1 ADDENDUM NO. 2 February 12, 2019 Page 1 of 1 1 General This Addendum is issued prior to receipt of Bid to provide clarifications and revisions to the Drawings and Specifications. The following additional instructions shall apply to and govern the Bid Documents. The following amendments are hereby made an integral part of the Contract Documents for the above project, including all applicable sub-contractors affected. Included attachments are as follows: Section Tender Form Drawing AD-2 Indicate the receipt of this Addendum on the specified Tender Form as required. 2 Amendments 2.1 PROJECT MANUAL - SPECIFICATIONS.1 Section Tender Form.1 Revise tender form to include Alternate Price 5. See attached revised Tender form to be submitted as per the specifications. 2.2 DRAWINGS.1 Drawing AD2.1 Provide insulated areas above existing soffits as indicated on attached drawings. We acknowledge that the contract must be Deemed Complete no later than August 23, We acknowledge our compliance with the Instructions to Bidders and the Tender Documents relating to the Work, including all Addenda numbered as follows: Allowances We have included all allowances as Specified under Division 01 within our Base Bid price. Tender We agree and acknowledge that the lowest or any of the submitted Tenders will not necessarily be accepted. We agree and acknowledge that this Bid is irrevocable and open to acceptance for a period of 60 days from the date of Bid Closing.

3 Page 2 of 6 DECLARATIONS IN AGREEMENT TO ABIDE BY ESTABLISHED PROCESS We hereby agree comply with the following ground rules regarding the Established Tender Process : a. All communications, including requests for information, between Bidders and the Board must be between only the designated representative of the Architect and each Bidder, named below, who have been authorized and designated for that particular purpose; b. Apart from the communications between and among the designated representatives (Bidder and Architect s representative), there must be no communication between the Board and any representative of the Bidder, and no giving of information with respect to the tender document and the contract. c. Any attempt on the part of any Bidder, or any of its employees, agents, proponents, subcontractors or representatives to contact any persons other than the designated representative of the Architect with respect to the tender, or any action or violation of the above requirements, will be grounds for disqualification, and the Board may, in their discretion, in addition to any other rights or remedies available at law, reject any potential or actual tender submitted by that bidder. d. We accept and agree to abide by the ground rules regarding the Established «tender Process and we will inform our staff and our sub-contractors and their staff and ensure their compliance therewith. CONFLICT OF INTEREST The Bidder shall declare in its Tender any situation that may be a conflict of interest or a potential or perceived conflict of interest of the Bidder, including but not limited to its obligations to the Conseil scolaire catholique Franco-Nord, the contract, the contract price or any customer. The Education Act states that goods or services must not be purchased from a Teacher, Supervisory Officer, other Employee of the Board or an employee of the Ministry of Education and Training. This also applies to firms owned directly or indirectly by an employee of a Board. This is outlined in Chapter E.2, Section 217, of the Education Act, RSO 1990 (latest revision). The Board has a fiduciary responsibility to ensure that such behaviour is not permitted and reserves the right to remove from eligibility, the name of any Bidder for failure to comply with the above conditions. The Bidder declares that this proposal is not made in connection with any other Bidder submitting a tender for the same commodity/service and is, in all respects, fair and without collusion or fraud. 4 Page 3 of 6 BID ENCLOSURES/REQUIREMENTS The following documents are required as part of a complete Tender Form submission (Answer Yes or No to each Question) CONFIRMATIONS YES NO Security Deposit Each Tender Form Section shall be submitted with a Bid Bond in the name of an approved surety, made payable to owner in an amount equal to 10% (ten percent) of the Tender Price. Agreement to Bond Submit with the Tender Form Section and Bid Bond, an Agreement to Bond, stating that the surety providing the Bid Bond is willing to supply the Performance and Labour and Materials Payment Bond required. Insurance Submit with the Tender Form Section a signed Undertaking of Insurance on a standard form provided by the insurance company stating their intention to provide insurance to the bidder in accordance with the insurance requirements of the Contract Documents. APPENDIX AP - Alternative Prices The following prices are offered as additions or deletions to the Base Bid for the use of alternative methods and/or materials to those specified in the tender documents. Alternate Prices do not include Harmonized Sales Tax (HST). Alternate Prices include all overhead and profit for the Work. As per the Instructions to Bidders, the Owner at their discretion, may select the alternative price upon evaluation of the bid submission. Clearly circle Add or Deduct to define work that is added to the base bid or subtracted from the base bid. ALTERNATE PRICE NO. 1 Aluminium windows have been specified in the tender documents and included in the base bid. The following alternate price is provided to substitute the aluminium windows with fiberglass windows as per Section of the specifications.
