1 Exterior Painting, Conway Homes and Sierra Vista IFB No SCOPE OF WORK (SOW) & TECHNICAL SPECIFICATIONS 1.0 GENERAL DESCRIPTION: The Housing Authority of the County of San Joaquin (HACSJ) is seeking bids from licensed and bonded Painting Contractors to paint the exteriors of its units within the community of Conway Homes located in Stockton, CA (see attached address sheet). Items to receive paint shall be each residential building s exterior wall surfaces, soffits, trim and exterior doors. In addition the exterior surfaces of HACSJ s Sierra Vista Office/Community Center/Gymnasium and Maintenance Facility located at 2436 Belleview Street, Stockton, CA. This shall include all detached sheds to receive same treatment as primary buildings. Conway Homes consists of two distinct neighborhoods both of which are included within this Scope of Work. The first community is the original community built in the early 1950 s consisting of one hundred and sixteen (116) single story duplex buildings and an office/maintenance facility. There are four (4) floor plans that range in size from a 1,480 square-foot (Plan I ) 1 bedroom/1 bedroom single story duplex to a 2,224 square-foot (Plan H ) 4-bedroom/4- bedroom single story duplex. The second community titled Conway Homes Annex was built in the later part of the 1950 s consisting of one hundred and fifty-three (153) single story buildings. Three (3) building types of single story, single-family detached residential buildings (Plan X, Y and Z ) and one (1) building type of single story duplex residential buildings (Plan W ) ranging in size from 919 square-foot single-family detached 3-bedroom unit (Plan X ) to the 1,556 square-foot single story duplex (Plan W ). The Annex buildings have four (4 ) foot high brick masonry veneer around the entire building with stucco over the remaining walls, and the Original community has stucco walls from foundation to soffit. The Housing Authority has three color palettes that shall be applied per the attached spreadsheet depicting addresses, sizes, bedroom count and individual color palette. Contractor shall anticipate that there are some residential buildings that have been altered and may have an increased surface area to be painted. Contract shall be responsible for including these variations within their bid price. Exterior surfaces to include: Exterior Walls (not to include brick veneer on buildings within the Conway Homes Annex Community Eaves/Soffits Trim and/or Fascia Exterior Doors: Front, Rear, Water Heater Closet (if applicable) and Storage Sheds (one per unit). 3.2 "Brand names: Any brand names mentioned within this document are for reference only and are included solely to aid Contractors in identifying the paint colors selected by the HACSJ. 6 Eaves/Soffits: Kelly Moore KM Peach Rose Trim and/or Fascia: Pure White Exterior Doors: Kelly Moore KM Woodland Fern Primer Coat: Stucco Walls: White, Exterior Masonry Primer Wood Surfaces: White, Exterior Wood Primer 3.7 Color & Product Approval: The HACSJ Project Manager or another HACSJ authorized representative will approve color of paint before Contractor purchases the paint. 3.8 Product Mixing: All paint colors shall be store or factory mixed in large enough patches so that dye lots are not changed on any one exterior building surfaces. On-site mixing will not be allowed. 3.9 Product Inspection: The Contractor shall notify the HACSJ Project Manager when the paint is scheduled for delivery to the job site. The paint shall be delivered in unopened containers for HACSJ inspection. Because of limited storage space, inspection of paint may take place at Contractor s location Right to Reject: HACSJ reserves the right to reject bids offering paint products which cannot meet the warranty conditions and specifications stated herein Sampling: Color sampling will be required Product Compatibility: Contractor shall provide written approval from the manufacturer of replacement materials indicating its compatibility with the encapsulating material to be used Warrantee: 1 year labor, 2 years materials Extra Paint: Upon completion of the project, the Contractor shall furnish fifteen (15) gallons of paint (per paint type and color) in five-gallon containers before final payment will be made. Cost of this paint shall be included in the bid price Delivery, Storage, and Handling: Contractor shall deliver materials to job site in new, original, and unopened containers bearing manufacturer s name, trade name, and label analysis Contractor shall be responsible for storage of material Contractor shall store paint products in accordance with the manufacturer s instructions Contractor shall be fully responsible at all times for securing any and all equipment and property belonging to the Contractor The Contractor shall confine the storage of any materials and/or equipment on site to the area designated by the HACSJ authorized representative. 7 4.0 SCOPE OF WORK: designated area is behind HACSJ s controlled gates Contractor shall not gain access before or after stated working hours (Section 11.1). 