8 Setbacks Surface Waters of the State Surface Waters of the State means all streams, lakes, ponds, marshes, watercourses, wetlands, springs, drainage systems, and other bodies or accumulations of surface water, natural or artificial, that are situated wholly or partly within, or border upon, Ohio, or are within its jurisdiction, except those private waters that do not combine or effect a junction with natural surface or underground waters.

9 Setbacks Surface Waters of the State Permitted CAFFs and Certified Livestock Managers Setbacks are the same for SWOTS regardless of whether the manure is surface applied, incorporated within 24 hours, or injected. 35 foot setback buffer must be completely vegetated 100 foot setback applies if no vegetative buffer exists or is less than 35 feet. Perennial & Intermittent Streams. Setback is measured from the top of the bank Waterways Setback is measured from the edge of the waterway. Roadside ditches ARE considered SWOTS!!

10 Setbacks Surface Waters of the State Non-Permitted Small and Medium AFFs There are different setbacks depending on the body of surface water or type of watercourse and the method of application. Pond or Lake Surface Application 35 foot vegetative buffer plus an additional 65 feet of setback, totaling 100 ft. Injection or Incorporation within 24 hours 35 foot vegetative buffer -OR- 100 feet if no vegetative buffer exists or is less than 35 feet. Streams, Ditches, & Surface Inlets Surface Application 35 foot vegetative buffer -OR- 100 feet if no vegetative buffer exists or is less than 35 feet. A 35 foot non-vegetative buffer can exist if the manure application area has at least 50% vegetation/residue cover at the time of application. Injection or Incorporation No setback Grassed Waterways and Field Surface Furrows Surface Application 35 feet (edge of Waterway) Injection or Incorporation within 24 hours No setback Roadside ditches would fall into this category.

11 Manure Applications on Frozen or Snow Covered Ground Permitted CAFFs and CLMS Prior Approval from ODA-DLEP must be obtained prior to manure applications on Frozen or Snow Covered Ground. Emergency Situation ONLY Alternative plans will be evaluated first. Facilities will be required to submit plans outlining methods to prevent this situation from occurring again. Non-Permitted Small & Medium AFFs Application of manure on frozen or snow covered ground is not acceptable and can only occur in an emergency situation. Detailed records of manure application activities must be maintained in your Comprehensive Nutrient Management Plan. Work with your local SWCD! REMEMBER, if the manure can be injected or immediately incorporated, the soil is not considered frozen.

13 Manure Applications on Frozen or Snow Covered Ground Manure applications on Frozen or Snow Covered Ground must meet ALL of these conditions, regardless of whether the facility is a Permitted CAFF or Non-Permitted AFF. A) Solid Manure shall be stockpiled in lieu of land application. Liquid manure application rate shall not exceed 5,000 GPA. B) Land must have at least 90% surface residue cover C) Application site can be no more than 20 contiguous acres. 200 foot break in between each 20 contiguous acres D) Increase Setbacks (as displayed in the previous tables) E) The rate of nutrient application shall not exceed rates specified in NRCS 590 and OAC 901:10 for frozen or snow covered conditions F) Additional criteria for sites that have greater than a 6% slope.

14 Manure Applications on Frozen or Snow Covered Ground Watersheds in Distress Grand Lake Saint Mary s OAC 901: , Part (B) 1) No manure shall be applied between December 15 th and March 1 st. 2) After March 1 st and before December 15 th, manure shall not be surface applied on frozen ground or ground covered in more than one inch of snow. It is permissible to apply when manure is injected or incorporated within 24 hours. Western Lake Erie Basin ORC No manure shall be surface applied on Frozen or Snow Covered ground. In the event of an emergency, manure application in WLEB shall be approved by ODA-DSWC Chief and in accordance with NRCS 590.

15 Stockpile Setbacks Note: Staging areas for manure must follow the Surface Application setbacks. If a solid manure pile is in a location considered a staging area for more than 15 days, it will be considered a stockpile and must meet the setbacks in the table above.
