1 DRAFT TEXT on CMP 12 agenda item 4 Matters relating to the clean development mechanism Version 01 of 13 November 2016 at 15:00 Draft decision -/CMP.12 The Conference of the Parties serving as the meeting of the Parties to the Kyoto Protocol, Recalling the provisions of Articles 3 and 12 of the Kyoto Protocol and decision 1/CMP.6, Cognizant of decision 3/CMP.1 and subsequent guidance provided by the Conference of the Parties serving as the meeting of the Parties to the Kyoto Protocol relating to the clean development mechanism, Noting decision 1/CP.19 on the promotion of voluntary cancellation of certified emission reductions, as a means of closing the pre-2020 ambition gap, Noting further the ongoing work of the SBSTA under its agenda items 12(a) and 12(b), I. General 1. Welcomes the report for of the Executive Board of the clean development mechanism (hereinafter referred to as the Executive Board); 1 2. Commends the Executive Board for the substantial work undertaken over the past year; 3. Expresses satisfaction with the progress of the clean development mechanism of the Kyoto Protocol, which to date has been responsible for: 2 (a) Over ### project activities being registered in over ### countries; (b) Over ### component project activities being included in over ### programmes of activities registered in over ### countries; (c) Over ### billion certified emission reductions being issued and over USD ### billion being invested; (d) Over ### million certified emission reductions voluntarily cancelled; (e) Over ### million certified emission reductions being transferred through the share of proceeds to the Adaptation Fund; (f) Over USD ### million of revenue for the Adaptation Fund from the sale of certified emission reductions; (g) ### loans under the clean development mechanism loan scheme being approved and over USD ### million of total commitment; (h) ### sustainable development co-benefit description reports being published using the voluntary sustainable development tool; 1 FCCC/KP/CMP/2016/4 2 See document FCCC/KP/CMP/2016/4 and the UNFCCC CDM website at < 1 of 6

Invites the Conference of the Parties serving as the meeting of the Parties to the Paris Agreement, at its first session, to consider the future role of the CDM, or elements thereof, in the context of the Paris Agreement; (EB report to CMP 12, para 22(a)) 5. Encourages Parties, public and private entities and citizens to contribute to the reduction of global emissions by supporting additional emission reductions achieved via the online voluntary cancellation platform; (EB report to CMP 12, para 22(g)) 6. Encourages the consideration by Parties of a continuing contribution of the CDM under existing work under SBSTA items 12(a) and 12(b); 7. Invites Parties to consider the use of CERs as a compliance instrument in emissions trading schemes; (EB report to CMP 12, para 22(b)) 8. Encourages aviation and maritime companies to commit to reducing emissions from their operations, including through the immediate voluntary cancellation of CERs; (EB report to CMP 12, para 22(c)) 9. Affirms that the clean development mechanism can contribute to action in the international aviation sector; 10. Encourages the Executive Board to continue its collaboration with ICAO and to further promote early action using CERs for voluntary purposes in the aviation sector; 11. Encourages ICAO and its Member States, as appropriate, to use CERs under the Carbon Offsetting and Reduction Scheme for International Aviation (CORSIA); 12. Requests the secretariat to monitor the development of eligibility criteria for offset projects under CORSIA and to analyze the implications in view of ensuring equal access to the scheme by projects with higher social benefits to households and communities; 13. Requests the Executive Board and the secretariat to engage with the financial and investment communities to promote the use of the CDM as a tool for the measurement, reporting and verification of green securities; (EB report to CMP 12, para 22(d)) 14. Invites the COP to request the operating entities of the Financial Mechanism to consider using the CDM as a tool for the measurement, reporting and verification of mitigation activities, as appropriate; (EB report to CMP 12, para 22(e)) 15. Requests the Executive Board, in consultation with the operating entities of the Financial Mechanism, to explore means of simplifying the application of the CDM for activities that are funded by the Financial Mechanism; (EB report to CMP 12, para 22(f)) 16. Invites development agencies and multilateral development banks to use the CDM, or elements thereof, to verify the mitigation impact of their supported activities, as appropriate; (EB report to CMP 12, para 22(h)) 17. Invites the Executive Board to continue its interaction with the Executive Board of the Green Climate Fund to ensure its inclusion in the annual meetings between the GCF and the thematic bodies of the United Nations Framework Convention on Climate Change in order to enhance cooperation and coherence of engagement; 18. Encourages the Executive Board to continue its activities in response to decision 6/CMP.11, paragraph 7 (exploring options for using the clean development mechanism as a tool for other uses.) and paragraph 8 (explore the opportunities for the financing of the clean development mechanism through international climate financing institutions, such as the Green Climate Fund); 19. Requests country Parties to refrain from restrictive practices including unilateral measures related to utilizing Certified Emission Reductions (CERs), such as but not limited to discrimination against some countries, technologies or greenhouse gases, in an effort to 2 of 6

