2 Who we are: CIOPORA the International Community of Breeders of Asexually Reproduced Ornamental and Fruit Plants Founded by ornamental breeders in 1961 simultaneously with the establishment of UPOV by the International Convention for the Protection of New Varieties of Plants Specializes in the IPprotection of ornamental and fruit plant innovations by means of Plant Breeders Rights, Plant Patents & Patents CIOPORA functions include: - Advisory - Representation - Lobby - Education on IP - Enforcement co-ordination - Industry network

3 What we do: Advisory content of IP laws and enforcement tools; CIOPORA develops comprehensive Position Papers on various aspects of PBR, incl. EDV, Minimum Distance, Breeders Exemption, Exhaustion, Scope of the Right, Patents, etc. Representation, Network & Lobby CIOPORA enjoys observer status at UPOV, the Administrative Council of CPVO and has a strong global network which includes governments, industry associations, research institutions and decision-makers. Co-ordination & Education CIOPORA communicates breeders positions on IP to governments, co-ordinates enforcement activities of its members, raises industry s awareness towards the IP and organizes CIOPORA Academy.

11 Things That Matter: Colombia, a productive UPOV implementation Colombia is a member of UPOV 1978, but with the amendments brought by the Decree 345 & good enforcement options for breeders UPOV With the UPOV standard Colombia managed to create an innovationfriendly and secure climate for breeders, inviting them to work with local growers & bringing their varieties into the country. 15 Innovative varieties are profitable for all One time 666 EUR royalties for the trees (1,666 trees by 0.40 EUR) Growers income from apples per ha per year: EUR 13,500 (50 tons, 0.27 EUR/kg) Growers income from apples: per life time of the apple trees - EUR 202,500 (15 years) End-consumer price of the apples per ha per year: 100,000 EUR (50 tons, 1.99 EUR/kg) End-consumer price of the apples: per lifetime of the trees: EUR 1,500,000 Money earned in the trade chain: EUR 1,300,000 Portion of royalty in grower s income: 0.33%

16 CIOPORA Member Survey 2013: PBR Registration CIOPORA conducts regular surveys among ist members about their experiences with PBR regimes worldwide: China Survey 2013 PBR registration in China. The following problems were identified: - No protection for all species; - Difficulties with import of certain varieties, such as rhododendron & azalea: - No requests for plant material for applications from ; - Average waiting period for obtaining PBR in China: 3 years, the longest years; - Lack of testing facilities for certain species or too small facilities with restricted capacity; - Difficulties with import of plant material, etc.

17 CIOPORA Member Survey 2016: User PBR in China why register? Frequent answers: - Variety commercialization via licensing; - Protection against unauthorized propagation; - Better control over varieties in case of export. On scale from 1 (very unsatisfied) to 5 (very satisfied) and as a user of Chinese PBR system, how satisfied are you with its current state?: - average score - 1,7 More than 50 % of respondents (ornamentals & fruits) currently commercialize their varieties in China, however indicate that royalty collection is extremely difficult.

18 CIOPORA Member Survey 2016: Challenges 4 3 Evaluate the challenging character of the following points on the scale from 1 to 10, where 1 - not challenging at all, 10 - the most challenging Importing plant material for DUS tests into China Importing plant material to deliver to growers into China Bureaucratic hurdles to variety registration Lengthy PBR registration procedures Lack of capacities for DUS trial in some/all varieties Language barrier and high cost associated with it Not all plant varieties can be protected under the current PBR regime/lack of protocols for some species Lack of information on what is actually covered/protected by a PBR title Narrow scope of Plant Breeders' Right Lack/absence of effective enforcement options The lack of/low access to new innovative varieties with high yield/improved properties for the local growers Large number of small growers in remote areas Lack of growing know-how among local growers Low quality and/or copy-cat breeding by local breeders Lack of understanding of and awareness towards IPR protection and its benefits for both breeders and growers among the Chinese growers Lack of support from the PBR regime implementing authorities - 8

19 CIOPORA Member Survey: Opportunities Where do you see the main opportunities for Chinese growers? Broader access to better varieties with higher yield and improved properties, both for domestic and export purposes; High potential internal market; Obtaining competitive advantage through the access to improved varieties; Obtaining growing know-how from breeders; Stabilization of price levels on production through quality enhancement and reduction of illegal propagation.

20 CIOPORA Member Survey: Breeders Voices PBR protection is easy. Enforcement is impossible. There are two methods for enforcement administrative & judicial. But all of our enforcement attempts have failed so far. The DUS test regulations & rules change rapidly. We keep getting conflicting statements about what we need to do for the DUS testing. There is not enough space in testing facility in Shanghai: only five varieties at a time are accepted. Growers are not willing to sign royalty agreements. The lack of effective enforcement hurts both breeders and honest growers business.

21 CIOPORA Member Survey: Breeders miss Protection for all species; Online PBR application; Online database with rules, procedures, database of titles for foreign users; Expansion of capacities in DUS tests; Effective and realistic enforcement options; More species that can be protected and better enforcement; Lack of legal specialists for actual PBR filing.

22 PBR in China: CIOPORA Analysis Limited number of species is protectable: genera and species (MoA) genera and species (Ministry of Forestry) 336 genera and species in total* Article 27(3) of the TRIPS Agreement obliges the WTO member-states to provide for protection of (all) plant varieties. In this case regulations of TRIPS Agreement prevail over the provisions of Act 1978 of UPOV Convention, since TRIPS Agreement came into effect on January 1, DUS tests can be shared by other test authorities, such as CPVO, as it is already the case in roses. *From 1995 till 2015 the CPVO received applications from genera and species

23 PBR in China: CIOPORA Analysis Farmers exemption applies to ornamental and fruit varieties in China. As there is no definition of farmer, this also applies to fruit & ornamental growers. Under this condition, there can be no sufficient return on R&D investment for breeders due to easy propagation of ornamentals & fruits: E.g. One apple tree bought from a breeder can be multiplied hundreds of times and harvested for 25 years.

24 PBR in China: CIOPORA Analysis Scope of Right: harvested & processed material is not covered! In vegetative varieties, it is the harvested and not the propagating material which represents the highest economic value. With no effective protection for harvested material, the PBR system has limited value for breeders of such varieties. They can neither control the production or internal trade, nor export and import of the harvested material of their varieties. In the view of CIOPORA UPOV 1991 Act describes a minimum scope of protection and thus allows a direct protection of harvested material.

25 Proposal for a balanced PBR Law in China Sufficiently broad Minimum Distance between varieties Direct protection of propagating and harvested material, or at least a broad definition of propagating material EDV concept, which includes Mutants and GMO Breeders exemption No farmers exemption for ornamental and fruit crops Balanced Exhaustion regime, which applies only to the material brought on the market with the consent of the titleholder Effective Enforcement mechanisms

26 Effective enforcement mechanisms Sufficient information and access to premises Fast and reliable proceedings Specialized Courts Full compensation of costs Effective border measures Deterrent sanctions
