1 SECTION 1: STREET AND WALKWAY 1. Motorcycles, mopeds, and other mechanically powered vehicles may be used only for entering or leaving the Community and may not be used for joy riding or other recreational use within the development. 2. All non-engine powered recreation-type vehicles such as bicycles, skateboards, scooters, etc. are restricted to operation on streets and designated pathways They are not to be operated on the hillside slopes or other Common Areas. 3. Homeowners, guests and/or their family members use the streets and Common Areas at their own risk. The association accepts no responsibility or liability for injury to anyone using streets or Common Property as a playground 4. Sidewalks may not be blocked or partially blocked by vehicles parked in driveways. 5. Homeowners are responsible for the violations of any Association Rules by their guests or tenants. SECTION II:GARAGES 1. Garages, when not in use must have their doors closed unless attended by owner. 2. Garage doors shall be closed by 9 P.M. regardless if attended by resident. a. Garages shall not be used as living quarters or for commercial business purposes and must be kept in an orderly state to allow the parking of at least the number of vehicles for which the garage was originally constructed (i.e., two (2) vehicles). [NOTE: Section 8.2(c) requires garages to be maintained so as to accommodate the number of vehicles for which the garage was originally constructed. Are all garages 1 or 2 vehicle garages? This rule may need to be further revised.] 3. Driveways must be kept clean of oil, grease, rust and/or any other debris. {NOTE: Pursuant to Section 2.7(b) of the CC&Rs, private driveways are the maintenance responsibility of the Association. However, if damaged by an owner, then the Association will likely be entitled (following notice and hearing) to impose a reimbursement assessment upon the owner for the cost of repair.] 4. Garage Sales are not permitted, except as may be allowed by the Board on a scheduled basis. 5. No repairs or restorations of any vehicles, boat, or trailer are allowed except wholly within the owner's garage, with the garage door closed. [NOTE: Garage door maintenance is the responsibility of the Association. (CC&Rs Sections 2.7(a); 1.17 and 1.19; Condo Plan Nte Page 1 of 1

2 SECTION III:ANIMALS AND PETS 1. Dogs, cats, and caged birds shall be limited to two (2) each per single dwelling. 2. All animal droppings must be removed from the common or private areas by the owner of the pet. 3. Dogs or cats belonging to owners/tenants or guests must either be kept within an enclosed yard or on a leash held by a person capable of controlling the animal. a. Owners are responsible for all damage caused by their pets to private or common areas. b. Owners are to control excessive barking. Avoid leaving dogs penned up and alone over long weekends. SECTION IV: GARBAGE/PRIVATE AREA 1. All garbage cans are to be kept out of sight either in garages or in constructed containment areas out of sight from the street. No container or trash can should be put out to the curb for collection prior to the night before the pick-up. All containers must be put away the evening of the pick-up. 2. Private areas must be kept free of litter, cardboard, and other trash. 3. All garages must be kept clean to avoid attracting rodents or other pests. Pest control within units and garages is the responsibility of the homeowner. 4. Owners are responsible for maintaining all personal property visible from the common area in a neat and orderly manner. No unsightly or deteriorated items may be visible from the common areas. SECTION V: GENERAL RULES 1. Operation of radios, televisions, and stereos may not be operated in such a manner as to disturb other homeowners. Refrain from noisy parties etc. especially after hours (i.e., 11:00 p.m.). 2. No clotheslines are permitted 3. No clothes, towels, bathing suits, or other objects may be hung on fencing or to be visible from Common Area. 4. No bird feeders are permitted with the exception of hummingbird feeders. Hours of operation for parksite are 7:00 am through 11:00 pm. Page 2 of 2

3 5. No parties after hours. Owners are responsible for cleanup after activities and parties in parksite. 6. Common areas to be kept clean, no dumping of building materials on landscaping. SECTION VI: ARCHITECTURAL CONTROL 1. All architectural changes must be approved by the Architectural Review Committee. (ARC) All Landscape Architectural Plan Submissions will be reviewed by Smith Architects to ensure all designs are properly drafted and adhere to the existing regulations, irrigation networks and themes. Please note that there is a $ fee for the review and payment must be paid via check or money order made out Mesa Vista South Townhome Association. a. The fee covers the cost for reviewing the design documents, making comments and finalizing a report for Board review, and an onsite inspection after completion for design compliance. b. Any plans found in non-compliance and need to re-reviewed or re-inspected will be billed at $ per hour. The fee must be submitted together with plans or the application will be considered incomplete and will not be forwarded for review. 2. The Architectural Review Committee (ARC) is charged with interpreting and enforcing architectural guidelines for the board of directors. 3. The overall goal of the Architectural Review Committee is to insure that any improvements or amendments made to the structure of homes are in-keeping with the general style and quality of the neighborhood and either maintain or increase property values. 4. Three copies of proposed changes or requests must be submitted to the management company with a completed application form for the ARC approval. Application forms are available from the management company. Sufficient information an detail for full and comprehensive evaluation by the ARC must be presented. All requests will be processed in a timely manner, and a response provided no later than 45 days, after receipt of all required materials. [NOTE: This is the required timeframe pursuant to Section 4.2 of the CC&Rs. 5. Specific guidelines for architectural changes or requests: a. Show clearly all details, dimensions, locations and colors of proposed changes or improvements b. Show relationship of proposed changes or improvements to existing structure and fencing. c. Proposed changes or improvements must be compatible to surrounding structures. No architectural Changes can be made to common area. Page 3 of 3

