4 FOREWORD Seed Certification in Wyoming is authorized by the Wyoming Seed Law, Chapter 12 ( ). This law designated the College of Agriculture of the University of Wyoming as the official seed certifying agency for the state. Seed Certification is conducted under the direction of the Plant Sciences Department and the University of Wyoming Cooperative Extension Service. The Wyoming Crop Improvement Association (WCIA) serves as an advisory board to the Seed Certification Service. The WCIA is an organization of seed growers with a common interest in the Wyoming seed industry. The function of this organization is to advise the Seed Certification Service, distribute information concerning seed, promote certified seed and conduct any other business the members deem necessary for the betterment of the certified seed industry. The Association is governed by a board of directors elected by the membership and represents the various districts of the state. In addition, the Director of the Wyoming Agricultural Experiment Station; the Department Head for Plant Sciences and the Director of the University of Wyoming Cooperative Extension Service preside on the board as ex-officio directors. Growers listed in this directory are members of WCIA, producing seed in accordance with the rules and regulations set forth by the Wyoming Seed Certification Service, which is a member of the Association of Official Seed Certifying Agencies (AOSCA). AOSCA is an organization composed of agencies responsible for seed certification in the U.S., Canada, and New Zealand. Certified seed may be sold bagged or in bulk. Bagged seed must be packaged in new containers and have an official certified tag attached to each bag. Certified seed sold in bulk must be accompanied by a bulk sales certificate completed and signed by the grower. "Certification" of any seed lot by the University means only that the certified seed lot has been visually inspected and that random samples have been tested and have been found to be in compliance with applicable standards as set forth by the Wyoming Seed Certification Service. Certification of any lot is not a guaranty or warranty that the certified lot is free from defects such as disease, rot or noxious weeds. 5 SEED CLASSES FOUR CLASSES OF SEEDS OR PROPAGATING MATERIALS ARE RECOGNIZED IN SEED CERTIFICATION: BREEDER, FOUNDATION, REGISTERED, AND CERTIFIED. THE WYOMING SEED CERTIFICATION SERVICE REQUIREMENTS FOR THESE CLASSES MUST MEET OR EXCEED THE MINIMUM STANDARDS OF THE ASSOCIATION OF OFFICIAL SEED CERTIFYING AGENCIES (AOSCA). THE FOUR CLASSES OF SEED ARE DEFINED AS FOLLOWS: Breeder - Breeder seed shall be that seed or vegetative propagating material directly controlled by the originating or, in certain cases, the sponsoring plant breeder, institution, or firm which provides the source for the initial and recurring increase of Foundation seed. Foundation - Foundation seed (white tag) shall be seed stocks that are so handled as to maintain specific genetic identity and purity, and which may be designated or produced by an Agricultural Experiment Station or originator. Foundation seed shall be the source of Registered and/or Certified seed. Registered - Registered seed (purple tag) shall be the progeny of Foundation seed so handled as to maintain genetic identity and purity and meeting the standards set forth by the Wyoming Seed Certification Service. Registered seed is the parent stock for the production of Certified seed. Certified - Certified seed (blue tag) is the progeny of Foundation or Registered seed that is so handled as to maintain genetic identity and purity and meeting the standards set forth by the Wyoming Seed Certification Service. Certified seed is the planting stock recommended for commercial production. 3

6 PLANT VARIETY PROTECTION ACT The Plant Variety Protection Act (PVPA) was signed into law December 24, The purpose of PVPA is to encourage the development of novel varieties of sexually reproduced plants and to make them available to the public, providing protection available to those who breed, develop or discover them and thereby promoting progress in agriculture in the public interest. The owner of a new and novel variety who obtains a Certificate of Protection under the PVPA has control over the use of that variety, somewhat like an inventor has control over his patented inventions. The term of plant variety protection expires 18 years after the Certificate of Protection is issued. The owner has the right to exclude others from selling, offering for sale, reproducing, importing, exporting or using the protected variety in the production of a hybrid or different variety during this time. Two options for plant protection are available to the developer of a variety. The first option enables the developer and certificate holder to sell or authorize for sale either certified or uncertified seed of the variety. If the certificate holder chooses this option he must resort to civil action if his/her rights are infringed upon within the 18 year period. The second option for protecting a variety is the "certification only" option which utilizes provisions of Title V of the Federal Seed Act. A variety protected in this manner may be sold by variety name only as a class of certified seed. Sale of uncertified seed by variety name is in violation of both the certificate owner' s rights and federal and state seed laws. Violators of the Title V may be prosecuted by the Federal or state government. It is the responsibility of the seller to inform the buyer if the variety is protected. Each container of seed sold should be labeled with a tag indicating the type of protection which the owner has. Under the first option the label will state: "Unauthorized Propagation Prohibited - U.S. PROTECTED VARIETY." If the owner of the variety has chosen the "certification only" option for variety protection, the label will state: "Unauthorized propagation Prohibited - To Be Sold By Variety Name Only As A Class of Certified Seed - U.S. PROTECTED VARIETY." 9 APPROVED SEED PROCESSORS An approved conditioner is one that has been inspected and authorized by the Wyoming Seed Certification Service to condition seed which is eligible for certification in Wyoming. The building, equipment, storage facilities, and the training and experience level of the employees must be satisfactory before a conditioner can be approved. Conditioners have the responsibility of maintaining genetic purity and identity of all certified seed lots and keeping records according to the instructions issued by the certifying agency. Upon receiving approval status, conditioners are authorized to receive, clean, sample, treat and tag certified seed. The following list of seed conditioners have been inspected and approved by the Wyoming Seed Certification Service to condition small grain eligible for certification through April It does not include seed producers approved to condition only their own seed.
