3 Reason: For the avoidance of doubt and in the interests of proper planning and so as to ensure that the development is carried out fully in accordance with the plans as assessed in accordance with Policies CS NPPF and CS1 of the Local Plan Core Strategy DPD (2012) and Policy DM01 of the Local Plan Development Management Policies DPD (2012). Highways, Access and Traffic 3. Prior to the operation of the development hereby permitted a Servicing and Delivery Strategy shall be submitted to and approved in writing by the Local Planning Authority. This Servicing and Delivery Strategy shall include an enforceable route management strategy relating to the routing of Heavy Goods Vehicles (any vehicle over 3.5 tonnes unladen weight) and other vehicles to and from the Site. The Servicing and Delivery Strategy shall be implemented as approved throughout the duration of the development. Reason: To ensure that the development does not cause danger and inconvenience to users of the adjoining pavement and highway; and, insofar as is practicable, to ensure that vehicles remain on the Strategic Road Network (SRN) and Transport for London Road Network (TLRN) to minimise congestion and highway safety on local roads in accordance with Policy DM17 of the Local Plan Development Management Policies DPD (2012) and Policy 6.3 of the London Plan (2016). 4. The development hereby permitted shall be carried out in accordance with the document titled Construction Transport Management Plan: Brent Cross GTR Compound & Accommodation Works (prepared by Galliford Try & Network Rail version 006, dated 23/08/18) throughout the duration of construction phase. Reason: To ensure that the proposed development does not prejudice the amenities of occupiers of adjoining residential properties in accordance with policy DM04 of the Development Management Policies DPD (adopted September 2012); to minimise traffic congestion associated with the proposed development in accordance with Policy 6.14 of the London Plan (2016); and to accord with the Mayor of London s The Control of Dust and Emissions During Construction and Demolition SPG (2014). 5. Prior to the delivery of the GTR Accommodation and EMT Fuel Farm Accommodation units to the Site, a Supplemental Construction Traffic Management Plan shall be submitted to and approved in writing by the Local Planning Authority. This Supplemental Construction Traffic Management Plan shall, as a minimum, include manoeuvring tracks of the size of the transporting vehicles to be used, number of vehicles required, times of deliveries and any highway traffic management orders that may be required to enable vehicle turning and passage on local roads. The Supplemental Construction Traffic Management Plan shall thereafter be implemented as approved for the delivery of the GTR Accommodation and EMT Fuel Farm Accommodation units. Reason: To minimise traffic congestion associated with the proposed development in accordance with Policy 6.14 of the London Plan (2016); and to accord with the Mayor of

4 London s The Control of Dust and Emissions During Construction and Demolition SPG (2014). 6. Within three months of occupation of the development a full Travel Plan shall be submitted to and approved in writing by the Local Planning Authority. The Travel Plan shall include, but not be limited to, surveys of staff modes of travel, objectives, targets and a monitoring regime. The approved Travel Plan shall be updated within 6 months of approval pursuant to this Condition and then annually thereafter. The Travel Plan (and any update to it) shall be implemented as approved for the duration of the development hereby permitted. Reason: To encourage the use of sustainable forms of transport to the Site in accordance with Policy CS9 of the Local Plan Core Strategy DPD (2012) and Policy DM17 of the Local Plan Development Management Policies DPD (2012). Environmental Controls 7. The permitted hours of construction work and/or site engineering and preparation works shall be: a) 08:00 to 18:00 Mondays to Fridays; and b) 08:00 to 15:00 Saturdays. No construction work and/or site engineering and preparation works shall be carried out on Sundays or Bank Holidays. No construction work and/or site engineering and preparation works shall be carried out outside these specified permitted hours without the written consent of the Local Planning Authority. Reason: To ensure that the proposed development does not prejudice the enjoyment of the occupiers of their homes in accordance with Policy DM04 of the Local Plan Development Management Policies DPD (2012) and Policy 7.15 of the London Plan (2016). 8. Prior to the commencement of the development other than the erection of any means of temporary enclosure or security hoarding a Construction Environmental Management Plan ( CEMP ) shall be submitted to and approved in writing by the Local Planning Authority. The Construction Environmental Management Plan shall include, but not be limited to, the following: a) A detailed programme of works; b) A statement of the construction method(s); c) Hours of construction including deliveries and the loading and unloading of plant and materials; d) Access arrangements; e) Location of parking for site operatives and visitors;

