2 A. APPLICATION SUBMITTALS 1. The Ownership and Encumbrance (O&E) Report should be searched from time of platting or 1953 (earliest of two). SECOND REQUEST Response: Updated O&E included 2. Provide Certified ALTA Survey based on and dated after the Ownership and Encumbrance Report. Work with Engineering Department to ensure O&E Report and Survey are accurate. SECOND REQUEST Response: Updated survey based on O&E included 3. Revise the Final TAC meeting date on Cover Sheet. Response: See revised Cover Sheet. 4. The Survey should state net and gross area of property. 5. Provide a matrix on the Site Plan Sheet to indicate the previously approved and proposed development standards. List all amendments to the previously approved PD Master Plan. Work with Staff to determine adequate formatting. Response: See revised SP-1 previously approved and proposed data table. 6. Provide a list of all requested Modifications and Variances in separate boxes. Response: See revised SP-1 previously approved and proposed data table. 7. Revise Site Data numbers; there are discrepancies in the Open Space calculations. Response: See revised SP-1, information added to site data. 8. The roof level shall be labeled as such. Remove 6 th floor. Revise all drawings as necessary. Response: See revised A-6 9. Provide a Street profile or elevation along A1A to include adjacent buildings. Response: See revised SP Staff encourages the Applicant to meet with homeowners or civic associations. For list of homeowners or civic associations visit: Response: Informational. Noted. B. ZONING 1. The proposed number of parking spaces was reduced from the previous submittal. Revise the plans to provide the appropriate number of parking spaces. Response: See revised SP-1 parking data. Proposed parking now exceeds requirements. 2

3 C. DESIGN 1. The alternative design provided for the ADA ramp it is not the ideal solution. Maintain the south ramp and replace the north ramp with landscaping. The previous rendering showed more trees and shrubs along the front façade. Consider increasing the landscaping along the location of the proposed north ramp. Response: See revised SP-1 and A-1 Terrence Comiskey, Architect, Sheet L-1: What are the 13 palms on the Intercoastal? They are not listed on the Plant List. Two groups of 2 appear too close to each other. Response: Palms shown are Royal Palms and are now indicated on the plant list. Double stacking of palms has been eliminated. 2. Sheet SP-2: Garbage Room Detail; Where is there a can wash for the proposed restaurants? Response: See revised SP-2 and A-1 3. Sheet A-1: In the walkway area under the car ramp there are notes calling for 8 and 9 soffits. The landscape plans call for Key Thatch Palms that are 8 high with a full head. How is this going to work? Response: Palms have been changed to European Fan Palms, 4' heights. 4. Sheet A-1: are the plants in the walkway area going to receive irrigation? Response: See revised A-1. The planters under the roofs will receive irrigation. 5. Sheet A-1: Where will bicycle racks be installed? Response: See revised A-1. Also see changing room. 6. Sheet A-5: How do the planters work? Are they recessed or sit on the slab? Are they irrigated? What is planted in them? Response: Planters will be raised on the surface of the slab. 7. Sheet A-5: The Toilet Room doors need to be ADA compliant. They don t have the minimum dimension required on the push side. Response: See revised A-5 8. Sheet A-5: Is the Utility Room a janitorial room with a mop sinks? Response: Yes, the utility room has a mop sink. And also added two small garbage rooms with a mop sink in each one for the restaurants. See revised A-5. 3

4 9. Sheet A-5: Why is the only access to the elevator room through the restaurant? Response: Access moved to the elevator machine room. Relocated to the second level. See revised A-1 and A Sheet A-6 & A-7: Exterior Elevations; Stucco scoring should be done in all large areas of stucco in order to prevent cracking. Response: See revised A-7 and A-8. Walter Wernecke, Architect, D. LANDSCAPING 1. Consider relocating trees on-site. Response: Relocation would require a holding area since the site is small and will undergo extensive onsite construction and most likely damage to the palms. Existing palms will be mitigated. 2. Consider vertical vegetation along the South and North Facades. Response: Discussion with owner-developer is still in progress regarding this comment. The north and south elevations now contain screening of the parking levels and multiple architectural features. 3. All landscaping shall comply with Zoning and Land Development Regulations. Response: Landscaping is in compliance per comment. 4. Ensure that the landscaping along South Ocean Drive will not be in conflict with the overhead wires. Response: There are no existing overhead power lines along South Ocean Drive adjacent to the property. 5. Show calculations for total number of trees required and provided. Indicate number of trees to be removed. Tree mitigation requirements are in addition to base landscape requirements. Indicate mitigation methods. Response: Calculations for number of trees required are shown on Sheet L-1 Tabulations and mitigation shown for tree removal is shown on Sheet TD-1. "Tree Removal -Replacement Schedule. Please note that removal is for palms only, there are no trees to be removed. 6. If removing or relocating trees, a tree removal/relocation permit will be required prior to Board consideration. A bond and tree mitigation agreement will be required for trees proposed to be relocated prior to issuance of Building permits. Response: Only palms are to be removed. Bond for removal of the palms will be posted per comment. 4