4 d. Any damages to common area caused by the installation or maintenance of improvements will be the financial responsibility of the owner. 6. Out-building or utility shed structures may not be higher than five (5) feet or visible from street. 7. No for sale signs may be placed in the backyard. For sale signs may be placed in the front yard and may be no larger than 18" x 24". [NOTE: Pursuant to Civil Code Section 4710, an association cannot prohibit the posting of noncommercial signs, posters, flags or banners on an owner s separate interest property, and such signs, posters, etc. may only be made of paper, cardboard, cloth, plastic or fabric, and may be displayed only from the yard, window, door, balcony or outside wall of the separate interest. Such signs, etc. may not be made of lights, roofing, siding, paving materials, flora, or balloons, or any other similar building, landscaping or decorative component, or include the painting of architectural surfaces. Noncommercial sign and posters more than 9 square feet in size, and noncommercial flags or banners that are more than 15 square feet in size, may be prohibited. 8. No owner may be in violation of any federal, state, city, or county ordinance or permit procedure relative to activities or construction on the owner's property. SECTION VII: LANDSCAPE 1. All Landscape Architectural Plan Submissions will be reviewed by Smith Architects to ensure all designs are properly drafted and adhere to the existing regulations, irrigation networks and themes. The approval process follows the same guidelines as outlined in Section VI for improvements and changes. (see #6 in this section). 3. The ARC will automatically disapprove of the planting of any trees, bushes, or other plants whose root structure is likely to undermine streets, driveways or walls. Owners are liable for the damage their plants may cause to any structures or development or equipment. 4. Weed control, clearing of brush, pruning trees, and otherwise dealing with excessive plant growth - particularly in relation to fire-risk of individual private areas is the responsibility of Page 4 of 4

5 the homeowner and must be maintained in an attractive and tidy condition and receive regular attention. 5. All public and governing agencies permits and approvals are the Owner's responsibility. 6. Guidelines for Landscape Improvement and Changes a. Three sets of proposed landscape improvement drawings with a completed application form submitted to the management company review for the ARC approval. Application forms are available through the management company. Request will be responded to within forty-five (45) days after receipt of all required materials. b. Landscape plans must clarify size and location of trees and shrubs, detail irrigation system and location of timers and valves. c. Show existing drains and intended drainage patterns and directions. d. Show existing structures and fencing and detail location of all landscaping features and color. e. Detail tree and shrub heights at maturity. f. No landscape changes can be made to common areas. g. Repair for any damage to common area caused by owner or workers completing landscaping for owner will be the responsibility of owner. PARKING RULES AND POLICIES Both Via Montoya and Paseo Segovia are private streets owned by the association, and are designated as fire lanes. Because of that designation, street parking is prohibited except for temporary, attended loading and unloading of residential and trade vehicles. It is important to keep those lanes open at all times. Our CC&R's outline our basic parking and vehicular restrictions on page These rules and policies stated here summarize and/or supplement the CC&R's. Page 5 of 5

6 We have twenty-five (25) available parking spaces in the complex, seven (7) of which have been reserved for RESIDENT PERMIT PARKING. All Mesa Vista South residents who have more than one vehicle shall make space available within their garages for two vehicles, and use such space to park those vehicles. If a resident has three (3) vehicles and three (3) resident licensed drivers, they may park the third vehicle on the driveway as long as no portion of the vehicle overhangs any portion of the sidewalk. If this is not feasible, they may apply for a parking permit to park in one of the Resident Permit Parking stalls. There is a maximum of one permit per household, available on a first come first served, annual, basis. If all allowable permits (7) have been issued, remaining cars shall be parked offsite of the Mesa Vista South property. Applicants will then be put on a waiting/space available list and there is no angle parking in the driveways. Permits will be $75 per year and after initial issue will be due on January 1 of each year and will be valid for the calendar year. Permits are issued subject to Board approval, and when issued, must be displayed on the approved vehicle's dashboard when parked in the Resident Permit Parking stall. Failure to display the permit will subject the vehicle to be towed at the owner's expense. Residents may request permits by contacting: Accell Property Management, Inc Avenida De La Carlota, Ste 700 Laguna Hills, CA Seven stalls (dispersed throughout the complex) will have the curb painted white with words RESIDENT PERMIT PARKING, These spaces are not for Guest Parking. The other, open, unmarked, spaces are Guest Parking. There is an uneven distribution of parking spaces relative to the location of residences throughout the association. Therefore the board will designate where RESIDENT PERMIT PARKING stalls are located and assigned. The guest stalls may be used for guest parking for a period of less than seven (7) consecutive days. Guest parking in excess of seven (7) days requires a permit. This is for actual long term guests, not residents, roommates, etc. Permits may be utilized only two times in one calendar year per residence Page 6 of 6
