Their use does not confer license or grant for other purposes..4 Examination:.1 Bid Documents may be viewed at office of City of Parksville, Public Works Yard 1116 Herring Gull Way and at Online Planroom..2 Upon receipt of Bid Documents verify that documents are complete..3 Immediately and in writing notify Consultant upon finding discrepancies or omissions in Bid Documents..5 Queries/Addenda:.1 Direct questions to Mike Squire..1 Telephone: msquire@parksville.ca.2 Addenda may be issued during bidding period. Addenda become part of Contract Documents. Include costs in Bid Price. Identify Addenda on Bid Form..3 Verbal answers are not binding. Answers will be confirmed by written addenda..4 Clarifications requested by bidders must be in writing not less than seven days before date set for receipt of Bids. Reply will be in form of an addendum, a copy of which will be forwarded by to known bidders no later than five (5) working days before receipt of Bids..6 Product/System Options:.1 Where Bid Documents stipulate a particular product in conjunction with or approved alternate in the related article, substitutions will be considered by Consultant up to 7 days before receipt of Bids. When or approved alternate is not stated in the related article, substitutions will not be reviewed or entertained..2 When a request to substitute a product is made, Consultant may approve substitution and will issue an Addendum to known bidders. Consultant is under no obligation to provide reason for not entertaining a request..3 Unless substitutions are submitted in this manner and subsequently accepted by process of addenda, provide products as specified..4 In submission of substitutions to products specified, Bidders shall include in their Bid, changes required in work to accommodate such substitutions. A later claim by Bidder for an addition to contract price because of changes in work necessitated by use of substitutions shall not be considered. 1.5 SITE ASSESSMENT.1 Site Examination:

BONDING Project No Page 1 of 2 Part 1 General 1.1 CONTRACT PERFORMANCE SECURITY.1 Contractor shall provide security for performance of the Contract in the form of the following:.1 Performance Bond for 50% of the Contract Price. 1.2 SECURITY FOR PAYMENT OF CLAIMS.1 Contractor shall provide security for payment to claimants for labour and material used or reasonably required for use in the performance of the Contract. 31 Community Park Concession/Washroom Building Alterations Section SUPPLEMENTARY CONDITIONS Project No Page 1 GENERAL CONDITIONS OF THE STIPULATED PRICE CONTRACT PART 11 INSURANCE AND CONTRACT SECURITY GC 11.1 INSURANCE GC 11.1 delete in its entirety and replace with, Liability Insurance The Contractor shall buy and keep in force during the course of this Contract and until twelve (12) months after issuance of the Notice of Acceptance, Personal injury and Property Damage Liability Insurance. Such insurance shall be in the name of the Contractor and the Owner, and shall include a Cross Liability or Severability of Interests clause. Such insurance shall be on a form and with an Insurer acceptable to the Owner. Both Personal Injury and Property Damage sections are to provide coverage on an "Occurrence Basis." The term Personal Injury shall include: 1. Bodily injury, sickness, disease, or death therefrom. 2. Libel, slander, or defamation of character. 3. False arrest, detention or imprisonment, or malicious prosecution. 4. Invasion of privacy, wrongful eviction, or wrongful entry. Such insurance shall cover, subject to acceptable exclusions, liability claims arising out of all premises, operations, subcontracted operations, elevators (if any), products, completed operations, broad form property damage, and liability assumed by the Contractor under any contract or agreement, including this Contract. Where applicable, exclusions to the following operations to be performed by the Contractor or anyone on his behalf are to be deleted: 1. Blasting or use of explosives. 2. Pile driving. 3. Excavation. 4. Underpinning, shoring or removal, or rebuilding of support. 5. Demolition. 6. Operations that could cause the accidental pollution or contamination of any property, land, air, or water. 7. Use of any industrial machine such as a forklift, crane, front end loader, grader, earth remover, prime mover, or road building machine that is licensed, specially licensed (x plate), or operating under permit. 8. Use of any machinery or equipment such as hydraulic cranes, compressors, lift gates, or winches that may be attached to or mounted on a licensed motor vehicle when such use is not insured by any form of automobile insurance specified in this Article. Such insurance shall include by endorsement contingent employer's liability insurance in the name of the Contractor for the limits specified in this section. Such insurance shall be for the following minimum limits:

The following parties and any of their employees, servants or agents shall be added to the liability policy as additional named insured: City of Parksville Tetra Tech WEI Inc. 2. Automobile Insurance The Contractor shall buy and keep in force until all conditions of the Contract have been fully complied with, a standard Automobile Policy covering all licensed vehicles owned by him, registered in his name, or leased to him. Such insurance shall include liability insurance for the following minimum limits: Bodily Injury and Property Damage $5,000,000 Inclusive. The Contractor shall furnish proofs of insurance of ICBC Form APV Non Owned Automobile Insurance The Contractor shall buy and keep in force until all conditions of the Contract have been fully complied with, a standard Non Owned Automobile Policy. Such insurance shall be for the following limits: Bodily Injury and Property Damage $5,000,000 Inclusive. The Contractor shall furnish proofs of insurance on ICBC form APV 29, or its equivalent. 4. Contractor's Equipment Insurance The Contractor shall buy and keep in force until ten (10) days after issuance of the Notice of Acceptance a standard Equipment Insurance Policy insuring at fair market value all equipment owned and non owned, which is to be utilized on the project. Notwithstanding anything contained elsewhere herein, it is understood and agreed that the Owner and/or Engineer will not be liable for any loss or damage to Contractor's equipment, including loss of use thereof. Each and every policy insuring Contractor's equipment to be used on this project shall contain the following clause: "Waiver of Subrogation: It is understood and agreed that the Insurers hereby waive all rights which they may acquire by payment of claim under this policy to recover the amount so paid from the Owner and the Engineer or any of their parent, subsidiary, affiliated companies or corporations or any employee thereof, provided, nevertheless, that a subrogated right arising out of professional errors by any such person shall not be waived." The minimum rate of pay for work performed under this Contract or under subcontract shall be as classified in the current collective agreement between the City and the Canadian Union of Public Employees, Local 401. Should the City determine that any contractor is not complying with this requirement, the City will immediately exercise any and all rights it has under the Contract and take such measures as may be appropriate under its Contract with the Contractor. The measures include, but are not limited to, termination of said Contract.