5 7. A preconstruction landscape inspection to ensure remaining trees are adequately protected will be required prior to issuance of Building permits. Response: Existing on-site palms to be removed. E. SIGNAGE 1. All signs, which are electrically illuminated by neon or other means, shall require a separate electrical permit and inspection. Separate permits are required for each sign. Response: Noted. Will comply. A separate process will be processed for signs. Signs indicated are only shown to indicate areas designated for signs. 2. Signs, as shown on elevations, have not been reviewed or approved. All signage shall comply with Zoning and Land Development regulations. Response: Noted. Will comply. Revise the note on Site Plan to state maximum 0.5 foot candle level to all property lines adjacent to residential. Response: See revised SP-1 G. GREEN BUILDING 1. Submittal shall indicate compliance with Green Building Ordinance. Review and adjust drawings as necessary. Indicate on drawings Green Building certification to be achieved and green practices to be implemented. Response: Noted. Will comply. H. Provide preliminary drainage calculations in conformance to Broward County criteria.. 4. Discharge into the Intracoastal requires additional permit from Broward County and USACOE.. 5. FDOT approval will be required. Response: Noted. Will comply. 6. Provide signed and sealed survey. Response: See attached survey. 7. On civil plans, show finished floor elevations of the proposed building addition and any mechanical and electrical pads meeting FEMA and City Code requirements. Please note that the National Flood Insurance Program is in the process of implementing new Flood Insurance Rate Maps. At time of building permit the project will be required to comply with the maps in effect at t hat time. Update FEMA information on survey accordingly.. 8. Conflict exists between proposed drainage, double detector check valve, backflow preventer assemblies and the proposed landscaping. 9. Broward County approval for surface water management will be required prior to issuance of building permit. Response: Noted. Will comply. Water & Sewer: 1. Site Plan Deficiency: No utilities plans are submitted to show the method for providing any water or sewer service to the new structure. 2. A separate tap is required for fire line. 3. Indicate size of existing utilities. 6

7 4. Provide detail for a double detector check valve. 5. Provide calculations to show proposed water demand and sewer capacity requirement for the development. Response: Noted. The following comments are provided as a courtesy: 6. NPDES Over 1 acre The construction activity on this site is regulated and required to obtain the NPDES Construction Generic Permit (CGP) from DEP. Failure to obtain permit coverage and/or maintain job site erosion and sedimentation control in accordance with permit conditions and applicable regulations may result in fines up to $27, per day. Prior to issuance of building permit a Storm water Pollution Prevention Plan (SWPPP) shall be required and CGP Notice of Intent (NOI) must be submitted to DEP. SWPPP must be maintained at the job site at al l times until the project is terminated and Notice of Termination (NOT) filed with DEP. The SWPPP shall contain detailed descriptions of structures, procedures, contact names and/or control measures designed to reduce sediment and storm water runoff. Construction sites and operations shall be required to maintain during and after all construction, development, excavation, dewatering, and/or alteration operations, structural and non-structural Best Management Practices (BMP's) with the intent to reduce pollutants and sediment in storm water runoff. 8 1. Indicate on the site plan the placement of ADA sidewalk ramps at the driveway curb cut. Ensure that the cross slope of the sidewalk within the driveway opening meets allowable ADA specifications. and architectural plans. ADA maximum slopes met. 2. Provide additional landscaping along South Ocean Drive that will not be in conflict with the overhead wires. Response: Additional landscaping is shown per comment. There are no existing overhead wires along the South Ocean Drive right of way. 3. Revise the site plan so that all the columns located adjacent to the parking garage ramps have a 2 offset from the travel lane. Response: See revised SP-1 and A-1 4. Revise the radio on the second, third and fourth floor parking levels from a 5 foot radius to 10 foot radius. Response: The traffic within the parking levels will always be counterclockwise thus always meeting a larger radius. No tight turns. K.
