To permit a minimum interior side yard setback of metres to the swimming pool. 2. To permit a minimum rear yard setback of metres to the swimming pool. 3. To permit a minimum interior side yard setback of 0.30 metres to the hot tub. 4. To permit a minimum exterior side yard setback of 0.30 metres to the accessory building. 5. To permit a minimum rear yard setback of 0.30 metres to the accessory building. By-law Requirements: 1. A minimum interior side yard setback of 1.5 metre is required. 2. A minimum rear yard setback of 1.5 metres is required. 3. A minimum interior side yard setback of 1.5 metres is required. 4. A minimum exterior side yard setback of 2.4 metres is required. 5. A minimum rear yard setback of 0.60 metres is required. Official Plan: VOP 2010 designation: Low-Rise Residential. The proposal conforms to the Official Plan. Comments: The Owner is requesting to construct a swimming pool, hot tub, covered porch, and shed on the subject lands with the above noted variances. The covered porch does not require relief from By-law The Development Planning Department has no objection to Variance #1, #2, #3, #4 and #5. The proposed swimming pool, hot tub, and shed will be enclosed by an existing privacy fence, and will not physically or visually impact any properties. The proposed shed maintains the permitted maximum height, and maximum accessory building size requirements within Zoning By-law The Development Engineering and Infrastructure Planning Department advises that the proposed structures will not negatively impact the existing drainage pattern on the subject lands. The requested variances are minor and can therefore be supported. Accordingly, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land. Recommendation: The Development Planning Department recommends approval of the application. Condition(s): None. The Owner shall submit a Pool Enclosure Permit application directly to the Development Inspection and Lot Grading Division within the Development Engineering and Infrastructure Planning Department to obtain all necessary approvals for the proposed swimming pool construction and accessory works. 2. City staff reserves the right to object or require greater setbacks for minor variances 3 through 5 if, upon detailed design review and pre-construction inspection, City staff deems that the proposed setbacks may alter the existing grades in such a manner as to obstruct stormwater surface runoff drainage conveyance or cause any adverse effects on the subject and/or adjacent lands (i.e. nuisance ponding, flooding, scour, etc.). Final approved setbacks shall be determined per the Pool Enclosure Permit review process in accordance with the City s accepted Lot Grading Criteria. 3. The Development Engineering and Infrastructure Planning Department, based on the review of documentation supplied with this application, does not object to the proposed minor variance requests outlined in items 1 through 5 subject to the above comments. 19 COMMENTS: PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream s cost for any relocation work.
