7 Respirable Crystalline Silica Directive (EU) 2017/ December 2017 amending Directive 2004/37/EC on the protection of workers from the risks related to exposure to carcinogens or mutagens at work - FI A proportionate and technically feasible BOELV of 0.1 mg/m³ (Respirable fraction) (Annex III) for Work involving exposure to respirable crystalline silica dust generated by a work process (Annex I - 6.) NEPSI Recognition as a valuable and necessary instrument to complement regulatory measures and to support the effective implementation of the limit value (Recital 19) The evalusation of RCS when appropriate according to review process on the basis of available information, including scientific and technical data, economic feasibility, a thorough assessment of the socioeconomic impact and availability of exposire measurement protocols and technicques at the worplace (Article 1-18ª Recital 1)

8 Main Obligations Respirable Crystalline Silica Directive 2004/37/EC (CMD) on the protection of workers from the risks related to exposure to carcinogens or mutagens at work Substitution (replacement) Closed systems (if replacement not technically possible) Exposure reduction as low as technically possible (if closed system is not technically possible) If requested, inform competent authorities re exposures, etc. Restrict access to areas of risk Strict requirements for workers information and training Strict hygiene and health surveillance Medical record-keeping for 40 years. European Social Dialogue Agreement on Silica - protection of health of Employees and other individuals occupationally exposed at the workplace - minimisation of exposure to Respirable crystalline silica at the workplace by applying the Good Practices - prevent, eliminate or reduce occupational health risks related to Respirable crystalline silica - increasing the knowledge about potential health effects and about Good Practices

13 Principles of the NEPSI Agreement Respirable Crystalline Silica Carry out an INITIAL RISK ASSESSMENT Based on the results of personal DUST EXPOSURE MONITORING Implement Good Practices (collective and if necessary personal protection measures) Provide information, instruction and training to the workforce Organise health surveillance Monitor the application of the Agreement & Good Practices (site level) on the application of the Agreement from site to EU level, in a consolidated 13 way. Once every 2 years

14 NEPSI NEPSI Road Map Co-funding proposal: 1. Develop a specific action/training programme for the new generations of workers 2. Update the Good Practice Guide and Task Sheets 3. Develop a detailed standardised RCS Measurement Methodology 4. Continue the biennial Key Performance Indicators Reporting, enhance the participation through continuous awareness, promote the Agreement in cooperation with Health Safety and Environment Specialists 5. Common methodology and protocol (currently reviewed) to be agreed on RCS control on site Simplified Protocol on dust control on site targeting SMEs 6. Review the Agreement and the Good Practice Guide to check language coherence once the amended Carcinogens and Mutagens Directive will be adopted 7. Guidance for Members on the implementation of the CMD 8. IMA NEPSI 2.0. Project : Guidance for integration of NEPSI measures into companies HSE management systems 9. Collect of data on exposure on site to be prepared for future proposal of lower limit value 10.Internal and external communication strategy to prepare Members

15 RCS in a harmonised classification? In February 2016, France notified the ECHA Registry of an intention to submit a Harmonised Classification (CLH) for crystalline silica under the endpoint Carcinogenicity, by 31 March 2017 An alert concerning the risk of severe silicosis linked to the use of reconstituted stone containing high percentages of crystalline silica was transmitted to the relevant French ministries whose asked ANSES, the French expert agency, to issue an update knowledge of the sectors in which crystalline silica is produced and used In January 2017, Directorate General of Labour informed our French Colleagues that the classification dossier of crystalline silica would not be submitted to ECHA in March 2017 but will await the recommendation of their expert agency (ANSES) due in March By then, they will either submit a classification dossier or withdraw the intention to classify to ECHA , ANSES would make a Risk Management Options Analysis (RMOA) before any decision to help Authorities to decide on further regulatory risk management activities & to identify the most appropriate instrument to address.

18 EU Directives on Safety and Health at work The determined Directives to be reviewed in 2018 are: 1. Personal Protective Equipment (89/656) 2. Biological agents at work (2000/54) 3. Medical Assistance on board (92/29) 4. The review of the Carcinogens and Mutagens Directive (CMD) is still an going work with new batches to come. The proposed process for specific changes except for the CMD is: Based on the ACSH opinion, Experts and ACSH WGs will be set and meet in February/March A draft opinion on the specific directives should be adopted at the May plenary meeting of the ACSH. The Commission has committed to doing the technical updates by end of It is Important to note that this work will only concern technical amendments of the directive on non-essential elements in the annexes. There will be no ordinary legislative procedure with more substantial changes to the other directives during the current commission (till 2019).

19 Healthier and Safer Machines and Equipments UEPG is liaison at the CEN/TC Construction equipment and building material machines - Safety sur; Member of the CEN/TC WG and European Commission on the Machine Directive. UEPG is promoting actively Safer by Design and opened the initiative to Healthier Machines and Equipment. UEPG with the support of its Members is focusing on standardisation for Healthier and Safer Machines in Europe. Links are also made Globally over the GAIN Global Aggregates Information Network. UEPG has developed H&S Tool box starting with themes like Vibration and Noise.
