1 .15 Qual Rse Rules.15.1 Zone Purpose The purpose of the Qual Rse Zone s to provde low densty resdental and rural resdental lvng wthn a hgh amenty area, n a locaton affordng good access to sun and vews of the surroundng landscape Dstrct Rules Attenton s drawn to the followng Dstrct Wde Rules whch may apply n addton to any relevant Zone Rules. If the provsons of the Dstrct Wde Rules are not met then consent wll be requred n respect of that matter. Resdental Actvtes Resdental actvtes provded the maxmum number of resdental unts whch may be erected wthn the zone (excludng Actvty Area R1 Lots 1 and 3 DP ) shall not exceed (see also rule ) provded that no more than one resdental unt s permtted per allotment. Wthn the R and R1 Actvty Areas the external appearance and locaton of all buldngs and the effect of earthworks, on landscape and vsual amenty values of the area ncludng coherence wth surroundng buldngs. - 1

2 Wthn the R2 and R2(A)-(D) Actvty Areas the erecton of any buldngs n respect of: Commercal Recreaton Facltes Lmted to equestran centre, stables and assocated facltes. () () () (v) External appearance; and Access and earthworks; and Interor and exteror lghtng; and Landscapng, ncludng the protecton of any exstng or proposed trees. Wthn the R2 (Desgn Urban Edge) Actvty Area the erecton of any buldngs wthn an approved resdental buldng platform n respect of: v Vstor Accommodaton Secton.13.6 contans the assessment matters whch apply to the consderaton of applcatons for resource consents for vstor accommodaton n the Qual Rse zone. Commercal Actvtes Except retal sales Tree Removal and Toppng () () () (v) External appearance; and Access and earthworks; and Interor and exteror lghtng; and Ste specfc landscapng to complment the purpose of the G (Desgn Urban Edge), ncludng the protecton of any exstng or proposed trees. Note: Zone Standard (x) v Parkng, Loadng and Access Parkng, loadng and access n respect of earthworks and the mpact on the safety and effcency of the surroundng road network and the number of parkng spaces to be provded and n respect of the vsual mpact of earthworks. Secton.13.6 contans the assessment matters whch apply to the consderaton of applcatons for resource consents for buldngs, parkng, loadng and access n the Qual Rse zone Dscretonary Actvtes The removal or toppng of any tree from Actvty Area G, except for the followng wldng speces: Radata pne (Pnus Radata); Contorta or Lodgepole pne (Pnus contorta); Scots pne (Pnus sylvestrs) European larch (Larx decdua); Corscan pne (Pnus ngra); and Pseudotsuga menzes (Douglas fr). The removal or toppng of any tree from the G (DUE), R2, R2(A)-(D) or R2 (Desgn Urban Edge) Actvty Areas, except such removal as approved by a resource consent (land use or subdvson) Non-Complyng Actvtes The followng shall be Non-Complyng Actvtes, provded that they are not lsted as a Prohbted Actvty: Factory Farmng The followng shall be Dscretonary actvtes provded they are not lsted as a Prohbted or Non-complyng actvty and they comply wth the relevant Zone standards: Forestry Actvtes Mnng Actvtes - 2

Buldngs Any buldngs wthn Open Space G, as shown on the Qual Rse Structure Plan An buldngs wthn the R2 (Desgn Urban Edge) Actvty Area that are not located wthn a resdental buldng platform approved by resource consent. Any applcaton for a resource consent for the followng matters may be consdered wthout the need to obtan a wrtten approval of affected persons and need not be notfed n accordance wth Secton 93 of the Act, unless specal crcumstances exst n relaton to any such applcaton: All applcatons for Controlled Actvtes Standards - Actvtes Ste Standards Structure Plan The stng of buldngs and actvtes must be n conformty wth the relevant Structure Plan except for Accessory, Utlty and Servce Buldngs less than 40 m² floor area. The locaton of actvtes as provded for by the Structure Plan s restrcted to the followng: v Any buldng wthn the R2, R2(A)-(D) or R2 (Desgn Urban Edge) Actvty Areas wthn an area annotated Buldng Restrcton Area on the Structure Plan. Any actvty whch s not lsted as a Prohbted Actvty and whch does not comply wth one or more of the relevant Zone Standards shall be a non-complyng actvty Prohbted Actvtes The followng shall be Prohbted Actvtes: Panelbeatng, spray pantng, motor vehcle repar or dsmantlng, fbreglassng, sheet metal work, bottle or scrap storage, motorbody buldng, fsh or meat processng, or any actvty requrng an Offensve Trade Lcence under the Health Act Non-Notfcaton of Applcatons Resdental Actvtes Area R R1, R2, R2(A)-(D) and R2 (Desgn Urban Edge) - the use of these areas s restrcted to Resdental Accommodaton (and Vstor Accommodaton as a dscretonary actvty). Resdental Actvtes Area RR - the use of ths area s restrcted to Resdental Accommodaton (and Vstor Accommodaton as a dscretonary actvty) provded that no more than one resdental unt may be establshed per 4000m² of ste area. Open Space G - the use of ths area s restrcted to outdoor recreaton actvtes and open space. Open Space G (Desgn Urban Edge) The purpose of ths area s establsh landscapng that wll make buldngs wthn the R2 (DUE) Actvty Area not vsble from State Hghway 6. Setback from Roads and Internal Boundares - 3

