4 WESTON POLICE STATION CONDITIONS ASSESSMENT AND FEASIBILITY STUDY SUMMARY AND RECOMMENDATIONS The Feasibility Study investigated numerous options for present day and future needs for the Town of Weston s Police Department. Following is a summary of the investigations, including viable options, the pro s and con s of each option and the Designer s recommendations. It is noted that at the time of this Study, a new centrally located Town owned site was not available as an option to be investigated by the Designer. Prototypical Site layouts where developed to establish new site requirements for a one story or two story police facility that would provide for the recommended Facility Program The recommended Facility Program, prepared by DiMarinisi & Wolfe in consultation with the Town of Weston, determined the square footage required to provide a Police facility that meets today s and the future policing requirements for the Town of Weston would be approximately 21,400 gross square feet, or 8,600 gross square feet of additional area than currently exists. A 2.24 acre site would be required for a new one story police station, and a 1.57 acre site would be required for a new two story police station. Option No. 1 Repair and Renovate Existing Building, no Additional Space Repair / renovate the existing one story and partial basement Police Station that was built in 1973 with no addition. The first floor is 8,712 gross square feet, the basement is 4,067 gross square feet for a total Building area of approximately 12,800 gross square feet. The total usable site area, including Building footprint is approximately 1.28 acres. The area within the 50 foot wetlands buffer zone is excluded from usable site area. Pro s: Least expensive construction Option Partial repair and replacement of obsolete Site Structures, Building Materials and Systems. Use of energy Efficient Materials and Systems. Partial removal of Building Code Violations, including Handicap Accessibly Improvements Improvement to Police Operations and Security within the Building Upgrades some Mechanical, Electrical, Plumbing and Fire Protection systems Con s: The Site and Building Space needs are not provided for current and future Police Operations. Major Program Components will not be properly provided, or will not be provided for at all, i.e. Female Locker, Toilet and Showers; Male Locker, Toilet and Showers; Evidence Processing; Conference Space; Files; E911 Equipment; Booking; Secure Sallyport and a Community Room During renovation, detainees will have to be transported to a neighboring community or State Police Barracks During renovation, Police and Administrative Staff Operations will be required to work out of on-site trailers Upon completion of repairs and renovations to the Existing Building, it will not totally comply with present day Structural and Energy Code requirements The estimated Project Cost for the required repairs and renovations to the Site and Building is $4,145, The end result of this expenditure will be a Police Station that does not meet present and future Police Operational Needs and the Building will not comply with present day Building and Energy Code requirements No change to Police Station Image / Appearance from Public view / access The existing Building footprint is within the 100 Foot Wetlands Buffer Zone A major portion of the Building is in the Basement, providing no natural daylight. 5 WESTON POLICE STATION CONDITIONS ASSESSMENT AND FEASIBILITY STUDY Working with the Town, DiMarinisi & Wolfe prepared a detailed list of Life Cycle, Building Code and Operations Work Items that should be implemented into the existing facility over the next five years to maintain a safe, functional police facility, although lacking the required space to function efficiently in meeting today s and future policing needs. Upon completion and approval of the above list by the Town, a detailed estimated construction cost was prepared by the Cost Estimator for the Study. The Estimated Project Cost for renovating the Existing Building including site improvements with no Building Addition breaks down as follows: Estimated Construction Cost $3,116, (Refer to November 12, 2007 Cost Estimate by A.M. Fogarty) Temporary Modular Offices / Trailers (8 Months) $200, Soft Costs $829, (Twenty five percent (25%) is carried for Project Soft Costs that include: Project Contingency, Town s Project Manager, Town s Administrative Costs, Design Consultants Fees, Bonds, Insurance, Furnishings, Site Survey, Geotechnical Report, Police Details, Etc.) Total Estimated Project Cost $4,145, Notes for Option No. 1: 1. In accord with paragraph of Chapter 34, Repair, Alteration, Addition and Change of Use of Existing Buildings, of the Mass. State Building Code, 780 CMR, Sixth Edition, the structural systems of the existing Weston Police Station are required to conform to the code applicable at the time of its construction and to the requirements of 780 CMR , Alterations, Repairs and Changes of Use portion of 780 CMR , Structural Requirements for Existing Buildings, which would be generally inapplicable since there is no proposed structural alterations or change in use to the existing building. 