Proposals will take effect one year after publication. (Electronic copy was distributed in early October 2011)

106 PMO, Section 7, Pages Item 5r-Allows for additional alternatives for the direct loading of milk on a dairy farm by utilizing stubbed piping outside of the milkhouse wall as well as a transfer hose through the milkhouse hose port. Any installation would still need approval by DATCP Regulatory.

120 PMO, Section 8 and Appendix A, Pages 117, 118 and 129 Section 8-Makes corrections to the errors cited in Section 8-Animal Health in relationship to what animal species are covered and not covered under the USDA Tuberculosis (TB) Eradication Program.

120 Cont. PMO, Section 8 and Appendix A, Pages 117, 118 and 129 It also reflects changes to the USDA Brucellosis Eradication Program under the Interim Rule to 9 CFR Part 78 and updates the references cited in Appendix A-Animal Health Control to obtain copies of the USDA TB and Brucellosis Eradication. FYI. Doesn t affect Field Reps directly.

208 PMO, Table of Contents, Page X, Sections 6, Pages 24 and 26, and Appendix B, Pages 130, 132 and 134 Allows for the use of an approved alternative aseptic sampler for a farm bulk milk tank sampling system to obtain the universal sample. Any installation would still need approval by DATCP Regulatory.

210 PMO, Appendix B, Page 135 Allows for the tanker stickers to be located on the front LEFT side of the milk tank truck bulkhead. Driver side or Passenger side?? Depends on where you stand???

214 PMO, Section 7 and Appendixes F and L, Pages 46, 202 and 336 Item 11r-Provides an update in relationship to the Code of Federal Regulations (CFR) citation referenced from 21 CFR to 40 CFR dealing with sanitizers. OKAY

215 PMO, Section 7 and Appendix G, Page 211 Updates language in Private Water Supplies and Recirculated Water Bacteriological Testing. No problems foreseen.

216 MMSR, Sections G and H, Appendix A, and FORM FDA 2359j (Pages 4 and 5), Pages 30, 31, 48, 51, 52, 54, 56, 76, 77 and Provides a clarification and reorganization of requirements/criteria for Computing Enforcement Ratings, Part I. Dairy Farms, Item 10. Permit Issuance, Suspension, Revocation, Reinstatement, Hearings, and/or Court Action Taken as Required and Part II. Milk Plants, Item 9. Permit Issuance, Suspension, Revocation, Reinstatement, Hearings, &/or Court Action Taken as Required.

This affects the way the MSROs calculate the Enforcement Score for a Survey. I do not anticipate these changes causing any problems, just answers to questions we have had in certain situations.

219 Marked 2400 Forms Approve the CHARM Beta Lactum and Flunixin Test for screening under Appendix N. Approve a 2400 form and add the method to the list of allowable tank/tanker screening tests in M-a-85 CAUTION -Test is not required, however if you use the Flunixin Test and get a Presumptive Positive, you must follow ALL of the App. N Protocols, including the notification of DATCP and the disposal of Confirmed Positives.

224 Revises the 2400 Form for Appendix N. Bulk Milk Tanker Screening for Neogen BetaStar US to reflect the replacement of this method with the BetaStar Plus Beta Lactam Test. Upon approval the BetaStar US kit will be removed from commerce. This is a Procedure Change which affects the Labs.

233 Allows for beta lactam drug residue testing of sheep milk by the Charm SLBL method after a quantity of such milk has been frozen for up to 60 days and properly thawed. Subsequently the samples shall be held at C and analyzed within 24 hours as per the instructions for frozen controls of the Charm SLBL test method as described in the Charm SL / SL6 / SL form.

Previously the sheep milk was tested fresh and lab certified before freezing. Since it is shipped frozen, the receiving plant could not comply fully with App. N protocols. This is Pending LQAT Review.

313 Requests a Study Committee No Document Referenced Requests the NCIMS Executive Board to establish an Ad HOC committee to align the Pasteurized Milk Ordinance with the FDA Food Safety Modernization Act. Mostly editorial changes anticipated, no major changes in how the NCIMS and PMO operate.

THIS DID NOT PASS!!!! 305 PROCEDURES, Sections V and VIII, Pages 24 and 44 PROCEDURES CHANGE Seeks to increase the maximum inspection frequency for State Ratings on farms, plants, receiving stations, transfer stations and single-service facilities from 24 to 36 months. LIFE GOES ON IN THE SURVEY WORLD

Hydrogen Peroxide or other APPROVED Chemicals added to water systems FDA recently accepted Hydrogen Peroxide or other approved chemical addition anywhere in the water system on the farm and set criteria for proper use. DCOMM and DNR rules are almost identical to the FDA guidelines:

FDA GUIDELINES 1) NSF 60 Approved Chemical for addition to water systems. 2) Approved Metering Pump. 3) Documentation of pump setting needed to achieve required PPM of chemical. 4) Approved, properly placed BFP. (DCOMM & DNR have stated that if 1, 2, & 3 above are met, then NO BFP is needed.)

Bob says: Since the approved chemicals can be injected directly into the well, there is no place to properly install a BFP. WI Survey will accept the DATCP position that the DCOMM and DNR guidelines must be followed.
