2 County of Alameda, General Services Agency-Procurement Project No. CPP14C , Addendum No. 2, October 26, 2016 Issued by the General Services Agency, Technical Services Department TO ALL PROSPECTIVE BIDDERS for the above project, notice is hereby given that the following changes, modifications, corrections, clarifications, and additions, as herein set forth, shall apply to the specifications and drawings described herein and shall be made part thereof and subject to all requirements as if originally specified or drawn. Receipt of this Addendum No. 2 must be acknowledged in writing in the Bidder s submittal on Document Bid Form. Addendum No. 1: Addendum No. 1 was issued without a date. The date of issue for Addendum No. 1 is October 24, Receipt of Addendum No. 1 must be acknowledged in writing in the Bidder s submittal on Document Bid Form. Submittal of Written Questions: The deadline for submitting written questions has been extended by two days from Wednesday, October 26, 2016 to Friday, October 28, Bid Submittal: The deadline for submitting bids as specified in the Notice to Bidders (Document ) is extended from 2:00 p.m., Tuesday, November 15, 2016 to 2:00 p.m., Thursday, November 17, QUESTIONS ASKED DURING PRE-BID MEETING - RESPONSES, CLARIFICATIONS AND MODIFICATIONS Q1) What is the current status of utilities at this Site? A1) PGandE has verified that gas and electric services to the Site have been disconnected. Water service to the Site has been turned off. Q2) Does Alameda County or the City of Hayward have permitting authority over this project? A2) Permitting authority for the Site itself resides with the Alameda County Public Works Agency (ACPWA). Permitting authority for areas of public domain is for the Contractor to ascertain. GSA has confirmed that no tree removal, excavation or grading permits will be required for work on the Site. Any other permits required for this project are the Contractor s responsibility. Q3) Is removal of all utility lines from the Site required? A3) Only those encountered/exposed in the areas of work. For example, if an abandoned gas line is encountered/exposed in one of the excavation areas, removal to the edge of the excavation is required. The Contractor need not chase it further. Q4) Adverse impacts to perimeter fencing and adjacent properties may be unavoidable when removing trees located on or immediately adjacent to the property line/perimeter of the Site. What agreements does the County have in place with neighbors regarding access to their properties in order to remove these trees and correct any adverse impacts? A4) The Contractor is not required to remove trees located on or immediately adjacent to the property line/perimeter of the Site that both the County and the Contractor agree cannot Project #13023, Addendum No. 2 Page 1

3 County of Alameda, General Services Agency-Procurement Project No. CPP14C , Addendum No. 2, October 26, 2016 be removed without a high likelihood of adversely impacting adjacent properties. This includes the five trees (tree #12, tree #21 and three trees on eastern property line) highlighted on the attached drawing SU1 - Topographic Survey, which drawing can be relied upon only as to the approximate location of the five trees. If contaminated soil remediation objectives make it necessary to remove a tree that the County and the Contractor previously agreed could remain in place, the County will negotiate required agreements for access to the affected neighboring properties. Q5) Will grading the Site flat and/or a survey of the Site at the completion of work be required as discussed at the pre-bid Site meeting? A5) A survey of the Site is not required. Grading the Site flat is not required. Required grading shall be as specified in Division 13, Document , Section Site Restoration. In order to comply with Section 1.08 we anticipate that edges of excavations will need to be knocked down and graded to an approximate 2:1 slope. For areas of excavation along the Site perimeter/property line, some backfilling with Site soils may be necessary to slope and stabilize the edge of the excavation. WRITTEN QUESTIONS SUBMITTED - RESPONSES, CLARIFICATIONS AND MODIFICATIONS Q6) With respect to traffic control at site ingresses and egresses, is an approved traffic control plan needed by the City or County? If so, is plan development, approval, and implementation to be completed by the contractor? A6) The Contractor is required to develop and implement a traffic control plan as may be necessary for health and safety and to minimize traffic impacts on the neighborhood. This plan is to be included in the required pre-work submittals to the County. The Contractor is also required to comply with any permit requirements for traffic control plan development, approval and implementation. Q7) During the meeting this morning there was a discussion on grading and surveying of the site post excavation. During that discussion there was mention that the site needs to be construction ready at the completion of work. Does this include any sort of geotechnical assessment or is that beyond the scope of this specific bid? A7) See response to Q4 regarding grading and surveying of the Site post excavation. Additionally, no post excavation geotechnical assessment is required. Q8) Is the County the generator of record for cleanup wastes and will the County be covering the BOE Generator fee paid directly to the disposal facility for Class 1 soil disposal? A8) The County is the generator of record. The Contractor is responsible for paying all fees collected by the disposal facility. No disposal facility fees will be paid directly by the County. Appendix A: The August 26, 2016 Draft Final Removal Action Plan included in Appendix A of the specification has been accepted by the Dept. of Toxic Substances Control without modification and is no longer considered a draft. 2. Document Bid Form: The Contractor is required to provide rate sheets for valuing services not currently anticipated that may become necessary for project completion (e.g., stormwater containment and disposal at a permitted facility, septic tank removal). The Unit Price section of the Bid Form - Document has been modified to address this requirement. The attached Document supersedes the one previously provided and is to be used for Bid submittal. 3. Document , Section 1.06A - Site Security Fencing: Wind/privacy screening for chainlink fencing is to be green in color. Contractor is responsible for determining the actual depth that support posts need to be driven into the ground in order to provide stable fencing, but in no case should the depth be less than Document : References to the County s Consultant and the County s Remediation Consultant are used interchangeably. The two are synonymous. 5. Document , Section 1.07.A - Excavation and Stockpiling, 1 st Paragraph: The County s Remediation Consultant will review and provide soil sample results within 48 hours of receiving laboratory data. 6. Document , Section 1.07C.3 - Off-Site Shipment of Wastes: The County s Remediation Consultant does not presently have authority to sign Hazardous Waste Manifests and Non-Hazardous Waste Manifests on the County s behalf. If it remains that way, only the County will have authority to sign manifests. CPP14C The Bidder represents that it is competent, knowledgeable and has special skills with respect to the nature, extent, and inherent conditions of the Work to be performed. Bidder further acknowledges that there are certain peculiar and inherent conditions existent in the construction of the Work that may create, during the Work, unusual or peculiar unsafe conditions hazardous to persons and property. 11. Bidder expressly acknowledges that it is aware of such peculiar risks and that it has the skill and experience to foresee and to adopt protective measures to adequately and safely perform the Work with respect to such hazards. 12. Bidder expressly acknowledges that it is aware that if a false claim is knowingly submitted (as the terms claim and knowingly are defined in the California False Claims Act, Cal. Gov. Code, et seq.), County will be entitled to civil remedies set forth in the California False Claim Act. It may also be considered fraud and the Contractor may be subject to criminal prosecution. 13. The undersigned Bidder certifies that it is, at the time of bidding, and shall be throughout the period of the contract, licensed by the State of California to do the type of work required under the terms of the Contract Documents.
