(31) FAX (31) Architectural Commission Report Meeting Date: Subject: Wednesday, January 18, NORTH CANON DRIVE (PLI 747) 338 North Canon Drive Request for approval of a sign program, which includes business identification signage and a sign accommodation to allow multiple building identification signs and to allow building identification signs to be located less than twenty-five feet above grade. The Commission will also consider adoption of a Categorical Exemption, pursuant to California Environmental Quality Act. Project Agent: Jeanine Wilson Services Recommendation: Conduct a public hearing to discuss project details and provide applicant with an approval, as conditioned. REPORT SUMMARY The applicant is requesting review and approval of a sign program, which includes business identification signage and a sign accommodation to allow multiple building identification signs and to allow building identification signs to be located less than twenty-five feet above grade for property located at 338 North Canon Drive. The business and building identification signs were installed without permits and proposed sign program seeks to legalize such signs. The applicant will also be required to obtain sign permits from City s Development Services Program in a manner consistent with sign program approved by Architectural Commission. The project includes following components: Business Identification Signaqe N. CANON DRIVE Location Size Quantity Illumination Material Storefront-adjacent (Hologram USA) 2.58 SF 1 Halo Aluminum face + returns TOTAL SIGN AREA: 2.58 SF (1 SIGN) Pursuant to Beverly Hills Municipal Code (BHMC) , maximum allowable sign area for business identification signage for a ground floor business with street frontage is two square feet (2 ) in area for each one foot (1 ) of ground floor street frontage, in no event to exceed 1 square feet. Based on a storefront tength of 22-4, maximum sign area for this tenant is approximately 44 square feet. As such, proposed business identification signage is within maximum standards set forth in BHMC. Additional business identification signage is shown on projecting canopy feature; however, specific details were not provided for this sign. The sign shall not exceed six (6) square feet in area. The sign shall be shared by all such businesses desiring signage. As such, proposed business identification signage is within maximum standards set forth in BHMC. Building Identification Signage N. CANON DRIVE Location Size Quantity Illumination Lower façade (Film On TV) 9.33 SF 1 Halo Mid-façade (Salon 921) 6.44 Halo TOTAL SIGN AREA: 33.2 SF (2 SIGNS) Material Aluminum face + returns Aluminum face + returns Pursuant to BHMC , Architectural Commission may grant a sign accommodation to allow a greater number of building identification signs or to allow such signs to be located in areas or than those orwise permitted (less than 25 -O above grade), provided that signs located on any one side of a building do not exceed two percent (2%) of vertical surface area of that side, excluding penthouse walls. Based on a vertical surface area of 2,2 square feet, maximum allowable area for building identification signage is 44 square feet. As such, proposed business identification signage is within maximum standards set forth in BHMC. The proposed sign program also includes standards for any future replacement of existing business and building identification signage. Any future signage will be reviewed and must be consistent with sign program approved by Architectural Commission. Note: Full details have not been provided for business identification sign located on projecting façade element. Any future tenant signage will be subject to City s architectural review process.

Canon Drive (Sign Program) January 18, 217 URBAN DESIGN ANALYSIS The proposed sign program creates an unfocused sign aestic for traditionally-styled building façade. A revised, more regulated sign program could allow for strategically grouped signage for non-ground floor tenants in conjunction with ground-floor and anchor tenancies. Project-specific conditions have not been proposed as a result of this analysis; however, Commission may wish to consider such comments during course of its review. ZONING CODE COMPLIANCE Applications for design review are preliminarily evaluated for compliance with zoning code. Applicants are encouraged and have option of requesting a comprehensive review separate and apart from this application. Formal compliance review will occur when a building permit application is filed (plan check). The applicant has been advised that changes during plan check may require revisions and subsequent approval from Architectural Commission or staff, as appropriate. ENVIRONMENTAL ASSESSMENT The subject project is exempt from California Environmental Quality Act (CEQA Public Resources Code 21O 21178), pursuant to Section 1561(b)(3) of State CEQA Guidelines in that project includes review of building design, colors and materials to façade of building, front yard landscaping or minor low-scaled accessory structures, such as fences or walls. It can be seen with certainty that re is no possibility that subject activity could result in a significant effect on environment. The project has also been reviewed and found not be a historic resource. The existing improvements to be demolished or altered were not designed by an architect or builder identified on City s Master Architect list and site and improvements are not listed on City s historic resource inventory. PUBLIC OUTREACH AND NOTIFICATION Public outreach and notification was not required for this project.

18 Public RESOLUTION NO. AC XX-17 RESOLUTION OF THE ARCHITECTURAL COMMISSION OF THE CITY OF BEVERLY HILLS CONDITIONALLY APPROVING AN ARCHITECTURAL REVIEW PERMIT OF A SIGN PROGRAM. WHICFI INCLUDES BUSINESS IDENTIFICATION SIGNAGE AND A SIGN ACCOMMODATION TO ALLOW MULTIPLE BUILDING IDENTIFICATION SIGNS AND TO PERMIT BUILDING IDENTIFICATION SIGNS TO BE LOCATED LESS THAN TWENTY-FIVE FEET ABOVE GRADE FOR THE PROPERTY LOCATED AT 33$ NORTH CANON DRIVE (PL1747). as follows: The Architectural Commission of City of Beverly Hills hereby finds, resolves and determines Section 1. Jeanine Wilson, Permit Services, agent, on behalf of property owner, Albert Ahohirn, (Collectively Applicant ), has applied for architectural approval of a sign program, which includes business identification signage and a sign accommodation to allow multiple building identification signs and to allow building identification signs to be located less than twenty-five feet above grade for property located at 33$ North Canon Drive. Section 2. Beverly Hills Municipal Code Article 3, Chapter 3 of Title 1, authorizes Architectural Commission authority to approve, approve with conditions, or deny design-related aspects of projects located in city s commercial and multi-family districts, subject to findings set forth in Beverly Hills Municipal Code Section Section 3. Consistent with Beverly Hills Municipal Code Section , this resolution documents official action of Architectural Commission with respect to project. Section 4. The subject project has been reviewed pursuant to provisions set forth in California Environmental Qtiality Act (CEQA Resource Code Sections 21, et seq.), State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15 et seq.), and city s local CEQA Guidelines. The subject project is exempt from California Environmental Quality Act (CEQA Pagelof5 ACXX-17