2. In accord with paragraph of Chapter 34, energy conservation measures for the alterations to the existing Weston Police Station are required to be in conformance to 780 CMR , Energy Provisions for Existing Buildings, which provides a table of the required energy conservation performance by component (U or R-value for wall, roof, window, etc.) for building elements altered, but does not require compliance with 780 CMR, Chapter 13, Energy Conservation. 3. If the Town determines that the existing building should be renovated to remain the Weston Police Station for the foreseeable future, it would be prudent to consider renovation work on the existing building in addition to that required to comply with code, including additional work to improve the existing building's energy efficiency and to provide additional seismic resistance to the structure. 4. It is noted that the Estimated Construction Cost does not include renovations to the exterior single wyth structural CMU walls to comply with present day structural (earthquake and wind) and energy code requirements. 6 WESTON POLICE STATION CONDITIONS ASSESSMENT AND FEASIBILITY STUDY Option No. 2 Repair and Renovate Existing Building, plus Addition Renovation of existing Building and expansion / addition to the first floor and basement. There are two possible Site locations for the addition: to the west or south of the existing Building. The existing Building area is approximately 12,800 gross square feet and the proposed addition would be 8,000 gross square feet or 4,000 gross square feet per floor. The total gross square footage, existing and new is 20,800 gross square feet. Refer to Site Diagrams No. 1 and no.2 dated September 19, 2007 for recommended site layouts and option features. The new addition would be structurally separate from the existing Building which therefore would not be required to be brought up to meet current Codes for new construction. The addition would fully comply with the Commonwealth of Massachusetts, State Building Code, 780 CMR, Sixth Edition. Pro s: The Entire Site and Building Program is provided for except a number of parking spaces. Fifty nine (59) parking spaces programmed, forty (40) spaces provided Police Operations will remain on Existing Site which is centrally located within the Town of Weston Con s: Most expensive Option, ie: Exterior and interior walls are concrete masonry units with no provision for technology wiring, electric wiring and HVAC upgrades. To retrofit the Existing Building to meet present day requirements would be costly. The physical image of the Police Station will basically remain unchanged to the tax payer of Weston, especially if the addition is built behind the existing building Underpinning of existing building required at Addition Drive through Sallyport is not provided During renovation, detainees will have to be transported to a neighboring community or State Police Barracks During renovation, Police and Administrative Staff Operations will be required to work out of on-site trailers Upon completion of repairs and renovations to the Existing Building, it will not totally comply with present day Structural and Energy Code requirements The existing Building footprint is within the 100 Foot Wetlands Buffer Zone A major portion of the Building is in the Basement, providing no natural daylight. Further, in accord with paragraph of 780 CMR, if an addition is structurally separated from the existing building, the addition is required to conform to all the structural requirements for new construction but the existing portions of the structure need conform only to structural requirements for 780 CMR If the Town determines that the existing building should be renovated and expanded to be the Weston Police Station for the foreseeable future, it would be prudent to consider renovation work on the existing building in addition to that required to comply with code, including additional work to improve the existing building's energy efficiency and to provide additional seismic resistance to the structure. 5. It is noted that the Estimated Construction Cost does not include renovations to the exterior single wyth structural CMU walls to comply with present day structural (earthquake and wind) and energy code requirements. 6. To prepare the existing thirty five year old Police Station Site and Building, which no longer complies with present day Building and Energy Codes and does not provide for present day Police Operations will require a major, time consuming Selective Demolition process. The slow, careful demolition process must maintain the existing structure intact, including the exterior structural masonry walls, foundation walls, structural slab, roof structure, etc. while carefully removing the exterior doors, windows, skylights, roof mounted mechanical equipment, louvers, etc. and preparing the existing structure to receive DiMarinisi & Wolfe Architects Urban Designers Boston, Massachusetts 4

