2 INSTRUCTIONS TO GENERAL CONTRACTORS [Bidder Company Name] [Bidder s Address] Salata Restaurant 3411 Nelson Rd suite 400 Lake Charles LA The following standards and procedures shall be incorporated into your proposal: 1. COPIES OF BIDDING DOCUMENTS Attached you will find one set of Bidding Documents for your use in preparing Bids. Neither Owner nor Architect assumes any responsibility for errors or misinterpretations. Additional sets may be obtained from the architect for a fee. Owner, in making copies of Bidding Documents available on the above terms does so only for obtaining Bids on the work and does not confer a license or grant for any other use. 2. EAMINATION OF CONTRACT DOCUMENTS AND SITE 2.1 It is the responsibility of each bidder before submitting a bid to (a) examine the Contract Documents thoroughly, (b) visit the site plan to become familiar with local conditions that may affect cost, progress performance or furnishing of the work, (c) consider federal, state, and local laws and Regulations that may affect cost, progress performance or furnishing of the work, (d) study and carefully correlate bidder s observations with the Contract Documents, and (e) notify Architect of all conflicts, errors or discrepancies in the Contract Documents.

3 2.2 Information and data reflected in the Contract Documents with respect to Underground Facilities at or contiguous to the site is based upon information and date furnished to Owner and Architect by owners of such underground facilities or others, and Owner does not assume responsibility of the accuracy or completeness thereof unless it is expressly provided otherwise. 2.3 Before submitting a Bid, each Bidder will, at Bidder own expense, make or obtain any additional examinations, investigations, explorations, test and studies and obtain any additional information and data which pertain to the physical conditions at or contiguous to the site or otherwise may which may affect cost, progress, performance or furnishing of which Bidder s deems necessary to the Work and determine its Bids for performing and furnish the work in accordance with the time, price and other terms and conditions of the Contract Documents. 2.4 Upon request in advance, owner will provide each bidder access to the site to conduct such explorations and tests, as each Bidder deems necessary for submission of a bid. Bidder shall fill all holes, clean up and restore the site to its former conditions of the Contract Documents. 2.5 The submission of a Bid will constitute an incontrovertible representation by bidder that Bidder has complied with every requirements of this Article 3, that without exception that Bid is premised upon performing and furnishing the Work required by the Contract Documents and such means, methods, techniques, sequences or procedures of construction as may be indicated in or required by the Contract Documents, and that the Contract Documents are sufficient in scope and detail to indicate and convey understanding of all items and conditions for performance and furnishing the Work. 3. BID FORM Make bids on the forms provided signed and with all items completed.

4 4. PROJECT TIMELINE 4.1 This project has been approved by the City of Lake Charles. Construction Documents are ready for pick up. Estimated construction start date TBD. 4.2 Your proposal must be accompanied by a timeline not exceeded 90 calendar days. This timeline should clearly exhibit your ability to complete the project and include all critical path items. 4.3 Is shall be assumed that you have anticipated weather conditions and have adequately allowed for normal weather variations in creating this timeline. 5. SCOPE OF WORK A list of responsibilities is attached for the scope of work by vendor/owner or by GC 6. STORE EQUIPMENT AND FITURES See drawings and attached exhibits in Miscellaneous section of Instruction to Bidders. All items listed in this section will be outlined on the scope of work and installed by vendors or completed by General Contractor. 7. SITE EQUIPMENT See drawings and attached exhibits in Miscellaneous section of Instruction to Bidders. All items listed in this section shall be completed by General Contractor.

5 8. PERMITS AND FEES The building permit, fees, and assessments shall be paid by owner. Trade permits and construction related inspection and miscellaneous fees shall be paid by contractor. 9. TESTING 9.1 If needed or provided, a copy of the soil report is attached for your review and reference NA. Contractor shall utilize the information included as reference only. Specific design shall come from the plans and specifications unless noted otherwise. 9.2 Contractor shall be responsible for all spoils excavated onsite. If soil is unsuitable or not needed for onsite use contractor must execute an excavated material addendum taking ownership of said material. 9.3 Owner shall contract separately a testing company that shall provide compliance testing for all soils, concrete and other items as requested by Owner. 10. BONDING AND FINANCIAL INFORMATION Contractors should include a completed Contractor s Qualifications Statement (AIA A305) and bonding company certification for Performance and Payment Bonds and associated cost for this project. The Owner reserves the right to require these bonds. Company financial information or credit certification should also be included to prove company s financial standing. 11. SUBCONTRACTOR, SUPPLIERS AND OTHERS 11.1 The Owner will request the identity of any Subcontractors, Suppliers or other persons or organizations who are to furnish the principal items of material and equipment, from the apparent low bidder, after any clarifications. Such list shall be delivered to owner within 3 days of request and shall be accompanied by an experience statement with pertinent information regarding similar project and other evidence of qualification for

6 each such subcontractor, supplier s person or organization. If Owner or Architect after due investigation has reasonable objection to any proposed subcontractor, supplier, other person or organization either may before the Contract execution request a substitute without an increase in bid price If apparent successful bidder declines to make any such substitution, Owner may award the contract to another bidder of his choice that proposes to use acceptable Subcontractors, suppliers, and other persons and organizations. Any Subcontractor, Supplier, other person or organization listed and to whom Owner or Architect does not make written objection prior to the execution of the contract for construction will be deemed acceptable to the Owner. 12. MISCELLANEOUS All contractors submitting proposals agree that they have inspected the project site and have reviewed the Instruction to Bidders. Contractor further certified that there are no apparent discrepancies or omissions. Any apparent discrepancies found shall be clarified via RFA process spelled our previously and included in the bid. Change Orders will not be approved for project omissions. General contractor further certifies that they are familiar with the construction materials, labor, supervision and coordination required to complete the proposed project. NO CHANGES SHALL BE MADE TO THE PLANS WITHOUT PRIOR WRITTEN AUTHORIZATION. RESERVES THE RIGHT TO REJECT ANY OR ALL BIDS. THIS IS CLOSED BID BY INVITATION ONLY. BIDS WILL BE OPENED IN PRIVATE AND WILL NOT BE SHARED.
