HDR Project Manager/Engineer Bid # ADDENDUM NUMBER ONE (1) December 6, 2016 The following Addendum shall be incorporated into the Contract Documents for the above referenced project. Questions / Clarifications: All construction shall conform to the City of Carlsbad Public Infrastructure Specifications which can be obtain from the City of Carlsbad s website under the Planning, Eng. & Reg. Dept. page, Publication tab. A link to the specifications is as follows. %20council%20approved%20copy%20-%20combined%20-% pdf 1. Question: Can alternate products not listed be added by addendum? Response: Product substitutions will be evaluated after notice of award and must be submitted per Specification Section Question: Will Domestic Materials be required for this project? Response: The funding source is local funds. Domestic materials are not required for this project. 3. Question: Quantities shown on the Dwgs are not matching the Bid Schedule, Please Verify. Response: The quantities have been verified and bid form revised as part of this addendum. Bidders to note that the quantity listed for Bid Item 2 Reconnect Existing Sanitary Sewer Service includes quantities for existing services in W Rose St and Davis Park that are not shown on the drawings. Engineer and City will coordinate with Contractor following award of project to provide location of these existing services. 4. Can we get a trench detail? Response: Sewer line construction and trench detail shall be per the City of Carlsbad Public Infrastructure Specifications. 5. Can existing soils be used or will bedding be required around the pipe? City of Carlsbad Sanitary Sewer Interceptor 118 Upgrades Phase I Bid Addendum No. 1

2 Response: Soils for pipe bedding and backfill shall conform to the City of Carlsbad Public Infrastructure Specifications. 6. On Rose street, is the curb and gutter and drive pads incidental? Response: Curb and gutter and drive pad replacement shall be considered incidental to the unit price to install sanitary sewer. 7. For the Asphalt bid item, what was the width of road to be replaced? Does that bid item include remove and replace of asphalt? Response: Asphalt replacement shall be per the City of Carlsbad Public Infrastructure Specifications. Bid Item 7.0 for asphalt replacement includes remove and replace asphalt. 8. Is traffic control incidental? Response: Traffic control shall be considered incidental to the unit price to install sanitary sewer. 9. Can you provide the flow rates on Pecan Street for the bypass pumping required for the pipe bursting? Response: Historical data for the flow rates on Pecan Street vary from 25 to 150 gpm. Flows provided are for information purposes only. Contractor shall be responsible in determining flows and by-pass pumping required for Construction. 10. Can the lines shown as new open cut SAS be pipe bursted instead? Response: No. Open cutting is required to adjust the interceptor profile and correct the slopes with the new sewer line. 11. Is the 60 day construction allowed for base bid only? Can we get another 60 days for the alternate pipe bursting? Response: 60 day construction is for base bid only. If additive alternates are awarded, additional construction time will be reviewed with Contractor after project award. 12. Is the award based on low number for base bid or combined total? Response: Project will be awarded off of base bid. Depending on available budget, Owner may elect to award the pipe bursting additive alternate at any quantity at the unit prices stipulated on the bid proposal. Contract Documents: 1. Bid Form: Replace in it s entirety with the updated bid form attached. 2. Specification Section : Measurement and Payment Add the following Bid Item 3.0 and renumber all successive items. 3 BID ITEM 3.0 REHAB EXISTING MANHOLES: Payment will be made for the Unit prices indicated in the bid proposal for each manhole that is rehabilitated. Price bid shall include but not be limited to the following: bypass pumping; rebuilding existing manhole inverts, bottom and channel to match newly installed pipe; replacing collar, and replacing manhole frame and lid; repairing and/or filling voids; concrete protective coatings including cleaning, surface preparation, and application of coatings; traffic control; testing; warranties; Record Drawings, cleaning and all other materials, equipment and labor incidental thereto. Add the following Bid Item 9.0. BID ITEM 9.0 ROCK REMOVAL: Payment will be made at the Unit prices indicated in the Bid Proposal. Price Bid shall include but not limited to the following: rock breaking, excavation, hauling, offsite disposal, import of suitable backfill materials and all other materials, equipment and labor incidental thereto. Rock shall be classified per the City of Carlsbad Specifications which follows APWA Specifications. Change Bid Item 8.0 Demobilization to Bid Item 10.0 Demobilization. Update Bid Item AA-1.0 Pipe Bursting to include insertion pits including replacement of existing manholes after..excavation and backfill... Delete Bid Item AA-4.0 Install 4-ft Dia. Manhole. 