4 No buldng or structure shall be located closer than 6m to the zone boundary. No buldng or structure shall be located wthn 10 m of Jm s Way or Tucker Beach Road. The mnmum setback from nternal boundares and road boundares other than descrbed n and above shall be 4m. Earthworks ste boundary (see nterpretatve dagram 6). Except where the cut or fll s retaned, n whch case t may be located up to the boundary, f less or equal to 0.5m n heght. The maxmum heght of any cut shall not exceed 2.4 metres. The maxmum heght of any fll shall not exceed 2 metres. 3. Envronmental Protecton Measures The followng lmtatons apply to all earthworks (as defned n ths Plan), except for earthworks assocated wth a subdvson that has both resource consent and engneerng approval. 1. Earthworks The total volume of earthworks does not exceed 100m³ per ste (wthn a month perod). For clarfcaton of volume, see nterpretatve dagram 5. The maxmum area of bare sol exposed from any earthworks where the average depth s greater than 0.5m shall not exceed 200m² n area wthn that ste (wthn a month perod). Where any earthworks are undertaken wthn 7m of a Water body the total volume shall not exceed 20m² (notwthstandng provson ). No earthworks shall: () () () 2. Heght of cut and fll and slope expose any groundwater aqufer; cause artfcal dranage of any groundwater aqufer; cause temporary pondng of any surface water. The vertcal heght of any cut or fll shall not be greater than the dstance of the top of the cut or the toe of the fll from the Where vegetaton clearance assocated wth earthworks results n areas of exposed sol, these areas shall be revegetated wthn months of the completon of the operatons. Any person carryng out earthworks shall: () () Implement eroson and sedment control measures to avod sol eroson or any sedment enterng any water body. Refer to the Queenstown Lakes Dstrct earthworks gudelne to assst n the achevement of ths standard. Ensure that any materal assocated wth the earthworks actvty s not postoned on a ste wthn 7m of a water body or where t may dam or dvert or contamnate water. Any person carryng out earthworks shall mplement approprate dust control measures to avod nusance effects of dust beyond the boundary of the ste. Refer to the Queenstown Lakes Dstrct earthworks gudelne to assst n the achevement of ths standard. 4. Protecton of Archaeologcal stes and stes of cultural hertage The actvty shall not modfy, damage or destroy any Waah Tapu, Waah Taoka or archaeologcal stes that are dentfed - 4

