2 2 Sealed tenders are invited from interested and reputed firms for the supply of Bio-Medical Waste Bins, Cans, etc., to ESIC MH, PGIMSR & MC, Rajaji Nagar, Bangalore 10., in 2 bid system. Period of downloading of tender document: From onwards. Last date of submission of Bid : at hrs. If it happens to be holiday, on next working day. Late/delayed offers shall not be opened/entertained under any circumstances. The Offer/Tender should be dropped in the Sealed Tender Box available in the General Branch, ESIC Model Hospital, Rajaji nagar, Bangalore 10. The tender should be dropped latest by Hrs on or before Tender Box will be opened at Hrs sharp on by the duly authorized Officer /Team of officers of ESIC Model Hospital, Rajajinagar in the presence of all such bidders who wish to be present. I M P O R T A N T I N F O R M A T I O N & TERMS AND CONDITIONS ESIC MH, PGIMSR & MC, Rajaji Nagar, Bangalore 10 invites sealed quotations in 2 bid system from reputed firms for the supply of Bio-Medical Waste Bins, Cans, etc. 1. The detailed specification of items to be supplied is given in Annexure III. 2. Minimum eligibility: 2.1. The firm should be manufacturer/supplier and should have branch office in Bangalore Should not have been blacklisted by the Govt. / PSUs 3. Bid Security/ Earnest Money Deposit (EMD) 4.1. EMD of Rs.25000/- (Rupees Twenty Five Thousand Only) in the form of Demand Draft/Bankers Cheque from any Schedule bank drawn in favour of ESIC Account No. 1 payable at Bangalore shall accompany the bid EMD shall remain valid for a period of 30 days beyond the final validity period of bids (60 days) A bid received without Bid security (EMD) shall be rejected at the bid opening stage The earnest money shall be refunded to the unsuccessful Tenderers after finalization of the contract It shall be refunded to the successful Tenderer on receipt of Security deposit No interest is payable on the EMD The EMD may be forfeited: (i) If a bidder withdraws his bid during the specified period of bid validity specified in the bid document. (ii) In the case of successful bidder, if the bidder fails to : o Supply the items. o furnish the Performance security within the time specified in the document 5. Submission of Bid a) The tenderers are required to submit bid in two separate bid i.e. Technical bid and Financial bid, as per prescribed proforma. The two

3 3 Bids should be submitted in two separately sealed envelopes superscribed Technical Bid for supply of Bio-Medical Waste bins, cans etc. and Financial Bid for supply of Bio-Medical Waste bins, cans etc.. Both sealed envelopes should be put in a third sealed envelope superscribed Tender for supply of Bio-Medical Waste bins, cans etc. in ESICMC, PGIMSR & MH, Rajajinagar, Bangalore -10. b) The sealed envelope for the Technical bid should contain the following: i) Tender application form in Annexure I ii) Earnest Money Deposit of Rs.25,000/- (Rupees Twenty Five Thousand Only) in the form of Demand Draft/Bnakers Cheque from a commercial bank drawn in favour of ESIC Fund A/c-1, payable at Bangalore. iii) The envelope should be superscribed as Technical bid for supply of Bio-Medical Waste bins, cans, etc. iv) Copy of Income Tax returns filed for the past 03 years. v) Copy of PAN Card. vi) Declaration form duly signed with seal in Annexure II vii) Specification form duly signed with seal in Annexure III. viii) Self Attested Sale Tax/VAT Registration Certificate. ix) Image of the items quoted as per annexure III may also be submitted. c) The envelope for the Financial bid should contain the Financial bid tender form in Annexure IV and the envelope should be superscribed as Financial bid for supply of Bio-Medical Waste bins, cans etc. in ESICMC, PGIMSR & MH, Rajajinagar, Bangalore 10. d) The sealed envelopes containing Technical bid and the Financial bid should be put into a third sealed envelope and superscribed a s Tender for supply of Bio-Medical Waste bins, cans, etc. in ESICMH Bangalore -10. e) The firms qualified in the technical evaluation will have to submit the samples of the quoted item for scrutiny by the hospital. The bids of selected samples will only be considered for financial evaluation. The sample of the items for which contract is awarded will be retained by the hospital for further comparison during supply. N.B. All the documents submitted in the bid must be legible and self attested along with the seal of the firm. Otherwise the bid is likely to be rejected. 6. Deadline for submission of bids 6.1. The above envelopes shall be sealed and addressed to The Deant, ESIC MC, PGIMSR & MH, Rajajinagar, Bangalore 10 and must reach on or before by Hrs No bids will be received/accepted after the expiry of the prescribed date and time for submission of the bids.

