Assistant City Engineer REQUEST FOR COUNCIL ACTION AGENDA ITEM Stonegate at Rush Creek Project No Change Order No.1 3G AGENDA ITEM CITY ADMINISTRATOR APPROVAL PREVIOUS ACTIONS: At their June 1, 2015 meeting, Council awarded a contract in the amount of $641, to Friedges Contracting, Inc. for the Stonegate at Rush Creek Project No RECOMMENDED COUNCIL ACTION: Motion to approve Change Order No.1 to the Stonegate at Rush Creek Project No providing for inflationary unit price increases and revised project schedule. Total contract increase is proposed to be $19,237.65, contract time for substantial completion is proposed to be 88 calendar days from Notice to Proceed, and final contract completion date is proposed to be June 17,2017. COMMENTS: Original project schedule anticipated a late summer 2016 start date, dependent on completion of mass grading on the site by the developer. Mass grading was not complete on site until late September/early October, at which point weather and temperature variability introduced significant risk in starting the project, with no commensurate benefit to the public improvements. Consequently, project start was delayed until The revised unit prices reflected in Change Order No. 1 are consistent with industry-wide inflation of materials and labor, generally understood to be in the neighborhood of 3%. It bears noting that Friedges Contracting, Inc.'s original bid was substantially less than the next lowest bidder, such that acceptance of this inflationary Change Order No.1 and revised schedule is desirable as compared to pursuing the next lowest bidder or rebidding the work entirely. It is recommended that Council approve the attached Change Order No.1, increasing the contract amount by $19, to a total contract amount of$660,729.95, and modifying the project schedule to 88 calendar days with a final completion date of June 17,2017.

Consistent with The City of Maple Grove Standard Specifications for Utility and Street Construction 2015, Conditions of the Contract Section 7, Section S-15 of the Contract Special Provisions is hereby deleted and replaced with the following: (1806) DETERMINATION AND EXTENSION OF CONTRACT TIME Section 1806 is hereby deleted, except for Sections A and B of Section , and the following substituted therefore: Contract time for substantial completion shall be on a calendar day basis as follows that begins 14 calendar days from a Notice to Proceed: Utilities and Road Work through all but the final wear surfacing, all sidewalk, turf establishment and interim casting adjustments for the entire project shall be completed 88 calendar days from a Notice to Proceed. This includes installation time and coordination for small utilities. Contract time for final completion shall be on a completion date basis as follows: The final completion date including final casting adjustments, bituminous wear paving, any remaining contract work and all punch list work and clean up shall be completed by June 15,2017. Completion shall be construed to mean when all items have been installed, tested, inspected and approved. 3. The Contractor will not make claim of any kind or character whatsoever for any additional costs or expenses he may have incurred or that he may hereafter incur in performing the work and furnishing the materials described in the proposal, or for work performed relating to the described work. 4.
