1 Senior Manager Construction Consulting 420 Lexington Avenue, Suite 1740 New York, NY (212) tel Professional Profile Mr. Meyers advises construction clients on a variety of issues related to risk management, project controls, change management, project scheduling, contract review and assessments, change order negotiations, dispute avoidance, and the development or defense of construction claims. Mr. Meyers has over 12 years of experience in the construction industry, including significant dispute resolution and litigation support work. He has consulted on complex construction disputes involving delay and disruption, financial auditing and damages, contract termination, and project management. His experience includes the preparation of expert reports and presentations involving various aspects of dispute resolution, including arbitration, mediation, and litigation proceedings. Mr. Meyers specializes in delay analysis and critical path method scheduling to quantify delay and determine the causes of delay. Mr. Meyers has provided these services across a wide range of projects, including bridges, rail/transit, refineries, power plants, hotels, air/seaports, residential towers, LNG plants, commercial office buildings, educational facilities, golf courses, mines, manufacturing facilities, naval bases, nuclear fuel facilities, and shopping malls. His clients have included corporate entities, public agencies, contractors and subcontractors, architectural and engineering firms, and attorneys. Prior to joining Exponent, Mr. Meyers worked in the Construction Solutions practice for FTI Consulting. He also worked at Secretariat International where he advised clients on large international disputes for projects primarily throughout Europe, Asia, South America, and Australia. Mr. Meyers began his career as a project engineer for Austin Commercial and Webcor Builders on large scale commercial and residential projects. As a third-generation builder, his on-site construction experience includes project supervision, planning, cost estimating, and quality control. Nassau County Bar Association, New York, Project Experience Buildings & High-rise Residential: Authored expert reports, on behalf of the owner, to analyze the delays arising during the construction of a 37-floor luxury apartment high-rise in New York City. Shopping Mall: Provided claims support services, on behalf of the contractor, for a $290 million shopping mall and commercial office building complex in Doha, Qatar. Mixed-use: Conducted a fraud investigation and performed various construction audits, on behalf of an owner, for multiple high-rise buildings and interior fit-outs in New York City. The audit services included a review of contracts, change orders, job cost reports, labor records, invoices and purchase orders related to materials and other job costs, billings, and payment applications. Commercial: Provided advisory services for a construction bankruptcy case in New York City involving bonded and unbonded contracts for various commercial and residential buildings in various stages of completion. The services included an assessment of the financial costs, job cost reports, and payment applications. School: Performed schedule delay and cost analysis, on behalf of the owner, for a mediation involving the construction of a public school in New Jersey, USA. The analysis consisted of identifying critical impacts, assessing delay events, and determining prolongation costs. Mixed-use: Provided project management services involving the core and shell construction of a $160 million mixed-use 30-story condominium in downtown Los Angeles, California. Mr. Meyers reviewed contract documents, analyzed and negotiated change orders, reviewed submittals and issued RFIs, evaluated bids, prepared subcontracts, procured materials, and assisted field team with planning/scheduling. Mixed-use: Performed quality inspections and implemented a QA/QC program for subsequent retrofit work in excess of $50 million. The $100 million project encompassed nearly 700,000 SF in residential, office, retail, and parking garage space in Miami, Florida. 3 Residential: Provided pre-construction services including preparing project estimates, developing subcontractor bid packages, analyzing design documents for constructability, reviewing submittals, and issuing RFIs for a 35-story condominium in Miami, Florida. Transport Light Rail: Authored expert and rebuttal reports for an arbitration, on behalf of the contractor, to assess the delays to the construction of a $250 million streetcar maintenance and storage facility in Canada. Bridge: Authored a report and assessed schedule impacts involving the design and construction of a liftspan segmental bridge in the Northeast region of the United States. Findings were presented in an independent report for the purposes of a contractor's request for equitable adjustment. Bridge: Provided claims services, on behalf of a contractor, for delays related to the construction of a pedestrian bridge in New York City. The services included schedule review and delay analysis to assist the contractor with its claim submission to the owner. Highway: Evaluated contractor's claims for equitable adjustment arising from delays and disruption to the improvement of a highway in Washington State. The project included new paving, sidewalks, median construction, drainage improvements, structural retaining walls, utility undergrounding, traffic signals, and landscaping. Light Rail: Provided claims services, on behalf of the owner, for changes and delays impacting the design and construction of a $1 billion light rail project in the Washington D.C. metropolitan area. The services included various cost analyses related to design changes and the preparation of position papers to present at mediation and Dispute Review Board hearings. Also, performed a review of numerous contractor and subcontractor claims related to delays and damages and provided an independent evaluation and peer review of contractor's request for an extension of time and entitlement to costs associated with delays. Light Rail: