2 ANNEXURE I SPECIAL CONDITION OF CONTRACT 1 SCOPE OF WORK OF SUB CONTRACTOR i. Taking delivery of paint drum from BBJ s site store at Kathjodi Bridge site, mixing, carrying to bridge point. ii. iii. iv. Arrangement and fixing staging and access ladders. Arrange wire brush, cotton waste, paint brush and all other consumables. Brushing, cleaning, and washing of erected girder before painting and apply touch-up as necessary as per instruction of SIC /BBJ. v. Application of one coat of final paint (Aluminium) to a thickness of 15 to 20 micron. If the desired thickness is not achieved in one coat, the agency will cover up the thickness without any extra payment. vi. vii. viii. ix. The bridge members will be painted by the contractor in one go except Top flange of cross girders and stringers, which will be painted after fixing of permanent rail tracks. Providing all skilled and unskilled labour, tools & tackles, safety items, supervision etc. for successful completion of work. The contractor is to get clearance from RVNL/Expert_SPA JV for the cleaning of members to start painting work. Arranging land for labour hutment, site office and store of the agency at your own cost. x. All empty drums are to be returned to BBJ s store in good condition. xi. xii. xiii. xiv. xv. Covering area will be decided by SIC/BBJ. Only very skilled painters are to be arranged. Safety and security of the agency s labour and supervisory staff will be the responsibility of the agency. The agency must obtain Workmen Compensation Policy. The agency will be allowed to use the existing access and no separate/special arrangement will be made. If required the same will be arranged by the agency with no extra cost to BBJ. Individual span may not be allowed for painting in one go. It may so happen that the bottom floor will be released for painting at a later date. The agency should take care of this without any extra payment from BBJ.

3 2. BBJ s SCOPE OF SUPPLY: i. Paint (free of cost) 3. JOB DISTRIBUTION: BBJ reserve the right to accept or reject any tender either wholly or partly or to distribute the work among more than one tenderers without assigning any reason whatsoever. 4. DRAWING/SPECIFICATION: BBJ reserves the right to alter/modify the design/drawing/specification to suit to their condition. If due to change in design/drawing/specification, there is any increase/decrease in items/quantities to the extent of +/- 25% (twenty five) or both, payment will be made only for actual work done with the same rate, terms and conditions of the original order on them by BBJ duly certified by the Site-In-Charge/BBJ, Kathjodi Bridge Site. 5. MEASUREMENT FOR PAYMENT: The quantity mentioned in the BOQ is tentative and may vary without any adjustment in accepted rate. Payment will be made on actual area painted certified by SIC/BBJ. No extra measurement will be made for rivet heads/weld. 6. INSPECTION &INSPECTION AGENCY: The surfaces are to be cleaned before painting and have to be get inspected and approved. The painted surface will also need to be inspected and approved. The inspection agency will be BBJ/RVNL/Expert_SPA JV or their authorized representative. The cost of inspection will be at the agency s account. 7. EARNEST MONEY: EARNEST MONEY DEPOSIT OF Rs. 5000/- (Rupees Five thousand only ), in the form of DD or pay order or banker s cheque from a nationalized bank at Kolkata, drawn in favour of The Braithwaite Burn & Jessop Construction Company Limited. 8. COMPLETION TIME: The entire work in all respect should be completed within 1.25 months from the date of issuance of LOI/Work order. 9. PAYMENT: a. 95% payment will be made against R.A. bills, duly certified by SIC Kathjodi Bridge Site. b. 5 (Five) % of each certified bill value would be withheld for release after six months from the date of completion of work successfully. Within that period the agency will be required make good any defect of painting due to poor workmanship. c. The EMD deposited by you will be released alongwith the payment mentioned in clause 9-b above. 10. PERFORMANCE GUARANTEE: a. On completion of the painting job successfully and getting completion certificate from BBJ, you will be responsible for repairing, covering the defects attributed to you for a further period of 06 months from the date of completion. b. You will make good and remedy at your own cost within such period as stipulated by BBJ, any defect in painting, which may develop or may be noticed before the expiry of 06 month. c. In case you fail to make adequate arrangements to rectify the defects within seven days after receipt of notice from BBJ, necessary arrangements will be made by BBJ to rectify the defects without any further notice to you and cost of such rectification shall be recovered from the amount kept by BBJ towards Performance Guarantee.

4 11. TAXES & DUTIES: Rate for the above work as mentioned in BOQ is inclusive of all taxes and duties. 12. PRICE VARIATION: No price-variation of any kind will be allowed in this contract under any circumstances. Price shall remain firm for entire scope of work. 13. RISK PURCHASE: a. TERMINATION OF CONTRACT: If the you persistently discharged the instruction of BBJ or failed to adhere to the agreed programme by a margin of 10% of the stipulated period, BBJ shall be at liberty to terminate the contract in full or part as would be applicable by issuing first seven days and then 48 hours notice. b. In case of failure to complete the work as per requirement and within the stipulated completed period, BBJ reserves the right to cancel the order, either in part or full as the situation demands and get the work done by deploying other agency/agencies. Additional cost if incurred shall be recovered from your bill & Security Deposit. 14. LABOUR: a. You have to arrange accommodation & transportation of your labour engaged for execution of the above work. b. BBJ will not be responsible for workmen engaged by you in case of any accident. c. During execution of the contract, you will observe all formalities as required by BBJ/RVNL/Expert_SPA JV. 15. LABOUR LAWS: You must observe all Labour Laws relevant for execution of the above work applicable at Orissa State. Contractor has to observe all obligations towards Insurance Coverage, the statutory labour laws and wages act including Contract Labour and minimum Wages Acts with latest amendments applicable in the state. BBJ will have no responsibility in this regard.
