2 MINUTES OF THE PLANNING COMMISSION MEETING HELD APRIL 25, 2018 Planning Commission Members Present: Mayor Ken Tutaj, Alderman Steve Wattawa, Darrin Frerichs, Tom Kiepczynski, John Sidoff, Eric Stemwell and Tim Niemiec (arrived 6:05). Also present: City Administrator Mark Johnsrud and Alderwoman Janis Schandel. Call to Order Meeting was posted and noticed in accordance with law. The meeting was called to order by Mayor Tutaj at 6:00 p.m. Approval of Minutes - Motion by Alderman Wattawa, seconded by Commissioner Stemwell to approve minutes of February 28, 2018 and March 28, Motion carried. Correspondence None. Discussion with Possible Action A) Mayor Tutaj reviewed the Ethics Statement with the members of the commission. B) City Administrator Johnsrud reviewed of the Code of Ordinances and State Stat No action taken. Adjourn A motion was made by Commissioner Frerichs, seconded by Commission Stemwell to adjourn. Motion carried. Meeting adjourned 6:40 p.m.

Dejewski, PE, City Engineer/Director of Public Works June 21, 2018 Honorable Mayor and Planning Commission City of St. Francis Subject: Certified Survey Map for Lots 4 and 5 of Sivyer Plat Gentlepersons: A Certified Survey Map (CSM) has been submitted to combine lots 4 and 5 of the Sivyer plat on E. Sivyer Avenue to facilitate the construction of a 2530 square foot home. We have reviewed the CSM. Our comments are as follows: 1. Sheet 1 of the proposed CSM shows 2 measurements from the quarter section corner. The feet and feet measurements should be verified. We do not believe they are correct. 2. Sheet 3 has several mistakes on the signature blocks. The Planning Commission signatures should be as follows: Ken Tutaj, Chairman; Melinda K. Dejewski, PE, Secretary. The Common Council signatures should be as follows: Common Council Approval: Ken Tutaj, Mayor; Anne B. Uecker, City Clerk/Treasurer. 3. The proposed driveway is too close to the lot line and the adjacent mailbox and adjacent driveway. This will need to be revised. 18 STATE OF WISCONSIN CITY OF ST. FRANCIS MILWAUKEE COUNTY ORDINANCE NO. AN ORDINANCE TO REPEAL AND RECREATE SECTION OF THE CITY OF ST. FRANCIS CODE OF ORDINANCES ESTABLISHING A ZONING ADMINISTRATOR FOR THE CITY OF ST. FRANCIS WHEREAS, of the City of St. Francis Code of Ordinances establishes the position of Zoning Administrator for the City of St. Francis; and WHEREAS, currently provides that the Building Inspector shall serve as Zoning Administrator; and WHEREAS, due to retirement of the existing Building Inspector, the Common Council finds it appropriate to designate the Zoning Administrator separately from the appointment of the Citys Building Inspector; and WHEREAS, the Common Council has separately addressed the appointment of a Zoning Administrator within Chapter 105 of the Code; and WHEREAS, upon the request of the Common Council, the Planning Commission duly considered the proposed revision at a meeting held on, 2018 following notice and provided its recommendation to the Common Council concerning amendment of the Zoning Code to reflect revisions to Chapter 105; and WHEREAS, at a duly noticed public hearing was conducted concerning the recommendation of the Planning Commission on, 2018; NOW, THEREFORE, the Common Council of the City of St. Francis, Wisconsin do ordain as follows: SECTION 1. Section , Zoning Administrator, of the Municipal Code of the City of St. Francis, Wisconsin, is hereby repealed and recreated to read as follows: Zoning Administrator. The Building Inspector shall serve as the Zoning Administrator designated under of this Code and shall perform the duties of Zoning Administrator set forth in this chapter and shall enforce all of the provisions of this chapter, and for such purposes he shall have all of the powers of a police officer. His duties shall include inspecting premises and issuing building permits and certificates of occupancy for buildings and uses of land that meet the requirements of this chapter. SECTION 2: SEVERABILITY. The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a court of competent jurisdiction to be invalid, unlawful or

