Qualifications received in the issuing office after the date and hour designated are automatically nonresponsive and will not be considered. The College is not responsible for delays in the delivery of mail by the U.S. Postal Service, private couriers, or the intra-university mail system. It is the sole responsibility of the respondent to ensure qualifications are received by the issuing office no later than the designated date and hour. In compliance with this Request For Qualifications which includes the attached Table of Contents and all provisions and appendices attached and referenced therein, and subject to all the terms and conditions set forth herein, the undersigned offers this document as a true and accurate representation of his firm s work experience and qualifications in accordance with the attached signed proposal. 3 I. PURPOSE: The purpose of this Request for Qualifications (RFQ) is to obtain Statement of Qualifications from interested SWAM Contractors in order to select a list of up to ten (10) Contractors prequalified to bid on various construction projects, on the campus of The College of William and Mary, Williamsburg, Virginia, and Virginia Institute of Marine Science (VIMS) at Gloucester Point, Virginia. This RFQ is for 2 years from the contract issuance date. At the completion of the two year period, the College will re-solicit SWAM contractors to submit their qualifications and a new list will be established. All certified SWAM contractors that were previously pre-qualified (between October 2011 through October 2013) must reapply to be considered. The College reserves the right to revoke the pre-qualified status from any contractor at any time for cause (sub-standard performance) if a prequalified Contractor s lack of performance warrants. Prequalification status may also be revoked if the Contractor s license or DMBE certification expires during the 2-year time period of this RFP. II REFERENCES: Construction procurement and administration are governed by the College of William and Mary Facilities Management, Design and Construction Manual dated October 2007, (The Manual). Proposers should note the following: Chapter 11 - Construction Services: Procurement Procedures Chapter 12 - Construction Services: Special Project Delivery Procedures Chapter 13 - Construction Services: Contract Administration, Fees and Payments Chapter 14 - Construction Services: Project Close-Out III. DEFINITIONS: The Commonwealth of Virginia, General Conditions of the Construction Contract offer the following definitions to be utilized in conjunction with this Request for Qualifications. Contractor: The person with whom the Owner has entered into a contractual agreement to do the work. Owner: The College of William and Mary and Virginia Institute of Marine Science (VIMS) with whom the Contractor has entered into a contractual agreement and for whom the work or services is to be provided. The term Owner, as used herein, shall also mean The Agency. Subcontractor: A person having a direct contract with the Contractor or with any other Subcontractor for the performance of the work. Subcontractor includes any person who provides on-site labor, but does not include any person who only furnishes or supplies materials for the project. Substantial Completion: The condition when the Owner agrees that the work, or a specific portion thereof, is sufficiently complete, in accordance with the Contract Documents, so that it can be occupied and utilized by the Owner for the purposes for which it was intended. After obtaining the necessary approvals and certificates, the Owner, at its sole discretion, may take Beneficial Occupancy at this time or choose to wait to occupy until after Final Completion is achieved. 4 IV. BACKGROUND: The College of William and Mary has many historic and unique facilities with sophisticated building systems. Project scheduling and sequencing is critical, requiring the use of Contractors capable of meeting the requirements of the Contract, respecting the academic schedule and performing work within budget. Proposed work on a college campus must be performed in a manner that will minimize the disruption of the operation of the College, and the quality of life of those who live and work on the campus. V. STATEMENT OF NEEDS / SCOPE OF SERVICES: The scope of work will include the following types of projects: A. Interior Renovations Partition demolition/construction Interior finishes repair/replacement Door repair/replacement Other architectural features repair/replacement B Building System Repair, Demolition, Extension and/or Replacement Mechanical Electrical Plumbing Fire Alarm Fire Suppression Telcom Data/AV C. Exterior Envelope Repairs/Replacement Brick repair/repointing Exterior trim repair/replacement Door/window repair/replacement Mechanical enclosures construction/repair Brick walkways construction/repair Other exterior architecture/landscape repair/replacement VI. CONTRACTOR S STATEMENT OF QUALIFICATIONS: A. General: The respondent s proposal must include a complete response to this RFQ and the signed cover page (page 1) of the RFQ. One original, manually signed (in blue ink) and five (5) copies of each proposal must be submitted to the Issuing Agency. No other distribution of the qualifications shall be made by the respondent. B. Statement of Qualification Preparation: 1. The Contractor s Statement of Qualifications, CO-16 shall be prepared and signed by the authorized representative of the respondent. This form is attached at Appendix A. Qualification criteria listing the standards for pre-qualification on Form CO-16- Attachment 1 is at Appendix B. All information requested shall be submitted. Failure to submit all information requested may result in the Owner Page 4 of 7