5 f) Details relating to the storage of plant and materials to be used in the construction of the development; g) Details of the piling method(s) to be used; h) Details of the Best Practicable Means to be employed during all construction activities; i) Measures to prevent any light spill beyond the Site boundary; j) Measures to prevent mud and debris being carried onto the public highway; k) Measures to minimise dust, noise and vibration pollution; and l) Details of a resident liaison and communication strategy. Reason: To ensure that the proposed development does not prejudice the amenities of occupiers of adjoining residential properties in accordance with policy DM04 of the Local Plan Development Management Policies DPD (2012); and to accord with the Mayor of London's The Control of Dust and Emissions During Construction and Demolition SPG (2014). 9. The free field LAeq,T level of noise emitted from the development from any new fixed plant, vehicles, equipment or noise generated within the buildings or externally on site shall not exceed 5dB below existing LA90,T, when measured outside the nearest habitable room at the nearest noise sensitive receptor (where T is a 15 minute period during the night-time and 1 hour period during the daytime). If the noise emitted from any fixed plant has a distinguishable, discrete continuous note (whine, hiss, screech, hum tone) that are not present in the existing environment, then the noise level generated shall be at least 10dB(A) below the background level. Noise levels shall be as measured from any point 1 metre outside the window of any habitable room of a neighbouring noise sensitive receptor. Existing background noise levels used for comparison shall be as reported in the Planning Application. Reason: To ensure that the proposed development does not prejudice the enjoyment of the occupiers of their homes in accordance with Policy DM04 of the Local Plan Development Management Policies DPD (2012) and Policy 7.15 of the London Plan (2016). 10. Prior to the installation of any fixed mechanical plant required in connection with the development hereby permitted a report shall be carried out by a competent acoustic consultant that assesses the likely noise impacts from that plant and identifies necessary mitigation measures to reduce any noise impacts to the levels stipulated by Condition 9. The report shall include all calculations and baseline data, and be set out so that the Local Planning Authority can fully audit the report and critically analyse its content and recommendations. The report shall be submitted to and approved in writing by the Local Planning Authority and implemented in its entirety prior to the first occupation of the GTR Accommodation Unit and retained as such thereafter. Reason: To ensure that the proposed development does not prejudice the amenities of occupiers of neighbouring properties in accordance with Policy DM04 of the Local

6 Plan Development Management Policies DPD (2012), the Council s Sustainable Design and Construction SPD (2013) and Policy 7.15 of the London Plan (2016). 11. All Non Road Mobile Machinery (NRMM) of net power of 37kW and up to and including 560kW used during the course of the demolition, site preparation and construction phases shall comply with the emission standards set out in Chapter 7 of the Mayor of London s Supplementary Planning Guidance ( SPG ) Control of Dust and Emissions During Construction and Demolition (July 2014), or subsequent guidance as applicable at that time. Unless it complies with the standards set out in this SPG (or other subsequent guidance), no NRMM shall be on Site at any time, whether in use or not, without the prior written consent of the Local Planning Authority. The developer shall keep an up to date list of all NRMM used during the demolition, site preparation and construction phases of the development on the online register at Reasons: In the interests of good air quality with regard to Policies 5.3 and 7.14 of the London Plan (2016). 12. Heavy Goods Vehicles (HGVs) (any vehicle over 3.5 tonnes unladen weight) shall not be permitted to idle while on Site and all HGVs operating in association with the construction and operation of the development hereby permitted shall be Euro VI Standard (or equivalent) as a minimum. Reason: To ensure that the development does not prejudice the amenities of occupiers of adjoining residential properties in accordance with Policy DM04 of the Local Plan Development Management Policies DPD (2012). Land Contamination 13. Prior to the commencement of any remediation works other than for investigative works: a) A Method Statement detailing the remediation requirements using the information obtained from the site investigation, including that contained within Chapter 13 of the Supplementary Environmental Statement (Volume 1) Brent Cross Cricklewood: Midland Mainline Train Stabling Facility Sidings Compound (Capita, document reference CS095428/Env/001 (Version 1), dated August 2018) and Applicant s correspondence dated 13 th November 2018, and also detailing any post remedial monitoring shall be submitted to and approved in writing by the Local Planning Authority prior to any remediation works being carried out on site. b) Where remediation of contamination on the Site is required, completion of the remediation works detailed within the approved Method Statement shall be carried out and a report that provides verification that the required works have been carried out, shall be submitted to and approved in writing by the Local Planning Authority before the development is first occupied. Reason: To ensure the development can be implemented and occupied with adequate regard for environmental and public safety in accordance with Policy CS NPPF of the

