Definition of Terms Contractor = Bidder Construction Manager = Flintco, Inc. Owner = Cherokee Nation Enterprises Architect = Thalden Boyd Architects SECTION A: The scope of work for this bid package shall include, but is not necessarily limited to the following general items: Project Coordination: 1.) Contractor is to furnish manpower, materials, and equipment necessary, as required by the project schedule, including interim milestone dates, and to furnish additional crews, equipment, etc. and/or overtime required to maintain the schedule if Contractor falls behind due to their own fault or due to inclement weather. 2.) Contractor is responsible for field engineering, layout and field layout from benchmarks and base building control furnished by the Construction Manager. Rough-In requirements are to be dimensioned off of column lines as shown on the contract documents. 3.) Contractor shall furnish hoisting, material transport, and all material handling for the scope of this bid package. 4.) Contractor shall furnish pumping and dewatering as required for the scope of this bid package. Any pumping performed must be done so as not to hinder any other trades work. 5.) Contractor will perform any saw cutting, patching, and removal of debris as required for the scope of this bid package. The Construction Manager must approve the quality of any cutting and patching work. 6.) Contractor shall furnish drinking water for its employees and its subcontractors employees for the scope of this bid package. 7.) Contractor shall Include all remobilization operations required to complete the scope of this bid package. Cherokee Casino Catoosa Bid Package 02A

2 8.) Contractor shall coordinate all material deliveries with the Construction Manager and shall have a representative on site to receive all deliveries of materials under the scope of work of this bid package. 9.) Contractor shall clean up his work in such a manner as to maintain safe working conditions on the project, including but not limited to excess material, lunch trash, and dirt and debris on streets and sidewalks. All trash generated from this Contractor s work or its forces shall be removed by the Contractor s own forces and Contractor s equipment. Trash shall be placed in an on-site dumpster provided by construction manager. Any waste that requires special disposal such as concrete, pavement or hazardous waste will be disposed of by Contractor and not placed in the on-site dumpster. Debris placed in the dumpster must fit within the confines of the dumpster; otherwise it is the responsibility of this contractor to remove such debris from the project in an acceptable manner. If after a 24 hours notice Contractor fails to clean-up trash, then the Construction Manager may clean up the trash and the cost thereof shall be charged to the Contractor. 10.) Contractor shall submit to Construction Manager an emergency contact list containing information on field supervisory personnel and management personnel complete with phone numbers prior to commencing work on the project. 11.) Contractor s field supervisory personnel shall attend weekly project coordination meetings while performing work on the site. 12.) Contractor shall periodically inspect the progress of project and attend weekly project coordination meetings prior to performing work on the site for purposes of coordinating future work of this contractor with other trades and construction manager. 13.) Contractor shall comply with Flintco s Zero by Design policies and procedures. 14.) Contractor shall conform to the Construction Manager s work hours. 15.) Contractor shall furnish protection of adjacent surfaces and repair of any damage caused by the work of this Contractor. Safety: 16.) Contractor is to provide for its employees all necessary safety railing and fall protection as required by the authorities having jurisdiction and Flintco s standard safety policies and procedures. 17.) Contractor will comply with the new OSHA subpart R effective July 18, 2001 & Flintco s Safety Memo dated April 24, 2001 regarding this same subject. 18.) Contractor will furnish temporary barricades, flagmen and traffic control as required for the scope of this bid package. 19.) Contractor shall furnish all scaffolding, work platforms, equipment and supplies to complete all work performed under the scope of this bid package, and as required by the authorities having jurisdiction and Flintco s standard safety policies and procedures. 20.) Contractor shall furnish all temporary shoring and bracing that may be required under the scope of this bid package. If engineering is required for such bracing or shoring, cost of such engineering is to be included in this bid package. 21.) Contractor will prepare in an acceptable format a job specific safety plan including written hazard analysis and hazardous materials communication information prior to starting work. 22.) Contractor will comply with the Flintco Construction Safety requirements as outlined in the Flintco Safety Manual (00125 Flintco Safety Manual). Testing: 23.) Contractor will assist the Material Testing Laboratory in obtaining samples and gathering data as needed and shall notify the Construction Manager a minimum of 24 hours in advance of testing required under the scope of work of this bid package. 24.) Laboratory materials testing shall be provided by others, however, any re-testing required due to failed initial testing or areas not being ready for required testing due to the actions of this Contractor shall be paid for by this Contractor. Administrative: 25.) Contractor will furnish all submittals, shop drawings, samples, mock-ups, and closeout documents required by the contract documents. 