8 WESTON POLICE STATION CONDITIONS ASSESSMENT AND FEASIBILITY STUDY new materials and systems. The exterior walls and foundations must be cleaned, patched, re-pointed and waterproofed. All site structures, paving, landscaping, etc. must be removed and the site must be prepared to receive new site features. The interior of the building for the most part must be gutted, removing walls, ceilings, flooring, doors, mechanical / electrical systems, etc. and patching as required to receive new materials and systems. The interior existing structural slabs, walls and roof structure will require minimal non - structural changes to provide for proposed Police Operations. As stated above, Selective Demolition is time consuming and therefore an expensive construction process. Historically, site and buildings requiring major selective demolition and preparation for new construction are more costly than total demolition and building new. Option No. 3 New Two Story Building on Existing Police Station Site A new pitched roof two story masonry Building on the existing Police Station Site. The existing Building would be demolished in its entirety. The new Building would be approximately 20,800 gross square feet plus a usable attic for dead storage, mechanical equipment and future expansion. The elevator and egress stairs would extend up to the attic. Refer to Site Diagram No. 3, dated September 19, 2007 for recommended Site layout and Design Option No. 3, Schematic Design for New Building on Existing Site, dated January 16, Pro s: Town of Weston would have a new state-of-the-art Police Station Construction Cost would be lower than Option No. 2 The entire Building would comply with the requirements of the latest Building Codes The entire Site and Building Program is provided for except a number of parking spaces. The new Building would be approximately 20,800 gross square feet, with a partially usable attic for dead storage, mechanical equipment and future expansion. An elevator and egress stairs would provide access to the attic. Refer to Site Diagram No. 5, dated September 19, 2007 for recommended Site layout and Option features. A 2.24 Acre Lot would be required for this Option. It is noted that a 2.24 Acre Site located centrally in the Town of Weston for a new Police Station is most likely not available. However, resulting from a brief discussion with the Town Assessor, the following is hypothetically assumed for this Study: A centrally located commercial 2.24 acre lot with direct access to a major Town road would cost 2 to 2.5 million dollars. A centrally located one house 2.24 acre residential lot with direct access to a major Town road would cost 1.5 to 2 million dollars. The estimated lot costs can vary depending on location, abutters and site constraints. Pro s: Town of Weston would have a new state-of-the-art Police Station Construction Costs would be the lowest of all Options if a Town owned Site was available The recommended Facility Program can be provided for in its entirety on one floor, providing a very efficient operation The existing Police Operations will be unaffected during construction, avoiding the requirements and cost of moving into and out of temporary trailers during construction Detainees will not have to be transported to a neighboring community or State Police Barracks during construction The vacated Police Station Site and Building can be an opportunity for other Town needs that should be centrally located (see Con s below) The entire Building would comply with the requirements of the latest Building Codes The entire Site and Building Program is provided for. Unfinished Attic Space would be available for future use Drive through Sallyport provided Con s: Construction Costs would be the highest of all Options if Town owned Site is not available The vacated Police Site and Building can be a constraint for the Town if there are no other Town needs for the Site and Building. The Estimated Project Cost for a one story Police Station on a new Site, including Site Development is as follows: A. 11 WESTON POLICE STATION CONDITIONS ASSESSMENT AND FEASIBILITY STUDY Study Recommendations The Study s recommendation considered numerous factors. The major factors are cost, availability of sites to the Town of Weston, the physical condition of the existing Police Facility, possibilities for renovation and expansion of the existing Police Facility and the benefits of a totally new Police Facility on the Existing Site or a New Site. At the time of this Study, there were no new sites identified that would be centrally located, off a major roadway, of the required size or shape, that were owned by the Town of Weston, or available for purchase by the Town for a new Police Facility. Therefore the Option of a Police Facility on a new identified Site was not investigated. Option No. 4 hypothetically describes a Site that would meet the requirement for a new one story Police Facility and the estimated project cost. This option would be the least expensive to provide fully for the recommended Facility Program if a Town owned centrally located site was available and the most expensive if a centrally located Site had to be purchased for the recommended Facility. Option No. 1, renovation of the existing Building and Site in phases over the next five years, with no Addition, deleting some of the present day deficiencies, but not providing many of the requirements of the Facility Program or complying with portions of the present State Building Code was investigated in detail, providing a detailed Cost