4.1 Pre-Construction Site Inspection: Contractor is responsible for inspecting surfaces and verifying quantities before painting begins on each building, and determining if paint application will satisfactorily adhere and perform as intended. 4.2 Treatment of Adjacent Surfaces and Structures: Prior to surface preparation and painting, Contractor shall completely mask, remove, and otherwise adequately protect all adjacent properties, including windows, hardware, accessories, surfaces, lighting fixtures, vegetation, and similar items that may be in contact with painted surfaces but not scheduled to receive paint "Contractor shall be responsible for preventing unwanted painting/overspraying of all other surfaces not identified for painting, including but not limited to: personal property, vehicles (including those owned by the HACSJ, its tenants, or guests), common areas (including roadways, sidewalks, driveways, fencing), and utility boxes and cables. Corrections of such unwanted painting/overspraying are the sole responsibility of the Contractor and will be paid for by the Contractor. Failure of the Contractor to correct such damages may result in the HACSJ taking action to correct them and then withhold funds from payment to the Contractor or redeem the Contractor's bonds to cover expenses incurred by the HACSJ." Contractor shall be responsible for providing in-place, adequate, and clean cover and protection Security Screen Doors: Screen doors can be masked and cut-in around existing frame Rain Diffusers: Contractor to remove rain diffusers from attached brackets and reinstall after painting is completed for each building. Contractor to notify HACSJ Project Manager or HACSJ Authorized Representative if segments of the rain diffusers are damaged and unable to be reinstall. HACSJ shall then determine if rain diffusers shall be removed and/or replaced. Replacement of rain diffusers shall be separately contracted or handled by HACSJ staff. Rain diffusers are considered to be surfaces that do not receive paint, although brackets can receive paint. Contractor to provided HACSJ of all existing rain diffuser material that is attached to dry rot material. HACSJ shall replace rain diffusers once building is completed Mask off all items subject to damage or over painting All over sprayed painted items of work shall be cleaned by Contractor to the satisfaction of the Housing Authority of the Count of San Joaquin (HACSJ). 8 4.3 Surface Preparation: All walls shall be properly prepared and primed by Contractor to ensure full coverage of paint specified in scope of work Pressure wash all surfaces that shall receive paint to remove dirt, dust, grease, loose, chipped, peeling paint, mildew, and any other surface conditions affecting the coating performance. Scraping of surfaces may still need to be performed if pressure washing has not been fully successful in removing the items mentioned above. Contractor shall not paint over unscraped, chipped, blistered, peeling paint or improperly prepared surfaces. Surfaces which cannot be adequately covered with one coat shall be painted with additional coat(s) at the discretion of the HACSJ authorized representative and shall be included in the bid price Treat mildew on any surface with a solution of one part bleach to three parts water before painting. This can be performed concurrently with pressure washing. (Note: Always add water to the bucket first, and then carefully pour in the bleach. Wear eye and skin protection.) Leave the bleach-and-water solution on the surface for 20 minutes, then rinse thoroughly. Wall surface shall be dry to manufacturer s recommendations before applying primer and/or paint Remove projecting nails, screws, or hooks, and then fill all holes, cracks and defects. Patch cracks and holes, prime, then paint all patch work. Caulk all cracks around windows, doors, walls, etc., by using exterior acrylic latex paintable caulk Remove any foreign objects from surfaces to be finished or painted. 4.4 Water Damage/Dry Rot Repair: The HACSJ requires the Contractor to anticipate minimum repairs for water damage and/or dry rot repair. The bid price shall include a separate line item for contingency only to repair the maximum damage, identified as: Stucco Walls: Contractor to include a cost to repair up to 10 square-feet of exterior wall surface per building Eaves/Soffits: Contractor to include a cost to repair up to 6 square-feet of soffits per building Trim: Contractor to include a cost to repair up to 20 linear feet of trim and/or fascia board per building Contractor shall notify the HACSJ Project Manager or HACSJ authorized representative immediately if water damage/dry-rot is found. Repair limits shall be directed by the HACSJ. Contractor shall not apply paint to surfaces that show signs of water damage/dry rot without first receiving confirmation from a HACSJ authorized representative. Page 8 of 14

