7 One Stop Center In realizing the government's aspiration to achieve excellence in Public Delivery System, the Ministry of housing and Local Government (KPKT) has taken initiative to revamp and reengineer procedures and process implemented via One Stop Center (OSC). Definition: A counter service provided as a secretariat to handle construction or development affairs. 7

8 Function of OSC Receive application for approval of layout planning plan, building plan and endorsement for conversion plan. Review and advise the applicant if the document for the application is incomplete Distributing application which has been reviewed to technical department and external technical agencies to be processed and approved Monitor the duration of all approval from technical agencies to ensure that it is within the stipulated time. Reinstate a review of all the technical agencies and check whether the agencies has certified and reviewed 8

9 Function of OSC After all the reviews of the application had been completed, the secretariat of OSC will bring forward the application to OSC pre-meeting to be rechecked once again before going to Local Authorities Board of Meeting for the final approval. 9

40 Introduction Previously known as Certificate of Fitness for Occupation (CFO) issued by the Local Authorities (LA)/Pihak Berkuasa Tempatan (PBT). In April 2007, the Government had launched the improvement to the building delivery system to enhance the competitiveness of Malaysia globally. Introduce the Certificate of Completion and Compliance (CCC) issue by the project s Principal Submitting Person (PSP); Professional Architects and Professional Engineers as well as Building Draughtsman registered with the Board of Architects Malaysia (BAM) and the Board of Engineers Malaysia (LJM). 40

41 Terminologies Principal submitting person (PSP) refers to a qualified person who submits building plans to the LA for approval. It includes any other qualified person who takes over the duties and responsibilities of PSP; Submitting person (SP) means a qualified person, and any other qualified person taking over his duties and responsibilities, who submits plans other than building plans to the LA or relevant statutory authority; Qualified person means a Professional Architect, Professional Engineer or registered Building Draughtsman registered with the bodies relating to their registration; 41

42 The Professionals Responsible for the Issuance of CCC CCC will be issued by the Professional Architect or Professional Engineer who is registered with the respective Board of Architects Malaysia (BAM) or Board of Engineers Malaysia (BEM) acting in the capacity of PSP. For buildings which require intensive design input, the Professional Architect will function as the PSP while the Professional Engineer will be the PSP for the projects with high engineering input in nature. For the bungalows which do not exceed 2 floors in height and 300 square metres in total built up floor area, a registered Building Draughtsman may perform the role of PSP and issue the CCC. The CCC can only be issued when all parties concerned are satisfied that the building construction have been supervised and completed in full compliance with the provisions of the law and technical conditions as imposed by the LA in approving the Planning Permission and Building Plan. 42

43 COMPLETION OF WORK Certification of completion and compliance (CCC) Local Authorities (Pihak Berkuasa Tempatan PBT) will receive, process and approve planning permissions and building plan through One Stop Centre (OSC) Role of Local Authorities (LA) under CCC: Authorize site inspection on their own initiative Act on complaint to check work progress Issue notice to the PSP not to issue the CCC Take action to rectify any continuous breach of divergence including reporting to the relevant Professional Boards 43

44 COMPLETION OF WORK Certification of completion and compliance (CCC) Role of PSP in issuing CCC: PSP as the principal officer have to ensure that all Form Gs (under CCC) must be properly filled and certified and all conditions fullfilled before CCC can be issued PSP must have supervised the works and satisfied with the supervision of the works To ensure all contractors are properly registered with CIDB and with relevant licensing agencies (e.g. electrician with Suruhanjaya Tenaga, plumber with SPAN etc.) 44

45 Role and Responsibilities of LA & PSP LA Approve the Planning Permission Approve the Building Plan Conduct on-site inspections on own initiative or in response to complaints Issue notice to PSP to take action on any matter not in compliance with the provisions of the law and the technical conditions imposed in the Planning Permission and Building Plan Issue notice to the PSP to withhold the issuance of the CCC Until the non-compliances have been rectified If a fraud occurs in the construction, documentation or project management, If inaccurate information is discovered in the documentation PSP Submit the Building Plan to the LA for approval using Form A Coordinate the preparation, commence and submission of other plans besides building plans Inform the LA through Form B to construction operation at the site Supervise construction works at the site and ensure that the provisions of the law and technical conditions imposed are complied with Report and explain the reasons for noncompliance and state the rectification measures taken in the event of noncompliance occurring during construction 45

46 Role and Responsibilities of LA & PSP LA Issue the notice to PSP if a non-compliance occurs but not reported to the LA Charge the professional in court and report to the Professional Board for any wrongdoings Charge the parties who have provided false certification in the forms as specified in the UBBL 2007 and report them to the respective regulatory bodies Ensure that buildings exceeding 5 floors and aging 10 years from the date CCC is issued are inspected every 10 years PSP Submit notice for the resumption of work through Form B to the LA Ensure that G Forms are propely completed and deposit copies of all said Forms (including those not related) to the LA and Professional Board Submit the CCC to the owner or developer and a copy of the said certificate to the LA and the relevant Professional Board Ensure that the rectification of noncompliances during construction as stipulated in the LA notice to the PSP are complied with before issuing the CCC Issue CFO for development which submitted building plan have been approved or for buildings that are completed before the coming into operation of the CCC system 46

