Call to Order Mr. Winnette called the meeting to order at 6:00 P.M. He stated that the technical qualifications of the Commission and the staff are on file with the City of Frederick and are made a part of each and every case before the Commission. He also noted that the Frederick City Historic Preservation Commission uses the Guidelines adopted by the Mayor and Board of Aldermen and the Secretary of the Interior s Standards for Rehabilitation published by the U. S. Department of the Interior, National Park Service, and these Guidelines are made a part of each and every case. All cases were duly advertised in the Frederick News Post in accordance with Section 301 of the Land Management Code. Announcements There were no announcements. II. Approval of Minutes 1. July 26, 2012 Hearing/Workshop Minutes Motion: Stephen Parnes moved to approve the July 26, 2012 hearing and workshop minutes as written. III. HPC Business 1

Presentation of FFY2011 Certified Local Government Grant Project Frederick Historic District Database and Map Discussion Ms. Murphy stated that this is the same website that was presented to the Commission at the last hearing and she hoped most of them have had the opportunity to take a look to see if they found any issues. She added that there are a few things she has come across that they will be fixing before it is sent to MHT for review. Mr. Winnette stated that he found the photographs to be very helpful 5. Presentation of Memo on Hotel Project/Preservation Issues Discussion Ms. Murphy stated that they looked at all of the sites that were identified in the Critique/Update of the Market and Economic Analysis for the proposed full service downtown hotel in Frederick, MD dated July 2012 and staff went through each site. Ms. Murphy mentioned the sites listed and gave a brief summary of each. Public Comment Anthony Moscato, resident at 9 E. South Street, stated that he wanted to express his interest and concern. he stated it is a wonderful idea to have a possible downtown hotel but some of the things he really wanted to emphasize are the streetscape and sky line. He added that those are two things he would like the Commission to think about and focus on when determining whether to approve a site for the hotel. He stated that one thing he has seen related to the sites is that there is a contributing structure at the Frederick News Post site and another structure that is there is the tannery which has a long history in Frederick. Kate McConnell, resident at 117 E. 5 th Street, stated that she understood that they are early in the process but she wanted to point out that the timeline for the hotel selection process is a concern to her. She added that going to the HPC for review is pretty late in the selection process and that does set up the perception that historic preservation could be a hindrance to redevelopment in downtown. She went on to say that her feeling and belief is that reuse of the tannery and incorporation of that building into the hotel site made early in the process could be a great benefit to the City and the citizens of Frederick. She said that the tannery is one of only five historic buildings that are in the block along Carroll Creek between Market and East Street. She added that she would recommend that the City place some greater importance on historic resources on the Frederick News Post property early on if that is one of the sites they do select. IV. Market Street 6601 Suitland Road, LLC Level I New Construction Public Comment Margaret Kline, resident at 105 W. 2 nd Street, stated that her corporation has some ownership that goes around the property that they are talking about and they had concerns regarding that. She went on to say that the backs of these properties would be seen from a public point of view. She stated that this property should be looked at in all aspects for highest and best use of a very important site in the downtown area. Motion: Shawn Burns moved to grant Level 1 approval for the drawings dated 7/31/2012 because the location, footprint, massing, height, setbacks, scale, façade, roof form, materials and plot plan are compatible with the streetscape and surrounding historic properties and that during the Level II review process the Commission will consider and review the proposal in more detail including texture, openings, lighting, landscape, site plan, final articulation, detailed façade elevations and fenestration, specific product information and cut sheets. Vote: 6 1, Gary Baker opposed 8. HPC E. 5 th Street WSD Capital, LLC Construct a two story addition Motion: Timothy Wesolek moved to approve this application in accordance with drawings dated 7/27/2012 those drawings being A1, A3, A4 and S1 and that the applicant use wood German lap siding that should be untreated Southern Wood Specialties cypress or comparable, that they have 6/6 all wood non-clad exterior double hung windows on the front elevation that have a true divided light to be submitted for staff approval, that they follow the National Park Service Brief 2 on repointing mortar joints in historic masonry buildings if any repointing of the stone foundation is needed, any new gutters and downspouts shall be round profile, galvanized or pre -finished aluminum, the new railing at the front step should have a ½ inch square picket and molded handrails unless an alternate design is submitted to staff for final approval, all new wood features and components should be painted or stained with a solid color opaque stain and the final selection and location of light fixtures shall be submitted to staff for final approval. They also have approval to use Jeld-Wen wood double hung windows, a manual crimped standing seam metal roof in red and the wood sash door model PDM3120SJ with a clear glass by Pine Door. 9. 4 Motion: Timothy Wesolek moved to approve this application in accordance with the drawings dated 7/27/2012 those drawings being A1, A3, A4 and S1 with the following conditions: That German wood lap siding shall be untreated and should be Southern Wood Specialties untreated cypress or compatible. That the 6/6 wood double hung wood windows on the front elevation should be true divided light with insulated glass and be approved by staff. Any repointing of the stone foundation shall be in conference with the National Park Service Brief 2: Repointing Mortar Joints on Historic Masonry Buildings. Any new gutters and downspouts shall be round profile galvanized or prefinished aluminum. The new railing at the front stoop shall have a ½ inch square picket and molded handrail unless an alternate design has been submitted for staff approval. The railing on the rear porch shall be non-pressure treated wood inset picket railing according to the Frederick Town Historic District Info Sheet #1 Typical Porch Railings or a comparable detail that will be approved by staff. The rear porch shall have non-pressure treated tongue-and-groove wood decking and a beaded wood ceiling. Any repair or replacement to the basement door shall be in-kind. All new wood features and components shall be painted or stained with a solid color opaque stain. The final selection and location of light fixtures shall be submitted to staff for final approval. Materials to be approved are: Jeld-Wen wood double hung windows--aluminum clad. Manually crimped standing seam metal roof in red. The wood sash door model PDM3120SJ with a clear glass by Pine Door. 10. HPC E. 2 nd Street Lawrence Attanasio Construct addition Ms. Martinkosky entered the entire staff report into the record. Brogan Construct addition Ms. Martinkosky entered the entire staff report into the record. Motion: Scott Winnette moved to approve the construction of the one story rear addition me asuring 10 by 9 with 6 with the following conditions: 4

5 That the doors and windows feature the clear glass option. That a revised drawing indicating the location of the proposed exterior light is submitted and also make the modification of error discussed during the hearing. That product information or cut sheet for exterior lighting by submitted for staff approval. With the following materials to be approved: The red cedar bevel siding in a 6 ½ exposure. Poured concrete slab foundation. Glass seal asphalt shingles from Tamko in the Gray Blend or Rustic Cedar color option. Model S118 smooth star fiberglass doors from Therma Tru. Smooth star transom from Therma Tru. Quick Set Juno smart key venetian bronze round door knob. Mounted skylight measuring 16 by 36. Round profile metal gutters and downspouts 12. HPC E.
