The site is currently occupied with a truck and trailer rental operation. Motor vehicle repair as an accessory to the rental business is permitted. The site is currently nonconforming with respect to use as there are no conditional use permits approved for truck and trailer rental. The applicant has rented the building in the rear of the site to an independent motor vehicle repair operation and thus needs a Conditional Use Permit for an Automotive Repair Garage. The site is developed with three buildings, an office, an automobile detailing building, and the repair building. Portions of the site are paved for parking areas and a gravel area exists on the eastern portion of the site. Minimal landscaping exists on the site as it was developed before there were any landscape requirements. Page 1

2 LAND USE AND PLAN INFORMATION EXISTING LAND USE: The site is developed with three buildings, two one-story masonry buildings and one metal garage, as well as associated parking areas. COMPREHENSIVE PLAN: Urban Area - Rosemont SGA 4 The Comprehensive Plan designates this area of the City as Urban Area Rosemont Strategic Growth Area 5 (Rosemont SGA). The Rosemont SGA Master Plan, adopted September 2011 is one of eight strategic growth areas within the city identified to provide opportunities for continued physical and economic growth; protect established neighborhoods from incompatible development; maximize infrastructure efficiency and create unique and exciting urban destinations. The vision for the Rosemont SGA is a transit-oriented residential village with complementary mix-use and office. CITY SERVICES MASTER TRANSPORTATION PLAN (MTP) / CAPITAL IMPROVEMENT PROGRAM (CIP): The site has right-in / right-out access to westbound Virginia Beach Boulevard. Virginia Beach Boulevard is an eight lane urban major arterial. The Master Transportation Plan Major Street Network Ultimate Rights-of-Way document proposes no changes to this, and there are no CIP projects in the area. 3 EVALUATION AND RECOMMENDATION Staff recommends approval of this request with the conditions below. The conditional use permit to locate an automotive repair garage in the existing building is generally consistent with the land use principles of the Comprehensive Plan. CONDITIONS 1. All motor vehicle repairs shall take place inside the building. Vehicles in a state of disrepair shall be stored inside the building. There shall be no outside storage of equipment, parts, or materials on the site. 2. There shall be no vehicle painting on the site. 3. The chain link fence shall be removed. A solid fence, a minimum of six feet in height, shall be installed 15 feet from the northern and eastern property lines. The 15 feet buffer shall be planted with evergreen shrubs and trees. The applicant may use the back wall of the vehicle repair building as part of the fencing. A solid fence, a minimum of six feet in height, shall be installed along the western property line where the chain link fence currently exists. 4. The existing paved parking areas as well as the gravel areas shall be resurfaced and or paved where needed. 5. All outdoor lighting shall be shielded to direct light and glare onto the premises; said lighting and glare shall be deflected, shaded, and focused away from adjoining property. Any outdoor lighting fixtures shall not be erected any higher than 14 feet. 6. The applicant shall obtain all necessary permits and inspections from the Permits and Inspections division of the Planning Department and the Fire Department, as well as obtain a certificate of occupancy for the motor vehicle repair building from the Building Official before issuance of a business license. NOTE: Further conditions may be required during the administration of applicable City Ordinances and Standards. Any site plan submitted with this application may require revision during detailed site plan review to meet all applicable City Codes and Standards. All applicable permits required by the City Code, including those administered by the Department of Planning / Development Services Center and Department of Planning / Permits and Inspections Division, and the issuance of a Certificate of Occupancy, are required before any uses allowed by this Use Permit are valid. The applicant is encouraged to contact and work with the Crime Prevention Office within the Police Department for crime prevention techniques and Crime Prevention Through Environmental Design (CPTED) concepts and strategies as they pertain to this site.
