Labor only as specified in this contract will be supplied by the (). Materials supplied by Sparta Trades will be warrantied by the manufacturer. Any equipment, material, or labor designated as OWNERS responsibility must be on the job site, uncrated and inspected and approved on the day the project begins. Client supplied material used will be warrantied by the manufacturer, not Sparta Trades. Labor will be warrantied by Sparta Trades for 1 year from the date of completion for products supplied by Sparta Trades Kitchens & Baths. If project is not paid in full upon completion, all warranties will be void. All surfaces of walls, ceilings, doors, windows, and woodwork (except those of factory made kitchen cabinetry) will be left unpainted and unfinished. Final spackling and sanding is the responsibility of the painter. Please review and return the signed contract within 5 days of the date on the contract to keep your project on a timely schedule. Thank You. The owner acknowledges that Sparta Trades has the right to assert and file a lien for any unpaid work in accordance with New Jersey lien law and that all unpaid material shall remain the property of Sparta Trades. Attached is a blank copy of the change order. We would prefer not to have changes when the project has started, however, they do occur. The procedure is, Sparta Trades Kitchens & Baths will write up requested change(s) with a price and length of time the change will delay the project. The change must be signed by client and paid for in full within 48 hours prior to starting change, or the project will be done as originally planned. Any change from contract additions deletion or substitution will delay the project. If specifications call for re-use of existing equipment, no responsibility on the part of the () for appearance, function or service shall be implied. The owner recognizes that slight variations in finish, sheen, wood grain -knots etc, are inherent in wood and as such are considered acceptable in this project. Wood by nature will undergo expansion and contraction movements year after year as it compensates and adjusts to ever changing atmospheric humidity and temperature conditions, as such, finish stress lines may become visible on painted cabinets especially at the joints. Any such occurrence is not considered a defect. Color variations are also a natural occurrence due to species, age, character of cabinets, and exposure to UV light and sunlight, for these reasons new cabinets you order may not exactly match display samples and/or existing cabinets. Samples of wood, tile, stone, and porcelain may not be an exact match to what will be installed. Slight variations in the gloss, color, shape and pattern are to be expected and considered acceptable. Stone granite marble limestone, etc, and any natural products have a wide range of color movement fissures - grain shade crazing indentations etc, all of which are considered inherent in natural materials and are acceptable in this project. The client recognizes the above features and understands that Sparta Trades Kitchen & Baths will use its best judgment and industry standards to make your project as acceptable as possible. STKB calls your attention to limitations of matching materials such as drywall, plaster, paint, tile, roofing, wood trim, planes, etc., exact duplication is not promised and should not be expected. Changes in field measurements and job site conditions may necessitate on site adjustments, which STKB will use its best judgment to handle. If the floor, wall, or ceiling is not level or plumb STKB reserves the right to charge and additional fee for added labor & material. Actual dimensions on site may vary from floor plan. Care and maintenance of your bath is your responsibility. We encourage you to annually look at the grout, caulk and silicone joints and re do and replace as needed to protect your investment. Homeowner is responsible for sealing grout as part of the care and maintenance of the grout if they choose to do so. * Flat or matte finish for paint is recommended for walls and ceiling. We Do Not Recommend The Use Of Hi Gloss Paint On Walls Or Ceilings. (STKB is not responsible in any way for problems arising from the use of these hi-gloss finishes) Not included in this contract is: Any Testing or Analysis or Remediation Removal or Repair of Radon Lead Asbestos Mold or any other like substances. STKB shall have free access to work site for materials, trucks, men, etc. Access to the home/project area must be available during normal business hours. agrees to remove and protect any personal property in all rooms we will work in to include, window treatments, photos, etc. and outside including shrubs, flowers, etc. and STKB shall not be held responsible for damage to such items. It is the owner s responsibility to ensure the heat is on and goes to all appropriate areas of the home. STKB is not responsible for any freezing water issues caused by insufficient heating. Property owner must carry fire, tornado and other necessary insurance. Client must reply within 24 hours on all questions, any delays will make project take longer. Thanks. Retainers may be applied towards purchase from Sparta Trades within 6 months from date of receipt for projects over 6,000 and are non transferable. If client / homeowner cancels contract after it is signed, the deposit and all monies paid to date will be forfeited to STKB. In the event of a dispute, the owner and STKB give up the right to have the dispute decided in a court of law before a judge or jury, and instead are accepting the use of arbitration for resolution. The use of credit cards for payment is a courtesy extended to you (our client) by Sparta Trades Kitchens & Baths. Payment made with credit cards that Sparta Trades Kitchens & Baths processes over the phone (without your signature) is acknowledgement to be acceptance of work done or materials supplied. We may sometimes ask the credit card company for a 3 rd party verification when we process your card. We reserve the right to add 5% to credit cards that are used for making payments. 1. DEBRIS REMOVAL: TO BE PAID BY CLIENT DIRECT TO DUMPSTER COMPANY CLIENT TO PROVIDE DUMPSTER PLANKS TO PROTECT THEIR PROPERTY, WE SUGGEST FOUR (ONE FOR EACH WHEEL) 4 LONG X 12 WIDE X 2 THICK EACH If a dumpster is required for trash and construction material removal, this cost will be paid directly by the client to the trash company. It is the clients responsibility to clear all walkways and driveways during inclement weather. It is the responsibility of the client to determine the best location for dumpster re: wires, pipes, septic, accessibility and safety. Sparta Trades will assume no responsibility for damage done by dumpster. 11. PERMITS: LOT BLOCK PAID BY CLIENT Obtaining permits, if appropriate are the responsibility of the client homeowner. Sparta Trades will help fill out permits and file if clients wants. If Sparta Trades fills out and files the permits the actual cost of the permits will be paid separately by the client, when obtained. It is the responsibility of the homeowner to have the home open and someone home on the days of inspections. Additional work, testing or inspection time required by the code official will be billed as extra under this contract, to be paid for prior to starting extra work. If the homeowner cannot be home on the days of inspections, Sparta Trades will try to get a house sitter to wait for the inspector. The homeowner will pay for the house sitter direct 25 per hour including travel time or a minimum of 75 whichever is greater. A check or cash must be left at the jobsite on day of inspection. 12. MISCELLANEOUS: Sparta Trades Kitchens and Bath will make its best effort to determine job conditions, however, INITIAL

4 removal or correction of any concealed wall, ceiling or floor obstruction,decay, pipe, ducting, etc. revealed during construction, is not included in this contract. If this type of situation occurs, it will be reviewed with the client, and a separate price will be quoted on that part of the project. Payment for the extra work will be paid in full prior to any additional work proceeding. All changes to the basic contract deletions, changes, additions etc. will generally increase the time it takes to complete the project. Change Order Forms must be signed by both Sparta Trades and client. 5 NOTICE TO CONSUMER YOU MAY CANCEL THIS CONTRACT AT ANY TIME BEFORE MIDNIGHT OF THE THIRD BUSINESS DAY AFTER RECEIVING A COPY OF THIS CONTRACT. IF YOU WISH TO CANCEL THIS CONTRACT, YOU MUST EITHER: 1. SEND A SIGNED AND D WRITTEN NOTICE OF CANCELLATION BY REGISTERED OR CERTIFIED MAIL, RETURN RECEIPT REQUESTED; OR 2.