26.) Contractor shall furnish all submittals, shop drawings, and samples within 10 days of receipt of notice to proceed. 27.) Any professional engineering services required by the contract documents for the assembly of submittals and shop drawings are the responsibility of this contractor. 28.) Contractor will furnish all licenses, permits, and certifications and arrange for inspections and testing as may be required by and for this Contractor s work, and as required by the authorities having jurisdiction. 3 29.) Contractor will be expected to sign the form of agreement, and provide insurance and bonds as required in the Contract Documents. 30.) Contractor shall include the cost of bonds and insurance in this bid package. 31.) Contractor shall submit, with executed contract, Flintco s Subcontractor/Supplier Certification. 32.) The term substantial completion is defined as substantial completion of the overall project or portions thereof as designated by the Owner, Architect, & Construction Manager. 33.) Contractor shall submit closeout documents within 30 days of completion of the scope of this bid package. 34.) Any jobsite offices required by the subcontractor are to be the responsibility of that subcontractor. SECTION B: The scope of work of this bid package shall also include the following items, but without limiting the scope of work as provided above: 1.) Coordinate locations of existing utilities with Authorities having jurisdiction prior to beginning any work. 2.) Provided site clearing and grubbing, including all trees and shrubbery to be removed to complete the scope of this bid package in accordance the Contract Documents. 3.) This bid package includes bringing the entire site to rough-grade as shown on the Contract Documents. Include all rough grading as shown on the contract documents. All final grades and berming on this project are the responsibility of this bid package 4.) Excavation, fill, backfill, and compaction per contract documents and geotechnical report. 5.) Strip and stockpile topsoil as required and directed by the Construction Manager. 6.) Scarify exposed sub-grade in accordance with the Contract Documents/Geotechnical Report before placing fill. 7.) Backfill the curb and gutter as required or as shown on the Contract Documents. 8.) Furnish and install modified sub-grade for all paving areas as specified. Provide rough grading of sub grade to within +/- one tenth of a foot. 9.) Contractor to ensure positive drainage away from building/structures for all grassed and paved areas. Maintain positive drainage throughout the site during the construction phase to avoid ponding or rutting. 10.) Placement and final grading of topsoil replacement at all areas to within +/- one tenth of a foot, including backfilling and hand grading behind curbs and in islands. 11.) Contractor shall provide and maintain temporary construction entrance(s) as directed by the Construction Manager per owner requirements. 12.) All right-of-way Bonds, etc. as required by the City, County, and State or other agencies having jurisdiction. 13.) Provide any necessary traffic control and barricades for work relative to this bid package; coordinate lane closings etc. with Construction Manager and Authorities having Jurisdiction prior to such closings. 14.) Establish, protect and maintain all excavations and slopes to provide a safe work area and as otherwise required by State, Local and Federal regulations. 15.) Include all erosion control work including construction, maintenance throughout life of project and removal of silt fencing, straw bale dike sediment control and stabilized construction entrances in accordance with the contract documents and all applicable codes and regulations of the authorities having jurisdiction over erosion control requirements. 16.) Keep surrounding streets, drives, and parking areas free of dirt and debris including dust control caused or created by the work of this bid package. 17.) Provide and maintain all barricades, flashers and temporary lane markings to re-route traffic for each phase of the work of this bid package. 18.) Contractor shall examine substrates upon which work is to be installed. Notification must be given to the Construction Manager in writing of conditions detrimental to timely and proper installation of work. Do not start the work until unsatisfactory conditions have been corrected. If work is started without notification of unsatisfactory conditions, it shall be construed as an acceptance of substrate by this Contractor, who shall repair unsatisfactory work caused by unsatisfactory substrate at no expense to the Owner. 19.) Provisions for cold weather work as may be required for the work of this bid package. 20.) Contractor shall coordinate with other trades in advance and make provisions for installation of their work to avoid cutting and patching. Cherokee Casino Catoosa Bid Package 02A