9 4.5 Coverage: Paint to cover is defined as follows: 5.0 WORK SCHEDULE: One (1) coat of premium flat white exterior masonry primer to be applied over stucco, or masonry material (see product definition in Section 3.0) One (1) coat of premium flat white exterior wood primer to be applied over wood surfaces such as eaves/soffits and trim/fascia (see product definition in Section 3.0) One (1) coat of premium exterior flat, 100% acrylic paint over previously applied primer (see product definition in Section 3.0) One (1) coat of exterior semi-gloss enamel, 100% acrylic paint over previously applied primer (see product definition in Section 3.0) Method of application shall be by spray, roller, and brush Painting preparation and paint application shall be carried out in accordance with the manufacturer s printed specifications. The Contractor shall keep a copy of these specifications on the job site at all times Each coat shall be thoroughly dry before the application of the succeeding coat. 5.1 The project shall be completed within 365 calendar days from the Start Date shown on the Notice to Proceed letter. 5.2 The Contractor shall submit a schedule of work with the HACSJ authorized representative, and adhere to the Work Schedule and subsequent timeline provided within this document. Care shall be exercised by the Contractor to minimize the inconvenience and danger to residents, and personnel. 5.3 Contractor s painting and delivery schedules shall be coordinated with the HACSJ Project Manager or designated HACSJ authorized representative. 5.4 Contractor shall not park vehicles on lawns at any time. 6.0 SPECIAL PROVISIONS 6.1 Contractor shall supply all wet paint signs, equipment, plastic covers, barricades and any other specialty items that may be required and shall include these costs in the bid price. 6.2 Contractor shall proceed with painting work to be performed in accordance with manufacturer s recommendations and warranty requirements. 10 7.0 CONSTRUCTION MANAGEMENT 7.1 A pre-construction meeting will be held with the Contractor, Subcontractors (if any), and with the HACSJ to review the overall project, bond information, and phasing of project before commencement of work. 7.2 The Contractor shall hold weekly jobsite progress meetings in order to keep HACSJ inform as to the project s schedule. These costs shall be factored into the pricing submitted by the Contractor. 7.3 In performing all services, the Contractor shall comply with all applicable federal, state, county, and city statutes, ordinances, and regulations. If such compliance is impossible for reasons beyond its control, the Contractor shall immediately notify the HACSJ of that fact and the reasons therefore. 7.4 All work shall be inspected and signed off by HACSJ authorized representative before the work is deemed complete. No payment will be made until all work is completed to the satisfaction of the manager and is deemed complete. Progress billing is acceptable with the submittal of the appropriate HUD forms and the acceptance of the HACSJ Project Manager. 8.0 GENERAL REQUIREMENTS 8.1 Maintenance of Work Area: The Contractor shall keep the working area sufficiently clear of equipment, material, and implements of service to prevent endangering persons and damage to the HACSJ property and to avoid an unsightly condition. Removal of such items shall be performed promptly upon completion of work. The Contractor shall not use HACSJ facilities for disposal of debris and waste material, whether hazardous or non-hazardous, or asbestos-containing or non-asbestoscontaining. 8.2 Safety and Security: The Contractor shall comply with all laws, ordinances, rules and regulations applicable to the work. The Contractor shall provide adequate protection for all persons and all HACSJ personnel within the working area or approaches thereto, and shall furnish and erect temporary barricades where necessary. 8.3 Access: The Contractor, its employees, subcontractors, or other representatives, have no tenancy and shall be admitted to the grounds only for the proper execution of the work under this contract. The Contractor, its employees, subcontractors, or other representatives must wear identifying company uniform and employee badge while working on HACSJ properties. A person not wearing appropriate identification may be asked to leave HACSJ property. 8.4 Workmanship and Labor: All employees of the Contractor, subcontractors or other representatives, shall be skilled in the type of work for which they are employed on the project and shall work under direction of competent superintendent. Should the HACSJ deem anyone employed in the work incompetent or unfit for their duties, the Contractor shall remove such employee from the work and shall not reemploy them on work with the HACSJ on this project or any other project without prior written permission from the HACSJ. 11 8.5 On-Site Interviews: Inform all workers of prevailing wage rates, position titles, and job duties. Contractor shall post on site all appropriate wage determination related to this project. 