5 A. Introduction 1. Goal and objectives 1. This social safeguards compliance monitoring report has been prepared following the requirements of ADB Safeguard Policy Statement (SPS 2009), principles and requirements as well as the legislation of the Republic of Tajikistan. The report is based on the review of project implementation progress of the project component 3 managed Project Implementation Group under of Building Climate Change Resilience in the Pyanj River Basin Project of State Unitary Enterprise Khochagii Manziliyu Kommunali of the Republic of Tajikistan (RT). 2. In accordance with the requirements of ADB policy, Social Safeguards Review conducted in all sup-projects sites covering several project districts and LARP has been developed by the PIG, if project negative impact on lands and properties occur in the project locations, which stipulated rendering full money compensation.. However, most of the subproject locations were outside of the residential area and LAR occurred only on one project site effecting only 1 APs. Other project sites managed by KMKI did not have any negative impact on people. 3. The main purpose of the report is to document and ensure compliance of the project against social safeguards covenants and requirements. This compliance semi-annual social monitoring report as an important component of overall project implementation process and is based on field monitoring visit, which took place between March and June, 2018 by the PIG SUEKMK safeguards team to project sites. The objectives of the compliance assessment include: Verification of compliance of the project to ADB SPS 2009 requirements and Tajikistan National Laws; Observation of ongoing construction activities and verification of none existence of project negative impact; Checking of Grievance Redress Mechanism (GRM) functionality and the established procedures; Community perceptions on project implementation and benefits. 2. General Project Information 4. The Building Climate Resilience in the Pyanj River Basin, Republic of Tajikistan project is directed to increasing resilience to climate change in the Pyanj river basin of Tajikistan. It consists of four components: (i) more sustainable flood protection systems, (ii) more sustainable irrigation systems, (iii) more sustainable drinking water supply systems, including rehabilitation of drinking water infrastructures in the most vulnerable communities, and the development of the capacity of water user groups and (Iv) microfinance component for providing financial services to vulnerable groups especially women. The project is implementing through a grant from the Asian Development Bank. 1

6 5. The project includes physical and non-physical measures. The main area of physical activities are upgrading / restoration activities for infrastructure, which include detailed engineering design, earthwork, reinforced concrete structures, drainage, protection of river banks, replacement of pumping equipment and electrical networks and regulation / control equipment. Sustainability of the improved infrastructure will be providing through climate-resilient design, project decisions, operation and maintenance, as well as community participation. The infrastructure will become climate resilient by incorporating information on climate change (e.g, temperature increase, drought, floods and other climate disasters predicted in the next years) in engineering design and in the guidelines / guidance / operating and maintenance provisions. 6. The main area of non-physical measures is the capacity building of the WUA, the Disaster Management Committees and the infrastructure operation and maintenance manual, training on adaptation to climate change for local community groups (e.g. jamoat officials), Training for Local communities should be orginized through the Project Management Office (PMO and climate change information centers established under the PPAC. 7. The target of the output 3, (the rural water supply), includes the following: (i) Restoration and protection from the effects of climate change of seven drinking water supply systems in rural areas, including restoration, renovation and construction of boreholes, provision of new and restored pumping equipment, construction of new reservoirs and water towers; (ii) Identify O & M methods for drinking water supply systems, develop an O & M guide, and train local units of responsible institutions; (iii) Creation of drinking water consumers groups to influence responsible institutions and guarantee the functionality of water supply facilities; and (iv) raising awareness of health and other risks associated with climate change. 8. The project is oriented on building resilience of communities to climate vulnerability and climate change in the Pyanj river basin. The water supply output is realized by the State Unitary Enterprise (SUE) Khojagii Manzilyu Kommunali (KMK), the Government of the Republic of Tajikistan in 3 southern districts in Pyanj river basin of Tajikistan in the period According to the agreement on the project implementation, the Project Implementation Group (PIG) with the Guidance and with the assistance of Consultants on Technical Support (CTS) was established within the SUE. Three Project Implementation Offices (PIOs) were formed at the district level to provide overall guidance for project management and performance in various jamoats. 9. Water supply component consist of 7 subprojects in 3 southern districts: Kulyab, Vose and Pyanj. In Kulyab district located 2 subprojects, K02: Water supply of Ziraki and K08: Water supply of Dahana. In Vose district located 3 subproject, V07-1 (Ibrat) and V07-2 (Navbahor) Water supply of Tugarak, V14 - Water supply of Rudaki and 1 subproject located in Pyanj district: P05: Water supply of Namuna. 10. The consultant of the project the BETS Consulting Service Ltd., Bangladesh in association with LLC Panasia Ltd., Tajikistan signed a contract with OJSC Tajikkommunproekt on May 20, 2015 to conduct survey and investigation works, developments and prepare and provide detailed design of the structures necessary for conducting bids for all sub-projects within Output 3, as detailed in the table below. The subprojects of the package 1 located in Kulyab district, the subprojects of package 2 located in Vose district and subprojects of the package 3 for the works in Pyanj district. The construction works designed for the construction of Package 3 covering two subprojects in Pyanj district; One in Namuna jamoat, Kommunism village, for the entire Kommunism village and one in Jamoat Mehvar for five villages. The project includes social screening and social impact assessment to identify any issues of social protection compliance and consultations with beneficiaries and other stakeholders to contribute into the inclusive design of subprojects. The subprojects according to PBLAR are expected to be in accordance with the ADB SPS 2009 (SPS 2009). 12. The subprojects, at the same time, had to comply with the requirements of ADB's social and environmental policy measures, and comply with the national legislation of Tajikistan in the field of environmental safeguard and public health. The figure below gives an overview of the location of the projects. 3

