5 Legal framework Federal constitution Art. 104 Agriculture 1 The Confederation shall ensure that agriculture makes a major contribution through sustainable production geared to market demands to: a. ensuring food supplies for the population; b. maintaining the natural resources and preserving the countryside; c. maintaining a decentralized settlement pattern in rural areas. 6 Legal framework Agricultural Law Art. 4 Difficult production and living conditions The legal framework shall take under account the difficult production and living conditions, especially in mountain and upland areas. Art. 7 Principle The regulatory framework for production and selling agricultural products shall be defined so that the farmers could produce in a sustainable matter and as cheep as possible. From the selling of products farmers should achieve an higher income. 6

7 Legal framework Art. 14 General provisions 1 For the credibility and to promote quality and sales the Federal Council can promulgate regulations on characterization of agricultural products, that : are produce in mountain areas; are priced due to their origin; 2 Characterization is on a voluntary base. [ ] 4 The Federal Council can define official labels. Their utilization is on a voluntary base. 7

9 Rules for mountain and alp products Key figures Come into force the 1 th of January 2007 After a transitional provision all mountain and alp products after have to be certified since the 1 th of January 2009 Goals Producers: Protection for the terms Mountain and Alp, legal security, product differentiation Consumers: guarantee of origin Confederation: clear rules, element of the strategy for quality 9

10 Terms Mountain and Alp Scope of application For Swiss agricultural products and foodstuffs. Use of the terms «Mountain» and «Alp» Only when the legal requirements are fulfill; Translations and derived characterizations. 10

16 Property of the logos Guarantee Mark, without emotional contents Voluntary, free of charge With or without text, 4 languages (Italian, French, German and Romansch) and English No certification required Authorisation: Compliance with the Mountain and Alp ordinance Compliance with the ordinance about the official logos for mountain and alp products. 16