5 requiring prompt submission of missing information and/or giving a lowered evaluation of the qualification. Qualifications which are substantially incomplete or lack key information may be rejected by the Owner at its discretion. 2. Qualifications should be prepared simply and economically, providing a straightforward, concise description of capabilities to satisfy the requirements of the RFQ. Emphasis should be on completeness and clarity of content. Each copy of the qualification should be bound as a single volume where practical. C. Oral Presentation: Respondents may be required to give an oral presentation of their qualifications to the Owner to clarify or elaborate on the proposal. The Owner will schedule the time and location of these presentations. Oral presentations are an option of the Owner and may not be conducted. Therefore, qualifications should be complete. D. Specific Proposal Submission Requirements: Respondents are required to submit the following items for a complete qualification: 1. The complete RFQ with page 1 signed and filled out and attachments as follows: DMBE Certification; A copy of the Contractor s Virginia Class A BLD License. eva Vendor Registration 2. The Contractor s Statement of Qualifications (CO-16) with attachments as follows: CO-16 Attachment One (Qualification Criteria) Surety Statement from the Contractor s Bonding Company indicating bonding capacities for single and aggregate projects. As applicable: For Standard Bonding: Surety Statement of Bonding Eligibility For Self-Bonding Program: CO-16 Attachment Two (Additional Financial and Insurance Requirements) Additional information, if any, provided under CO-16 Sections III, IV, V Additional information provided under CO-16 Section VI A copy of the Companies most recent Experience Modification Ratio (EMR) rating. NOTE: Statements of Qualifications should be as thorough and detailed as possible so the Owner may properly evaluate the Respondent s capabilities to provide the required services 3. It is strongly suggested, but not required that the Respondent, provide a Contractor Reference Letter from the three Project Owners listed in the CO-16. The three references may be included within the RFQ package. The reference letter format and requested reference questions are included in Appendix D titled Contractor Reference Letter Format (REF-1 through REF-3). It should be noted that the College may contact references and visit the projects listed to validate quality of work. Page 5 of 7

6 VII. PREQUALIFICATION EVALUATION CRITERIA The Issuing Agency shall review the Contractor s Statement of Qualifications data submitted by interested Contractors and determine which, if any, of the contractors shall be pre-qualified, using the criteria attached in Appendices A and B to this RFQ. The College will evaluate proposals and select a Firm whose proposal conforms to the RFP and will be most advantageous to the College based on the factors listed below: Description Points Key personnel experience and qualifications 25 Past performance and experience on similar size & scope projects 25 Commonwealth of Virginia capital outlay program experience 20 o (Proposal to indicate those projects performed as Prime or Sub-contractor, specifically for Virginia public higher education institutions) Schedule/budget compliance (on time/in budget) 20 o (Proposal to provide dollar values at contract award versus completion and reason for the difference in cost) Safety performance 10 Total Points 100 VIII. IX. NOTIFICATION OF SELECTION/NON-SELECTION: The Issuing Agency shall notify, in writing, each contractor that submitted the Contractor s Statement of Qualifications that their firm has been pre-qualified or denied pre-qualification. If a contractor is denied pre-qualification, the written notice ed to that contractor shall state the reason(s) for denial of pre-qualification and the factual basis of such reason(s). APPEAL PROCESS If a contractor is denied prequalification, a written notice to that contractor shall state the reason(s) for denial of prequalification and the factual basis of such reason(s). The written notice to each contractor shall be sent via to the contractor s address noted on page 1 of the RFQ. A contractor denied prequalification shall have ten (10) calendar days from the date to appeal the result. The contractor may submit an appeal with any additional information which may support the appeal to the agency s designated appeal officer s noted on page 1 of the RFQ no later than October 14, The Committee Chairman, Gilbert Stewart, shall notify the contractor via of his decision within the (10) working days of receipt of the appeal. The decision of the Committee Chairman shall be final. There is no further administrative appeal procedure pursuant to the Code of Virginia sections and 11-70: however, the contractor may initiate legal action pursuant to the Code of Virginia sections and X. PROCESS FOR SOLICITING WORK FROM PREQUALIFIED CONTRACTORS A. Single Projects with estimated value $50,000 to $250,000: All pre-qualified contractors will be notified and given an opportunity to submit a lump sum bid. The College will issue to the pre-qualified firms an IFB describing the nature of the work, project schedule and all other project pertinent information. Sealed bids will be required from the selected firms in 21 days at a minimum. Page 6 of 7

7 The contract will be awarded to the lowest bidder. The College may elect to select to solicit prequalified firms for projects greater than $250,000. B. Single Projects with estimated value of LESS THAN $50,000: The College may notify a minimum of four firms of an opportunity to submit a lump sum bid. The College will issue to interested, pre-qualified firms an IFB describing the nature of the work, project schedule and all other project pertinent information. Sealed bids will be required from the selected firms at 10 days at a minimum. Contract will be awarded to the lowest bidder. XI.