8.6 Prevailing Wages must be paid to all workers involved with this project. In accordance with regulations, the Housing Authority will enforce the Prevailing Wages shown in the Wage Determination in effect ten (10) days before bids for the IFB are due on 5/1/2013, which unless modified through a written Bid Addendum shall be 4/21/2013. It is the Contractor s responsibility to visit the website to see the wage determinations in effect on this date. As of the date of this document (4/3/2013), the current wage rate determination is: Davis-Bacon: (CA13, Residential, Mod 3 dated 3/8/13) 9.0 TREATMENT OF ADJACENT SURFACES AND STRUCTURES; AND TRAFFIC 9.1 Contractor shall take particular care in preserving the integrity of the adjacent sites and ensure consistency of his or her work in order to maintain the overall appearance of the community. 9.2 Contractor shall minimize dust from any construction activities and conform to the requirements of San Joaquin Valley Air Pollution Control District (SJVAPCD). 9.3 The Contractor shall conduct and maintain all working forces at the surfaces in a neat and orderly manner throughout the construction operations. The work shall be conducted in a manner that will control dust. When ordered to or required to provide dust control, the Contractor shall use water to reduce the dusty conditions, all to the satisfaction of the HACSJ. All water used in the project must be included in the base bid and obtained by the Contractor though the City of Stockton, Cal Water or reimbursed to the owner (HACSJ). Metering devices attached to water sources like fire hydrants are the responsibility of the Contractor and its subcontractors, and evidence of usage and payment must be provided at each billing cycle. 9.4 During construction, the Contractor shall remove all rubbish and debris as it is generated to the satisfaction of the HACSJ. 9.5 Contractor at the completion each working day shall clean and make safe the work site, provide security fencing to restrict access to the project site, and make unobstructed resident access available to the residential units and common areas. 9.6 The Contractor shall provide traffic control so as to limit the impact on automobile traffic ASSIGNMENT OF PERSONNEL 10.1 The HACSJ shall retain the right to demand and receive a change in personnel assigned to the work if the HACSJ believes that such change is in the best interest of the HACSJ. Contractor shall select and employ the replacement personnel. Page 11 of 14

12 11.0 CONSTRUCTION SCHEDULE AND HOURS OF WORK 11.1 Schedules and operations shall be performed to minimize intrusion and potential risks to the residents within the community. Construction hours shall take place between the hours of 7:00 AM and 4:00 PM. Work shall not be performed on weekends or holidays without prior approval form HACSJ. The selected Contractor must also coordinate their work schedule with other Contractors on-site (the Housing Authority will act as project coordinator for the job) HACSJ must provide its residents 48-hour notice before Contractor may commence work on an occupied unit; therefore, the Contractor shall provide written notification to the HACSJ at least one week in advance before the anticipated start date for each occupied unit The exact starting and ending dates for this project have yet to be defined. The Housing Authority anticipates that this project will start in June 2013 and will end approximately 365 calendar days from the notice to proceed date PROPERTY DAMAGE 12.1 Contractor shall be responsible for repair of any tangential damage to HACSJ property and the personal property owned by tenants and visitors within the developments and the restoration of any such area disturbed to the satisfaction of the HACSJ Authorized Representative prior to final payment Any repair and/or restoration of damaged area or property shall be performed at no cost to the HACSJ LICENSING AND INSURANCE REQUIREMENTS: Contractor will ensure all required licensing and insurance requirements listed below are met. Prior to award (but not prior to submission of the proposal) the successful proposer will be required to provide: 13.1 Fees, Permits, Licenses, Patents, Royalties, and Payments Thereof: The Contractor and Contractor s employees and agents shall secure and maintain in force such licenses and permits as are required by law and shall conformed to all Federal, State, and local laws, ordinances, and regulations covering the work under the contract. All operations and materials shall be in accordance with applicable laws, ordinances, and regulations Licensing: The Contractor shall provide to the HACSJ copies of any required current City, State and/or Federal licenses. Failure to maintain these licenses in a current status during the term(s) of this contract shall constitute a material breach thereof. Contractor will have a California Contractors License for the appropriate trade listed in this Invitation for Bid (IFB), bonding and insurance required by the State of California, and have the ability to obtain all required permitting either through local, state and federal agencies and being in good standing with all governing agencies. The Contractor shall provide to the HACSJ copies of these and any other required current City, State and/or Federal licenses. Failure to maintain these licenses in a current status during the term(s) of this contract shall constitute a material breach thereof. Page 12 of 14

