ADOPTION OF AGENDA It was Moved by P. Harrison Seconded by R. Wetzel That the agenda of the Agricultural Advisory Committee meeting be amended by adding under Other Competent Business Item H.1 Update on RV Parking on No. 10 Highway, and that the agenda be adopted as amended. Carried B. ADOPTION OF MINUTES It was Moved by P. Harrison Seconded by S. VanKeulen That the minutes of the Agricultural Advisory Committee meeting held on January 12, 2006, be amended on page 8, Item H. 3 Farm Access by removing 16 th Avenue and inserting 176 Street, and that the minutes as amended be adopted. Carried C. NEW BUSINESS 1. Meeting with South Coastal Panel, Agricultural Land Commission The Agricultural Advisory Committee met with members of the Agricultural Land Commission, South Coastal Panel. 2 Walter Dyck, Commissioner South Coastal Panel Carol Paulson Commissioner South Coastal Panel Gordon Bednard, Commission staff Research Officer for the South Coastal Panel, and member of Langley Agricultural Advisory Committee Tony Pellett Commission staff Planner for the South Coastal Panel and member of the Surrey, GVRD, and other Agricultural Advisory Committees The Agricultural Advisory Committee noted the following: That when land is removed from the Agricultural Land Reserve, it is assumed that it will be removed to be used for a non-agricultural purpose. That when land is removed from the Reserve, there should be some benefit to agriculture. That Surrey is faced with rapid growth and the Agricultural Advisory Committee often receives presentations on potential development which will encroach on agricultural land in terms of development, water run-off and other auxiliary issues. That there is some uncertainty about the number of Panel Members required to approve an application. That it would be interesting to know of any supplemental legislation that might influence a decision to exclude property from the Agricultural Land Reserve. That there appears to be misunderstanding surrounding the exclusion of the Abbotsford Land, and although it was not Class 1, perhaps it could have been used for other agricultural uses such poultry or greenhouses. That the Agricultural Advisory Committee is a partner with the Agricultural Land Commission, and on the front line to work with ALC guidelines and policies. That there is a concern with isolation of agricultural properties such as is seen in Richmond. That there is a need to preserve land for agriculture and that it is not classed as greenspace, for example the trailways project in England. That there is a need for proper edge planning That the Committee is interested in learning the process for applications to the Agricultural Land Commission, and what the Agricultural Advisory Committee can do to make the job easier. That there is a concern over when the need for growth will supersede our ability to produce agricultural products for ourselves. Erik Karlsen, Chair of the Agricultural Land Reserve Commission reviewed the role of the Commission and its responsibility. Mr. Karlsen noted: That the Chair is appointed for 3 years and he has just completed his first year. That the Legislation speaks to community issues, which includes community needs and interests. That operational policy is to anticipate community needs and communities were given 5 years to identify the areas of urban growth. h:\aac\minutes\2006\02026aac.min.doc Page 2

3 That development did not stop after the 5-year closure date and the issue becomes how to deal with that. That Abbotsford did what the Agricultural Land Commission guidelines asked them to do, and there may have been some communications issues around how this was communicated to the public. That policy directives come primarily from the annual service plan that is developed under the budget and defined in the service plan on web site. That the Agricultural Land Commission does not receive direction or comment from senior government on any application. That in reviewing an application they look at Provincial Government Policy, community planning process and policies. That engagement with the community is a core job and area panels are set up to have community communication done more directly. In response to questions from the Agricultural Advisory Committee, members of the South Coastal Panel noted: That Commission meets all applicants on site and does look at what benefit there will be for agriculture. That there are 6 regional panels with 3 members each. That a quorum is 2, and if a panel member is missing, they will often send a panel member from another region to fill in. That 98% of the decisions are unanimous, and the Panels are made up of diverse groups with different skill sets. That a decision cannot be made with one panel member. That members of a panel are not appointed by the Chair. That Abbotsford was a long, exhaustive 1.5 year process. That the Commission did look at community need and the need to preserve farmland. That a lot of the property in Abbotsford was in industrial use, and it was difficult to break small parcels out of that. That the Abbotsford application was for an exclusion of 1,000 acres, but the applicants were only