19 unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision and shall not affect the validity of any other provisions, sections or portions thereof of the ordinance. The remainder of the ordinance shall remain in full force and effect. Any other ordinances whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict. SECTION 3: EFFECTIVE DATE. This ordinance shall take effect immediately upon passage and publication as provided by law. 20 STATE OF WISCONSIN CITY OF ST. FRANCIS MILWAUKEE COUNTY ORDINANCE NO. AN ORDINANCE TO REPEAL AND RECREATE SECTION , ENTITLED "AESTHETIC CONTROL BOARD, OF THE CITY OF ST. FRANCIS CODE OF ORDINANCES WHEREAS, of the City of St. Francis Code of Ordinances establishes and describes the duties and responsibilities of the Aesthetic Control Board for the City of St. Francis; and WHEREAS, upon the recommendation of the Legislative Committee, the Common Council has referred the provisions of to the Planning Commission for its recommendation concerning enlargement of the membership of the Aesthetic Control Board to five members and concerning clarifications pertaining to the duties and responsibilities of the Board; and WHEREAS, the Planning Commission considered the proposed revisions to at a public meeting held on, 2018; and WHEREAS, a public hearing was conducted before the Common Council on, 2018 concerning the Planning Commission s recommendation regarding revising ; NOW, THEREFORE, the Common Council of the City of St. Francis, Wisconsin do ordain as follows: SECTION 1. Chapter 455, entitled Zoning, Section , entitled Aesthetic Control Board, is hereby repealed and recreated to read as follows: Aesthetic Control Board. There is hereby established an Aesthetic Control Board for the City of St. Francis. A. Composition. The Aesthetic Control Board should consist of three five members as follows: three five citizen members to serve two-year terms. Such members may be employees or officers of the City of St. Francis. The Building InspectorZoning Administrator shall be serve as an advisor and Recording Secretary of the Aesthetic Control Board and a nonvoting advisory member to the Board. B. DutiesPowers. The Aesthetic Control Board shall have the power to: (1) Hear and decide applications to erect, move, reconstruct, extend, alter or change the exterior of all residential structures. Small accessory structures, decks and minor exterior alterations shall be exempt unless a determination is requested by the Zoning Administrator. 1

21 (2) Hear and decide development applications for building plans, landscaping, HVAC locations, and signage for all commercial, industrial, institutional and multifamily uses. (3) Approve, deny or conditionally approve an application and may request such modifications as it may deem necessary to carry out the purpose of this division. The Board, however, shall not require private deed restrictions. (4) Request assistance from other municipal officers, departments, boards and commissions. (5) Request the applicant to furnish such additional information as the Board may reasonably require to make its required determinations under this section. (1) No site plans, architectural plans, or specifications shall be approved and no building permits or permits to move buildings within the City shall be issued for any principal building unless first submitted to the Aesthetic Control Board. This applies to all new construction, second-floor additions and any building additions which enlarge the existing structure in excess of 50% of its current size. At the discretion of the Building Inspector, other matters may also be referred for Aesthetic Control Board review and approval. (2) The Aesthetic Control Board is authorized to review all site plans and architectural plans. The Aesthetic Control Board may approve, conditionally approve, or deny applications regarding single-family and two-family homes; on all other matters the Aesthetic Control Board recommends action to the Planning Commission. (3) Upon application for such a building permit or permit to move a building, the Building Inspector shall call a meeting of the Aesthetic Control Board. The Aesthetic Control Board shall review all such plans for how the building and the grounds surrounding the building: (a) Harmonize with the neighborhood. (b) Harmonize with the general makeup of the City. (c) Are, in general, aesthetically pleasing. (4) The Aesthetic Control Board may require that the applicant make such changes as it directs to such plans prior to approval. The Aesthetic Control Board may refuse to authorize the issuance of a permit if the applicant is unwilling to make the changes required by the Aesthetic Control Board. No building permit or permit to move a building within the City shall be issued until receipt of a positive finding by the Aesthetic Control Board. C. Hearing. The Building Inspector shall call a meeting of the Aesthetic Control Board upon application, at a time he determines appropriate. Notice thereof shall conform with the requirements of 19.84, Wis. Stats. C. Aesthetic Principles, Guidelines. (1) Principles: To implement and define criteria for the purposes of this section, the following principles are established: 2