13 13.3 Proof of Insurance: Contractor shall maintain throughout the course of any contract resulting from this IFB, at a minimum, insurance coverages shown on the attached Insurance Requirements for Contractors. Proof of such coverages must be presented to the HACSJ upon request PERFORMANCE SPECIFICATIONS 14.1 Contract Service Standards: All work performed pursuant to this contract must conform and comply with all applicable local, state and federal codes, statutes, laws and regulations Personnel Standards: Services shall be performed by personnel who are trained and otherwise qualified to perform tasks assigned Contractor s employees shall wear clearly visible identification while performing duties All personnel shall be neat in appearance and shall conduct their work in a professional manner with minimal disturbance to the contracting party. If any of the Contractor s personnel are not satisfactory to the Authority or its managers, Contractor shall replace such personnel with those who are satisfactory Contractor shall use all reasonable care, consistent with his right to manage and control his operation, not to employ any persons or use any labor, or use or have any equipment or permit any condition to exist which shall or may cause or be conductive to any labor complaints, troubles, safety issues, disputes or controversies at the owner s place of business or which interfere or are likely to interfere with the operations of business Contractor shall immediately give such notice to the HACSJ Authorized Representative to be followed by written reports, as shall be reasonably necessary to advise the manager of any and all impending or existing labor complaints, troubles, disputes, or controversies and the progress thereof that Contractor, in his opinion, believes may interfere with the operation of the business. Contractor shall use his/her best efforts to resolve any such complaints, trouble, disputes, or controversies Supervision: Contractor shall furnish the necessary qualified supervision to oversee all operations Equipment: Contractor shall furnish all equipment necessary to perform the services in accordance with these specifications, and warrants that all equipment will be of such type as to cause no hazard or danger. 14 15.0 CONTRACT CONDITIONS: The following provisions are considered mandatory conditions of any contract award made by HACSJ pursuant to this IFB: 15.1 Contract Form: The HACSJ will not execute a contract on the successful proposer's form. Contracts will only be executed on a form supplied by the HACSJ, and by submitting a bid proposal the successful proposer agrees to do so. However, the HACSJ will consider any contract clauses or Appendices that the proposer wishes to include. The failure of the HACSJ to include such clauses or Appendices does not give the successful proposer the right to refuse to execute the HACSJ's contract form Required Clauses: At a minimum, the attached form HUD-5370 General Conditions for Construction Contracts Public Housing Programs" will be applicable to any Purchase Order and/or Contract issued by the HACSJ Unauthorized Sub-Contracting Prohibited: The successful proposer shall not assign any right, nor delegate any duty for the work proposed pursuant to this IFB (including, but not limited to, selling or transferring the contract) without the prior written consent of the HACSJ Executive Director (ED). Any purported assignment of interest or delegation of duty, without the prior written consent of the HACSJ ED shall be void. It may result in the cancellation of the contract with the HACSJ, or may result in the full or partial forfeiture of funds paid to the successful proposer as a result of the proposed contract; either as determined by the HACSJ ED NON-COLLUSION: Contractor shall complete an affidavit in proof that they have not entered into any collusion with any person in respect to this bid or any other bid or the submitting of bids for the contract for which this bid is submitted SECTION 3 CONTRACT: The work to be performed under this contract is on a project assisted under a program receiving direct Federal financial assistance from the Department of Housing and Urban Development and is subject to the requirement of Section 3 of the Housing and Urban Development Act of 1968 which requires that, to the greatest extent feasible, opportunities for training and employment will be given to residents of the area of the Section 3 covered project.
