2 Alisal Union School District Contractor Pre-Qualification Form PRE-QUALIFICATION FOR PROSPECTIVE BIDDERS FOR ALISAL UNION SCHOOL DISTRICT Revised February 11, 2015 I. BACKGROUND AND OVERVIEW The Alisal Union School District (District) is pre-qualifying General Contractors (Contractor) to bid to perform construction work on District facilities for up to 12 months. It is estimated that construction costs will range from $15,000 to $5,000,000 per facility and/or per project. As a condition of bidding to perform any of the construction work on any of these facilities and/or on a project, and in accordance with California Public Contract Code , the District requires prospective bidders to fully complete a pre-qualification questionnaire on forms supplied and a financial statement. Once a Contractor s pre-qualification statement is submitted, the District will notify the Contractor if the Contractor meets the pre-qualification requirements. If pre-qualified, Contractors will be pre-qualified for one calendar year following the date of initial pre-qualification. Contractors who are pre-qualified must update pre-qualification forms as a prequalified Contractor s status or information changes. The District reserves the right to request that Contractor(s) update pre-qualification forms on a quarterly basis. The District also reserves the right to revoke, rescind, and/or reuse the pre-qualification status of a Contractor. PROJECT DESCRIPTION The construction projects include reconstruction, modernization, and new construction of District facilities estimated to cost $15,000 to $5,000,000 per facility. The projects that the District is considering for award to pre-qualified Contractors include: A. New construction and modernization of various school building facilities B. New and modernization of site utilities C. New and modernization of athletic facilities D. New and modernization of exterior landscape and paved area III. PRE-QUALIFICATION PROCESS The following process will govern the conduct of Contractor pre-qualification for the District projects. A Contractor who submits pre-qualification responses thereby consents to and will comply with the procedure outlined below and as set forth in greater detail in this document. A. Submittal. Contractors desiring to qualify for work on District projects shall submit a Contractor Pre-qualification Questionnaire and Certification (Questionnaire) in a sealed envelope to Alisal Union School District, 1205 E. Market St., Salinas, CA, 93905, Attention: Business Office. However, the District reserves the right to request, receive, and evaluate supplemental information after the above time and date at its sole discretion. B. Form. Contractor shall successfully complete the pre-qualification process and timely submit all documents as indicated in the Questionnaire. No other pre-qualification documents previously completed by Contractor will meet these requirements. All information requested in the Questionnaire must be provided in order to be considered responsive to the requirements of pre-qualification. The Questionnaire shall be submitted as one package it shall not be submitted piecemeal. Contractors shall submit one (1) completed Questionnaire with required attachments in hard copy format (i.e., 8-1/2 x 11 paper) in a sealed envelope. Submission of an incomplete and/or unclear Questionnaire is likely to result in a determination that the Contractor is non-responsive. C. District s Review. Information submitted in the Questionnaire shall not be public information and shall not be open to public inspection, to the extent allowed by law. Contractors that have submitted a Questionnaire shall receive written notification of their pre-qualification status. The District reserves the right to reject any or all Questionnaires or to waive irregularities in any Questionnaire received. The District also reserves the right to certify a Contractor only up to a specific Contract size or dollar amount. 3

Any addenda issued will be faxed, mailed, or sent by messenger service to all Contractors known to the District to have received a Questionnaire and who have provided a complete and legible physical address, telephone number, and fax number for receipt of addenda. E. Nonresponsiveness. A Contractor s Questionnaire shall be deemed nonresponsive if: 1. The Questionnaire is not returned on time. 2. Contractor does not provided all requested information. 3. The Questionnaire is not signed under penalty of perjury by individuals who have the authority to the bind the Contractor on whose behalf they are signing. 4. Information contained in the Questionnaire is not updated under penalty of perjury when it is no longer accurate. 5. Any information provided by the Contractor is misleading or inaccurate in any material manner (e.g.; financial resources are overstated; previous violations of law are not accurately reported). Even after a Contractor has been determined to be qualified, the District reserves the right to revoke that determination at any subsequent time, to terminate any Contract awarded, and to cease making payments if it determines that any information provided by the Contractor was incomplete, misleading, or inaccurate in any material manner. F. Deadline for Submission. Per Public Contract Code Section , a proposal form required pursuant to subdivision (e) shall not be accepted from any person or other entity that is required to submit a completed questionnaire and financial statement for prequalification pursuant to subdivision (b) or from any person or other entity that uses a subcontractor that is required to submit a completed questionnaire and financial statement for prequalification pursuant to subdivision (b), but has not done so at least 10 business days prior to the date fixed for the public opening of sealed bids or has not been prequalified for at least five business days prior to that date. The district may require the completed questionnaire and financial statement for prequalification to be submitted more than 10 business days prior to the fixed date for the public opening of sealed bids. The district may also require the prequalification more than five business days prior to the fixed date. Please note that the determination, by the District, of successful pre-qualification may take several days. Please submit pre-qualification forms well in excess of the limit prescribed in Public Contract Code

5 Alisal Union School District Contractor Pre-Qualification Form IV. APPEALING A QUALIFICATION FINDING Contractor may appeal the District s decision. If a Contractor decides to appeal the District s qualification decision, it shall follow this procedure: 1. Contractor shall submit, in writing, within three (3) working days from notification, a request for a written response from the District to explain any aspect of the District s determination. 2. Within three (3) working days from receipt of the District s written response to the Contractor s request, Contractor may submit, in writing, a request for a meeting with the District s staff. Contractor may submit with the request any information that it believes supports a finding that District s determination should be changed. 3. Within three (3) working days from receipt of the District s written response to the Contractor s submittal of information, Contractor may submit, in writing, a request for a meeting with the District s Assistant Superintendent at which time Contractor may submit any previously submitted information that it believes supports a finding that District s determination should be changed. 4. Within three (3) working days from receipt of the District s written response to the Contractor s request, Contractor may submit, in writing, a request that the District s finding be submitted to the District s governing board, at which time the Contractor may address the Board pursuant to the Board s procedures for public inquiry. 5