3 avoid the introduction of distortions to the carbon market and facilitate the market recovery. Such an approach will also augment the Adaptation Fund with increased share of proceeds; II. Baseline and monitoring methodologies 20. Invites the Executive Board to assess the implications to integrate the length of the crediting periods in the methodologies, to better reflect the characteristics of different project types, i.e. with regard to technological lifetimes or financial viability including transaction costs; 21. Encourages the Executive Board to explore possibilities to reduce transaction costs of monitoring by expanding the use of tiered approaches offering a choice between conservative default values and direct measurements; 22. Acknowledges the efforts of the Executive Board with regard to some work in progress, inter alia on: (a) (b) (c) (d) The assessment of additionality; The consideration of e+/- policies; Standardized baselines; and The application of the concept of materiality to all stages of the project cycle; 23. Encourages the Executive Board to continue with its work on the areas specified in the paragraph 22 above and to report back on its outcome to CMP.13; 24. Encourages the Executive Board to continue its activities in response to decision 6/CMP.11, paragraph 14 (the development of digitized project and programme design document forms for clean development mechanism project activities and programmes of activities); III. Registration of project activities and programmes and issuance of certified emission reductions 25. Encourages the designated national authorities (DNAs) to make public the sustainable development criteria they use in their letter of approval process; 26. Requests the Executive Board to further develop the tool for assessment of the contribution to sustainable development, including assessing positive as well as negative impacts, that sets comparable standards, in order to assist DNAs, while not precluding host countries deciding on their national criteria; 27. Reminds the Executive Board that the holdings of CERs in the CDM registry should be published as required by the decision 3/CMP.1, appendix D, paragraph 12; 28. Requests the Executive Board to annually publish the holdings on each account in the CDM registry aggregated at party level in the way presented in table 1 in the appendix 1 of the relevant concept note from EB 89; IV. Regional and subregional distribution 29. Invites the Executive Board to further work on development of simplified clean development mechanism (CDM) methodologies and standardized baselines with support of regional collaboration centres (RCCs); 3 of 6

4 30. Invites the Executive Board to further work on development of simplified clean development mechanism (CDM) methodologies with support of regional collaboration centres (RCCs); 31. Invites Parties, organizations and institutions, wishing to do so, to make voluntary contributions to the regional collaboration centres, as described above in paragraph #, in order to expand the support provided through the centres; V. CDM Loan Scheme 32. Reaffirms the importance of increasing the participation of underrepresented countries in the CDM; (EB report to CMP 12, annex I, para 1(a)) Alt to 32: Recalls the purpose of the CDM Loan Scheme, which is to increase the participation of underrepresented countries in the CDM; 33. Takes note of the report on the evaluation of the CDM Loan Scheme, implemented pursuant to decision 2/CMP.5, paragraphs 49 and 50, and decision 3/CMP.6, paragraphs 64 and 67 and annex III; (EB report to CMP 12, annex I, para 1(b)) 34. Recognizes the implications for the CDM Loan Scheme of the current low price of certified emission reductions and, in particular, the implications for the recipients of CDM Loan Scheme funds with regard to potential difficulties in the repayment of loans; (EB report to CMP 12, annex I, para 1(c)) 35. Decides that the implementing agency of the CDM Loan Scheme, after consultation with the secretariat, may write off amounts disbursed under individual loans on a case-bycase basis, where it becomes evident that it will not be feasible for the loan recipient to repay the disbursed funds; (EB report to CMP 12, annex I, para 1(d)) 36. Requests the implementing agency and the secretariat to work closely with loan recipients that wish to continue under the CDM Loan Scheme to help those recipients identify ways to progress through the project cycle, including making adjustments to loan agreement terms, if appropriate; (EB report to CMP 12, annex I, para 1(e)) 37. Decides that, until market conditions improve such that new funds are available and new loans under the CDM Loan Scheme could be provided and repaid, the secretariat should not seek a new implementing agency after the expiry of the term of the current contract as required by paragraph 8 of annex III to decision 3/CMP.6; (EB report to CMP 12, annex I, para 1(f)) Alt to 37: Decides that the secretariat should not seek a new implementing agency after the expiry of the term of the current contract as required by paragraph 8 of annex III to decision 3/CMP.6; 38. Decides also that other changes to the CDM Loan Scheme are not required at this time; (EB report to CMP 12, annex I, para 1(g)) 39. Recommends the CDM Loan Scheme should be continued for the existing recipients that have the possibility of repaying the funds in the future. Extend the term of the loan agreements until 2020 to accommodate the current project cycle status of the loan recipients; 40. The Loan Scheme should be continued for the existing recipients that have the possibility of repaying the funds in the future. 5 VI. Resources for work on the clean development mechanism 41. Recalls that the Executive Board has to be able to perform its main duties continuously until the closure of the second commitment period of the Kyoto Protocol. Any redirection of resources from regulatory activities to promotional activities would require further explanation and consideration by the Executive Board. We see a greater value in maintaining broadly relevant no-regret technical work than in outreach activities; 42. Encourages the Executive Board to be prudent with its spending, including for the Executive Board members. 5 of 6