4 21.) This bid package is intended to be all inclusive of labor, material, and equipment required for the earthwork to rough grade, utility pad/areas, site paving subgrade, site clearing and grubbing, stockpiling of topsoil, and soil erosion control work required by the contract documents. 22.) Contractor shall provide any earthwork shoring as required. 23.) Contractor shall perform all site demolition and removal of demolished material. 24.) Contractor shall furnish and install 6 of topsoil at all locations receiving sod and 12 of topsoil at all planting beds. 25.) Contractor shall coordinate schedule of all tests and inspections with the owner s testing company to prevent any schedule disruption. 26.) This package shall include all concrete and asphalt paving demolition and patching for work included in this package and needed for the electrical package and mechanical package. Most conduit, gas line, and mechanical pipe routings are shown on the contract documents 27.) Furnish and install all concrete paving, asphalt paving, curb & gutter, concrete swales, utilities, concrete piers, equipment/electrical pads, gas meter pad, and sidewalks shown on the Contract Documents. 28.) Furnish and install all concrete materials and related materials for the sidewalks, handicap entries, entry drives, curb and gutter, transformer/electrical gear pads, gas meter pads, piers, and footings, etc. as shown on the Contract Documents. 29.) Furnish and install all reinforcing steel and all associated accessories for a complete installation of the Cast-In-Place Concrete and Concrete Paving Work as described in this bid package. 30.) Pier depths are per the geotechnical report shall be the top of pier elevation for all of the piers. 31.) Place and finish concrete surfaces including all rubbing and patching required. 32.) Furnish and erect all form materials and accessories as required for a complete installation. 33.) Furnish all expansion joints required by this bid package. 34.) Perform all saw cutting required by this bid package. 35.) Furnish and install all concrete curing compounds and finishing products as required by this bid package. 36.) Furnish and install all caulking and sealants in joints as needed for a proper installation. Perform all cleaning and preparation work to make surfaces and joints ready to receive materials. 37.) Install all galvanized embeds and anchor bolts. Embeds and anchor bolts will be provided by bid package 5A. 38.) Include all drilling and epoxy as required. 39.) Provisions for cold weather work as may be required for the work of this bid package. 40.) Contractor shall coordinate with other trades in advance and make provisions for installation of their work to avoid cutting and patching. 41.) Furnish and install all subbase materials for all site paving and site concrete as required by the contract documents. 42.) Contractor shall furnish all equipment and material and perform all work required to complete the site utilities scope (including but not limited to all water distribution service, storm, and sanitary sewer). Water service stall be installed to the meter. Storm and sanitary sewer tie in shall be included in this bid package route piping to limits shown on P ) Provide City and State approval of utility work including City Performance and Maintenance Bonds engineered surveys, testing, etc. as required. 44.) Remove or abandon and cap, as required by the contract documents, all existing utilities including but not limited to the storm line and inlet removal, sanitary sewer line and associated manholes, water line plugged and abandoned, etc. Maintain all necessary utilities until new utilities are in place. Provide temporary lines, supports, etc as may be required. 45.) Furnish and install all water lines, meters, backflow preventers, and valve boxes for a complete operational system as required by the Contract Documents. 46.) Directional boring and conduit for the water line is part of this package 47.) Perform all excavation, backfilling, compaction and final grading as required. Backfilling shall be done in a manner that returns the disturbed area to the condition in which it was found (i.e. if you dig through a construction work road you put the gravel back). 48.) Furnish all required concrete/boxes accessories associated with this scope of Work. 49.) Provide all cleanouts and concrete bases at clean outs. All cleanouts shall be clearly marked and flagged to avoid damage by construction traffic. 50.) Furnish and install sanitary sewer system, piping, manholes, tees, and cleanouts as shown on the Contract Documents. 51.) Furnish and install storm line SDGI or DGDI with access manholes and grates, area inlets, gutter inlets, surface inlets, curb inlets, atrium grates, manholes, cleanouts, tees, etc. as shown on the Contract Documents. 5 52.) Complete all storm drain modifications as shown on the contract documents. 53.) Furnish and install all piping accessories as required for a complete installation including but not limited to tapping sleeves, valves, pipe fittings, meter(s), double check detector(s), manholes, vaults, valve boxes, rings, frames and covers. 54.) Furnish and install all sand cushion and rock fill as required by this bid package in accordance with the contract documents. Work excluded from this bid package: 1.) Piping protection bollards and cable 2.) Gas line installation and connections 3.) Irrigation 4.) Fencing 5.) Metal Grating NOTE 1: This bid package includes a required 40 hour work week, and any normal delays (such as weather, coordination conflicts, & work congestion) will be made up on Saturday and Sunday. 9 SECTION B: The scope of work of this bid package shall also include the following items, but without limiting the scope of work as provided above: 1.) Fabrication and Erection is to be bid as a complete package. 2.) Contractor shall furnish and install engineering calculations, shop drawings, manufacturer s data and samples, certifications for connections of structural steel members, welding certificates, and contract closing documents in accordance with the contract documents. 