As we understand, you require an MDS report as part of an application to permit the construction of a new livestock barn and manure storage tank on your property. We have prepared an MDS II review for property at Part Lot 6, Concession 1, Geographic Township of Camden, 1195 County Road 1 and note that the adjacent uses are considered Type A uses in accordance with the MDS Guidelines. We have used information supplied by you via s and by phone, a review of available aerial photography, and a site visit on October 14, In preparing this letter, CCS has referred to the MDS Training Manual and the MDS Implementation Guidelines as published by OMAFRA. MDS I is applied to new non-farm uses and MDS II is applied to new or expanded livestock facilities. In this case MDS II applies. In order to determine the actual separation distances we have used the sketch prepared by Clancy & Hopkins superimposed over an aerial photo from the Agricultural Information Atlas of the Ministry of Agriculture, Food and Rural Affairs. The proposed barn will house 100 milking and dry cows and 20 heifers with sand bedding. The proposed manure storage facility will be liquid with straight walls and no cap. According to the MDS II calculation provided in the attached MDS Report the calculated base distance for the barn is 234 m (767 ft.) and the calculated base distance for the storage facility is 310 m. (1019 ft.). These are the setback distances required for the nearest neighbour's dwelling from the barn and storage facility. As indicated on the attached sketch, after a slight adjustment the barn meets the separation distance from all neighbouring houses. 2 Mr Sutton MDS 11,1195 County Road 1 setback for 3 of the houses and the road allowance. We understand that an application for a minor variance has been made to reduce the setback distance from the road allowance.. In order to address the non-compliance of the manure storage facility the minor variance application should be amended to recognize the actual separation distances as outlined on the chart. It is noted that if the storage facility were capped, the separation distance for the storage facility would be the same as the base distance for the barn and all but one of the houses would meet the separation distance. It is also useful to point out that the houses closest to the storage facility are occupied by family members. Unfortunately Implementation Guideline 16 clarifies that even if the adjacent lot is owned by the same owner this does not prevent the application of the MDS. In considering a reduction in the setback distances it is important to consider the nature of the intervening land use and the extent of the reduction. It is my opinion that the variances required are minor and in keeping with the intent of the zoning by-law and the Official Plan Summary In reviewing the proposed barn and manure storage facility and its compliance with Minimum Distance Separation, we have studied the MDS Implementation Guidelines published by OMAFRA, information from you, available aerial photography and a site visit on October 14, In considering the above, we respectfully request that the Township of Stone Mills accepts this analysis of Minimum Distance Separation II Formula and the Guidelines as published by OMAFRA as it applies to the application. We find that although the storage facility does not meet the MDS II separation distances they are well separated and a minor variance application would allow the proposed livestock facility.
