All other parts of the project are to remain as originally released for bid. General 1. The General Contractor and all subcontractors are to have business licenses in the City of Springville. 2. Do not include sales taxes in the bid. The General Contractor is to obtain the form for sales tax exclusion and coordinate requirements with the Project Representative. Drawings 1. Refer to Sheet ST-1. Owner will remove the existing power pole at the building location, and coordinate new power connection to the building with the power company. The City owns the water and gas supply lines. 2. Refer to Sheet A2.1. Door No. 9 on the Door Schedule is to be a 4-0 x 7-0 FEMA rated door, frame and hardware. Refer to the Finish Schedule. Owner is to seal and or stain the floors. Contractor to protect the floor during construction with heavy cardboard or plywood. 3. Refer to Sheet A4.1. Increase the wood blocking at the roof to treated 2 x 4. The roof is to be screw down type matching the new City Hall across the parking lot, in type and color, rather than standing seam as indicated on the drawing. 4. Add attached Sheet E 3.1 to the drawing set. Specifications 1. Refer to Sections Architect s Instructions to Bidders, and Bid Form. Replace these forms with the attached forms. 2. Refer to Section Temporary Facilities. Owner to provide construction water and power. 3. Refer to Sections and The Owner will provide the generator and transfer switch delivered at the site. 2 SECTION INSTRUCTIONS TO BIDDERS 1.01 INTENT A. This Section is included as part of the Bidding Documents to give Bidders information required to prepare their bids properly SCOPE A. This project consists of the construction of a community safe room within the City of Springville. Whenever the documents refer to the "project" or "Project" they shall mean the community safe room to be constructed at the Fire Station Site. B. Each Bidder shall submit a Lump Sum Bid Proposal which shall include all costs for the completion of all systems, services and structures as required for this Project. C. It is the intent of the Bidding Documents to require the Contractor to include in his bid all costs involved for the coordination of all trades to the successful completion of this Project as specifically required, outlined or reasonably implied. D. Bids must be accompanied by a bid bond in the amount of 5% of the bid amount PROPOSALS A. All bids submitted shall be prepared in conformity with, and shall be based upon and submitted subject to all requirements of the Contract Documents. B. Each Bidder must ascertain prior to submitting his bid that he has received all Addenda issued, and he shall acknowledge their receipt in his Bid Proposal. C. Bid Proposals shall be enclosed in a sealed opaque envelope clearly labeled on the outside with the Bidder's firm name and address, the name of the Project, the General Contractors license number and the notation "SEALED BID". Bids will be opened publicly by the Owner. D. The Owner may consider as informal and reject any bid on which there is an alteration or departure from the Bid Proposal Form bound herewith. E. All blanks must be filled out on each Bid Proposal Form. The Bid Proposal shall be signed by the person or persons legally authorized to bind the Bidder to a contract. A bid by a corporation shall indicate the state of incorporation and shall have the corporate seal affixed. A bid submitted by an agent shall have a current power of attorney attached certifying the agent's authority to bind the Bidder

3 1.04 BID PROCEDURE A. The Owner reserves the right to waive informalities d/or technicalities, to reject any or all bids, and to award the Contract as his/her best interest appears. B. If possible, no Addendum will be issued less than four working days prior to the stated date for receipt of bids, except an Addendum which withdraws the request for bids, or which includes postponement of the Bid Date. C. Bidders are cautioned to allow adequate time for transmittal by mail or otherwise. D. Bids may be withdrawn or modified on written (including ) request dispatched by the Bidder in time for delivery in normal course of business prior to the time stated for bid opening, if withdrawal is confirmed in writing over the signature of the Bidder within 48 hours thereafter. Negligence on the part of the Bidder in preparing his bid confers no right for withdrawal of the bid after commencement of bid opening. E. Withdrawn bids may be resubmitted up to the time stated for the receipt of bids, provided they are in full conformance with the bidding requirements. F. Erasures or other changes in the bids must be explained or noted over the signature of the Bidder. G. In the event of disagreement between bid prices and Bid Proposal Forms submitted, as between words and figures, words shall govern. H. No Bidder may withdraw his bid for thirty (30) days after the scheduled time and date set for receipt of bids EXAMINATION OF DOCUMENTS AND SITES A. Each Bidder submitting a proposal shall examine the documents and the premises to satisfy himself as to the existing conditions under which the Work is to be performed, and shall correlate these existing conditions with the requirements of the Contract Documents. B. Bid Proposals shall take into consideration all such conditions as may affect the performance of the Contract. By submitting a bid, the Bidder represents that he has visited the project and that he understands the Contract Documents. C. Complete sets of Bidding Documents shall be used in preparing bids. The City of Springville and the Architect are not responsible for omissions, errors or misinterpretations resulting from the use of incomplete sets of Bidding Documents.

