Services resulted in resolution of major managerial issues between Owner and this prime contractor. World-Wide Data Center Program Program Manager - managed initiation, strategic planning, alternative analysis and Front End Loading including site selection, facility and infrastructure design and EPC contractor selection. Coordinated information technology strategy consultants, concept design consultants and numerous owner entities for replacement of world-wide data centers for a global pharmaceutical company. Utilized structured capital Project Delivery Process consistent with corporate leadership expectations. Oil Sands Upgrader Project Manager of Sulphur Recovery and Hydrogen Projects - Developed and issued Request for Proposal for both Sulphur and Hydrogen projects. Sulphur contracting strategy was lump sum engineer, procure, construct and Hydrogen was lump sum turnkey. Prepared cost estimate for Hydrogen project. Oil Sands Downstream Program Management - Developed a comprehensive Program Management and Execution Plan and Manual. This program management manual documented current practices and established programmatic-level bases for areas where existing practices presented opportunities for upgrading. High Technology Office and Laboratory Complex Project Manager - Managed conceptual design, detailed engineering, procurement, construction, and startup phases of mechanical and controls / automation scope of work. Program Execution Planning Program Management - Provided overall Program Management for development of master plans for roughly 100 Regulatory Consent Decree projects for a major international pharmaceutical company. Master Plans defined schedule, manpower and cost. Provided initial startup for an owner Project Management Office (PMO). $1.6 Billion Natural Gas Pipeline Project - Conducted extensive management review and assessment regarding the properness of all aspects of this major capital investment. $750 Million Pharmaceutical Launch Facility - Conducted review and analysis of alteration (changed work) orders (approximately 1000) to determine responsibility for overruns. $2 Billion Natural Gas Processing Plant - Conducted review of project schedule for the execution of this project which was nearing completion of the basic / conceptual design. The scheduled duration and sequencing of startup as well as other matters were in dispute.

5 Selected Representative Experience Disputes and Litigation: $200 Million Carbon Monoxide Plant - Representing the Lump Sum Turnkey contractor, developed eight figure claim based on delay, acceleration, disruption, and changed work. The development included Time Impact Analysis of schedule. English and Wales law. $1 Billion Gas-Fueled Power Generation (combined cycle) Plant - Conducted review of labor productivity and progress. Supported the owner regarding claims for delay, disruption, and labor inefficiencies. The owner successfully resolved the dispute. $150 Million Ethanol Plant (two plants) - Evaluated and developed delay, changed work, disruption and impact claims for the engineering and construction contractor. Lead a team of six to ten experts in various disciplines and managed a virtual claims team. The claims totaled middle eight figures on both plants. $1 Billion Gas-Fired Power Generation (combined cycle) Plant - Conducted review of project schedule and contract requirements. Successfully defended the construction contractor regarding claims for delay. Supported the contractor regarding claims for delay and disruption. The contractor claims were resolved satisfactorily. $150 Million Power Generation (Peaker) Plant - Completed delay and disruption analysis as well as expert support to defend owner regarding litigation initiated by the general contractor. Prepared owner counterclaims ($3 million). Provided extensive testimony at arbitration. Power Generation Plant (diesel) - Technical lead on claim involving changed work, delay, acceleration, disruption and other issues. The claim totaled eight figures in US Dollars. $1.6 Billion Natural Gas Pipeline Project - Conducted extensive management review and developed expert witness testimony regarding the properness of all aspects of this major capital investment. Work included analysis of As-Planned and As-Built schedule to rebut claims of delay, acceleration, disruption and mismanagement. Liquefied Natural Gas (LNG) Terminal - Named productivity / disruption expert for mechanical erection contractor in London-based arbitration under English law. Performed analyses at multiple levels of detail demonstrating cause and effect. Issues were variations, acceleration, overtime, and free-issue materials. Dispute was in eight figures USD. $750 Million Pharmaceutical Launch Facility - Conducted detailed review and analysis of alteration (changed work) orders (approximately 1000) to determine responsibility for cost and schedule overruns.