3.) Contractor shall furnish and deliver to the jobsite FOB (for installation by other trades) specifically but not limited to the following: a. Column anchor bolts b. Embed/Bearing plates c. Galvanized steel lintels for masonry openings for windows and doors. d. Galvanized steel embed plates e. Embed sleeves f. Any other steel members to be embedded in the concrete or masonry work. 4.) Contractor shall furnish and install all miscellaneous and structural steel per ALL of the contract documents as required for a complete installation. 5.) Furnish and install rolled or bent angle supports for roofing or deck as shown on the Contract Documents. 6.) Furnish and install all touch up painting as required by the contract documents for material installed in this bid package. 7.) Contractor is to level base plates prior to grouting by others. 8.) Contractor shall provide templates for each anchor bolt configuration for use by package 3A contractor. 9.) Contractor will perform all welding and grinding required for installations performed by this Contractor. Contractor shall utilize gas-welding machines. 10.) Contractor shall furnish and install all fasteners and attachments (bolts, erection bolts, washers, torque nuts, expansion anchors, lag bolts, etc.) as required for a complete erection of this bid package. 11.) Contractor shall furnish and install all galvanizing or electroplating that is required by the contract documents. All exterior steel for this project shall be galvanized. 12.) Contractor shall include any special preparation of architecturally exposed steel in accordance with the contract documents and referenced standards. 13.) Contractor shall furnish and install primers for steel that is to receive an architectural finish, in accordance with the contract documents. Coordinate types of primer with fireproofing contractor for all areas that are to receive fireproofing. 14.) Furnish and install all required miscellaneous metal supports, stands, hangers, etc. required for all mechanical equipment that are specifically shown and sized on the Structural Drawings, both permanent and temporary. 15.) Furnish and install frames and gratings shown on the Contract Documents. 16.) Contractor shall furnish and install all continuous support angles and all deck bearing angles. 17.) The shipment shall be properly bundled, packaged, and palletized. Contractor shall furnish adequate dunnage for on-site storage. Material shall be free and clean from dirt before, during, and after erection. 18.) Deliver shortages or fabricator errors within 24 hours of notification. 19.) Furnish and install all safety cable handrails required for this project. 20.) Contractor shall furnish and install all steel frames and supports for mechanical floor and roof penetrations as shown on the Contract Documents. 21.) Contractor shall furnish and install all curved or bent beams and other shapes as required by the Contract Documents. 22.) Contractor shall coordinate schedule of all tests and inspections with the owner s testing company to prevent any schedule disruption. 23.) Furnish and install all pipe stand protection bollards and cable as shown on the contract documents. 24.) Furnish and install roof decking support at all roof penetrations to prevent deck sagging and allow proper reroofing and flashing. 25.) 10 26.) Screen wall columns and horizontal tubes are part of this package 27.) Coordinate with the mechanical contractor for placing of pipe during pipe rack installation. 28.) Multiple crews will be required for the installation of the roof pipe rack system. 29.) This contractor shall coordinate with roofing contractor for cutting holes in roof and patching back daily. All roof layout will be part of this package. Contractor shall clean up his work in such a manner as to maintain safe working conditions on the project, including but not limited to excess material, lunch trash, and dirt and debris on streets and sidewalks. 14 generated from this Contractor s work or its forces shall be removed by the Contractor s own forces and Contractor s equipment. Trash shall be placed in an on-site dumpster provided by construction manager. Any waste that requires special disposal such as concrete, pavement or hazardous waste will be disposed of by Contractor and not placed in the on-site dumpster. Debris placed in the dumpster must fit within the confines of the dumpster; otherwise it is the responsibility of this contractor to remove such debris from the project in an acceptable manner. If after a 24 hours notice Contractor fails to clean-up trash, then the Construction Manager may clean up the trash and the cost thereof shall be charged to the Contractor. 10.) Contractor shall submit to Construction Manager an emergency contact list containing information on field supervisory personnel and management personnel complete with phone numbers prior to commencing work on the project. 11.) Contractor s field supervisory personnel shall attend weekly project coordination meetings while performing work on the site. 12.) Contractor shall periodically inspect the progress of project and attend weekly project coordination meetings prior to performing work on the site for purposes of coordinating future work of this contractor with other trades and construction manager. 13.) Contractor shall comply with Flintco s Zero by Design policies and procedures. 14.) Contractor shall conform to the Construction Manager s work hours. 