Estimate. It is estimated that it would cost over $4,000, over five years. The Town must evaluate spending $4,000, on the existing Building and Site, or spending $9,000, on a new Police Facility that meets present day and future needs and Code Requirements. The estimated Project Cost for Option No.2 renovation and expansion of the existing Police facility is estimated to be approximately $650, more expensive than Option No. 3, a totally new facility on the existing Site. Both Options would provide fully for the recommended Facility Program. However, Option No. 3 would function more efficiently and comply with present day Code requirements and be built outside the Wetland Buffer Zone. It is the finding of DiMarinisi & Wolfe s Study, resulting from the operational and space needs of the Town of Weston Police Department, that Option No. 3 best addresses the Town s needs while providing a codeconforming, state-of-the-art Police Facility. If the funds can be appropriated, providing a new Police Facility on the existing Site, Option No. 3, is the recommendation of this Study on how the Town of Weston should proceed to provide adequate facilities for their Police Department. The attached Construction Cost Estimate dated November 12, 2007 is for Renovation / Repair work in-place to the Existing Facility with no Building Expansion or Renovations to Exterior CMU Walls to comply with present day Energy and Structural (Earthquake) Code Requirements. It is estimated by DiMarinisi & Wolfe that an approximately 8600 GSF Addition would be required to meet present day and future space needs of the Police Department. 2. New Oil-fired Hot Water Boiler installed in Under the State AAB Code, Elevators are not required for employee only spaces located on the Lower (Basement) Level Under the Federal ADA requirements, if there are any staff members or members of the public that require access to the Lower Level, there should be an elevator. However, this is not entirely clear as the law is written with many exemptions, i.e. there is an exemption for two story building, except city, town and state offices. 4. Specifications are presently being drafted by the Town of Weston for lead removal and decontamination of the Firing Range. The existing Building would be demolished in its entirety. The new Building would be 19,300 gross square feet plus a usable attic for dead storage, mechanical equipment and future expansion. The elevator and egress stairs would extend up to the attic. Refer to Site Diagram, Option No. 3, dated January 16, 2008 for recommended Site layout and Option features The pro s of this Option are that the recommended Facility Program would be provided for except for a number of parking spaces, the Police Operations will remain on a Site that is centrally located within the Town, Construction Cost would be lower than Option No. 2, the new Building would be outside the 100 foot wetland buffer zone, unfinished attic space would be available for future use, no basement would be required, a drive thru secure Sallyport would be provided and the Town would have a new state-of-the-art police station that would provide for the Town s present and future police needs and comply with the latest Building Code requirements. The con s are that the Police would be required to operate out of on-site trailers for approximately one year and the new station would be two stories due to site constraints. One story stations are ideal, however often not possible or realistic due to site constraints within viable communities. Also, during construction, detainees will have to be transported to a neighboring community or the nearest State Police Barracks. This is inconvenient and not efficient for Police Operations. 180 WESTON POLICE STATION CONDITIONS ASSESSMENT AND FEASIBILITY STUDY 780 CMR CODE REVIEW Introduction The existing Weston Police Station was constructed in 1973 and has been in continuous operation since as the Town's police station. As an existing building presumed to have been built in compliance with the Mass. State Building Code in force at the time and with no current citations from local and state code enforcement officials for hazardous conditions or other code violations, the Weston Police Station is not required to comply with the provisions of the current Mass. State Building Code, 780 CMR - Sixth Edition, as amended. If, however, the Weston Police Station were to be renovated or added to, the Station would be subject to the provisions of 780 CMR Chapter 34, Repair, Alteration, Addition and Change of Use of Existing Buildings, or to whatever similar code requirements are applicable at the time of future work. With that point in mind, the following review is intended to assess the existing Weston Police Station in accord with requirements of the current Mass. State Building Code. Where the existing construction does not comply with current building code requirements, the issue is noted below in Bold Type. 780 CMR 3 - Use or Occupancy The Weston Police Station houses three principal uses: Police Operations, which is a Business Use Group B (780 CMR & Table 304.2); a Garage, which is a Low-Hazard Storage Use Group S-2, Public Garages, Group 2 (780 CMR & Table 311.3; 780 CMR 408.2); and