1 1 Revised 5/16/18 ORCHARD VALLEY HOMEOWNERS ASSOCIATION ARCHITECTURAL S The following architectural standards are an amplification and clarification of the standards set forth in ARTICLE VI, RESTRICTIVE COVENANTS. These standards were established to allow maximum individual freedom of expression consistent with (1) good taste as reflected by community-wide standards; (2) good residential appearance; and (3) the current scenic nature and character of the neighborhood. The standards adopted here are for Sections 5, 8, 10, 11, 12, 15, 16 and 17. The Architectural Review Board (ARB) has determined that Sections 1, 2, 3, 4, 6, 7, 9, 13 and 14 do not, AT THIS TIME, require standards beyond those stated in those sections. The ARB, however, may establish standards for these sections and may modify, delete or add standards for these sections as the ARB determines necessary. SIGNS: SECTION 5 All signs of whatever kind including, but not limited to: Advertising Political and informational signs displayed to the public view Exclusion: Real estate signs conforming to Article VI, Section 5 and safety related signs approved by ARB on a case-by-case basis. 1. Two feet square or less 2. Not illuminated 3. Removed immediately following the event for which it was displayed, i.e., advertising signs immediately after sale, rental or completion of a construction project; and political signs immediately after the election. Includes, but not limited to: EXTERIOR COLORS: SECTION 8 - Roof - Doors - Shutters - Siding - Driveways - Brick - Gutters - Walkways - Trim - Attached and detached Enclosures

2 2 Hereinafter referred to as the color rule": 1. Same as original or existing color of the house, does not require approval. 2. Colors different from original colors (including natural wood), will be approved by the ARB if they are determined to: a. be in harmony with, b. follow the color scheme of the original or existing exterior colors of the house. Includes, but not limited to: STRUCTURES AND ADDITIONS: SECTION 10 - Sheds - Decks - Patios - Walkways - Swimming Pools - Basketball Courts - Play Equipment - Tennis Courts - Solar Panels 1. Sheds and Other Storage Structures Dimensions: Colors: Wood or Metal May not exceed 12 ft. by 12 ft. and a peak height of 8 ft. Design subject to ARB approval. Will be approved if they are determined by the ARB to: a. be in harmony with, and b. follow the color scheme of the original or existing exterior colors of the house. Screening: Backyard only, immediately adjacent to the rear of the house. The rear wall of the shed must about the rear exterior of the house with no more than a 3 ft space. Must be screened from view. 2. Play Equipment, including Swing Sets, Forts and Sandboxes All play equipment, regardless of when it was put in place, must conform to the standards below: Backyard only, not to exceed back line of the house.

3 3 3. Decks Height: Colors: Wood or composite material Not to exceed second story of the existing house. Must be natural wood OR must be in harmony with and follow the color scheme of the original or existing colors of the house. See location rule for fences (Section 11). 4. Basketball Tennis and Similar Courts and Equipment Backyard only, not to exceed back line of house nor the sideline of house and must not be plainly visible from the street in front of the house. 5. Swimming Pools Scope: All permanent swimming pools, including above and below ground swimming pools, and hot tubs Backyard, not to exceed back line of house except those pools screened with a privacy fence so as to comply with rule for fences (Section 11). Hot tubs must be placed on approved decks and patios. 6. Patios and Walkways Color: Wood, brick, stone, gravel or other such commonly used materials. Must be in harmony with and follow the color scheme of the original or existing colors of the house. 7. Attached and Detached Enclosures Color: Other: Exclusion: Wood, brick, glass or metal Must be in harmony with and follow the color scheme of the original or existing colors of the house. Must be architecturally similar to and in harmony with the architecture or the original or existing house. Excluding sheds and other storage structures which are covered above.

4 8. Solar Panel Arrays: 4 Scope: Solar panels are permitted but still must go through the ARB process and adhere to the following installation guidelines below. 1. The solar panels should be placed as symmetrically as possible. 2. All installation must meet building code and not exceed metering code limitations. 3. The inverter box should be installed near other utilities. 4. The solar panels should be installed parallel to and as close to the roof as possible. 5. Wiring and components should be concealed as much as possible. 6. Wiring color should match roof and siding/trim color as much as possible (e.g. avoid black wire on white trim). 7. An apron should be used on the lowest row of panels to make the solar array appear closer to the roof.

5 5 FENCES: SECTION 11 Includes, but not limited to fences and privacy screens: 1. Wood only, wire mesh is acceptable for "split rail type" fences. 2. Height: Split rail and similar types, top rail height 48 inches (48") maximum. Privacy fence and similar types, six and one-half feet. (6-1/2') maximum. 3. Color: Must be natural wood or must be in harmony with and follow the color scheme of the original or existing colors of the house. 4. May ALWAYS begin and end at the rear of the house. May begin or end at the front of the house, anywhere in-between the rear and the front of the house IF it does not begin or end beyond the front of the house of the adjoining property. All fences must follow the contour of the land, i.e., "segmented steps" are not appropriate. ANTENNAS: SECTION 12 In order to comply with the new FCC regulations concerning telecommunications equipment, the following guidelines are established: 1. Satellite dishes that are being considered are one meter or less in diameter. 2. Application for the installation of telecommunications equipment consists of a notification form to be submitted to the Architectural Review Board (OVHA Property Improvement Request Form, Other Modifications), prior to installation. 3. The location for the placement of satellite dishes shall be in the following order of preference: a. rear of a pitched roof, with the dish as close to the roof as possible and not visible above any existing part of the house from the front. b. rear yard, if an acceptable qualify signal can be received there. If not: c. other location, if it is shown to be the only location that can receive an acceptable quality signal. After being installed in accordance with the above, the dish must create the least visual intrusion possible. In addition, painting or screening may be required. 4. All mountings should be done in a professional manner, and all wires concealed as much as possible.

6 6 MAILBOXES AND NEWSPAPER TUBES: SECTION Height: Must conform to U.S. Postal Regulations. 2. Color: Must be in harmony with the color scheme of the original or existing colors of the house. 3. Must conform to U.S. Postal Regulations. TREE CUTTING: SECTION 16 The ARB will approve requests for tree cutting if the purpose for cutting the tree(s) is: 1. to provide for a good residential appearance. 2. for safety purposes. PROPERTY IMPROVEMENT REQUEST FORM APPLICATION: SECTION 17 The Architectural Review Committee shall consist of the Directors of the Association, or a committee of three (3) or more persons appointed by them. Applications for approval by the Architectural Review Board shall be in writing. Failure of the Board to approve or disapprove a request within thirty (30) days shall be construed as Committee approval of the request. The OVHOA interprets the 30 day rule not to apply to requests which do not fall within the standards and would not be approved. The thirty (30) day period provided for in this article does not begin to run until the application or request is actually received by the chairperson of the Architectural Review Board. It is the applicant's responsibility to assure that the chairperson receives the request.