15.) Contractor shall furnish protection of adjacent surfaces and repair of any damage caused by the work of this Contractor. Safety: 16.) Contractor is to provide for its employees all necessary safety railing and fall protection as required by the authorities having jurisdiction and Flintco s standard safety policies and procedures. 17.) Contractor will comply with the new OSHA subpart R effective July 18, 2001 & Flintco s Safety Memo dated April 24, 2001 regarding this same subject. 18.) Contractor will furnish temporary barricades, flagmen and traffic control as required for the scope of this bid package. 19.) Contractor shall furnish all scaffolding, work platforms, equipment and supplies to complete all work performed under the scope of this bid package, and as required by the authorities having jurisdiction and Flintco s standard safety policies and procedures. 20.) Contractor shall furnish all temporary shoring and bracing that may be required under the scope of this bid package. If engineering is required for such bracing or shoring, cost of such engineering is to be included in this bid package. 21.) Contractor will prepare in an acceptable format a job specific safety plan including written hazard analysis and hazardous materials communication information prior to starting work. 22.) Contractor will comply with the Flintco Construction Safety requirements as outlined in the Flintco Safety Manual (00125 Flintco Safety Manual). Testing: 23.) Contractor will assist the Material Testing Laboratory in obtaining samples and gathering data as needed and shall notify the Construction Manager a minimum of 24 hours in advance of testing required under the scope of work of this bid package. 24.) Laboratory materials testing shall be provided by others, however, any re-testing required due to failed initial testing or areas not being ready for required testing due to the actions of this Contractor shall be paid for by this Contractor. Administrative: 25.) Contractor will furnish all submittals, shop drawings, samples, mock-ups, and closeout documents required by the contract documents. 26.) Contractor shall furnish all submittals, shop drawings, and samples within 30 days of receipt of notice to proceed. 27.) Any professional engineering services required by the contract documents for the assembly of submittals and shop drawings are the responsibility of this contractor. 28.) Contractor will furnish all licenses, permits, and certifications and arrange for inspections and testing as may be required by and for this Contractor s work, and as required by the authorities having jurisdiction. 29.) 15 30.) Contractor shall include the cost of bonds and insurance in this bid package. 31.) Contractor shall submit, with executed contract, Flintco s Subcontractor/Supplier Certification. 32.) The term substantial completion is defined as substantial completion of the overall project or portions thereof as designated by the Owner, Architect, & Construction Manager. 33.) Contractor shall submit closeout documents within 30 days of completion of the scope of this bid package. 34.) Any jobsite offices required by the subcontractor are to be the responsibility of that subcontractor. SECTION B: The scope of work of this bid package shall also include the following items, but without limiting the scope of work as provided above: 1.) Furnish and install all roofing systems patching, flashing, and modifying including, but not limited to, single ply roofing, sheet metal flashing & trim, preformed sheet roofing, standing seam, metal roof panels, snow guards, prefabricated roof specialties & roof accessories complete, in accordance with the contract documents and manufacturer s installation instructions. 2.) Furnish and install all walk pads in accordance with the contract documents and manufacturer s installation instructions. 3.) Furnish and install rigid insulation and insulation material for all re-roof areas and metal panels as specified and as required for positive drainage. 4.) All roofing work must be accepted by the existing roofing manufactures reprehensive and maintain the existing roofing manufacturer s full system warranty and applicator s guarantee for roofing materials and installation, including sheet metal work as specified. A letter from the existing roofing manufacture stating the warranty is intact will be required. 5.) Furnish and install all roof-related flashing and sheet metal for all roof and parapet penetrations, copings, mechanical equipment, roof hatch, support structures, etc. as required for a complete installation. Include all stainless steel flashings as shown. 6.) Furnish and install flexible flashing at all copings as required by the contract documents. 7.) Furnish and install all wood blocking, nailers and nailable sheathing as required for the installation of all roofing systems, column wraps and metal panels in accordance with the contract documents and manufacturer s requirements including, but not limited to, the 2x blocking shown at the tops of the parapets, at the roof edge, roof expansion, plywood under standing seam roofing, etc. 8.) Furnish and install all wood blocking, nailers and nailable sheathing as required for the installation mechanical or electrical piping and conduit on or above the roof. Contractor to coordinate installation with Mechanical and Electrical subcontractors. 9.) Furnish and install all required fire protective board. 10.) Furnish and install all pourable sealers as required. 11.) All colors and finishes shall be as required by the contract documents and match existing finishes. 12.) Examine all sub-surfaces or substrates prior to beginning work and report any conditions detrimental to the roofing or metal panel systems.