4 The Dean, ESIC Model Hospital, Rajajinagar, Bangalore - 10, may, at his/her discretion, extend the deadline for submission of bids. 7. Bid Opening and Evaluation 7.1. The Technical bid shall be opened by the Officers authorized by the Dean at hrs on in the presence of the bidders or their representatives duly authorized by the bidder who wish to be present. 7.2 The Technical bids will be scrutinized, and relevant documents will be checked for their authenticity and the tenderer whose technical bids are accepted will be informed about the date and time for submission of sample quoted items for verification by mail and also over telephone. 7.3 The Technically successful tenderers whose sample item will be accepted by the hospital, will be informed by mail and also over telephone about the date and time for opening the Financial Bid. 8. The tenderer should sign at each page of the tender and all its Annexures. No page should be removed /detached from the tender document. 9. The tendering firms will have to give a declaration to the effect that they have not been blacklisted or their business dealings with the Government departments have not been banned. This declaration may be furnished in the format given in Annexure II attached to this Tender Document. 10. Contacting the officials 10.1 No bidder shall try to influence the Purchaser on any matter relating to its bid, from the time of the bid opening till the time contract is awarded Any effort by the bidder to influence the Purchaser in the Purchaser s bid evaluation, bid comparison or contract award decision shall result in the rejection of the bid Canvassing in any form by the tenderer or his representative with any of the officials of ESIC Model Hospital shall render the tender liable to be rejected. 11. Non transferability : This tender is non transferrable 12. Tenders not received in the prescribed format shall be ignored and no correspondence in this regard will be entertained. Telegraphic/Telex/Fax/ /Quotations will not be accepted and ignored straightaway. 13. Bid Prices The price quoted should be valid for Three Months from the date of opening of Tender bid Item should be on site Guaranty for a minimum period of 01 year Any conditional acceptance is liable for rejection of tender The rates/ prices including the taxes, if any, should be quoted in Indian Rupees only in words as well as figures.

5 The rate quoted should be inclusive of all kind of taxes, duties, charges and statutory levies Tenderers are requested to quote their prices on a firm & fixed basis Tenderers are requested to quote their rates on F.O.R. destination basis (Free delivery and installation to the consignee's premises). 14. Awarding of contract The Tenderer has to quote the unit price and for the item being quoted in annexure IV The Tenderer who has quoted least itemwise in annexure IV in comparison to the other tenderers shall be considered as the lowest tenderer itemwise The successful tenderer has to deposit Security Deposit equivalent to 10% of value of supply order, in the form of Demand Draft in favour of ESIC Account No. 1 payable at State Bank of India, Rajajinagar, Bangalore 10. The security deposit will be released after completion of Guaranty for period of 01 year. For the period of 01 year no interest shall be paid. 15. Offering of lowest prices to EISC MC, PGIMSR & MH, Rajaji nagar: 15.1 The prices charged under the Contract by the Contractor shall in no event exceed the lowest price at which the Contractor sells or offer to sell the identical description to any person(s)/organisation(s) including the Purchaser or any Department of the Central Government or any Department of a State Government or any statutory undertaking of the Central or a State Government, as the case may be, during the period till performance of Supply Order is completed If at any time during the said period, the Contractor reduces the Sale price, sells or offers to sell such items to any person(s)/organisation(s) including the Purchaser or any Statutory Undertaking of the Central or a State Government, as the case may be, at a price lower than the price chargeable under this Contract, he shall forthwith notify such reduction or Sale or offer of Sale to the ESIC MH, Rajaji nagar and the price payable under the Contract for the items supplied after the date of coming into force of such reduction or sale or offer of sale stand correspondingly reduced The rates quoted by the selected firm and approved by this office shall remain valid through out the period of 03 month and to increase the rates for any item(s) during the period shall not be considered. 16. The Dean, EISC MC, PGIMSR & MH, Rajajinag Bangalore 10, reserves the right to accept or reject any bid including the lowest and to annul the bidding process and reject all bids, at any time prior to award of contract, without thereby incurring any liability to the affected bidder or bidders or any obligation to inform the affected bidder or bidders of the grounds for the said action. 17. The Dean is not bound to accept the lowest tender or any tender or to assign any reason for rejecting any or all the tenders. The Dean also reserves the right to accept/reject (part/whole) or any other tender(s) at their sole discretion without assigning any reason thereof. Its decision in the mater shall be final and binding. 18. Successful tenderer will have to supply the item within two weeks from the date of