5 ARTICLE 1 BID RECIPIENT 1.01 This Bid is submitted to: City of Carlsbad Purchasing Manager 101 N. Halagueno Carlsbad, NM (575) The undersigned Bidder proposes and agrees, if this Bid is accepted, to enter into an Agreement with Owner in the form included in the Bidding Documents to perform all Work as specified or indicated in the Bidding Documents for the prices and within the times indicated in this Bid and in accordance with the other terms and conditions of the Bidding Documents. ARTICLE 2 BIDDER S ACKNOWLEDGEMENTS 2.01 Bidder accepts all of the terms and conditions of the Instructions to Bidders, including without limitation those dealing with the disposition of Bid security. This Bid will remain subject to acceptance for 60 days after the Bid opening, or for such longer period of time that Bidder may agree to in writing upon request of Owner BIDDER will sign and deliver the required number of counterparts of the AGREEMENT with the Bonds and other documents required by the Bidding Requirements within 15 days after the date of OWNER's Notice of Award. ARTICLE 3 BIDDER S REPRESENTATIONS 3.01 In submitting this Bid, Bidder represents that: A. Bidder has examined and carefully studied the Bidding Documents, and any data and reference items identified in the Bidding Documents, and hereby acknowledges receipt of the following Addenda: Addendum No. Date B. Bidder has visited the Site, conducted a thorough, alert visual examination of the Site and adjacent areas, and become familiar with and satisfied itself as to the general, local, and Site conditions that may affect cost, progress, and performance of the Work. C. Bidder is familiar with and has satisfied itself as to all Laws and Regulations that may affect cost, progress, and performance of the Work. D. Bidder has carefully studied all: (1) reports of explorations and tests of subsurface conditions at or adjacent to the Site and all drawings of physical conditions relating to existing surface or subsurface structures at the Site that have been identified in the Supplementary Conditions, especially with respect to Technical Data in such reports and drawings, and (2) reports and drawings relating to Hazardous Environmental Conditions, if and American Society of Civil Engineers. 6 any, at or adjacent to the Site that have been identified in the Supplementary Conditions, especially with respect to Technical Data in such reports and drawings. E. Bidder has considered the information known to Bidder itself; information commonly known to contractors doing business in the locality of the Site; information and observations obtained from visits to the Site; the Bidding Documents; and any Site-related reports and drawings identified in the Bidding Documents, with respect to the effect of such information, observations, and documents on (1) the cost, progress, and performance of the Work; (2) the means, methods, techniques, sequences, and procedures of construction to be employed by Bidder; and (3) Bidder s safety precautions and programs. F. Bidder agrees, based on the information and observations referred to in the preceding paragraph, that no further examinations, investigations, explorations, tests, studies, or data are necessary for the determination of this Bid for performance of the Work at the price bid and within the times required, and in accordance with the other terms and conditions of the Bidding Documents. G. Bidder is aware of the general nature of work to be performed by Owner and others at the Site that relates to the Work as indicated in the Bidding Documents. H. Bidder has given Engineer written notice of all conflicts, errors, ambiguities, or discrepancies that Bidder has discovered in the Bidding Documents, and confirms that the written resolution thereof by Engineer is acceptable to Bidder. I. The Bidding Documents are generally sufficient to indicate and convey understanding of all terms and conditions for the performance and furnishing of the Work. J. The submission of this Bid constitutes an incontrovertible representation by Bidder that Bidder has complied with every requirement of this Article, and that without exception the Bid and all prices in the Bid are premised upon performing and furnishing the Work required by the Bidding Documents. ARTICLE 4 BIDDER S CERTIFICATION 4.01 Bidder certifies that: A. This Bid is genuine and not made in the interest of or on behalf of any undisclosed individual or entity and is not submitted in conformity with any collusive agreement or rules of any group, association, organization, or corporation; B. Bidder has not directly or indirectly induced or solicited any other Bidder to submit a false or sham Bid; C. Bidder has not solicited or induced any individual or entity to refrain from bidding; and D. Bidder has not engaged in corrupt, fraudulent, collusive, or coercive practices in competing for the Contract. For the purposes of this Paragraph 4.01.D: 1. corrupt practice means the offering, giving, receiving, or soliciting of any thing of value likely to influence the action of a public official in the bidding process; 2. fraudulent practice means an intentional misrepresentation of facts made (a) to influence the bidding process to the detriment of Owner, (b) to establish bid prices at artificial non-competitive levels, or (c) to deprive Owner of the benefits of free and open competition; and American Society of Civil Engineers. 10 ARTICLE 6 TIME OF COMPLETION 6.01 Bidder agrees that the Work will be substantially complete and will be completed and ready for final payment in accordance with Paragraph of the General Conditions on or before the dates or within the number of calendar days indicated in the Agreement Bidder accepts the provisions of the Agreement as to liquidated damages.