given 40% of the request. That the decision to not release all of the land was made on the point that it was good agricultural land. That even after the decision was made, they relooked at it to balance the need to protect and preserve agriculture and allow development. That in response to the mandate to work and enhance agriculture, 50% of the discussions with Abbotsford revolved around what would be done to benefit agriculture. That the end result was a mass for the industrial land and a mass for agriculture and a balance to ensure one did not infringe on the other. That at this point in Abbotsford no land has been excluded it is a provisional exclusion and they are looking at how to make it work. That 555 applications were received last year, and the balance of decisions are made on the side of land preservation. That there is more land in the Agricultural Land Reserve today than when it started out in h:\aac\minutes\2006\02026aac.min.doc Page 3

4 That since the Surrey policy was put into place, only one application has been forwarded to the Agricultural Land Commission and that was turned down. M. Bose left the meeting due to a conflict of interest. P. Harrison assumed the Chair. The South Coastal Panel and the Agricultural Advisory Committee discussed Barnston Island agriculture and greenspace noting that the public views the Island as community property for recreational use, but the land still has agricultural value. It was also noted: That because of the Surrey policy, if the land is removed, there would have to be some benefit back to agriculture. Barnston island is unique in the sense that it has limitation because of the ferry and if it is removed for community use, the community will have to give something back. M. Bose Returned to the meeting and assumed the Chair. The South Coastal Panel and Agricultural Advisory Committee discussed Campbell Heights noting that it is not ideal, but the land was identified for growth as far back as 1966 and not included in the Agricultural Land Reserve. In response to a question from the Committee, the South Coastal Panel noted: That when applications along buffers are received they ask for fences and protection for agricultural land to protect from trespass and garbage. That the Border Infrastructure applications go directly to the Agricultural Land Commission and they are referred back to the municipality to comment as there may be conditions the ALC is not aware of and they look to the local Committees for issues that need to be dealt with. Carol Paulson, Commissioner, noted the process for applications for exclusion: The applications come into the office and they are assumed to have cleared municipal government. Staff focuses on background research on the property and neighbouring properties. Documentation is put together with comments and the application goes before the Agricultural Land Commission Panel. The Panel tries to see every site so that they are not making a decision in an office. They meet with applicants, look at the soil, what it is being used for, what can be improved, how does this impact on agriculture, what the applicant is applying for. They also look at surrounding properties, quite often consult with the regional agrologist to look at what impact this will have on surrounding property. 5 The regional panels meet once a year, and the Executive meets at least twice per year. The meeting concluded with the Panel complimenting the Agricultural Advisory Committee on the successful Soil Watch Program, which is now being used in other municipalities. M. Hilmer joined the meeting at 10:00 a.m. The following members of the South Coastal Panel left the meeting: Peter Dhillon, Commissioner, Walter Dyck, Commissioner, Carol Paulson, Commissioner, Gordon Bednard, Commission staff, Tony Pellett, Commission staff The meeting recessed at 10:05 am and reconvened at 10:15 a.m. with David Aberdeen, and Randy Sawyer of the Border Infrastructure Program joining the meeting. D. BUSINESS ARISING FROM THE MINUTES 1. Border Infrastructure Program - Farm Highway Access along Highways 10 and 15 David Aberdeen, Property Agent and Randy Sawyer, Project Manger for the Border Infrastructure Program was in attendance to discuss access farm access issues along Highways 10 and 15. Staff provided an updated map outlining the situation. The Agricultural Advisory Committee noted concerns with the Livingston property at 176 th Street and the concern that although most of the development is taking place on the east side, farms on the west side are being impacted. The Committee also expressed concern that the project was effectively reducing the revenue of the farmer or hurting their property, without compensation. The Committee was interested in what the Border Infrastructure Program was doing to solve this problem. Randy Sawyer and David Aberdeen responded: That the median barrier has been an issue along the project. That the have gone back to the Livingston farm issue and he wants a left in off the highway. That the property will not be allowed a left in off the highway because it is very unsafe. That the issue goes back about 2 years and Mr. Livingston has been very adamant about his concerns. That Mr. Livingston has met with the Minister to express his concerns. That they have looked at Mr. Livingston s proposals and how to accommodate him. h:\aac\minutes\2006\02026aac.min.doc Page 5