Performed delay analysis for a dispute involving the construction of a new 800 metre connection track to link new maintenance and storage facility to the existing streetcar network in Toronto, Canada. The project largely involved subsurface construction work, such as upgrading sewers, water mains, and utilities along with streetscape improvements. Bridge: Reviewed schedule updates and analyzed delays, on behalf of the engineer, for a dispute involving the construction of a new bridge and widening of a 4-mile section of the existing state highway in Washington State. Mr. Meyers analyzed the claim and provided consulting assistance to the client. Subway: Provided claims services, on behalf of the contractor, for disputes arising during the construction of a $350 million subway station in New York City. The services involved the preparation of various claims for an extension of time and reimbursement attributable to delay and disruption. Light Rail: Performed an independent schedule analysis, on behalf of the owner, to quantify compensable delay in preparation for a mediation involving the late delivery of a light rail station in Seattle, Washington. Port: Provided claims services, on behalf of the programme manager, for variations and delays arising during the design and construction of an $8 billion seaport and naval base in Doha, Qatar. Light Rail & Tunnel: Assisted in the preparation of an expert report, on behalf of the engineer, for litigation services involving a $160 million light rail transit system in New Jersey. Airport: Prepared expert reports, on behalf of the contractor, for an international arbitration involving the construction of a $2 billion airport in Muscat, Oman. The services consisted of identifying and analyzing delay events and performing an as-planned vs. as-built analysis. Airport: Provided claims services, on behalf of the MEP contractor, for disputes arising during the design and construction of a $3.2 billion airport concourse in Dubai, UAE, which contained the largest first and business class lounges in the world. Airport: Assisted with the development of an expert report to analyze the delays incurred to the interior fitout of a $15 billion international airport in Doha, Qatar. Airport: Assisted in the preparation and issuance of expert reports, on behalf of the contractor, in a $250 million termination dispute involving the construction of an international airport in Doha, Qatar. The analysis included quantification of delays to various ancillary facilities, identification of delay events, and trial support for an international arbitration. Oil, Gas & Chemicals LNG Plant: Analyzed delay and disruption, on behalf of the contractor, for a potential international arbitration concerning the construction of an $18.5 billion LNG plant in Queensland, Australia. The analysis included conducting a review of the existing claims, performing various schedule analyses to quantify the actual delay incurred, and assessing the schedule impacts going forward. Refinery: Provided claims services, on behalf of a subcontractor, for a $30 million civil scope of works at a refinery expansion project in Suriname. The services involved the initial preparation of a claim for an extension of time and reimbursement attributable to delay and disruption. Refinery: Analyzed delay and disruption, on behalf of the contractor, in a $1.3 billion expansion and conversion of an existing oil refinery in Sines, Portugal. Petrochemical Plant: Analyzed delay for the construction of a $170 million cross-linkable polyethylene (XLPE) unit at a petrochemical plant in Abu Dhabi, UAE. Services included litigation support in preparation of a request for arbitration. Industrial Power Plant: Provided an independent assessment of the actual status of the works, following termination of the contractor, for a biomass-fired power plant on the island of Kauai, in the state of Hawaii. The assignment involved verifying the works in place and identifying the remaining works needed to complete various mechanical systems to achieve Substantial Completion. An expert report was also prepared to analyze the delays leading up to the termination of the contractor. Power Plant: Assisted in the development of an expert report, on behalf of the contractor, for a $1 billion ICC arbitration involving the design and construction of a next generation nuclear power plant in Finland. Nickel Processing Plant: Assisted with the preparation of an expert report to evaluate the contractor's scheduling practices and project controls related to the design and construction of a nickel processing plant in Newfoundland. Nuclear Fuel: Assisted with the preparation of an expert report, on behalf of the contractor, to opine on the reasonableness of damages associated with the termination of a subcontractor on a $7.7 billion nuclear fuel fabrication facility in South Carolina, USA. 5 costs incurred by the contractor to complete the subcontractor's scope of works following termination. Titanium Mine: Prepared expert reports, on behalf of the owner, to assess the contractor's performance in project management. The international arbitration involved the design and construction services of a floating titanium mine, with a base contract value of $200 million, located on the coast of Mozambique. Semi-conductor Plant: Performed delay analysis, on behalf of the owner, for a $160 million upgrade and expansion of an existing semiconductor fabrication plant in Moscow, Russian Federation. The analysis included the quantification of delays to the project, determination of the causes of the delays, and assistance to the legal team in preparation of a request for arbitration. Hotels & Leisure Hotel: Reviewed the baseline and as-built schedules to prepare a presentation on initial findings concerning the delays to the construction of an 8-storey hotel located in Washington, DC. Golf Course: Provided claims services, on behalf of the contractor, for additional work and delays arising during the construction of an 18-hole tournament quality golf course over an existing landfill site in New York, USA.