4 1.06 EXPLANATION AND INTERPRETATIONS A. Omissions, discrepancies, ambiguities or errors in the Contract Documents discovered by the Contractor, as well as doubts or failure to understand the meaning or intent contained therein, should be promptly reported to the Architect in writing. Questions should be received by the Architect at least seven days prior to the date set for receiving of bids, if possible. B. Corrections or clarifications will be made by Addendum, which will be sent to all prospective Bidders on record. C. Neither the Owner nor the Architect will be responsible for oral answers regarding the intent or meaning of the Contract Documents. D. In the event of discrepancies between the Contract Documents, larger scaled drawings shall take precedence over smaller scaled drawings; the architectural drawings over civil, structural, mechanical or electrical drawings; the Specifications over all Drawings; and the Agreement over all other documents. Should any conflict not be resolved as outlined above, it will be deemed that the Bid was prepared based on the most expensive way of doing the work involved SUBSTITUTIONS A. Proposed substitutions must conform to the standard of required function, dimension, appearance and quality established by the specified materials, products and equipment. B. Written request for approval of substitutions must be submitted to the Architect not later than five (5) working days prior to the date stated for receipt of bids. Each request must prove compliance with each specified requirement of the item for which the substitution is being proposed. The Architect's approval or disapproval shall be final for any reason, and approval of proposed substitutions will be indicated by an Addendum issued to all known Prime Bidders. C. No substitutions will be considered after award of the Contract unless specifically provided in the Contract Documents AGREEMENT BETWEEN THE CITY OF SPRINGVILLE AND CONTRACTOR AND PROCUREMENT A. The selected bidder will enter into an agreement with The Owner using the latest editions of the AIA Document A101 Standard Form of Agreement Between Owner and Contractor where the basis of payment is a STIPULATED SUM and AIA Document A201 General Conditions of the Contract for Construction.

5 B. A Performance Bond and Payment Bond in the amount of 100% of the Contract Amount Executed on AIA Forms are required with the execution of the contract. C. Contractor shall submit a list of subcontractors and a Schedule of Values to the Architect. D. Contractor is to provide a notarized Certificate of Insurance in the amounts listed in the Contract with the execution of the Contract. E. These forms are required to be submitted to the Architect within 10 working days of the notification to the successful bidder of the Award of the Contract. F. Contractor will be issued a Notice to Proceed with the work from the Owner within 15 working days from approval of the Contract, Bond and Insurance forms by the Owner FORMS TO BE USED IN ADMINISTRATION OF THE CONTRACT A. AIA Forms will be used in Contract Administration, except for Schedule of Values as indicated. B. See SECTION for forms to be used in the administration of the contract BIDDER QUALIFICATIONS FORM A. Bidder is required to fill out the Bidder Qualifications Form, SECTION 00115, which among other items requires the Bidder to list projects specifically similar to this project that have been successfully completed by the Bidder. All Work will be performed in accordance with the Contract Documents prepared by Dean + Tyler + Burns Architecture for the Stipulated Sum for the Base Bid of: ($ ) DOLLARS, And for the Alternates as follows: The total Project Bid (total of the base bid for the Fire Station Site and Recreation Center Site) ($ ) DOLLARS And for the Alternates as follows: Alternate No. 1: ($ ) DOLLARS.

7 The undersigned also agrees that all Work indicated and implied by the Contract Documents will be completed within one hundred eighty ( 150 ) calendar days from the date of issuance of the Owner s Notice to Proceed to the Contractor by the Architect. Liquidated Damages will be held in the amount of $250 per day thereafter. The undersigned understands in submitting this Bid that The City of Springville, Alabama reserves the right to reject any and all bids, and that this Bid may not be withdrawn for a period of thirty (30) calendar days from the opening thereof. The undersigned agrees that if written notice of the acceptance of this Bid is mailed (post or ) or delivered to the undersigned, he/she shall within five (5) calendar days after the date of such notice to execute and deliver a Contract and fifteen (15) calendar days after the date to begin construction of the Work. In submitting this Bid the undersigned certifies that there has been no collusion with any other bidder in respect to this Bid.
