1 Page 1 of 6 MINUTES OF A REGULAR VOTING MEETING OF THE FAIRFIELD PLANNING COMMISSION OCTOBER 10, 2018 Scott Lepsky called the Regular Meeting of the Fairfield Planning Commission to order. Members present: Scott Lepsky, Don Hassler, Dean Langevin, Terry Senger, Brian Begley, and Dale Paullus. Motion to excuse Bill Woeste carried unanimously. MINUTES OF THE PREVIOUS MEETING The minutes of the previous meeting, held September 26, 2018 were approved with a minor change. OLD BUSINESS I. Revised Concept and Final Development Plan 6305 S. Gilmore Rd. Scott Lepsky, seconded by Don Hassler, motioned to remove this item from the table. Motion carried unanimously. This item was tabled at the last meeting, to allow the applicants to address issues with the sign height and the design of the canopy in the drive-thru that were items of concern at the previous meeting. At the last meeting, the applicant provided drawings showing the sign of their preferred 12 feet and the city s preferred 8 feet height. The signage was discussed. Since the last meeting, Meijer has given their approval on the reduction of the sign height. The signs will have a one foot base, with a 7 foot sign, for a total of 8 feet in height. Ms. Lynn also indicated that the existing Meijer sign will need to be removed and replaced with seed/sod. All of the slides shown will be included in the approval for the PUD. The 26 x 44 metal canopy was discussed. The entire canopy including the roof will be painted a dark bronze color to match the cornice on the building. There is also additional landscaping planned for around and in front of the canopy, as shown on the updated landscape plan. Jennifer Santelli, with Chick-fil-A was in attendance. She thanked Ms. Lynn for all of the work she has done on this project. She was provided a copy of and agrees with the conditions of approval. Mr. Senger asked what kind of landscaping was being planted around the canopy. The plants are a mixture of evergreens, and deciduous bushes.

2 Page 2 of 6 Scott Lepsky, seconded by Dale Paullus, motioned to approve the revised concept and final development plan, with the following conditions: Condition of Approval for the entire Development Plan 1. The proceeding terms and conditions of approval shall be codified in a Development Agreement to be executed by the Owner and the City. Conditions of Approval for a Revised Concept Plan & Final Development Plan for the Chick-fil-A Restaurant (1.55 acres) 1. Approval is for a Chick-fil-A restaurant only, unless otherwise approved by the Planning Commission. 2. A revised landscape plan shall be submitted subject to approval by the Development Services staff with the following changes: a. The proposed landscaping shall conform to the following requirements and noted on the landscape plan: Remove and replace dead plant material and apply appropriate herbicides/pesticides as required. The landscape beds are to be kept free of weeds and the mulch within the beds is to be seasonally replaced and maintained. Plant replacement shall occur within 30 days after plant(s) die, provided that in the event the plant(s) die during the period of October-February, plant replacement shall occur no later than the immediately following month of April and must conform to the approved landscape plan. If plantings are not replaced or maintained as stated above within 30 days of written notice by the City, the City will contract the work and assess the cost of the work plus $100 administrative fee as a lien on the owner s property taxes in accordance with standard property maintenance procedures adopted by the City. b. The City does not permit rock as ground cover or in lieu of mulch unless it is used to convey stormwater run-off or as a minor accessory to site landscaping. The rock mulch shown on the landscape plan is to be replaced with mulch and noted on the plan. Rock mulch is permitted adjacent to the retaining wall, where no landscaping is proposed. 3. An irrigation system shall be installed and operated for landscaped beds and grass areas. The irrigation plan is subject to approval by the City of Fairfield Staff Technical Review Committee. 4. Access and utility easements will be required and granted as necessary if the retail center

3 Page 3 of 6 is developed as a separate parcel. 5. A lot split will be required in order to create the 2.5 acre site. A copy of the recorded document shall be submitted to the City prior to issuing a building permit. 6. All rooftop HVAC or other mechanical units shall be screened from view via extended parapet walls. 7. The entire length of the sidewalk along South Gilmore Road from Kolb Drive south to Meijer Drive shall be installed at the time the building is constructed and before occupancy of the building. 8. Screening for all dumpsters shall be constructed of the same brick material used on the building. 9. The base of the ground signs shall be constructed of the same brick material used on the building. 10. All signage shall conform to the C-2 Zoning District sign requirements. 11. An easement for the maintenance of the off-site sign on the Meijer parcel shall be recorded and submitted to the City prior to obtaining a Certificate of Occupancy. 12. The entire length of the retaining wall and railing on South Gilmore from Kolb Drive south to Meijer Drive shall be installed at the time the building is constructed and before occupancy of the building. The material and color of the retaining wall shall be substantially similar to what is shown on the retaining wall elevation. The railing shall be a decorative black metal railing and a minimum of 36 inches tall. 13. If construction does not begin within one year of City Council approval, the entire 2.55 acre site shall revert back to the original 1995 Planned Unit Development zoning terms and conditions, which state the lot shall remain as permanent open space with landscaping as required. 14. All sides and roofs of the canopies for the drive-thru lane and pick-up window are to be a dark bronze as shown in the rendered site perspectives. 15. The existing Meijer ground sign is to be removed prior to obtaining a certificate of occupancy. The area where the sign is located shall be seeded or sodded once the sign is removed. Conditions of Approval for Revised Concept Plan, Retail Center (0.94 acre) 1. Uses permitted in the C-2 Zoning District are permitted except for the following: self-service laundries, dry cleaning and laundry pick-up, variety and dime stores including discount stores, motor vehicle service and/or fuel dispensing facilities, fastfood restaurants, pawn shops, check cashing services, payday and vehicle title loans and bail bonds or unless such uses are specifically approved by the Planning Commission.

