16 ETNG Pooling Rate Schedule SA allows customers to aggregate supplies within defined pooling areas and provides a title transfer tracking service Gas nominated into a SA pool (service point) is referred to as Deliveries In. Nominations sourcing gas out of a SA pool are referred to as Receipts Out Physical Receipt Deliveries In Pool Receipts Out Physical Delivery SA contracts can be used to nominate gas: Between a physical receipt point and a SA pool within the same pooling area Between different SA contracts within the same pooling area To nominate out of the pool, customer must use a transportation contract with the upstream reference as the source party s SA contract. 30 Who is the FERC? The Federal Energy Regulatory Commission (FERC) is an independent government agency, under the Department of Energy whose purpose is to protect the public and energy customers, and ensure that regulated energy companies are acting within the law. 31 What is the FERC Responsible for? Interstate Natural Gas Pipelines Regulates interstate transportation rates and services Regulates construction and abandonment of pipelines, storage facilities and liquefied natural gas terminals Oversees environmental matters Responsible for the establishment of reasonable and not unduly discriminatory service terms, conditions and rates ETNG 2015 FALL CUSTOMER MEETING 31

Decisions vary depending on factors, including but not limited to: Impact on human environment Complexity and size of project Geographic location of the project Type, magnitude and complexity of environmental impacts Level of controversy or public/agency concern Quality of application materials Project changes introduced after application is filed? 34 FERC Process Traditional Filing Benefits FERC s review begins after application is filed Pipeline has more control over the project schedule and less upfront, unwarranted exposure to Non- Governmental Organizations (NGOs) Cost savings from not having to meet Pre-filing milestones and provide upfront Resource Report drafts Generally a more predictable process and results in an EA Risks Don t really know what to expect from FERC Usually results in voluminous data requests Significant issues not identified early FERC ex-parte rules apply limiting communication File Options Results ETNG 2015 FALL CUSTOMER MEETING 34

40 Non-FERC Agency Impacts The FERC process is as fast as the slowest agency permit! Require detailed survey information early Require more detailed mapping in some cases than FERC requires or that are available from alignment sheets In some areas of the country, these agencies drive the process more than FERC and FERC facilitates that interaction Other agencies may impose additional more restrictive conditions on projects Certificate condition All other Federal authorizations are required prior to commencement of construction ETNG 2015 FALL CUSTOMER MEETING 40