8 Fig.1. Location of pilot projects in the country scale 13. As a result, the project is being implemented in 7 jamoats of Kulyab, Pyanj and Vose districts of Khatlon region. In Kulyab district there are 2 sub-projects - K02: Water supply of Ziraki and K08: Water supply of Dahana. In Vose district there are 3 sub-projects - V07-1 (Ibrat) and V07-2 (Navbahor) Water supply of Tugarak, V14 - Water supply of Rudaki. In the Pyanj region will be implemented 1 sub-project: P05: Water supply of Namuna. 14. Detailed design of the majority of the sub-projects suggested that they do not include impact of land and / or relocation. The due diligence of the land allocation and resettlement activities for all three packages was fulfilled in accordance with the requirements of the Asian Development Bank (ADB) "Safeguard Policy Report 2009" (OPB 2009). Based on the results of due diligence of the subprojects in Kulyab and Vose districts, were recognized as socially acceptable and do not require involuntary allocation of land or relocation cases. All works and subproject construction works were developed for construction within the existing available land of the corresponding Vodokanals without any encroachments. However, the subprojects in Pyanj district within the Package 3 considers the allocation of land and resettlement of households/people. The land allocation and resettlement plan (LARP) was prepared on the basis of the results of due diligence of the subproject activity on water supply in Communism village of Namuna jamoat, Pyanj district. The construction work was planned for the construction on 1.2 ha of the private land in Saroykamar village for pump station and associated structures and infrastructures and on 1.0 ha of rural reserve lands in Kommunism village for the secondary reservoir. The process of land allocation and receiving of certificates has been completed. B. Project Sites Investigation Works 4

9 15. Visits to the project districts were carry out together with the Project Manager / Consultant, Engineers from the PMO office and local authorities of each sub-project site. The checks included a visit to the location of the proposed sub-projects. 16. Field visits were aimed at site inspection, verification of any potential land allocation and impact in the form of resettlement as a result of the proposed detailed projects, including permanent and temporary impacts, impacts on residential, agricultural areas, livelihoods and / or any economic activity / assets (including crops, trees, etc.) in the area. This section presents the results of observations of each visited sub-project. 17. Rehabilitation and construction of new water supply systems is carried out through 4 civil contracts, which are given in the table below. 10 4. NCB- CW-05- P5 in Vose district Water supply system in Pyanj district of Namuna district ,59 USD 13 October December 2018 CC «Behbudi» 1. Visits to project locations 18. Regular projects sites investigations conducted by multidisciplinary team of KMK including social and environmental specialists. Purpose of these visits are to ensure timely implementation of project activities as per scheduled tasks and ensure that contractor follows ADB Safeguards Policy Statement requirements. As per project team information and site observations there was no negative social and environmental impact on communities lands, livelihoods and properties. Ongoing projects did not effect commujnities lands, asssets and sources of livelihoods as al works wre continued in the designated territories of the water supply systems and allocated lands by the project. 2. Climate-proof water supply systems in Kulyab district" 19. The "Climate-proof water supply systems in Kulyab district" Dahana and Ziraki jamoats sub-project is ongoing. During the construction and rehabilitation works in this site, there was no negative environmental impact on the soils of the project areas (land) or negative impact on the livelihoods of the people living in the villages of Zerkala and Khocha Isok of Ziraki jamoat in Kulyab district, in Bahoriston, Gulrez, Kamar, Chanor and Yokhsuchiyon villages of Dahana jamoat in Kulyab district. 20. In August 2017, the Chairman of of Dahana jamoat addressed an appeal on rehabilitation of the bridge part across the river after the completion of works. Based on the results of this application, KMK instructed Consultants to supervise the execution of this obligation by the Contractor, to restore the dismantled part of the pedestrian bridge after the completion of the construction. The bridge was dismantled in February Reinstallation of the bridge will take place in September Also. Below are given the records of verbal application by the members of the community on the rehabilitation of streets after construction, in particular after the laying of pipelines. 6

