2 ADDEUM 2 December 7, 2012 Page 2 Questions / Answers 1. The drawings provided are not for construction. When can we expect the drawings for construction? The drawing description on the website has been corrected. References to not for construction have been deleted. 2. The structural work on columns has already been done. We were informed that that is not part of the current ITB. Please clarify. Website reference to platform building is not part of this project. 3. Please confirm if the electrical and communication work, as shown in a separate electrical plan, is part of this contract? Website reference to electrical communication work is not part of this project. 4. Has asbestos survey done? See attached Appendix II, Pre-Demolition Asbestos-Containing Building Materials Survey Report. 5. Has lead survey done? See attached Appendix II, Pre-Demolition Asbestos-Containing Building Materials Survey Report. 6. Who is responsible for moving the stuff from the building to be demolished? There were some locked rooms. The owner shall remove miscellaneous storage items prior to start up of construction work. 7. Currently all the people around were seen using the restroom facility within the building that is to be demolished. Is it contractor s responsibility to provide temporary facility? If so, how many? Should the facility be ADA compliant? Contractor is not responsible for temporary restrooms for restaurant. 8. Current plans do not have any civil drawings. What is government s intent once the building is demolished (i.e., leave site as is, sod it, etc.)? Who is responsible for designing the grading plan for the area of the demolished building? There seems to be a storm drainage structure in the vicinity of the building. Sheet Al01 has been added to the documents. Please review. Basically, the site shall be leveled off and prepared for grass seeding. 9. Will the restaurant remain open during the demolition and construction? Yes.

The owner shall remove antenna not being used. 11. Who is responsible for removal of the flagpole? General contractor shall remove flagpole. 12. Who is responsible for moving or relocating the mailboxes? Drawings don t show any plans for relocation. Owner shall relocate mailboxes. 13. There are no drawings showing the depth of existing foundation. We are assuming them to be deep. Please clarify if this is valid assumption. This would be a valid assumption. 14. What is the construction budget for this Project? Per page 9 of the Invitation to Bid, the estimated budget is $120, When is the anticipated Project start date? Early Under whose Jurisdiction does the permitting fall under (state, city, municipality, etc.)? City of Pompano Beach 17. Have the construction drawings been approved? Plans shall be submitted by awarded contractor to the City of Pompano. 18. Is there a permitting process number available? If not, can an allowance for permitting fees be established? No allowance for permitting has been established. 19. Will the owner reimburse any permitting fees? Permit fees to be included in bid. 20. Other than FPL, are there any additional utility companies necessary to coordinate with? Contractor is responsible to verify coordination with all project associated utility companies 21. Has there been an Asbestos Study on the existing structure? See attached Appendix II, Pre-Demolition Asbestos-Containing Building Materials Survey Report