6 That they have done multiple count evaluations and the Planning Department has been part of the process since last Fall. That they have gone through the resident area plans, the Ministry plans, and the City Plans. That they have held open houses to show the residents what they plan and believe that they have come up with the best option. That at that time 50% of the property owners were happy, but Mr. Livingston still did not support the plan. That access to the highway is complicated by the fact that this will be a 4-lane highway. That eventually the highway will extend from Highway 1 to the Border and traffic will increase substantially. That they have shown the individuals involved how they came up with the plan and have asked them to come back with written comments, which they have done and which have been channeled through the Project Manager. The Agricultural Advisory Committee and Border Infrastructure delegation discussed particular properties and potential solutions to access, internal road layouts. Eric Karlsen, Chair, Agricultural Land Commission left the meeting at 10:25 a.m. The Border Infrastructure delegation noted: That they have looked at future roads proposed by the Planning Department. That the plan proposed has a lot of positives. That there will be material available for placement on the Livingston property for placement on an internal road system. That they have not discussed paving, but the material will provide a hard surface. The Committee discussed potential solutions to some of the difficulties, but the Border Infrastructure delegation noted that it comes down to safety considerations, and there is an accident history in the area. That although 8 access points will be eliminated, 4 of these are very dangerous. The delegation also noted: That the legislation states that if no land is taken there is no right to compensation so that the properties on the other side of the road are not entitled to compensation. That originally Mr., Livingston appeared to commit to dedication of the land and when discussions began they believed they had given him what he wanted. Mr. Livingston has been at the open houses and they have talked to him and looked at the problems that needed to be solved. That the Border Infrastructure Program has spent a lot of time on the Livingston access and they need the property owner to work with them. h:\aac\minutes\2006\02026aac.min.doc Page 6

7 The Agricultural Advisory Committee noted that there is no formal application to the Agricultural Land Commission and the matter should be tabled until there is an application to deal with. Judy Mcleod left 11:00 a.m. Pat Harrison left the meeting at 11:20 a.m. and quorum was lost. 2. Edge Planning - Langley T. Atva of the Planning & Development Department brought information related to Edge Planning. This item arises out of the Agricultural Advisory Committee 2006 Work Plan. Ms. Atva noted work being done in Langley where they receive few complaints, most coming from rural estates which are lots of 4.2 acres. There are some issues in Langley, particularly with the rural estates which the Agricultural Land Commission would like to eliminate and increase the minimum lot size. Langley is very interested in the work being done in Surrey on edge planning. 3. GVRD Overflow Events Kathleen Zimmerman reported there was an overflow event on December 28 with an e coli count of 97,000 and one on January 9 with an e coli count of 400,000. E. ITEMS REFERRED BY COUNCIL F. CORRESPONDENCE G. INFORMATION ITEMS H. OTHER COMPETENT BUSINESS 1. Update on RV Parking on Number 10 Highway at 168 th ( Avenue) The Drainage Engineer noted that City by-law officers had visited the site on November 2 and 17 and there were about 11 to 12 RV s and 2 boats. The owners have been notified that they are to be removed. The owners did try to remove the, but got stuck and have promised to move them this spring when the weather and ground has dried up. 8 2. Fill sites along 176 th Street The Chair asked that several issues along 176 th Street be investigated. 3. Century Farms Program Kathleen Zimmerman advised that the Ministry of Agriculture wants to revive the Century Farms Program for farms that have been in the family for 100 years and asked for input from the Agricultural Advisory Committee. The Committee will make inquiries and report back. 4. Update on Agricultural Web Page T. Atva of the Planning & Development Department noted that they are still working on the update for the Agricultural Web Pages, and they hope to have those sent to the Committee members before the next agenda package comes out. 5. Mayor s Task Force on Transportation The Agricultural Advisory Committee expressed interest in receiving information on the Mayor s Task Force on Transportation. I. NEXT MEETING The next meeting of the Agricultural Advisory Committee is scheduled for March 1, 2006 at 9:00 a.m., in the Mayor s Executive Boardroom. J.