11 3. Climate-proof water supply systems in Vose district Tugarak subproject" 21. Sub-projects in Tugrak and Rudaki jamoats of Vose district construction works continued in this reporting period. Expected completion dates of the construction works is between May to October For all the time of construction and rehabilitation works to date, there has been no negative impact on the livelihoods of the population living in Ibrat, Navbahor, Tugarak villages of Tugarak Jamoat, except for temporary inconveniences (noise, dust) during the construction period, there are no questions regarding land allocation and resettlement. 22. The contract for water system in Rudaki Jamoat of Vose district was signed and it is expected to be completed in August During the entire period of construction and rehabilitation work to date, in this area, there was no negative environmental impact on the soils of the project areas (land) or Negative impact on the livelihoods of the population living in the village of Anoriston. For the exception of temporary inconveniences (noise, dust) during the construction period, there are no questions regarding land allocation and relocation. A request of the Chairman of Vose district was received from the Hukumat of Vose district regarding this site. Based on the results of this appeal, KMK instructed the Consultants to revise the Master Plan of the construction site and to fulfill this obligation in accordance with the proposals of the Chairman of Vose district. 4. "Climate-proof water supply systems in Pyanj district of Namuna jamoat. 23. Contract NCB-CW-05-Р5 "Climate-proof water supply system in Pyanj district» (water supply of Namuna jamoat) water supply in the Kommunism was concluded in 13 October Expected completion dates of the contract - December Since the commencement of construction and rehabilitation work up to date in this site, there has been no negative environmental impact on the soil of the project areas (land) or negative impact on the livelihoods of the population living in Kommunism. 7

For the exception of temporary inconveniences (noise, dust) during the construction period, issues regarding land allocation and resettlement have been resolved prior the signing of the Contract. C. Effectiveness of Land Acquisition and Resettlement Planning 25. Based on the due diligence and proper surveys, including the analysis of the final detailed engineering design, discussions with the Engineers team, site visits and consultations with stakeholders, the result of the survey was prepared and presented: 26. The conformity of social safeguards and gender mainstreaming in the design and implementation of project activities included in the proper process of land allocation and resettlement, consultations at subproject sites with communities and other key stakeholders, preparation on implementation of safeguards principles and social guarantees, gender issues and developing and conducting training for key stakeholders in the implementation process. For all three subprojects in the districts of Kulyab, Vose and Pyanj, a report was prepared on assessing the state of land and resettlement. To ensure compliance with social guarantees and gender mainstreaming in subproject activities, implementation guidelines were developed, including social impact assessments, preparation of a land acquisition and resettlement plan, the implementation of the Gender Action Plan adopted for the project, and social mobilization to improve water supply management. For PIG-KMK, district water utilities, district hukumat and jamoats, two rounds of training on social safeguards and gender issues were completed. 5. Land allocation 27. The subproject, basically, includes the rehabilitation of the existing infrastructure, with some new facilities located in riverbeds. Construction work will be carried out within existing land borders or on them. Sub-projects do not require the withdrawal of private land in accordance with the packages of contracts (except for the Pyanj subproject) mentioned in the report, subsequently, sub-projects will not entail the impact of involuntary resettlement. The offered land plots for storing construction materials are used barren land.subprojects do not have any impact on the holders of rights (land) for the reasons described above. D. Temporary Disturbance of the Common Rights 28. Although the project does not mean land allocation and / or Involuntary resettlement, (except sub-project Water supply system in Pyanj district of Namuna jamoat), there may be a temporary disturbance of order caused by construction work (See Annex 1.) 29. Earth works, transportation of construction materials through populated areas, and / or mobilization of heavy machinery and equipment for construction sites, where appropriate, limited access to agricultural land adjacent to construction sites, etc., may cause temporary inconvenience to local of the inhabitants. 30. In Vose, Kulyab and Pyanj district, construction works and / or transportation of construction materials, including from quarries, could potentially cause temporary disturbance in 8