Detention, which would be an Institutional Use Group I-3, Occupancy Condition V (780 CMR & ), were the number of detainees six or more. However, since the Weston Police Station now contains only five individual cells, the Detention area is not an I-3 Use as defined in 780 CMR 308.4, which leaves it unclassified. Presuming it's considered an R-1 Use (hotels, boarding houses, etc.), then it could be treated as an accessory area (780 CMR ) to the main Use Group of the Station, Business Use Group B, not requiring a fire separation assembly since it is less than 10% of the first floor area and less than 10% of the allowable area for an R-1 use in a Construction Type 2C building (780 CMR Table 503). Since the Station has two assigned Uses, Business Use Group B and Low-Hazard Storage Use Group S-2, the Station is designated a Mixed Use (780 CMR 302.2) and is required to comply with 780 CMR 313.0; and, since the two Uses are not demonstrably fire-separated, the Station is further classified as Nonseparated Use Groups (780 CMR ) and the allowable height and area for the entire building (780 CMR, Chapter 5) are required to be those of the more restrictive Use Group. In the case of Use Groups B and S-2, the height and area limitations are the same (780 CMR Table 503) and neither Use Group is more restrictive. Specific occupancy areas in the building are required to comply with the fire-separation and protection requirements in 780 CMR Table The specific occupancy areas in the Station subject to such requirements are the Boiler Room and Storage Rooms greater than 100 square feet. (Note: Storage Rooms greater than 50 square feet but less than 100 square feet are also subject to separation/protection requirements, but there are no Storage Rooms of that size in the Business Use Group areas of the Station since the two basement storage spaces, B05/B06, which are 84 square feet and 72 square feet respectively, are connected to form a single space of 156 square feet.) 181 WESTON POLICE STATION CONDITIONS ASSESSMENT AND FEASIBILITY STUDY The Boiler Room is required to have 1-hour construction or a fire-suppression system. The Station does not have a fire-suppression system, but the Boiler Room construction meets the 1-hr. rating with CMU and concrete walls, concrete ceiling and an A-label door. Storage rooms in the Business Use portion of the Station greater than 100 square feet are required to have an automatic fire suppression system with smoke partitions. Since the existing Station does not have an automatic fire suppression system, Record Storage Room B04, Long Term Storage Room B05/B06, Copy/Fire Room 106 and Storage Room 128 do not meet this requirement. Fire Suppression System would be required to meet current code. The wire mesh partitioned storage areas in the Garage are not subject to the fireseparation and protection requirements of Table because the Garage is a Storage Use, which is not included in the Table. 780 CMR 4 - Special Use and Occupancy If police cars are not classified as commercial vehicles, the Station's garage could be a Private Garage in accord with 780 CMR 407.2, since the garage is designed for four vehicles and without provision for repairing or servicing such vehicles for profit. Alternately, if police cars are classified as commercial vehicles, the Station's garage could be considered a Group 2 Public Garage in accord with 780 CMR 408.2, which is defined as a garage occupied exclusively for passenger vehicles that will accommodate not more than nine passengers. As noted above, this Code Review treats the Station's garage as a Group 2 Public Garage, making it a Low-Hazard Storage Use Group S-2 (780 CMR Table 311.3). Also, the difference between a Private Garage and Group 2 Public Garage is not consequential for the Weston Police Station since a Private Garage attached to another building is required to comply with the Mixed Use requirements of 780 CMR for Public Garages (780 CMR 407.1). The provisions of 780 CMR regarding Use Group I-3 are not applicable to the Weston Station because the number of detention cells, and presumably the number of detainees, is not six or more (780 CMR 308.4). 780 CMR 5 - General Building Limitations The allowable building height and area per floor for a building are determined by its Use(s) and Construction Type (780 CMR 6) in accord with 780 CMR Table 503 and applicable modifications. CMU carried one course above the ceiling, which does not provide the 1 Hr. fire-resistance required. 3. A smoke barrier is required for storage rooms greater than 100 square feet in area in Business B Uses (780 CMR Table ) in addition to an automatic fire suppression system, as previously discussed. As shown on the original construction documents some of the partitions around the large storage rooms are 6 in. CMU carried one course above the ceiling, which does not provide either the 1 Hr. fireresistance or the smoke barrier required. 