5 v n Appendx 3 of the Plan, or n the Ka Tahu k Otago Natural Resource Management Plan. The actvty shall not affect Nga Tahu s cultural, sprtual and tradtonal assocaton wth land adjacent to or wthn Statutory Acknowledgment Areas. External Appearance of Buldngs Total resdental unts There s no maxmum number of resdental unts wthn Actvty Area R1 (Lots 1 and 3 DP ) The prncpal roof of all buldngs must be desgned wth a mnmum ptch from the horzontal of 25. The angle of the ptch shall be towards the centre of the buldng from the longest external sde of the buldng. Stage 1 ncludes Lots 1 and 2, DP , Lots 20, 22-45, and -16. Stage 1a ncludes Lots 1, 2 and 6-11, DP 27481, 17 and Zone Standards Stage 1b ncludes Lots Resdental Unts The maxmum number of resdental unts permtted wthn the zone (excludng Actvty Area R1 Lots 1 and 3 DP ) s The unts are to be allocated on the bass of one unt per allotment as set out below: Stage 2 ncludes Lots 5, 46, and Stage 2a ncludes Lots 78-82, Stage 2b ncludes Lots 117, 118 and 100. Stage 1 35 resdental unts Stage 1a 10 resdental unts Stage 1b 7 resdental unts Stage 2 39 resdental unts Stage 2a 21 resdental unts Stage 2b 3 resdental unts Lot 6, DP resdental unts Lot 7, DP resdental unts Lot 2, DP resdental unts Lot 4, DP resdental unts Lot 6, DP resdental unts Actvty Area R2(A) 2 resdental unts Lot 6, DP Actvty Area R2(B) 5 resdental unts Actvty Area R2(C) 30 resdental unts Actvty Area R2(D) 20 resdental Unts Buldng Heght The maxmum heght of buldngs and other structures n the R and R1 Actvty Areas shall be 7m. Wthn the R2, R2(A)-(D) and R2 (Desgn Urban Edge) Actvty Areas no part of any buldng and other structure shall protrude through a surface drawn parallel to and 5m vertcally above ground level. Glare All fxed lghtng shall be drected away from adjacent roads and propertes. - 5

6 v v (e) Any buldng or fence constructed or clad n metal, or materal wth reflectve surfaces shall be panted or otherwse coated wth a nonreflectve fnsh. No actvty shall result n a greater than 3.0 lux spll, horzontal and vertcal, of lght onto any property located outsde of the Zone, measured at any pont nsde the boundary of the adjonng property. No exteror lghtng wthn the R2 and R2(A)-(D) Actvty Areas shall be vsble from State Hghway 6. Servcng All servces are to be retculated underground. All development shall be served by a communal sewage and water scheme. Ste Coverage The maxmum ste coverage for any allotment wthn the R Resdental Actvty Area of the Qual Rse Zone shall be 30%. The maxmum ste coverage for any allotment wthn the R1 Resdental Actvty Area of the Qual Rse Zone equal to or less than 800m² wll be 200m². The maxmum ste coverage for any allotment wthn the R1 Resdental Actvty Area of the Qual Rse Zone greater than 800m² wll be 25%. The maxmum ste coverage for any allotment wthn the R2 and R2(A) (D) Resdental Actvty Areas (excludng R2 (Desgn Urban Edge) Actvty Area) of the Qual Rse Zone wll be 30%. The maxmum ste coverage for any allotment wthn the Rural Resdental Actvty Area of the Qual Rse zone shall be 15%. Note: Ste Coverage wthn the R2 (Desgn Urban Edge) Actvty Area s controlled by the requrement for all buldngs to be wthn a resdental buldng platform and for any dentfed resdental buldng platforms to not exceed 30% of the net ste area. v Nature and Scale of Actvtes No goods, materals or equpment shall be stored outsde a buldng, except for vehcles assocated wth the actvty parked on the ste overnght. All manufacturng, alterng, reparng, dsmantlng or processng of any materals, goods or artcles shall be carred out wthn a buldng. v Nose Non-resdental actvtes shall be conducted so the followng nose levels are not exceeded at the boundary of the zone: Daytme hours 50 dba L 10 Nght-tme hours 40 dba L 10 and 70 dba L max Nose levels shall be measured and assessed n accordance wth NZS 6081:1991 and NZS 6802:1992. Constructon nose shall comply wth and be measured and assessed n accordance wth the relevant NZ Standard. v Access There shall be no vehcular access to the Qual Rse Zone from State Hghway 6. All access shall be from Tucker Beach Road or Jm s Way, provded that no traffc assocated wth constructon or development on the land shall be permtted to use the exstng access mmedately to the west of that land (Lot 5,DP 22166). x Arrow Irrgaton Race In the Qual Rse zone the Water User shall not obstruct access by the Arrow Irrgaton Company to any rrgaton works on or off the Water User s land and shall not plant trees or construct works whch would obstruct such access or - 6