13 neighboring villages. This is especially true for places where construction transport will travel through villages (for example, in the village of Ibrat, Vose district, etc.). E. Grievance Redress Mechanism 31. Regardless of whether there is no a land acquisition or resettlement of local communities living in the area, when construction work is carried out, some unfavorable consequences may occur during the construction period, such as property damage or losses caused by direct physical exposure to the equipment of the contractor, vibration, design of the contractor or employer, or because of other activities related to construction. Communities can submit complaints through the grievance mechanism established for the project over its duration and used to address environmental issues and resettlement. To resolve these issues for each jamoat were prepared complaints logs. 32. The steps and actions below describe the process of receiving and addressing the complaints and grievances within this project: - Step 1: Complaints will be lodged at the jamoat level, where all the relevant representatives (land and environmental specialists, deputy jamoat chairperson, responsible for gender policy, Jamoat Resource Center representatives), representatives of the affected households and EA/PIO, will attempt to resolve the issue. Each complaint will be registered, signed by the affected person and a representative of the Grievance Redress Committee (GRC), and the receipt of the complaint given to the affected person. The period for resolution of complaints is 14 calendar days the latest. - Step 2: If the complaint cannot be addressed at jamoat level, affected person can apply to the district level GRC for a solution, with assistance from GRC as needed. The district level committee should invite KMKI/PIO representative once they registered the complaint. Similar to jamoat level, district level committee will register and file all the complaints from the complainants. The period for resolution of a complaint is 16 calendar days. - Step 3: If no solution is reached within 16 days, the affected person can submit her/his case to the appropriate court of law, with all costs paid for by the project. 33. In the event when the established GRM is not in a position to resolve the issue, affected person also can directly contact ADB Tajikistan Resident Mission (TJRM). Contacts of local ADB TJRM social safeguards focal point is circulated among the local communities during the consultation meetings at the detailed design stage. 34. Grievance Redress Committee (GRC) is established at the relevant jamoat level in each relevant district to resolve complaints and grievances informally through community participation. The jamoat GRC consist of representatives of the PIG, PIO, local hukumat, local GWU members, women GWU members, and appropriate local NGOs to ensure a participatory decision-making process. 35. The grievance registration logbooks are kept in Jamoats, in particular for the site Vose - in Tugarak jamoat, in Rudaki jamoat (Anoriston), Ziraki and Dahana Jamoats in Kulyab and in Namuna jamoat of Pyanj district. 9

Persons who affected by the project will be provided with voucher forms for appeals so that they can register a complaint and then file a copy of the registered complaint further to its full resolution. 37. The process for resolving complaints is defined as follows: (i) Complaints will be first addressed to the jamoat level through GRC, where there is a representative of the local government and district authorities, the contractor, the IA, and the applicant will strive to resolve the issue as quickly and effectively as possible. If the complaint is not resolved within 14 days of the appeal, the complainant will file a complaint with the GRM / LARD Commission at the district level; (ii) KMK at the district level, together with a representative of the local authority, the contractor and other relevant stakeholders, will strive properly resolve the issue (s) or complaint raised. The elected representatives of the affected party will have the opportunity to mediate, if the person affected by the project decides so. If the decision is not reached within 16 days, the parties affected by the project may additionally present their case to the appropriate court; (iii) If the complaint is resolved, the case is closed and this will be reflected in the complaint log accordingly. If the decision is not found at the district level, then the person affected by the project can apply to the court. GRM, however, does not limit the rights of victims to trial directly from the very first Step, bypassing the GR mechanism. F. Conclusion and Recommendations I. Due review of sub-projects is carried out based on detailed technical drawings, field visits, and consultations with a group of engineers, with PMO offices at the central and local levels, as well as with end-users of sub-projects. II. The results of proper survey and due diligence assume that none of the subprojects listed in the stipulated contract packages will cause land allocation and / or involuntary resettlement. Rehabilitation / construction of sub-projects will take place within the existing land 14