7 Local Plan Core Strategy DPD (2012), DM04 of the Local Plan Development Management Policies DPD (2012), the Council s Sustainable Design and Construction SPD (2013) and Policy 5.21 of the London Plan (2016). Water Environment 14. The development hereby permitted shall be carried out in accordance with the drainage scheme identified on drawing no. BXT-CAP-0500-B-DR-D-0032 Rev. P02 and described within Chapter 10 of the Supplementary Environmental Statement (Volume 1) Brent Cross Cricklewood: Midland Mainline Train Stabling Facility Sidings Compound (Capita, document reference CS095428/Env/001 (Version 1), dated August 2018) and Brent Cross Railway Sidings Drop-in 1 Compound Development: Surface Water Calculations Technical Note (document reference CS BXRS- CAP-00-XX-D1-01 (Revision P01), dated November 2018). Reason: To ensure the development can be implemented and occupied with adequate regard for environmental and public safety in accordance with Policy CS NPPF of the Local Plan Core Strategy DPD (2012), DM04 of the Local Plan Development Management Policies DPD (2012), the Sustainable Design and Construction SPD (April 2013) and Policies 5.13, 5.14 and 5.15 of the London Plan (2016). 15. Prior to the installation of any fuel tanks, details relating to the design and capacity of the fuel tanks to be located within the site shall be submitted to and approved in writing by the Local Planning Authority. Fuel tanks to be installed at the site shall thereafter accord with the approved details. All fuels and oils shall be secured within a bunded area and the secondary containment system must provide storage for at least 110% of the tank's maximum capacity. Reason: To ensure the development can be implemented and occupied with adequate regard for environmental and public safety in accordance with Policy CS NPPF of the Local Plan Core Strategy DPD (2012), DM04 of the Local Plan Development Management Policies DPD (2012), the Sustainable Design and Construction SPD (2013) and Policy 5.21 of the London Plan (2016). Biodiversity and Tree Protection 16. Prior to the commencement of the development details of the tree protection measures to be implemented to safeguard the existing semi-natural broad-leaved woodland between the development and Brent Terrace shall be submitted to and approved in writing by the Local Planning Authority. The approved protection measures shall thereafter be implemented in their entirety throughout the duration of the construction works and operation of the development hereby permitted. Reason: To protect the tree and vegetation corridor which is identified as a Priority Habitat and Core Sustenance Zone for protected species in accordance with Policy CS7 of the Local Plan Core Strategy DPD (2012), Policy DM16 of the Local Plan Development Management Policies DPD (2012), and Policies 7.19 and 7.21 of the London Plan (2016).

Prior to the erection of any external lighting to be affixed to the GTR Accommodation Unit and/or EMT Accommodation Unit detailed lighting designs including any measures to prevent light spill shall be submitted to and approved in writing by the Local Planning Authority. The lighting designs shall thereafter be implemented as approved for the duration of the development. Reason: To ensure the development does not adversely affect protected species utilising the identified Priority Habitat and Core Sustenance Zone in accordance with Policy CS7 of the Local Plan Core Strategy DPD (2012), Policy DM16 of the Local Plan Development Management Policies DPD (2012), and Policy 7.19 of the London Plan (2016); and to ensure that the proposed development does not prejudice the enjoyment of the occupiers of their homes in accordance with Policy DM04 of the Local Plan Development Management Policies DPD (2012) and Policy 7.15 of the London Plan (2016). 18. Clearance of any Open Mosaic Habitat and/or other vegetation clearance shall be carried out exercising a precautionary method of working including the removal of vegetation by hand and under the supervision of a suitably qualified ecologist. Reason: To ensure that protected species are appropriately safeguarded during the construction phase of the development in accordance with Policy CS7 of the Core Strategy DPD (2012), Policy DM16 of the Development Management Policies DPD (2012) and Policy 7.19 of the London Plan (2016).

9 DRAFT INFORMATIVES A. In accordance with paragraph 38 of the NPPF, the Local Planning Authority (LPA) has taken a positive, proactive and creative approach to development proposals, being focused on finding solutions. The LPA has produced planning policies and written guidance to assist applicants when submitting planning applications. These are all available on the Council s website. A pre-application advice service is also offered and the Applicant engaged with this prior to the submission of this application. The LPA has negotiated with the applicant/agent where necessary during the application process to ensure that the proposed development is in accordance with the Development Plan. B. In relation to Condition 10 of this planning permission, the applicant is advised to engage a qualified acoustic consultant to advise on the scheme, including the specifications of any materials, construction, fittings and equipment necessary to achieve satisfactory internal noise levels in this location. The details of acoustic consultants can be obtained from the following contacts: a) Institute of Acoustics and b) Association of Noise Consultants. The assessment and report on the noise impacts of a development should use methods of measurement, calculation, prediction and assessment of noise levels and impacts that comply with the following standards, where appropriate: i) BS 7445(2003) Pt 1, BS7445 (1991) Pts 2 & 3 - Description and measurement of environmental noise; ii) BS 4142: Method for rating industrial noise affecting mixed residential and industrial areas; iii) BS 8223: 2014 Guidance on sound insulation and noise reduction for buildings: code of practice; iv) Department of Transport: Calculation of road traffic noise (1988); v) Department of Transport: Calculation of railway noise (1995); vi) National Planning Policy Framework (2018)/ National Planning Policy Guidance (2014) C. To carry out any construction works outside the hours stipulated by Condition 7 of this planning permission, including any such works after 15:00 on Saturdays, the Applicant will be required obtain consent under Section 61 of the Control of Pollution Act If construction works are planned outside the hours stipulated by Condition 7 of this planning permission, you are advised to contact the Council s Scientific Services Environmental Health Team at: Department of Development and Regulatory Services, London Borough of Barnet, Barnet House, 1255 High Road, Whetstone, N20 0EJ.
