PPA Definitions Procurement Contract: A contract between a Public Entity and a supplier, a construction entrepreneur or consultant, or service provider, for the provision of goods, services, or construction works, pursuant to Section 5 of the PPA. Procurement Contracts Refer to PPA 063 Section 5 () All procurement contracts, other than low value contracts, must include the following: o Scope of the procurement contract, o Work performance schedule, o Supply time, performance time or whether time can be extended or not, o Terms and conditions for acceptance of goods, construction work or services, o If price adjustment can be made, provision thereof. Procurement Contracts o If procurement contract can be amended and variation order can be issued, provision thereof, o Liquidated damages for failure of performance within the stipulated time, o Provision concerning bonus to be given if work is completed before the stipulated period, o Conditions in which procurement contract may be terminated, o Provision whether sub-contract can be included or not, o Mechanism for settlement of disputes 3. Normally for bids with high value, or technical specifications that it is not possible to meet nationally. Goods or services valuing above million Rupees, or construction work valuing above million Rupees 3. 6 Generally, Districts do not procure consultancy services, and this is managed by TMO 9. International Bidding Tender notice in international media (45 days) Criteria are as follows (Ref PPA, Section 5 ): a) Where the goods / works are not available under competitive price from more than one firm in Nepal, b) Where no bid was submitted in response to bid invitation at national level for the procurement of goods /works / other services, c) Where under an agreement entered into with a donor party, foreign goods or construction works have to be procured from foreign source, d) Where the Public Entity has certified that the goods or construction works, being of complex and special nature, have to be procured through an international level bidding. 0. National Level Bid Refer to PPR 064 (third amendment, 068) Rule - 3 Tender notice must be placed in national level media for a minimum of month National level bid when a Public Entity has to procure goods or services valuing above million Rupees, or construction work valuing above million Rupees. Sealed Quotation Refer to PPR 064 (third amendment, 068) Rule -84 A notice must be placed in local level media for a minimum of 5 days Threshold: For goods or services valuing less than million Rupees, construction work valuing less than million Rupees Sealed quotation form must be prepared before inviting sealed quotations. 7 Of the sealed quotations fulfilling the terms of the bid, the lowest value quotation must be approved 3. Direct Procurement Refer to PPR -85 Low-value procurement Criteria are as follows: a) For goods and services valuing less than 300,000 Rupees, and construction work valuing less than 500,000 Rupees b) If only one supplier, construction entrepreneur or consultant, or service provider has the technical efficiency or capacity to fulfil the procurement requirement c) If only one supplier has the exclusive right to supply the goods to be procured and no other appropriate alternative is available 4. Qualification Criteria For Goods refer to PPR 064 (third amendment, 068), Rule -5 For works refer to PPR 064 (third amendment, 068), Rule -6 Construction work with a value greater than 6 million Rupees Bidders supplying goods must meet criteria to be eligible and supporting documentation must be supplied Those tendering for construction work must meet criteria as bidding/prequalification document such as: o General work experience, o Special work experience o Min. annual average turnover, o Economic & Financial Capacity (LoC) o Skilled manpower 7. Procurement Method o Table Equipment Qualification criteria shall be applied for public procurement with a value greater than 6M NRs Bidders shall present document showing their work experience, personal, equipment and financial capacity.