7 nterfere wth the rrgaton works and shall ensure that such access to the Water User s land s always kept avalable to the Company. Further to ths rule, the Water User shall ensure that, wthout the consent of the company (not to be unreasonably wthheld): On slopes of 0º - º no buldngs, excavatons or tree plantng shall be effected wthn 6 m of an rrgaton race. On slopes of º - 20º no buldngs, excavatons or tree plantng shall be effected wthn 7 m of an rrgaton race. Wthn Actvty Areas R2(A)-(D) all buldngs or part of a buldng, or any new alteraton or addton to a buldng or part of a buldng, to be used for resdental actvtes, vstor accommodaton or communty actvtes shall be acoustcally nsulated from arcraft nose so as to acheve an ndoor desgn sound level of 40 dba Ldn, except for noncrtcal lstenng envronments where no specal sound nsulaton s requred. Ths control shall be met n ether of the followng two ways: EITHER: On slopes of greater than 20º no buldngs, excavatons or tree plantng shall be effected wthn 10 m of an rrgaton race. No fences shall be erected wthn 6 m of the waters edge of an rrgaton race except for those whch cross any access track. () By provdng a certfcate from a recognsed acoustc engneer statng that the proposed constructon wll acheve the nternal desgn nose level. OR: Gates shall be provded and pad for by the water user and located n a poston approved by the company. x x Buldngs R2 (Desgn Urban Edge) Actvty Area No buldng shall be erected wthn the R2 (Desgn Urban Edge) wthn a perod of fve years from the date the Councl certfes that the landscapng work approved by resource consent pursuant to Rule (v)() s complete. Upon applcaton by the consent holder that the landscapng work s complete as the Councl shall nspect the landscapng and certfy that t s complete as soon as practcable. For the purpose of and above s complete shall mean when all the landscapng work has been undertaken n accordance wth the resource consent. Arport Measures - Queenstown Arport () The buldng shall be constructed and fnshed n accordance wth the provsons of Table 2 appended to ths rule. Where two or more layers of glass are employed wth an ar gap between, total thckness of wndow glass may be calculated as the total of all glass layers (excludng ar gap) provded that at least one glass layer shall be of a dfferent thckness to the other layer(s). * If ar condtonng s provded to any space then the hgh settng ventlaton requrement for that space s not requred Resource Consent Assessment Matters In consderng whether or not to grant consent or mpose condtons, the Councl shall have regard to, but not be lmted by, the followng assessment matters: x Ventlaton Requrements General Wthn Actvty Areas R2(A), R2(B), R2(C) and R2(D) mechancal ventlaton that comples wth the followng table shall be nstalled n all buldngs to be used for resdental or vstor accommodaton actvtes. For all resource consent applcatons, ncludng subdvson, the Councl shall consder the relatonshp of open space wthn the Qual Rse zone to the surroundng rural area, and the densty of development n terms of: Room Type Prncpal Lvng Areas Other habtable areas Outdoor Ar Ventlaton Rate Low Settng* Hgh Settng* 1-2ac/hr Mn. 15ac/hr 1-2 ac/hr Mn. 5ac/hr the mpact on the vsual qualty and amenty values both wthn the zone and the surroundng landscape; the vsual mpact on any sgnfcant landforms; the senstvty of the landscape; proposed rehabltaton measures; and ntegrated management of open space wthn a proposed development, whether n ndvdual or common ownershp. Whether, and to what extent, the proposed development s vsble from scenc rural roads and other publc places. - 8

9 Whether the actvty wll exacerbate any natural hazard, ncludng eroson, sedmentaton, excessve water run-off, subsdence and landsldes. v Provson for buses. Earthworks v The extent to whch the scale of the actvty and the use of the buldngs wll be compatble wth the scale and nature of other actvtes and buldngs and open space n the area. Parkng, Loadng and Access. Buldngs The level of parkng provson s approprate havng regard to standards for smlar actvtes as set out n Rule 14, Transport. The desgn, locaton and access s safe. A tradtonal peak roof form of slate, shngles or coloursteel. Predomnant colours of grey and earth tones. External above ground claddng s predomnantly dry stack stone, plaster, natural tmber, and/or weatherboards. Buldngs and structures are screened by landscapng and, f necessary land forms, n order to reduce ther vsual promnence as seen from surroundng publc roads beyond the Qual Rse Specal Zone. Vstor Accommodaton Locaton of buldngs on ther ste. Desgn and external appearance of buldngs (see also secton.13.6 Parkng (see also secton.13.6 ()). 1. Envronmental Protecton Measures The extent proposed sedment/eroson control technques are adequate to ensure that sedment remans on-ste. Whether the earthworks wll adversely affect stormwater and overland flows, and create adverse effects off-ste. Whether earthworks wll be completed wthn a short perod, reducng the duraton of any adverse effects. Where earthworks are proposed on a ste wth a gradent >18.5 degrees (1 n 3), whether a geotechncal report has been suppled to assess the stablty of the earthworks. (e) Whether approprate measures to control dust emssons are proposed. (f) Whether any groundwater s lkely to be affected, and any mtgaton measures are proposed to deal wth any effects. NB: Any actvty affectng groundwater may requre resource consent from the Otago Regonal Councl. 2. Effects on landscape and vsual amenty values Whether the scale and locaton of any cut and fll wll adversely affect: - the vsual qualty and amenty values of the landscape; - the natural landform of any rdgelne or vsually promnent areas; - the vsual amenty values of surroundng stes. - 9