6 6 receipt of supply order on the rates quoted by them for sample item accepted by the competent authority of this Hospital. 19. The items shall be supplied F.O.R. destination. 20. The Dean, EISC MC, PGIMSR & MH, Rajajinagar, Bangalore 10, will not pay separately for transit insurance and the supplier will be responsible till the entire stores contracted for, arrive in good condition at the destination. 21. In case of delay / failure in supply, the item shall be purchased from the market at the risk and cost of the Contractor. The extra expenditure involved in procuring supplies from elsewhere will be recoverable from the Contractor in full at discretion of the Medical Superintendent. 22. The recovery thus due shall be deducted from any sum then due to the Contractor from the ESIC Model Hospital from this or any other contract placed with said contractor by the ESIC Model Hospital. 23. The Security Deposit may be forfeited if the item is not supplied as per supply order and item approved in demonstration and sample accepted. 24. Payment terms: 1. Advance payment will not be made under any circumstances. The payment shall be made through RTGS/NEFT only. Hence the Bank details are to be submitted along with the bills. 2. Bill should be submitted in triplicate along with RTGS details & copy of supply order to the ESIC MH, Rajajinagar, & ESIC Hospital Peenya separately for the items supplied at each destination. 25. The Terms & Conditions as set out in this Tender document shall be complied with by the tendering firm. 26. The Dean, EISC MC, PGIMSR & MH, Rajajinagar, Bangalore -10 reserves the right to withdraw/relax any of the terms and conditions mentioned above. 27. The quantity of item required is only approximate & the Dean reserves right to increase or decrease the quantity of the item. 28. If the successful Bidder fails to fulfill his obligations under this Tender i.e., Nonadherence to terms and conditions contained in this Tender, the ESIC MC, PGIMSR & MH after due notice to the contractor may blacklist the firm. In such events, the Contract will stand terminated and the EMD/Performance Securities of such Firm shall be forefeited to the ESIC. 29. For any dispute regarding quality / service and rates the decision of the Dean shall be final and binding to the Contractor. 30. While submitting the tender for this work, the tenderers will be deemed to have read, understood and accepted all the items and conditions stated in the tender document. Any doubts or clarifications with regard to the interpretation of the Terms & Conditions stipulated in this Tender Enquiry, may be got clarified from the Dean, ESIC MH, Rajaji nagar, Bangalore - 10 at least 03 days before tender closing date. Requests for postponing the tender opening date for the same shall not be accepted. 31. In the event of any disputes arising out of the execution of Rate Contracts/Supply Orders, the matter will be referred to the Dean, ESIC MH, Rajaji nagar, Bangalore All disputes relating to this tender can be resolved through The Dean in Bangalore

7 7 only. 33. If the contractor fails in fulfilling the terms and conditions mentioned here in different parts of this tender document, such failure will constitute a breach of the contract and the Dean shall be entitled to make other arrangements at the risk and expense of the contractor. Also non-performance/unsatisfactory performance or violation of terms and condition of the contract will make the contractor liable for forfeiture of security deposit. The decision of the Medical Superintendent shall be final and binding on this count Octroi Duty and Local Taxes: Normally the items supplied to Government Departments against Government Contracts are exempted the from levy of town duty, Octroi Duty, Terminal Tax and other levies of local bodies against production of Exemption Certificate from authorized officers. As the tenderers are requested to quote their prices on F.O.R. destination, door delivery basis, Octroi Exemption Certificate will not be issued by this Hospital and any separate charges for Octroi & local taxes will be borne by the Contractor himself only. 35. The Dean, ESIC Model Hospital, Rajajinagar reserves the option to give a purchase/price preference to offers from Small Scale industries etc. in accordance with the policies of the Govt. in force from time to time. 36. The decision of the Dean, ESIC MH, Rajaji nagar, Bangalore - 10 shall be final as to the quality of the items and shall be binding upon the tenderers and in case of any of the articles supplied not being found as per approved sample shall be liable to be rejected or replaced and any expenses or losses caused to the suppliers shall be borne by the supplier. It will be the responsibility of the supplier to ensure that articles supplied are of the best quality and free from all defects. The acceptance of articles will be given only when the articles are found upto approved sample and free from all defects. The rejected items must be removed by the tenderers from the ESIC MH, Rajaji nagar premises within 03 days from the date of the information about their rejection. Signature of the tenderer with Seal