4 Page 4 of 6 2. No additional curb-cuts or driveway approaches are permitted, except as shown on the approved final development plan for the Chick-fil-A Restaurant. 3. Access and utility easements will be required and granted with the adjacent Chick-fil-A Restaurant if the site is developed as a separate lot. 4. All signage shall conform to the C-2 Zoning District sign requirements. 5. The proposed ground sign located on the Retail Center site shall be maintained by Chickfil-A. If the site is split off at the time of the development, the sign shall be placed in an easement. An easement for the maintenance of the off-site sign on this parcel shall be recorded and submitted to the City prior to obtaining a Certificate of Occupancy. 6. The drive-thru proposed on this parcel shall not be approved at this time. The drive-thru will be considered at the time the Final Development Plan is submitted for approval. 7. A temporary three (3) foot high grass berm shall be constructed adjacent to the pavement for the curb-cut on Casual Drive. The berm shall be shown on the landscape plan required for the Chick-fil-A restaurant site and shall be completed prior to a certificate of occupancy is granted for the Chick-fil-A restaurant. 8. The future Retail Center lot shall remain grass until developed. If disturbed during the development of the Chick-fil-A Restaurant, it shall be restored to an acceptable grade, reseeded and maintained to the same standards as Chick-fil-A Restaurant site. Motion carried 6-0. NEW BUSINESS I. Six Month Review Fairfield Pub Nilles Rd. The original conditional use approval for a bar was given in 2014 and there have been 3 different owners since that time. The current owner received approval in April 2018, with a six month review. The neighbors were notified of this meeting, but staff did not hear from anyone and none were in attendance. Sgt. Pete Lagemann was in attendance and spoke. He indicated that there have not been many issues in the six months they have been operating the bar. There have been no calls regarding parking like the previous owners had. Christy Gentry and Jeff King were in attendance and spoke. They worked out the parking issues with Pfefferle, and have had no issues since. The bar is open from 12:00 pm to 2:30 am, 7 days a week. Sometimes they close at 1:00 am on Sundays, depending on the crowd. The applicant told

5 Page 5 of 6 the Commissioners that the liquor license transfer to this owner has been completed. Scott Lepsky, seconded by Brian Begley, motioned to approve conditional use request with the following conditions: 1. Doors are to be kept closed so noise cannot be heard beyond the property line. 2. Dumpster is to be located fully within the existing dumpster enclosure and to remain within said enclosure at all times, except when being emptied. 3. No DJ entertainment. 4. No outside promotors permitted to operate the establishment. 5. The business is to operate in accordance with the business plan and that plan includes applicant s commitment that he/she or an on-site manager will personally be at the business on a daily and nightly basis. 6. Approval is given to the current business owners, Clinton King and Jeff King, and shall not be transferable with the business. 7. There shall be no outdoor music, live or piped. (BZA condition of approval for outdoor seating dated 6/13/15) 8. Planters are to be added to the base of the wrought iron fence. (PC condition of approval for wrought iron fence dated 6/24/15) Motion carried 6-0. I. Conditional Use Power & Faith Ministries Fairfield Business Dr. This church received a conditional use approval in 2017 for 7044 Fairfield Business Dr., which is a couple spaces down from this space. The new location is much larger than the previous one. The neighbors that were notified for the previous conditional use approval were notified for the applicant s relocation. Pastor Ron Banks was in attendance. He said the congregation has grown and they need more air conditioned space. There are no structural changes planned; they will just be adding chairs to the space. Their members total 65 people, including children. Scott Lepsky, seconded by Brian Begley, motioned to approve conditional use request with the following conditions: 1. A Certificate of Occupancy is required to be obtained from the Fairfield Building Division by October 31, Any interior construction will require architectural

6 Page 6 of 6 drawings and a building permit. 2. The conditional use is for Power and Faith Ministries, Pastor Ron Banks and is nontransferrable. 3. All worship, choir and/or music activities shall occur on the weekends or after 5:00 PM weekdays (Monday-Friday). 4. The church shall not operate a daycare center on premises. Motion carried 6-0. REPORTS/STUDIES/GENERAL DISCUSSION Dale Paullus reported that the groundbreaking for the new dog park was held. Erin Donovan-Lynn reported the next comprehensive plan public workshop is scheduled for October 16 from 6:00 pm to 8:00 pm.