19 plot / allotment and / or on the lands of the state land reserve, and thus there is no need for the allocation of land in private ownership / use. III. Manual labor was used in the process of construction work on special sections of some subprojects with a complex terrain and difficult access for a heavy technician to avoid impact on the land near construction sites, creating a passage for the mobilization of equipment. It was decided to apply manual labor. These measures prevented the project from affecting the land plots of the communities. Members of local communities were hired to perform such jobs as the replacement of pipelines, storage of construction materials, etc. The communities supported this practice, as the project eliminated some possible project impacts and created opportunities for the benefit of the local population. IV. The construction works will be limited by the existing target areas / outlets and will not lead to violations of the usual order, and even if violations of order take place, they will be minimal. Nevertheless, in order to mitigate even the minimal potential violations of the usual order, in order to reduce their effects, the following measures are envisaged: - Informing all residents, local households about the duration of work through jamoats and mahalla leaders; - Provision of temporary access through trenches for pedestrians and metal sheets where vehicle access is required; - Increase the workforce and use the appropriate equipment to complete the work in the shortest possible time in these areas, where appropriate; - If and when the water supply is disrupted (both drinking and irrigation), inform people through jamoats and mahalla leaders in advance, and provide an alternative source for the entire period of lack of water supply / disturbance. - The contractor must first ensure proper access to housing and business (if any), so that the effect of temporary breach of order during construction is minimal. Provisions and alternatives should be discussed with a group of engineers. V. If and when the contractor needs land on a temporary basis, the rent must be agreed between the contractor and the owner of the land, (the owner of the land use rights) on the basis of mutually agreed terms and on the basis of loss of income by the land owner / secondary land user / tenant during the period of its use contractor. VI. After completion of the work, the land that was temporarily used should be restored in its former condition to the project and returned to the owner / user with mutual settlements based on the contract. VII. One of the conditions for the final payment of construction works to contractors is the submission of supporting documents and certificates that all the temporarily used lands have been fully restored and brought to the state prior to the start of the project and that there are no unresolved issues of compensation related to temporary land use. VIII. During construction, all necessary measures must be taken to avoid temporary impacts such as loss of access leading to livelihoods or any other types of restrictions mentioned above. The PMO will closely monitor the implementation phase to ensure compliance with ADB's social security measures, as well as national legislation. The PMO monitoring and evaluation specialist will conduct regular internal monitoring, and their results will be reflected in the progress reports to be submitted to ADB. 15

20 IX. During the implementation of the project, any complaints from the local population will be considered through grievance redress mechanism established within the framework of the project and applied to both social and environmental protective measures. X. If any unforeseen impacts or additional consequences are identified during the course of the project, KMK / PMU will prepare the LARP in accordance with the LARF and the ADB Regulation on Safeguard Policies 2009, as well as relevant national legislation. Until such planning documents are formulated, uncovered and approved (by ADB), PMU will not start implementing specific sub-projects in which the consequences of involuntary / involuntary resettlement have been identified. G. Awareness of population 38. Local consultants (NGO Znanie) conducted a number of trainings (seminars) on the legal aspects of water resources management at the on-farm level in the Kulyab and Vose districts as part of the "Building climate resilience in Pyanj river basin" project Fig.1. 22 Fig.4 Training fragments in Pyanj district 6-7 October Attention was paid to socially vulnerable groups and women, during conducting of all trainings (workshops). In pilot districts, these groups experience social exclusion at the local level. Therefore, mostly the meetings with women were held in jamoats in good rooms, where they felt comfortable and confident. During the conversations, the trainer mainly sought to awaken a sense of confidence in women in the future and tried to identify local gender problems. H. Conclusion 40. In accordance with paragraph 143 of the PAM, KMK should conduct interviews with project beneficiaries to confirm (i) their perception of improved access to water (in accordance with the target of the Framework and Monitoring Matrix (FMM)) and (ii) training sessions and consultations were provided to the appropriate Time (in accordance with the goal of the Gender Action Plan). KMK has requested proposals from companies conducting such surveys to conduct annual surveys in order to confirm the results. However, the presented quotations exceeded the expected balance of funds in the project, thereby delaying the signing of the contract. Considering that the progress of KMK construction works at some facilities is behind the schedule and the increase in water supply services is not yet observed, it was decided that the hiring of the survey firm will be postponed to the middle of 2018, when the situation with the available budget will be more clear, after the redistribution of funds, taking into account additional work. 18
