in equipments Micro Enterprises Does not exceed ten lakh rupees: Small Enterprises More than ten lakh rupees but does not exceed two crore rupees Medium Enterprises More than two crore rupees but does not exceed five core rupees Q.2. What are the state incentives available for Industrial Units? Partial Exemption from General Sale Tax GST (VAT) for new units in category A and B for 5 and 8 years respectively. Existing units on Expansion- deferment 75% GST(VAT) in category A and B for 5 and 8 years respectively. Partial Exemption from GST (VAT) for new units in category A and B for 5 and 8 Years respectively. Central Sales concessional rate 1% shall be leviable in the goods manufactured by new and existing industrial units except production breweries, distilleries, non fruit based wineries and bottling plants. Reimbursement cost incurred for shipment export samples by Micro & Small EOUs with a ceiling Rs /- per consignment, upto max Rs 50000/- per Enterprise during its period operation. Reimbursement 50% the cost incurred on the publishing export marketing brochures and product literature with a ceiling Rs /- per Enterprise. Reimbursement 50% the cost relevant overseas trade fairs with a ceiling Rs /- per enterprises. One time Grant Rs. 5 Lacs or 30% the cost machinery installed, whichever is lower is granted for setting up Testing Centres. For Technology Upgradation, reimbursement Rs Lacs or 50% the cost incurred on development prototype patent, whichever is lower, on setting up Technology Transfer unit by NGO s Societies.

2 For Installation New Pollution Control Devices, one time Grant Rs. 5 lacs or 20% cost modern pollution control devices, whichever is lower will be given. For setting up Thrust Industrial Enterprises, exemption from the payment State Excise Duty for period 7 years to thrust industrial enterprises set up as Micro and Small Scale Enterprises which are manufacturing wine/ cider by located in B and C areas. New Thrust Industrial Enterprises based on Horticulture/ vegetable/ maize/ Herbal/ produce enterprises and lacated in B and C Category Area shall be entitled for the following additional incentives such as Interest 5% p.a. with a ceiling Rs. 2 Lacs p.a. for a period 3 years. For setting up enterprises in category C areas there is a total exemption from payment any taxes and duties for a period 10 years. Also there is exemption from payment CST/GST (VAT for 10 years in the Tax Free Zone for new/ existing and industries in negative list. For all new Industrial Units and existing Industrial Units on their substantial expansion there is a provision for Capital Investment 15% investment in Plant and Machinery subject to maximum Rs. 30 lacs. Micro, Small and Medium enterprises would be eligible for Capital Investment 15% the Investment in Plant and machinery subjected to a ceiling Rs. 50 lacs. 75% Freight Subsidy on the transportation and finished goods as well as raw material from and to the nearest rail head broad gauge for a period 5 year from the date commercial production. Under the Town and Country Planning Act, the Floor Area Ratio (FAR) for industries has been increased. New Industrial Enterprises will be charged only 50% Stamp Duty on Sale Deed or lease deed for setting up the unit in State. Department MPP & Power vide its Notification dated 4 th March, 2014, has reduced the Electricity Duty in respect Industrial Units in the state Himachal Pradesh (except Cement Industries) with effect from 1 st April, Q.3. Under the scheme National Mission Food Processing (NMFP) Govt. What is the Procedure for purchase Private land for Industrial use by Non- Himachali/ Non- Agriculturist? In case purchase private land fpr setting up industry the concerned Entrepreneur has to apply for the Essentiality Certificate (EC) to the Industries Department along with all relevant land papers on the prescribed format. After scrutiny, the Department issues the EC in favor the Industrial Enterprise justifing the area to be purchased for setting up the industrial venture. Thereafter, the Entrepreneur has to apply to the Revenue Department through the concerned Deputy Commissioner for getting the permission u/s 118 HP Tenancy and Land reforms act Q.6. What main Raw material is available in the State? For setting up fruit/ vegetable based industries plenty fruits/ vegetables viz apple, apricot, plum, peaches, citrus fruits, mangoes, tomatoes, potatoes, ginger, garlic, peas, cabbage/cauliflower is available. Category A areas include four Development Blocks which are adjacent to adjoining States. Category B areas include 49 Development Blocks located in Non-Tribal Districts. Category C areas (Tax Free Zones) include 24 Development Blocks