22 a. No building or sign shall be permitted which has a design or exterior appearance that is of such unorthodox or abnormal character in relation to its surroundings as to be unsightly or offensive to generally accepted taste and community standards. b. No building or sign shall be permitted which has a design or exterior appearance that is so similar with those within reasonable proximity as to create excessive monotony or drabness. c. No building or sign shall be permitted where any exposed façade is constructed or faced with a finished material which is aesthetically incompatible with the other façades and which presents an unattractive appearance to the public and to surrounding properties. d. No building or sign shall be permitted to be sited on the property in a manner which would unnecessarily destroy or substantially damage the natural beauty of the area, particularly insofar as it would adversely affect values incident to ownership of land in that area; or which would unnecessarily have an adverse effect on the beauty and general enjoyment of existing structures on adjoining properties. e. Development and redevelopment shall be consistent with the public goals, objectives, principles, standards, policies and design guidelines set forth in the City s comprehensive plan or applicable components of it. (2) Guidelines. The following design guidelines are established for all development applications for commercial, industrial, institutional and multifamily uses: a. Building design. 1. Architectural style shall be consistent or compatible with the surrounding area. Compatibility may be achieved through the use of various visual architectural elements such as similar rooflines, building orientations, forms/shapes, proportions (scale and mass), door and window patterns (fenestration), textures, materials, colors and other architectural detailing. Building lighting, signage and mechanical equipment also shall be presented as an integral part of the building design and shall not detract from the architectural style of the building. 2. The composition of major building elements such as massing, rooflines, colors and material shall complement and contribute to a desirable community identity. 3. Colors shall be harmonious and relate to the overall site and to the City as a whole. Bright complementary colors may be used for highlighting purposes (accenting) provided such colors do not overbear the integrity of the building façade. 4. Rooftop mechanical equipment, trash/dumpster areas, and other utility hardware located on the site shall be screened from public view with building and landscape material or be located in a manner that is unobtrusive. 5. No rows of garage doors for multifamily uses and no overhead service doors or loading docks shall face a public street. The Planning Commission may allow such features to face a public street when it finds that there is no feasible 3

23 alternative orientation for such doors or docks and, insofar as is practicable, such doors and docks facing public streets are to be screened with landscaping and/or softened by architectural detailing. 6. Accessory buildings and structures shall be compatible with the principal building in terms of building façade character, roof shapes, materials, colors and architectural details. b. Exterior building materials. 1. Materials shall be consistent or compatible with the architectural character of the City and shall be consistent with the surrounding area. Where the proposed materials are dissimilar to prevailing materials used on existing buildings in the area, other characteristics such as form, proportion, texture, color and detailing shall be utilized to ensure that adequate similarity exists for the building to be compatible, despite the use of different materials. The requirements of this section concerning compatibility with existing buildings shall not be deemed to apply to areas that have been determined by the Planning Commission or Community Development Authority to be in need of, or suitable for, redevelopment. 2. Materials shall be of durable quality. 3. The façades of buildings shall be finished with an aesthetically pleasing material(s) such as natural or cultured stone, brick, wood, glass panels, or ornate masonry materials, except where the building style requires a different material. No plain concrete-block or plain concrete-panel buildings or smooth or corrugated metal-faced buildings that are devoid of an architectural merit or character, except those with an attractive finished surface listed above, may be allowed. 4. Building façades clad with a single exterior surface material shall provide some additional architectural design elements to break up the plane of large faceless and/or nondescript walls. This may be achieved by architectural design treatments consistent with the principal building design. D. Findings, decisions, and appeals (1) Findings. The Aesthetic Control Board shall not approve any application unless it finds that the purposes, principles, and guidelines in this section have been reasonably met. (2) Decision. The decision of the Aesthetic Control Board shall include the findings required under this section and shall be recorded in the minutes of the Aesthetic Control Board. (3) Appeal. Any person, or the City, aggrieved by any decision or order of the Aesthetic Control Board may appeal to the Zoning Board of Appeals of the City of St. Francis and pay the appropriate applicable fee within 30 days of such decision or order of Aesthetic Control Board s. No resort to any other court or forum shall be had until the remedies provided herein have been exhausted. 4

24 E. Fees. The fee for review by the Aesthetic Control Board shall be as set forth in the currently adopted fee schedule as amended from time to time,. Such fee shall be payable at time of application for the building permit. SECTION 2: SEVERABILITY. The several sections of this ordinance are declared to be severable.
