1 BOARD OF COUNTY COMMISSIONERS SARPY COUNTY, NEBRASKA RESOLUTION FLOOD PLAIN DEVELOPMENT Cornerstone Storage LLC, 8787 S 192 nd Street, (Lot 1, Red Addition) Sarpy County, NE WHEREAS, pursuant to Neb. Rev. Stat , the County has the power to do all acts in relation to the concerns of the County necessary to the exercise of its corporate powers; and, WHEREAS, pursuant to Neb. Rev. Stat , the powers of the County as a body are exercised by the County Board; and, WHEREAS, the County Board of Commissioners has the authority to adopt a Zoning Regulation, which shall have the force and effect of law pursuant to Neb. Rev. Stat.' ; and, WHEREAS, said Zoning Regulations require the County Board of Commissioners to approve applications for development permits within any Flood Plain District; and WHEREAS, pursuant to Resolutions and , the County Board of Commissioners approved a Special Use Permit for a mini-storage facility along with outdoor storage for Cornerstone Storage LLC; and, WHEREAS, Mr. Ryan Steele of Cornerstone Storage LLC has applied for a Flood Plain Development permit to construct commercial structures to be used for a convenience storage facility 8787 S 192 nd Street, Lot 1, Red Addition, Sarpy County; and, WHEREAS, the Sarpy County Planning Department staff reviewed the application for a Flood Plain Development Permit for compliance with the Zoning Regulations on said property; and, WHEREAS, said application is in compliance with Resolutions and and Section 30, Flood Plain District of the Zoning Regulations and further, the Natural Resources District has no objection to the flood plain development permit; and, WHEREAS, the Planning Department staff made a recommendation of approval as noted in the attached Exhibit A, which Exhibit A includes the Planning Department report and the Natural Resources District comments. NOW, THEREFORE, BE IT RESOLVED BY THE SARPY COUNTY BOARD OF COMMISSIONERS THAT the Flood Plain Development Permit Application for the property described in the attached Exhibit A is hereby approved subject to the following conditions: 1. All construction shall be in compliance with the Sarpy County Zoning Regulations and the Sarpy County Building Codes. 2. Upon completion of construction, an elevation certificate must be submitted to the Sarpy County Planning Department to verify the structure was built according to plans. The above Resolution was approved by a vote of the Sarpy County Board of Commissioners at a public meeting duly held in accordance with applicable law on the 17th day of October Attest SEAL Sarpy County Board Chairman County Clerk

Comprehensive Development Plan The Sarpy County Development Structure Plan (Future Land Use Map) designates this area as Mixed Use Center. Zoning / Floodplain Regulations The area is zoned IL-FP (Light Industrial - Floodplain) The property is located in an AE Flood Zone adjacent to South Papillion Creek/Crystal Creek. (see attached map). A Flood Plain Development Permit was previously approved for the placement of fill and grading on this site. This application is for the construction of the improvements and structures as proposed by his Special Use Permit approved by a Resolution The Base Flood Elevation (BFE) determined at this location ranges from to (NAVD 1988). The building plans indicate that the structures will be built at a minimum elevation of at least one foot above the base flood elevation for each structure on the site. Natural Resources District This Papio Missouri River Natural Resources District (NRD) has no objections to the proposed application. The NRD recommendation letter is attached. Recommendation Staff has reviewed the submittal documents and for the reasons stated above, we recommend the Floodplain Development Permit be approved to construct commercial structures to be used for a convenience storage facility 8787 S 192 nd Street, Lot 1, Red Addition.