780 CMR 7 - Fire Resistant Materials and Construction The fire separation distance of the Weston Police Station exceeds 30 feet on all sides; therefore, the exterior wall fire-resistance rating from 780 CMR Table is 0 Hr. Similarly, the maximum area of exterior wall openings has no limit in accord with 780 CMR Table The requirements relative to the existing Station for fire-resistance ratings for shafts (780 CMR 710.0) and smoke barriers (780 CMR 712.0) are discussed above. Current code contains requirements for fire-stopping through-penetrations of rated construction (780 CMR thru 713.0). Given the age of the Weston Police Station, it is probable that the fire-stopping of through-penetrations does not meet current code. However, since the existing building is not required to meet current code and examining the existing through-penetrations would likely require exploratory/demolition work, compliance to current code of the existing through-penetration fire-stopping should not be an issue at this time. The existing doors in fire-rated construction are shown in the original construction drawings with fire-resistance rating labels some of which meet current code requirements and some that do not (780 CMR Table 716.1). For example, the door to Basement Exit Stair Space B08 has a "B" Label, which satisfies current code, but the door to the First Floor Exit Stair Space 141 has a "C" Label, which does not meet current code. Also, most of the doors opening into exit access corridors are not listed as labeled. Under current code the exit access corridor doors should have a 1/3 Hr. rating if the building does not have a fire-suppression system (780 CMR Table & Table ). As with through-penetration fire-stopping, the labeling of firedoors should not be an issue at this time. Current code requires labeled fire dampers in ducts penetrating fire-resistance rated construction (780 CMR 717.0). Similar to the discussion above about through-penetration firestopping and fire-door ratings, the existence and appropriate labeling of fire dampers should not be an issue at this time since the building is not required to meet current code. The original construction documents for the Station show the inside face of the exterior CMU wall with urethane foam insulation adhered to it and covered with gypsum board. Current code requires concealed insulation to have a flame spread rating of 75 or less and a smokedeveloped rating of 450 or less when tested in accord with ASTM E84 (780 CMR 722.3). Whether the insulation actually installed complies with current code cannot be known without sampling and testing the installed material. As with the other issues discussed above, the conformance or non-conformance of the existing insulation should not be an issue at this time. 184 WESTON POLICE STATION CONDITIONS ASSESSMENT AND FEASIBILITY STUDY 780 CMR 8 - Interior Finishes The code requirements for flame spread ratings for interior finishes are presented in 780 CMR 803.0, including 803.2, & Table The existing finishes are likely to meet the current code requirements, but full determination of code compliance would require sampling and testing the existing finishes, which is not necessary at this time. 780 CMR 9 - Fire Protection Systems The existing Station does not have an automatic fire suppression system - sprinklers - as required by 780 CMR for Use Group B buildings of 12,000 square feet or more. As noted in the discussions above, the Station as an existing building is not required to comply with current code, but installation of an automatic fire suppression system would resolve other code compliance issues and may be required if extensive renovations are undertaken. 780 CMR 10 - Means of Egress The existing Station's conditions relative to the current code requirements for egress are as follows: The second means of egress for spaces along Corridor 117 traverses a passage at the back of Dispatch 120. Egress through another space is not in compliance with 780 CMR The maximum length of exist access travel is approximately 130 feet in the Basement and 100 feet on the First Floor, complying with 780 CMR Table , which limits the maximum length to 200 feet in an unsprinklered Business B Use building. Accessible means of egress (780 CMR ) are discussed in the separate report on accessibility by Deborah A. Ryan & Associates. The maximum occupant load for the existing Station is 117 people, calculated in accord with 780 CMR Table First Floor: Business Use - 7,472 1 Person/100 SF = 75 Garage - 1,450 1 Person/200 SF = 8 Total Occupants for First Floor 83 Basement: Business Use - 2,967 1 Person//100 SF = 30 Storage & Mechanical - 1,100 1 Person /300 SF = 4 Total Occupants for Basement 34 The minimum widths of the building's egress components are required to be as calculated from the occupant loads (780CMR Table ) or to meet the minimums for each specific egress element given in other code sections (780 CMR , , & ), whichever width is greater. The calculated widths for egress components in the existing Station, shown below, are less than the minimum widths: Stairways from Basement: 34 x 0.3 in. = 10.2 in. Means of Egress Doors (1017.3) 32 in. 36 in.