47 Stage Certification Process Under the CCC system, 21 building components have being identified for the stage certification process. 21 Stage Certification Forms (Form G 1 to G 21) have been introduced under the Second Schedule of the Uniform Building by Law (UBBL 2007). Type of forms to be used in accordance with the building components and the responsible parties involved in the stage certification process 47

54 CCC Issuing Process CCC Issuing Process Under By-law 25 of the UBBL 2007, the PSP can issue the CCC using Form F subject to the following conditions being met:- 1. When all technical conditions imposed by the LA have been satisfactorily complied with 2. When Form G 1 and Form G 21 in respect of stage certification as set out in the Second Schedule have been duly certified and received by him 3. When all the essential services, including access roads, landscape, car parks, drains, sanitary, water and electricity installations, fire hydrants, sewerage and refuse disposal requirements and fire lifts, where required, have been provided 4. When he certifies in Form F that he has supervised the erection and completion of the building and that to the best of his knowledge and belief the building has been constructed and completed in accordance with Act 133, the UBBL and the approved plans 54

55 Summary Proses 1- Proses Mulakan Kerja Di Tapak PSP akan mengemukakan Borang B kepada JT/PBT melalui OSC untuk memaklumkan pembinaan di tapak akan bermula dalam masa 4 hari. Proses 2- Proses Penyerahan Notis Penyerahan Penyiapan Berperingkat PSP hanya akan memaklumkan penyiapan peringkat substruktur (penyiapan komponen G1-G3) kepada JT/PBT melalui OSC. Proses 3- Proses Penghantaran Salinan Notis Penyiapan Berperingkat PSP Kepada PBT Oleh Kaunter OSC Setelah menerima pemakluman dari PSP, OSC akan edar sesalinan notis kepada JT/PBT. 55

56 Summary Proses 4 Proses Lawat Tapak Oleh PBT Pada peringkat ini wajar bagi JT/PBT melawat tapak agar sebarang ketidakpatuhan boleh diarahdiperbetulkan segera. Lawatan-lawatan seterusnya adalah digalakkan. 56

57 Summary Proses 5 Proses Pengemukakan Laporan Ketidakpatuhan Dari JT/PBT dan Penentuan Kaedah Pembetulan Oleh Jawatankuasa OSC Sekiranya semasa lawatan tapak didapati terdapat ketidakpatuhan, laporan ketidakpatuhan perlu dikemukakan untuk pertimbangan J/K OSC. PSP perlu perbetul ketidakpatuhan dalam tempoh 21 hari atau tempoh yang ditetapkan oleh J/K OSC. PSP maklumkan penyiapan pembetulan kepada JT/PBT. Sekiranya JT/PBT tidak melakukan lawatan tapak dalam masa 14 hari, peruntukkan undang-undang menganggap pembetulan adalah memuaskan. Jika kerja-kerja pembetulan melibatkan keselamatan awam dan perlu disegerakan, PBT boleh betulkan ketidakpatuhan dengan kos kerja ditnggung pemunya bangunan. Kerja tapak diteruskan semasa pertimbangan J/K OSC melainkan Arahan Berhenti Kerja dikeluarkan. Projek berjalan seperti biasa sekiranya tiada ketidakpatuhan. 57

58 Summary Proses 6 Proses Pengeluaran CCC oleh PSP (CCC dikeluarkan oleh PSP apabila): Syarat-syarat teknikal di dalam Kebenaran Merancang dan Pelan Bangunan yang diluluskan dan 21 komponen dalam borang-borang G siap dan dipatuhi. PSP sertakan surat pengesahan dari 6 Agensi Teknikal yang kritikal, iaitu Jabatan Bomba dan Penyelamat Malaysia, JKR atau PBT (jalan dan parit), Pihak Berkuasa Air Negeri, Jabatan Perkhidmatan Pembentungan (IWK), Tenaga Nasional dan Jabatan Kesihatan dan Keselamatan Pekerjaan. Perkhidmatan perlu selaras peruntukan Undang-undang Kecil 25 (1)( c ), UKBS 2007 disediakan. Bagi perumahan perkara di bawah subseksyen 20(1) jadual G atau subseksyen 23(1) jadual H,Akta Pemajuan Perumahan telah disediakan. Borang F iaitu sijil CCC telah ditandatangani oleh PSP. Nombor siri akan dicetak pada setiap sijil CCC bagi memastikan tiada penipuan. Sijil CCC boleh diperolehi daripada Lembaga Profesional yang berkaitan PSP. 58

59 Summary Proses 7 Proses Pengemukaan Dokumen Selepas Pengeluaran CCC PSP kemuka sijil asal CCC kepada pemaju projek atau pemilik Bangunan. PSP menyimpan borang-borang G asal. Sesalinan CCC dan borang borang G yang diakui sah dikemukakan kepada Lembaga Profesional dan PBT dalam tempoh 14 hari selepas CCC dikeluarkan. Bagi perumahan Notis Milikan Kosong hendaklah dikeluarkan bersekali dengan CCC. 59