19 Public 21178), Resources Code 21 pursuant to Section 1561(b)(3) of State CEQA Guidelines in that project includes review of building design, colors and materials to façade of building, front yard landscaping or minor low-scaled accessory structures, such as fences or walls. The Architectural Commission conducted a ditly noticed public hearing on January 18, 217 at which time oral and doctimentary evidence was received concerning application. Section 6. Based upon evidence presented at hearings, including staff report(s), oral and written testimony, Architectural Commission hereby makes following findings: A. The plan for proposed building or structure is in conformity with good taste and good design and, in general, contributes to image of Beverly Hills as a place of beauty, spaciousness, balance, taste, fitness, broad vistas, and high quality. Specifically, project incorporates an appropriate balance of color, high quality materials and appropriate architectural design principles to reinforce city s urban form and promote image of Beverly Hills. B. The plan for proposed building or structure indicates manner in which structure is reasonably protected against external and internal noise, vibrations, and or factors which may tend to make environmental less desirable. The proposed project is proposed to be constructed using contemporary building materials and practices, and, as conditioned, compliant with all applicable building codes, including standards that protect against unwanted noise and vibrations. C. Proposed building or structure is not, in its exterior design and appearance, of inferior quality such as to cause nature of local environment to materially depreciate in appearance and value. Specifically, commission has reviewed design and construction materials proposed for project, which incorporates contemporary building material of known quality and durability. 20 project design is appropriate to building and surrounding improvements and is well matched to selected materials. D. As conditioned, proposed building or structure is in harmony with proposed developments on land in general area, with general plan for Beverly Hills, and with any precise plans adopted pursuant to general plan. The proposed project complies with applicable goals and policies set forth in general plan, and, as conditioned, designed in a manner that complies with local ordinances. The overall design is consistent with and appropriate to or improvements in general vicinity. E. The proposed development is in conformity with standards of this code and or applicable laws insofar as location and appearance of buildings and structures are involved. As conditioned, project will be designed in compliance with all applicable regulations. F. The proposed development is designed in a manner that protects and preserves those exterior elements of building which Planning Commission found contributed to determination of project as a character contributing building in accordance with section of this title. The proposed project does not include a request and has not been determined by Planning Commission to be a project that qualifies as a character contributing building under section Therefore, this finding is not applicable to subject project. Section 7. Based on foregoing, Architectural Commission hereby grants request defined in this resolution subject to following conditions: Project-Specific Conditions No project-specific conditions are proposed. 21 1. Revised Plan Submittal. For all projects that are approved with project-specific conditions, a revised plan set that has fully incorporated all such conditions shall be submitted to project planner, both in hard copy format and in electronic format, prior to submitting for building permit plan check process. 2. Architectural Approval. Project approval is for design-related aspects of project only. No approval is implied or granted with regard to applicable city zoning or technical codes, which may require review and approval from or city commissions or officials. 3. Compliance with Municipal Code. Prior to issuance of a building permit, applicant shatl demonstrate compliance with all applicable provisions of city s municipal code and applicable conditions imposed by any discretionary review approval. 4. Compliance with Special Conditions. Any special conditions that require approval by Director of Community Development, or designee, shall be submitted to staff liaison to commission within fourteen (14) days of approval or prior to submittal of plan check review application, whichever is greater. 5. Project Rendering. Prior to issuance of a building permit, applicant shall incorporate into building permit set of plans, an updated color rendering of all building facades. The quality and detail of rendering shall be subject to approval from Director of Community Development, or designee, and shall include sufficient design information to evaluate project compliance during construction. 6. Approval Resolution. A copy of signed resolution of approval shall be scanned onto cover sheet(s) of building permit set of plans. 7. Substantial Compliance with Approved Plans. The Director of Community Development, or designee, shall determine if changes to approved project are in substantial compliance with Page 4 of 5 AC XX17

22 commission s action. This determination shall be subject to applicable fees and charges. A substantial modification to approved project requires approval from Architectural Commission. 8. Validity of Permits. The rights granted by this approval shall remain valid for three (3) years from date of approval, unless extended pursuant to Beverly Hills Municipal Code Section Section 8. The Secretary of Architectural Commission shall certifsr to passage, approval, and adoption of this resolution, and shall cause this resolution and its certification to be entered in administrative record maintained by Community Development Department. Section 9. Decisions of Architectural Commission may be appealed to City Council within fourteen (14) days of final action by filling a written appeal and paying appropriate fees with City of Beverly Hills City Clerk.