* (*Excluding 30 in. doors to Toilet 115 & Evidence 142) The two exits from the Basement and the First Floor comply with the requirements of 780 CMR Table Current code limits stair riser height to a maximum of 7 inches and tread depth to a minimum of 11 inches (780 CMR ). Existing interior stair riser height of 7.11 in. and tread depth of 10-5/8 in. and exterior tread depth of 10.5 in.; hence, existing stair tread and riser dimensions do not comply with current code. Exterior exit stairs are required to be protected from snow and ice accumulation (780 CMR ). The exterior exit stair from the Basement is partially protected by the building above; however, where the stair comes out from under the slab of the First Floor it is not protected as required by current code. Existing stair handrails and guardrails do not meet current code, as follows: Guard height of 33 in. is less than mandated 34 in. (780 CMR ) Guards are open without required opening limitations. (780 CMR ) Handrail height of 33 in. is less than mandated 34 in. (780 CMR ) Handrail ends do not extend 12 in. beyond top riser. (780 CMR ) 780 CMR 11 - Accessibility - See the Deborah A. Ryan & Associates report. 780 CMR 12 - Interior Environment There are no current Interior Environment code issues for the existing Station. 780 CMR 13 - Energy Conservation The existing Station was not designed or constructed to conform to the current code's Energy Conservation requirements. 780 CMR 14 - Exterior Wall Coverings Current code requires exterior masonry walls, such as those at the Station, to be designed and constructed in accordance with 780 CMR 21, which stipulates structural requirements for masonry construction. The building was recently reroofed, work which was presumably in accordance with 780 CMR & CMR 16 - Structural Loads - See the Lin Associates report. 780 CMR 17 to 33 The matters in these Chapters of the current 780 CMR are not germane to this Review because they deal with specific construction material requirements - concrete, lightweight metals, steel, wood, glass and glazing, gypsum board and plaster, and plastic; or because they deal with construction matters outside the review's purview - structural tests and inspections, foundations and retaining walls, mechanical systems, electrical, plumbing, elevators, special construction, construction in the public right-of-way, site work and demolition 780 CMR 34 - Repair, Alteration, Addition and Change of Use of Existing Buildings The requirements of Chapter 34 would be the controlling code if the existing Weston Police Station were to be renovated or added to. If the Station were to be maintained as a police station, then the renovation/addition work would be subject to 780 CMR , Requirements for Continuation of the Same Use Group The provisions of that could have a major effect on renovations/additions to the existing Station are: The requirements of 780 CMR , Structural Requirements for Existing Buildings, as applicable, will apply to the work (780 CMR ). (See the Lin Associates report.) Any new building systems or portions thereof are to conform to current code requirements to the fullest extent practical (780 CMR ). Means of egress shall be safe and conform to current code (780 CMR , , & ). A fire-protection system will have to be installed if the building is substantially altered or substantially renovated (780 CMR & ). Accessibility improvements will have to be made in accordance with the Mass. AAB Regulations, 521 CMR (780 CMR ). Energy conservation requirements are to conform to 780 CMR 3407 (780 CMR ). 188 WESTON POLICE STATION 521 CMR and ADAAG Compliance Review The following report prepared by Deborah A. Ryan & Associates is based upon plans provided by DiMarisini & Wolfe Architects. The plans provided are dated February 28, 1973 by Shepley Bulfinch Richardson and Abbott as well as existing conditions plans prepared by DiMarinisi & Wolfe Architects dated Sept. 19, The review outlines the general requirements under 521 CMR dated Jan. 27, 2006 as well as Title II of the ADA, using the Americans with Disabilities Act Accessibility Guidelines. 521 CMR, Rules and Regulations of the Massachusetts Architectural Access Board: The building is an existing single story, plus basement police station. As an existing building the extent of compliance required with 521CMR will depend upon the estimated cost of construction compared to the assessed value of the building. The requirements of Section 3.3 state: 3.3 EXISTING BUILDINGS All additions to, reconstruction, remodeling, and alterations or repairs of existing public buildings or facilities, which require a building permit or which are so defined by a state or local inspector, shall be governed by all applicable subsections in 521 CMR 3.00: JURISDICTION. For specific applicability of 521 CMR to existing multiple dwellings undergoing renovations, see 521 CMR If the work being performed amounts to less than 30% of the full and fair cash value of the building and a. if the work costs less than $100,000, then only the work being performed is required to comply with 521 CMR or b. if the work costs $100,000 or more, then the work being performed is required to comply with 521 CMR. In addition, an accessible public entrance and an accessible toilet room, telephone, drinking fountain (if toilets, telephones and drinking fountains are provided) shall also be provided in compliance with 521 CMR If the work performed, including the exempted work, amounts to 30% or more of the full and fair cash value (see 521 CMR 5.00) of the building the entire building is required to comply with 521 CMR.