including all the seven Tribal Development Blocks and 17 other Blocks and backward panchayats. The Development block Rohru is also included in category C. Graded State Govt. fiscal incentives have been provided in the Industrial Policy. Category C areas the State have been declared as Tax Free Zones, therefore new industrial units being set up in this area are exempted from the payment any State Taxes & Duties excluding levies in the shape cess, fees, royalties, etc. for a period 10 years in accordance to our presently applicable incentive rules. Q.16. Which are the Award Schemes for Employment in Industries in HP. Need based Land in Industrial areas/ Estates will be allotted for the establishment the Industrial Enterprise(s), Public Utilities, Social Infrastructure and such other purposes as are deemed fit by the Government on lease hold bases for a period 95 years. The premium for allotment land in Industrial Areas/ Estates and Govt. land in other areas for setting up Industrial Enterprise(s) will be fixed on a year to year basis and made effective from 1 st April every year. The e-tendering stware has been developed by National Informatics Centre, H.P. in this fice for finalization tenders through e-tendering process. The Controller Stores, Himachal Pradesh started e- Procurement/e-tendering in the month September, The Controller Stores, H.P. invites the tenders for finalization rate contract for 79 codes as per Detailed Instructions and Guidelines for the Purchase Goods and Services by all the State Government Departments and Offices the Government H.P. notified vide letter No.4-Ind/SP Misc/F(6-10)4/80-Vol-IV dated after getting the approval the Government. The above Instructions and Guideline have been issued in pursuance the provision Rule 192 HPFR All the tenders are invited/finalized by this fice through e-tendering. I & S.O.(F&A) & etc. Store Purchase Organisation only those tenders who qualifies technically. 6 Negotiation meeting The tenderer who qualifies technically & financially are L-1(lowest firm)for concerned item(s) are called for negotiation meeting fixed by the Additional Controller Stores,H.P. 7 Approval rates The proposal rates in comparison with DGS&D/previous rate contract rates/market rates/ negotiated rates etc. is prepared and submitted for approval the authority competent. 8 Issuance Acceptance letters The acceptance letters are prepared in respect approved items for eligible firms. 9 Issuance rate contract The rate contract is issued in favour eligible firms who submit the complete agreement documents within stipulated periodfrom the date issuance acceptance letters. Sericulture is an agro- based labour intensive rural cottage industry, which is providing gainful employment to some 9286 rural families. The functioning sericulture wing this Department has been organized into seven sericulture divisions viz. Ghumarwin, Mandi, Palampur,,Dehra,Nadaun, Dhaulkuan,Shimla under

10 which 72 Sericulture centers. 83 departmental mulberry farms and 28 mulberry nurseries are functioning in the State. These sericulture centers conduct incubation silkworm eggs, young age rearing and distribute chawki-reared silkworms to the farmers for late age rearing for production silk cocoons. Besides distributing mulberry saplings and providing technical guidance to the sericulturists. Currently sericulture is spread over in about 1928 villages and its major concentration is in the district Bilaspur, Kangra, Mandi, Hamirpur, Una and Sirmour. Total nine silk reeling units one in Govt. sector at Nurpur( District Kangra) and eight under private sector have been set up in District Kangra (3), Hamirpur(1), Mandi (1) and Bilaspur(3). State Government programmes for sericulture development are being implementing as under: I. Maintenance departmental mulberry farms and nurseries. II. Distribution silkworm mulberry food plants; III. Distribution chawki ( young age ) silkworms to the sericulturists;free supply disinfecting material and rodenticide to the sericulturists for prevention silkworms diseases and pests; IV. Technical assistance and guidance to the sericulturists/ entrepreneurs V. Marketing arrangement involving the stakeholders are made to fetch a fair price silk cocoon VI. produce; Financial assistance to individuals under various central sponsored programmes for adoption sericulture & silk industry. Production Performance: During the year, approx hectates mulberry plantation area was put to use for sericulture purpose to produce silk cocoons m.ton that was converted into metric tons raw silk value Rs Crores by 9286 families, besides it generated other intangible incomes and achieved generation 7.28 lakh mandays from the industry.