10 Whether the earthworks wll take nto account the senstvty of the landscape. The potental for cumulatve effects on the natural form of exstng landscapes. The proposed rehabltaton of the ste. 3. Effects on adjacent stes: Whether the earthworks wll adversely affect the stablty of neghbourng stes. Whether the earthworks wll change surface dranage, and whether the adjonng land wll be at a hgher rsk of nundaton, or a rased water table. Whether cut, fll and retanng are done n accordance wth engneerng standards. 4. General amenty values Whether the removal of sol to or from the ste wll affect the surroundng roads and neghbourhood through the deposton of sedment, partcularly where access to the ste s ganed through resdental areas. Whether the actvty wll generate nose, vbraton and dust effects, whch could detract from the amenty values of the surroundng area. Whether natural ground levels wll be altered. 5. Impacts on stes of cultural hertage value: Whether the subject land contans Waah Tapu or Waah Taoka, or s adjacent to a Statutory Acknowledgment Area, and whether tangata whenua have been notfed. v (e) v (e) Whether the subject land contans a recorded archaeologcal ste, and whether the NZ Hstorc Places Trust has been notfed. Commercal Actvtes Whether the actvty wll create any adverse effect through addtonal traffc and parkng generaton. Whether the locaton and desgn of vehcle access and loadng areas s such that t ensures safe and effcent movement of pedestrans, and vehcles on adjonng roads. Whether the actvty wll result n loss of prvacy to surroundng landowners. Whether the actvty s of a nature and scale compatble wth resdental actvtes, and therefore does not result n the loss of resdental amenty and character. The extent to whch the commercal actvty provdes a local functon by provdng for the needs of nearby resdents. Tree Removal and Toppng The extent to whch removal or toppng of the tree s necessary due to the health of the tree or any potental hazard that exsts. Whether the tree or trees currently mtgate the adverse vsual effects of any development, or may be requred to do the same n the future. The extent to whch the removal or toppng of a tree or trees exposes development when vewed from publc roads and other publc places outsde of the Zone. Whether the tree or trees serously restrct approprate development. Any substtute or compensatng tree plantng or landscapng proposed. - 10

11 v (e) x Landscapng G (Desgn Urban Edge) and r2 (Desgn Urban Edge) Actvty Area s The heght to whch the proposed vegetaton wll grow, and whether ts characterstcs are approprate wthn the surroundng envronment. The potental for the proposed vegetaton to adversely affect ndgenous and/or endemc vegetaton. Whether the proposed vegetaton and any proposed structures, ncludng fences, wll result n an unnatural appearance of the landscape when vewed from the State Hghway. Whether the proposed vegetaton and any proposed structures, ncludng fences, wll blend wth and enhance the natural vegetatve pattern of the envronment; and Whether the proposed landscapng s effectve n makng any resdental buldng platforms not vsble from State Hghway 6. Buldng Heght The extent to whch any buldng or structure wll be vsble from publc roads or other publc places; and Whether the proposed buldng or structure s lkely to affect the apprecaton of landscape values of the wder landscape. - 11

12 OTHER AMENDMENTS 1. Qual Rse Structure Plan It s proposed that the exstng Qual Rse Structure Plan on page -113 of the Dstrct Plan be amended n accordance wth the proposed rezonng. An amended Qual Rse Structure Plan has been prepared by Clark Fortune McDonald & Assocates as attached. 2.