Is Builders Risk required? Yes. 26. What will be the allowable working hours and days? No restrictions by FDACS on working hours/days. Awarded general contractor shall provide schedule. 27. Has there been a determined staging area for materials and waste? To be determined after contract is awarded. 28. Has there been a determined parking area for construction crews? Construction crew parking is available next to the site. 29. At what location will site access be allowed for deliveries and employees? Main entrance will be accessible. 30. Are there any noise restrictions? Contractor will need to verify regulations with City of Pompano Website provided: ftp://ftp.cphengineers.com as per addendum No. 1 dated November 19, 2012; there is a titled Structural Sheet: Column Restoration Work for the Platform Building. Please advise if this structural sheet is within the bid scope? This contract does not include work on platform building. To the extent this Addendum gives rise to a protest, failure to file a protest within the time prescribed in Section (3), Florida Statutes, shall constitute a waiver of proceedings under Chapter 120, Florida Statutes. (TCG) was contracted by the Florida Department of Agriculture and Consumer Services to perform a pre-demolition asbestos-containing materials (ACM) survey for the following location using the protocol established in US EPA 40 CFR 763 Subpart E, AHERA (Asbestos Hazard Emergency Response Act): Pompano State Farmers Market (north of existing restaurant) 1257 West Atlantic Boulevard Pompano Beach, FL The purpose of this inspection is to determine if asbestos-containing materials are present within the facility per the requirements set forth in 40 CFR 61 U.S. EPA NESHAP (National Emission Standards for Hazardous Air Pollutants) for asbestos impacted during planned demolition activities. The following materials were identified as asbestos-containing material (ACM): 9 x 9 Tan Vinyl Floor Tile & Black Mastic 9 x 9 Brown Vinyl Floor Tile & Black Mastic 9 x 9 Green-Gray Vinyl Floor Tile & Black Mastic SURVEY RESULTS Suspect materials were identified and sampled per 40 CFR 763 Subpart E (Asbestos Hazard Emergency Response Act) on November 29, Twenty-six (26) samples of suspect materials were collected by AHERA inspector Thomas Knox and analyzed using Polarized Light Microscopy per 40 CFR 763 Subpart E, by EMLab P&K, LLC (Fort Lauderdale, FL), a National Voluntary Laboratory Accreditation Program (NVLAP) accredited laboratory. A sample location diagram and representative photographs are included in Appendix A, and laboratory analytical results with chain of custody documentation are provided in Appendix B of this report. MATERIAL ASSESSMENT & RECOMMEATIONS The following building materials were confirmed to contain asbestos: 9 x 9 Tan Vinyl Floor Tile & Black Mastic 9 x 9 Brown Vinyl Floor Tile & Black Mastic 9 x 9 Green-Gray Vinyl Floor Tile & Black Mastic These flooring materials were observed in damaged to good condition and are presently classified as non-friable Category I ACM. If the materials are impacted by demolition, they do not necessarily require abatement prior to demolition and the building may be demolished with the materials in-place. However, vinyl floor tile may become friable during abatement or demolition, especially if the removal methods include sanding, grinding, cutting, or abrading, etc. that causes the asbestos-containing tiles to become crumbled, pulverized, or reduced to powder and, therefore, reclassified as Regulated Asbestos-Containing Material (RACM). RACM does require abatement prior to demolition. The demolition contractor must always abide by OSHA regulations pertaining to asbestos exposure. The contractor and owner must abide by all notification requirements (10 business work-day notification) set forth in 40 CFR 61 U.S. EPA NESHAP (National Emission Standards for Hazardous Air Pollutants) regarding planned renovations and demolitions. The owner/operator of the facility is responsible to submit notification. The owner should also consider ACM removal prior to demolition in order to reduce special handling of construction debris that will otherwise become mixed with ACM. Additional waste manifest requirements and disposal costs are expected for mixed debris. If abatement is selected, TCG recommends that a removal specification be prepared. Contractor adherence to the specification should be verified by licensed asbestos consultant such as TCG. [3]

10 Project # / Florida Department of Agriculture and Consumer Services LIMITATIONS This survey was based on the accessible areas specified for demolition in the plans identified as sheets AD101 & AD201 of CPH Engineers, Inc plans dated The survey does not include any other structures on or within the subject property. The survey does not include the existing restaurant located on the south side of the subject building that is not planned for demolition. This report is limited to: Pompano State Farmers Market (north of existing restaurant) 1257 West Atlantic Boulevard Pompano Beach, FL The results, conclusions, and recommendations in this report pertain to conditions observed at the time of inspection. Some asbestos-containing material (ACM) may not have been found due to material inaccessibility. Interstitial spaces (between walls and floors) may contain ACM. Any suspect materials encountered which are not included or addressed in this report must be sampled or otherwise assumed to be ACM. TCGI conducted and prepared this survey in accordance with industry standards. No other warranty expressed or implied is made. This document is not a removal specification and should not be used for bidding purposes without the abatement contractor confirming all quantities in the field. All quantities are estimates. [4]
