Building Permits Issued: A building permit has not been issued. The Ontario Building Code requires a building permit for structures that exceed 10m 2. Other Comments: 1. The applicant should note that an A/C unit shall be setback a minimum of 1.2 metres from the interior side lot line. It appears that the A/C unit may not comply. 2. It appears that a retaining wall is proposed to the rear of the property. The applicant should note that a retaining wall that exceeds 1.0m in height and that is constructed between two residential properties shall be setback from the property line a distance equal to its height. 3. The applicant shall be advised that additional variances may be required upon review of detailed drawings for building permit. 4. Staff should note that the subject lands may be subject to Ontario Regulation 166/06 (TRCA Toronto Region Conservation Authority). Conditions of Approval: If the committee finds merit in the application, the following conditions of approval are recommended. The proposal conforms to the policies of the Official Plan. The Development Planning Department has no concern with the proposed minimum rear yard setbacks to both the covered structure and cabana (Variances #1 and #3). The subject lands abut an OS1 Open Space Conservation Zone at the rear, which helps to mitigate the impact of the reduced rear yard setback. The Development Planning Department can also support the reduced interior side yard setbacks to both the covered structure and cabana (Variances #2 and #4). Both of the proposed accessory structures maintain the required height and size requirements, and the covered structure is unenclosed on the south, east and west sides, and only partially enclosed on the north side. The Development Planning Department recommends the installation of a 1.8 m privacy fence along the northerly interior side lot line as shown on the Site Plan submitted with the subject Minor Variance application to mitigate the visual impact of the covered structure on the adjacent neighbour to the north. Accordingly, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land. Comments: The Development Engineering and Infrastructure Planning Engineering Department requires a drainage swale to be maintained, which generally requires a 0.6m setback. From the provided sketch with this application, the proposed setbacks appear to be sufficient enough to provide for interior side and rear yard drainage. However, further review will be conducted at the building permit stage to ensure the drainage and grading pattern of any adjacent properties will not be adversely affected and in conformance with the city standards. Accordingly, the Development Engineering and Infrastructure Planning Department offers no comments or objection to Minor Variance Application A333/15. Conditions: None.

20 COMMENTS: PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream s cost for any relocation work.
